REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL DECEMBER 15, 1965
CITY HALL COUNCIL CHAMBER) 1.03 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Mayor Crites led the salute to the flag.

Mr. Vincent Moreno, LB54 Jerry Avenue, Baldwin Park, stated VINCENT MORENO,
he was asked to speak for Mr. Daniel Rodriguez; that he had L854 Jerry Ave.,
been nominated as spokesman for the citizens committee to B.Pk.
maintain progress within the City of Baldwin Park; primarily
they were presently hoping to get the City Council's backing RE IRWINDALE OVAL
against the Irwindale Racetrack; that they were in the pro- RACETRACK
cess of circulating petitions in all sections of the City;
that to date they had approximately 150 signatures; that
they planned to present these petitions on January 6, 1966,
to the Irwindale Planning Commission. He read the body of
the petition objecting to the proposed oval racetrack in
the thirty 30) acre tract on the southern side of River-
grade Road because of the proximity to homes in Baldwin
Park causing undue hardship, noise, nuisance and resulting
in traffic hazard. He stated without the backing of the

City Council the City of Irwindale would not pay too much
attention to them.
Mayor Crites stated the City of Baldwin Park had already
taken a stand on this matter and had sent the Planning
Director to the Planning Commission meeting in Irwindale
to voice the City's protest.
Mr. Moreno stated they were aware of the protest but the
primary issue this evening was in the event that the
Planning Commission of Irwindale approved the racetrack
they hoped that the City Council would appeal to the
Irwindale City Council.
Councilman Morehead stated this matter would be discussed
by the Council later in the meeting under Unfinished
Business.

Mr. C. Richard Corliss, under Oral Communications, was
not in the audience.

City Clerk Balkus presented a letter from Kevin D. Fowler
dated November 30, 1965, regarding curbs, gutters and
sidewalks at 3408 N. Frazier Street.
City Engineer French stated the storm drain referred to in
the letter was being constructed under the 1964 Bond Issue,
in Frazier Street and being presently designed by Lampman
and Associates; that there was not a serious drainage pro-
blem; that basically Mr. Fowler's problem was financial;
that Mr. Fowler did not think he would have to put in curbs,
gutters and sidewalks as part of final occupancy, he
thought they could be delayed; that Mr. Fowler did not have
the money to put them in but would like to guarantee them
in some manner satisfactory to the Council; that he was
willing to dedicate.
Mr. Fowler, 3408 N. Frazier Street, Baldwin Park, stated he
had asked for a grade two years ago but was told the City
had no grade at that time; that when he obtained his permit
for the garage he was not told or was not aware that he had
to put in the curbs and gutters if the amount spent for
construction was over $1,000.00; that he. had seven 7)
children and was not financially able to put these in at
the present time; that he would dedicate the land required
and when the remainder of the people put in curbs and gutters
he would be glad to put them in.
In answer to a question by Mayor Crites, City Engineer
French stated a grade could be established at this time;
that he did believe, that Mr. Fowler was right in that two
years ago he was sure there was no grade established.

City Attorney Flandrick stated this item would also be
coming up subsequently under the Chief Administrative
Officer in connection with the relocation permit moratorium.

AND PLACE FOR A HEARING TO DETERMINE

COUNCILMAN MOREHEAD MOVED THAT RESOLUTION NO. 65-206 BE

Chief Administrative Officer Nordby reviewed his report
regarding Resolution No. 65-207 stating that some of the'
neighboring communities had fou d it profitable to examine
the reporting of sales tax of business in their respective
communities; that this must take place in Sacramento.
Discussion followed that the examination could be accomplished
in two or three days; that the cost of the trip would be
approximately $200.00 to $250.00; that this trip would be
made once a year.
Mr. Vincent Moreno stated he was an employee of the State
Board of Equalization for the tast three years in this
area; that effective January I, 1965, the State Board of
Equalization went onto an electronic data processing
system; that 6 great deal of time and effort had been
donated by the employees in reference to determining exactly
where the business location was; that he did not feel'a'
yearly trip to Sacramento would be justified because of new
methods and procedures; that he did feel'one trip might
correct some problems from misallocations that had been
established for specific accounts.
Chief Administrative Officer Nordby stated the authorization
would be for one trip.

