In accordance with Section 2703 of the Municipal Code the.
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed On regular agenda items.
The City Council of the City of Baldwin Park met._,in,•

Iast"Thursday regarding the oval racetrack stating that
Mr. Moreno was in the audience.
At the request of the,Council,. C4.ty Clerk Belkus read
a letter dated January 194,,'19056 addressed'to the City of
Irwindale appealing the decision of the Fr(nning Commission
of the City of Irwindale relating to the adoption by
the Planning Commission on.Janiary 6, 1966, of,.Resolution
No. 4066 granting a conditional use permit`tothe Soland"
Corporation for the construction and operation of a motor
vehicle raceway. The letter was signed by Ivory D. Crites,
Adelina Gregory, William S. Adair, Joseph McCaron, Charles
E. Morehead and Charles Chivetta.
Chief Administrative Officer Nordby stated that the
appeal and the filing fee would be delivered personally
to the City Manager and City Clerk of the City of
Irwindale on the morning of January 20, 1966.
Mr. Vincent P. Moreno, 4854 Jerry Avenue; Baldwin Park,
stated the committee"had speci,fical ly a$it+ed' him to appear
this evening in reference to the appeal; that they had
almost 2,000 signatures; that on Saturday,~January 22,
1966, they would be circulating a pet-ition ih.`front df
Moody's Market; that they had.enlisted the ante of the local
clergy; that they had a committment from the Nazarene and
the Baptist Churches; that as far as he knew the Catholic
congregation was going to Join, i n on the fi=ght acid wou l d
be present at the hearing; that he had also beef. in touch
with Mr. Powell from the City.*of Jrwindaie and-Mr. PbWell
had informed him that he was recommending t'o, tlie, ity` Couhc i l
that a special hearing be set up in reference to this; that
2,000 leaflets would be circulated in the City of Baldwin
Park a day or two before the actual hearing date; that the
Chamber of Commerce of the City of Baldwin Park officially
sent an appeal to the City of Irwindale; that Dr. Skaggs of
the