PUBLIC HEARINGS
It was the time and place fixed for the public hearing on
Z-282, an application initiated by the Baldwin Park City
Council for the change of zone from Zone R-3 heavy
multiple family residential) Zone to Zone C-2 heavy
commercial) Zone or more restrictive use on property
located at 3419 and 3427 Baldwin Park Boulevard and 13643
Foster Avenue.
Proper publication, postings and mailings had been
accomplished.
Planning Director Chivetta presented a resume stating the
Planning Commission had adopted Resolution No. PC 65-53 on
November 24, 1965, recommending approval. He pointed out
the map on the wall showing the existing zoning and a plot
plan.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mr. Frank Mamone, 3127 Baldwin Park Boulevard, Baldwin
Park, stated on August 25, 1965, the Planning Commission
held a public hearing on their request for a zone change
from R-3 to C-2 under Case No. Z-274; that at that time
the Planning Commission by a majority vote of 6 to I
recommended to approve; that this recommendation was for-
warded to the City Council under Resolution No. PC 65-36;
that on September 15, 1965, after much favorable discussion
by a majority of the City Council it was discovered that the
approval of this zone change as stated in the original
application would create a landlocked parcel of land leaving
an interior lot which was prohibited by ordinance; that for
this reason this matter was sent back to the Planning
Commission for restudy and at that time they voted to deny
the application; that it was unfortunate that the hearing
had been closed because the entire situation developed over
a misunderstanding of information he had received when they
filed the original application; that it was their under-
standing that it would be better to square off the

boundary lines to make a more uniform appearing piece of
property; that the lot at 31127 Baldwin Park Boulevard was
approximately one hundred 100) feet deeper than the
adjoining property; that their home was on the back one
hundred 100) feet; that it was their understanding that
it would be legal and acceptable to leave the home there
and fully develop the front portion of the property; that
on October 20, 1965, based on the advice of the City
Attorney, the City Council denied the original application
then moved to initiate a zone change to include the back
one hundred 100) feet; that on November 24, 1965, the
Planning Commission conducted a second public hearing and
recommended to approve the zone change; that he respectfully
requested that the City Council approve the zone change.
City Attorney Flandrick stated that at the time of the
Planning Commission's second hearing on this same case he
advised Mr. Mamone at that time, and again for the record,
that if the zone change was granted on that lot on which
his residence was located it became a nonconforming use
and if he wanted to make any repair, addition or altera-
tion to the existing structure or put any new use on that
lot he would have to obtain a zone variance.
Mr. Frank Mamone stated he was aware of that and was pre-
pared to go ahead on that basis.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY TESTIMONY IN
MAYOR CRITES. OPPOSITION
Mr. William Crisp, 3132 Sparling, Baldwin Park, stated he WILLIAM CRISP,
was not notified of this hearing or of the hearing before 3432 Sparling,
the Planning Commission; that he was the legal owner of the B.Pk.
property at 3432 Sparling; that he was opposed to this
zone change because he lived right across the fence and did
not want any kind of a business right across the fence if
he could help it; that he did not mind apartments; that a
business would create noise and it would be a bad location
to raise children; that he bought this place with the
intention of living there until he retired;that he did not
think a C-2 was needed in this area right now; that there
were plenty of other areas already zoned C-2 that were not
developed.
Mr. Richard Winters, 3)x22 Sparling, Baldwin Park, stated RICHARD WINTERS,
he was opposed to the rezoning;.that they did not want 31.22 Sparling,
commercial property behind them and had moved from Cudahy B.Pk.
to get away from noise and businesses.
Mr. Angel Alvarez, 31123 Sparling, Baldwin Park, stated ANGEL ALVAREZ,
the proposed change was across the street and on the other 31}23 Sparling,
side of the fence from his property; that he felt at this B.Pk.
time this zone change would be a spot zoning; that if spot
zoning was continued the City would be so torn up with
hodge podge shopping centers that it would greatly affect
the value of the overall property in the areas and in the
entire City of Baldwin Park; that he was opposed to the zone
change at this time.
Mr. Richard Dickey, 4929 Fortin Street, Baldwin Park, RICHARD DICKEY,
stated he had no interest in the immediate area under 1929 Fortin St.,
discussion at the moment but did wholeheartedly endorse the B.Pk.
opinions voiced by the preceding two speakers.

Regular Meeting of the Baldwin Park City Council
Mr. Henry Knobloch, 3416 Sparling Street, Baldwin Park,
stated he was against the change of zone; that he would
like it to remain residential without noise.
TESTIMONY IN FAVOR OF THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mr. Paul Duncan, 13630 East Foster, Baldwin Park, stated
his property faced the property in question; that he was in
favor of the zone change; that he felt this was an ideal
location for commercial zone; that Baldwin Park Boulevard
was now a one hundred 100) foot highway and a direct main
thoroughfare from the freeway into the City of Baldwin Park;
that in the near past he had had the opportunity to watch
the smaller cities which had been affected by the freeway;
that he had seen the small businesses start out near the
freeway and work their way toward the existing city; that
he felt this could happen on Baldwin Park Boulevard; that
there was every indication that in the area of Baldwin Park
Boulevard and Francisquito there would be in the very near
future a large commercial development; that the main
reason he was in favor of this was taxes; that in the City
of Baldwin Park the taxes were as high or maybe the highest
of any other cities this size within the County of Los
Angeles; that there was one thing and one thing only that
would bring in revenue and reduce the taxes; that he
welcomed the commercial property.
Mr. Ron Wilson, 319 South 4th, Alhambra, stated he owned
property at 3974 Baldwin Park Boulevard; that anything that
could be done to improve the City of Baldwin Park and to
increase revenue and decrease property taxes he was in
favor of it; that he was in favor of anything that could
upgrade Baldwin Park, increase the revenue or bring in
industry,
Mr. Richard Dickey again spoke stating that as a tax payer
he endorsed some of the feelings of the two previous
speakers; however, he believed any rezoning should be done
in a planned comprehensive manner, not piecemeal.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to Z-282, Mayor
Crites declared the public hearing closed.
Council discussion followed with Councilwoman Gregory
opposing the change because of it being spot zoning and
not conducive to good planning and Councilman McCaron
opposing because in his opinion there was sufficient
undeveloped C-2 zoning on Baldwin Park Boulevard.

City Attorney Flandrick suggested in view of the fact
that there were two members of the Council that had indicated
dissatisfaction with the proposed rezoning that the motions
be separated.
With the approval of the second, Councilman Morehead with-
drew the motion.

LIGHTING ACT OF
1919
City Attorney Flandrick stated the purpose of this hearing
was to establish a Municipal Lighting District to supply
electric energy and facilities for that within the City
boundaries.
City Attorney Flandrick asked if there was anyone in the
audience who wished to file a written protest to the
nature of the improvement or the type of work proposed to
be accomplished pursuant to this District proceeding.
No one came forward.
City Clerk Balkus read in full a protest from Martha A. ONE WRITTEN PROTEST
and Richard Dickey. MARTHA A. AND
RICHARD DICKEY
City Attorney Flandrick stated the City Engineer had been
instructed to prepare the assessment as well as the plans
and specifications and other documents necessary to this
district; that subsequently to that appointment the City
Council authorized the City Engineer to employ Mr. W. J.
Lockman of Lockman and Sagucchi Engineers; that it would
be appropriate at this time to hear from Mr. Lockman and
or Mr. French concerning the nature of that proposal and
report and what was proposed in terms of cost and other
items concerning the district.
Mr. W. J. Lockman, 301 East Pomona Boulevard, Monterey W. J. LOCKMAN,
Park, stated the matter before the Council was whether or 301 E. Pomona Blvd.,
not a Street Lighting Maintenance District should be Monterey Park
formed which would include the entire area of the City of
Baldwin Park; that favorable action of this proposal
would create a uniform lighting system throughout the
City and a uniform tax rate to maintain this lighting
system; that to review the present lighting system the
City of Baldwin Park was lighted by a system which was
administered by the Los Angeles County Road Department;
that the system encompassed approximately 65% of the area
of the City; that it included approximately 1150 lighting
fixtures; that the plans before the Council and included
in his report would light the remaining 35% of the area by
the installation of an additional 550 lighting fixtures
bringin the total within the City to approximately 1700;
that the cost to light these fixtures had been estimated
in his report to be slightly less than $.27 per $100.00
assessed value; that the cost to light 65% of the City as
administered by the Los Angeles County Road Department had
two rates, one district $.3324 was about 25% of the City,
the remainder or about 4O% of the City was in a district
with a present rate of $.27LL; that the cost to consolidate
these into one district and light the remaining 35% of the
City would be slightly less than the $.27; that in the
report it computed to $12697; that the entire City would be
lighted with a uniform system at a cost slightly less than
that for the lowest assessment district presently within

the City; that the Council's favorable action would assume
the responsibility to maintain the existing fixtures of
1150 plus the maintenance and installation of the additional

City Attorney Flandrick asked Mr. Lockman if he was a
qualified Civil Engineer registered as such in the State
of California.
Mr. Lockman stated he was.
City Attorney Flandrick asked if he had occasion in the
past to process assessment districts including lighting
assessment districts.
Mr. Lockman stated he had.
City Attorney Flandrick asked if the manner in which he
proposed and had submitted in his report by way of cost
was a fair and equitable spread of the cost. and in
accordance with the 1919 Municipal Lighting Act.
Mr. Lockman stated it was.
City Engineer French stated he had reviewed the report and
the plans and was in complete agreement with the statements
made by Mr. Lockman; that he believed the City would have
a better system for less money than the City had presently.
City Attorney Flandrick stated although. the Act specified
and required that only written protests could be considered
as protests or objections, it would be appropriate if the
Council so desired to at this time open the public hearing
and permit any person who may have a question or a comment
or an oral protest to be heard.

PROTESTS OR COMMENTS.
Mr. Ronald Wilson, 319 South Fourth Street, Alhambra, RONALD WILSON,
owner of property at 3974 Baldwin Park Boulevard, Baldwin 319 S. Fourth St.,
Park, stated if this would decrease his taxes he was in Alhambra
favor of it. He asked when would the improvements be
installed stating that if these improvements were in-
stalled on Baldwin Park Boulevard now it would mean at a
later date they would have to be moved for the widening of
Baldwin Park Boulevard.
City Attorney Flandrick stated portions of the City were
presently located in the two existing lighting maintenance
districts; that the Council had taken the action necessary
to withdraw from those districts as of December 31, 1965,
contingent upon the formation of this district; that if this district was formed
tonight the withdrawal procedure would take place and as
of July I, 1966; that taxes had been paid by all property
owners within the City to maintain the existing districts
through June 30, 1966.
City Engineer French explained that if there was any move-
ments of standards required on Baldwin Park Boulevard all
of these would be owned by Edison Company and would be
moved at no cost to the district or the City; that installa-
tion would begin as soon after July 1, 1966, as Edison
could schedule the installation; that probably it would
take a total of six to nine months to have all of the

fixtures installed throughout the City.
Mr. Tom Williams, 13839 Masline Street, Baldwin Park,
stated he lived in the Americana Estates; that at present
they had ornamental street lights in the entire tract and
asked how this would affect him.
City Engineer French stated the Special Services tax rate
would be decreased.
Mr. Richard C. Dickey, L1.929 Fortin, Baldwin Park, stated
he wholeheartedly believed it was desirable to unify the
various lighting districts within the City and have it
administered by the City; that he believed, as in the
past, that residents should be able to request street
lights where there were none; that he had viewed the City
map indicating where the lights were to be placed and the
amount of brightness; that the brightness of the lights
to be placed in Fortin Street were to be 7,000 lumens,
two at the middle of the block and one at each end; that
some of the other areas had 7,000 and some had 4,000
lumens; that he had viewed streets of both types; that the
streets with 4,000 lumens seemed adequately lighted in
all respects; that, in his opinion, 4,000 lumens for small
residential streets would be completely adequate and that
7,000 lumens was unnecessary.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to the proposed
Municipal Lighting District, Mayor Crites declared the
public hearing closed.

City Attorney Flandrick explained that the ordinance
change as proposed would merely grant the Council the
discretion by motion to set additional days to be
holidays.
Councilwoman Gregory stated she did not believe the
unions condoned these Fridays off; that she suggested
giving the Friday before Christmas but not the Friday
before New Years.
Chief Administrative Officer Nordby stated that the
Employees Association had conducted a survey of
approximately ten 10) cities in the East San Gabriel
Valley; that of these, six 6) granted the Friday
before a legal holiday, two 2) granted half a day and
two 2) or three 3) others were considering a full or
half day.
Councilman McCaron stated the City should have a set
procedure for holidays taking In all circumstances;
that he agreed with Councilman Morehead that half days
would be suitable for the request before the Council.

City Engineer French stated at the. Couric,i F's' instruct ion
he had met with the Board of the Valley View Mutual Water
Company regarding certain claims they had broagbt against
the City concerning construction work on the widening of
Los Angeles Street, some on Center, Palm, and Walnut; that
they felt very strongly they had valid claims and felt they
had prior rights because their company was founded in 1907;
that it was apparent that It would take further action to
solve this problem; that since this time they had made
a counter offer which was that If the City would install
the curbs and gutters on a piece of property they were
presently developing on Center Street that had eightyfour
84) feet of frontage they would waive all claims against
the City in regard to this matter which amounted to
approximately $270.00 worth of claims; that they had also
agreed that in the future they would not bill on conflict
of services In dedicated streets; that he recommended that
the Council accept their offer and have the curbs and
gutters installed subject to Valley View Mutual Water
Company withdrawing their claims.
City Attorney Flandrick stated he concurred in this
recommendation.

Commission had adopted Resolution No. PC 65-54 on November
24, 1965, recommending approval. He pointed out the map

Discussion followed relative to the two long lots that RE TWO LANDLOCKED PARCELS
would be landlocked wherein City Engineer French stated TO EAST OF SUBDIVISION
to fully utilize the two long lots there would, be a need for more
than one street to tap into them; that It appeared that
the development of the two lots had to go along with the
property on La Rica the same as Councilman McCaron had
mentioned; that it would take structures and realignments
of Lots on La Rica; that if one street was brought off of
this subdivision out to tap these two lots there could be
four lots created facing the street but again there would
be deep interior lots.
Mr. Gus Nesseth, California Property Brokers, stated this GUS NESSETH,
property owner had already created his own landlock be- CALIF. PROPERTY BROKERS
cause of the development on the two lots; that it was a
lot split type situation with a private driveway and very
poor access even if he wanted to get back In there now;
that they had contacted the owner of the property; that
for this land to be utilized in this subdivision they
would lose one lot to gain two; that the price that the
owner had put on the rear portion of ground which was
landlocked presently was completely ridiculous.
Mayor Crites asked if this subdivision was approved as
presented would it violate the man's property rights who
owned the two landlocked parcels.
City Attorney Flandrick stated he did not believe so;
that from the map it appeared that what Mr. Nesseth
had said was correct; that the problem was probably
created by the present or prior owner; that whether
this subdivision was developed or not would have no
effect upon his legal rights.

Regarding the moratorium on relocations, Chief Administrative
Officer Nordby recommended that the suggestions of the
Planning Commission be drafted into ordinance form and be
presented to the City Council at the next regular meeting
in January; that if this was done it would have second
reading on January 19, 1966, and become effective on
February 18, 1966; that in order to continue the moratorium
it would be necessary to pass another urgency ordinance.
City Attorney Flandrick stated the Council had in their
Agenda folder an urgency ordinance; that it was suggested
that the effective date be February 18, 1966; that If the
Planning Commission's report was acceptable to the Council
for the type of regulation on the relocation permits these
would be incorporated in the ordinance.

Regular Meeting of the Baldwin Park City Council
In answer to Councilwoman Gregory, Planning Director
Chivetta stated there was a plan being checked now on
the corner of Francisquito and Garvey; that it was proposed
to move an existing garage and to construct a sales office
on the rear portion; that American Oil had leased the front
portion of the property.
City Attorney Flandrick stated the existing urgency ordinance
expired effective at midnight tonight; that he suggested that
the last full sentence of Ordinance No. 437 be deleted so it
would be a complete moratorium; that the moratorium covered
any relocation within the City even a lot to lot situation.
Extensive discussion followed.
City Attorney Flandrick stated the recommendations the
Planning Commission had made to the Council were acceptable
to the Planning Director, Chief Administrative Officer and
himself; that on January 5, 1966, an urgency ordinance as
well as a regular ordinance could be presented; that it
would have the effect of lifting the moratorium as of
January 5, 1966, which would be only a little over two weeks;
that if the man had not made an application yet it could not
possibly be approved until February. He further stated that
the staff as an administrative act could accept the applica-
tion advising the applicant that there was a moratorium and
the application would not be processed until the moratorium
had expired.

Councilwoman Gregory stated that Section 6 should be SECTION 6 TO BE
clarified. CLARIFIED
Chief Administrative Officer Nordby stated he would comment
on Section 6 prior to the introduction of the ordinance;
that he did not concur fully with the recommendation on
Section 6; that he did not think the criteria was sound.
Discussion followed regarding the last sentence of Section
2 wherein City Attorney Flandrick stated whether it was
left in or taken out there would be no further hearings
until such time as the Council finally adopted an ordinance
setting new rules and regulations. It was decided not to
delete the last sentence of Section 2.

Councilman McCaron asked if suggestions were to be made
at this time concerning any changes the Council might
make in the Planning Commission's recommendations.
Discussion followed wherein Chief Administrative Officer

January 5, 1966, when the ordinance was introduced.

Councilwoman Gregory stated the map indicated the entire
property was being rezoned from R-I to R-2; that the
motion was to draw up an ordinance indicating the zone
change on the one hundred sixty 160) feet facing Merced FRONT 160 FT. ON
to R-2 and the balance to remain R-I facing the future MERCED TO R-2;
street and that the second reading be held up until the BALANCE R-€
requirements of the lot split were complied with.
City Attorney Flandrick stated Section I should read: CORRECTION
That not withstanding the provisions of Section 9451 of the SECTION I
Baldwin Park Municipal Code that certain real property
as described on Exhibit A" attached hereto and incorporated
herein by this reference be and the same hereby is rezoned
from zone R-I to R-2 and the Director of Planning shall amend
the Zoning Map of the City of Baldwin Park to reflect such
change". He stated that Exhibit A" would have the effect
of rezoning just the front one hundred sixty 60) feet of
the subject property.
Councilwoman Gregory stated she believed on the action
sheet of the Planning Commission there was a request for
just such a thing on R-3 at the corner of Walnut and Los
Angeles Streets; that the person making this appeal wanted
to change the front part of the R-3 to C-2 and keep the
rear property R-3; that Planning Director Chivetta had
indicated this might be what would happen throughout the
City when it was not compatible with the rest of the land
use; that this application had been denied.
Councilman McCaron stated when the lot split was consumated
the back portion would be two separate lots and had nothing
to do with the portion that was being rezoned to R-3; that
this would not be splitting two zones on one lot.
City Engineer French stated the: 1911 Act that was processed
this evening was the street behind this property.
Planning Director Chivetta stated the Planning Commission PLANNING COMMISSION
had reaffirmed their position stating that they were still REAFFIRMED POSITION
against the reclassification for the reasons that the AGAINST RECLASSIFICA-
request would not conform to the General Plan and the TION
reclassification would create spot zoning.
COUNCILMAN MOREHEAD MOVED THAT ORDINANCE NO. 433 NOT BE MOTION MADE
INTRODUCED AND BE DENIED. COUNCILWOMAN GREGORY SECONDED.
Councilman McCaron stated he could not understand how this
could be considered as spot zoning; that there had been a
similar case earlier this evening approved and spot zoning
was not taken into consideration.
Councilwoman Gregory stated this was the reason she had opposed
it. Councilman Morehead stated the reason he opposed was that
this was not spot zoning, it was strip zoning; that this would
be starting a precedent.

at the very same location by R-3 next to R-I; that R-2 was
not as intensive a use as R-3; that as soon as Merced was
developed and widened and curbs, and gutters put in it
would appear that the ideas of developing it to R-3 would

racetrack be taken up at this time. OVAL RACETRACK
Councilman Morehead reported on his meeting with a
group of citizens at Mr. Moreno's home. He stated
It was his opinion that the Council should instruct
the Chief Administrative Officer and the Planning
Director to keep an eye on this Issue, and if on
January 6, 1966, the Irwindale Planning Commission
approves the racetrack an appeal should be submitted
to the Irwindale City Council and request the waiver
of a $50.00 fee for such an appeal. He suggested
that each of the Council members attend the hearing
and each have a topic to discuss.
In answer to a question by Councilwoman Gregory, City
Attorney Flandrick stated this would be on Irwindale's
next Planning Commission Agenda; that the direction had been
to prepare the resolution with conditions of approval;
that the public hearing had been closed; that the only
recourse anyone would have if the Planning Commission
were to approve it and no appeal was taken and it be-
came final would be a lawsuit; that this would be a very
difficult lawsuit because the question would be, is
it a public nuisance.
In answer to a question by Councilwoman Gregory, Chief of
Police Adams stated any diversion of police men from the
standard procedure would require additional personnel;
that the problem of the motorcycles cutting through the
vacant lot was there now.

Chief Administrative Officer Nordby stated that the
action of the Irwindale Planning Commission was-going to
be taken on January 6, 1966; that the City Council of
Baldwin Park had a meeting on January 5, 1966;. that any
direction to file an appeal should be taken this evening;
that he suggested that the Chief Administrative Officer's
office be directed to file an appeal in the event the
decision of the Planning Commission is adverse to the
City and the people; that this would permit the appeal to
be filed and at the same time request a waiver of the fee
of if necessary pay the fee and ask for a refund.
In answer to a question by Councilman McCaron, Mr. Vincent
Moreno, 4854 Jerry Avenue, Baldwin Park, stated they had
covered the City with petitions concerning this matter,
not just in the Americana Tract.

Councilwoman Gregory passed-out reports on street renaming
to the Council from the East San Gabriel Valley Planning
Committee stating that she would report on this item at the

Regular Meeting of the Baldwin Park City Council
Councilwoman Gregory asked if the street lights that
had just recently been put in on Ahern off of Pacific were
4,000 or 7,000 lumens.
City Engineer French stated they were 7,000 lumens.
The motion carried by the following vote:
AYES: COUNCILMEN MOREHEAD, MCCARON, ADAIR,
GREGORY AND MAYOR CRITES
NOES: NONE
ABSENT: NONE
City Attorney Flandrick stated that City Engineer French
and City Clerk Balkus would advise the County Road Depart-
ment tomorrow of this action and complete the withdrawal
from the two existing districts; that the Municipal Light-
ing District would take effect as of July I, 1966.

Chief Administrative Officer Nordby reviewed his report
on the request for holidays on the Fridays preceding
Christmas and New Years, December 24 and 31, 1965,
stating that the Employees Association had requested
that the Fridays preceding the two year-end holidays
be observed as holidays and that the Municipal Code be
changed accordingly; that virtually all cities in the
San Gabriel Valley recognize any Friday preceding a
holiday which falls on Saturday as the official holiday.
In answer to a question by Councilwoman Gregory, Chief
Administrative Officer Nordby stated that any holiday
which falls on Sunday, the following Monday was observed,
however there was no provision for a holiday which fell
on Saturday.
Councilwoman Gregory stated she certainly understood
the problems which arise but was unhappy with the request
coming in on such short notice. She asked how this would
affect the Safety Personnel. She stated perhaps It should
be stipulated in the Personnel Rules and Regulations that
all holidays that fall on Saturday or Sunday, the following
Monday would be observed.
Finance Director Duncan stated that when any employee was
given a holiday there was no discrimination; that any
employee working his regular day off or a holiday would
get an extra day's pay.
Councilman McCaron stated this matter should be given to
the Personnel Board for a study and recommendation on a
permanent basis; that in the meantime the Council should
take action on the present request.
City Attorney Flandrick read Ordinance No. 435 in full
entitled:
ORDINANCE NO. 435 AMENDING SECTION
2642 OF THE BALDWIN PARK MUNICIPAL
CODE RELATING TO HOLIDAYS AND
DECLARING THIS TO BE AN URGENCY
ORDINANCE
Councilman Morehead stated he was in opposition to this
additional holiday; that private industry did not follow
such a program and not all County, State and Federal
offices followed such a program; that he would consider
part of a Friday but not a full Friday prior to Christmas
and New Years.
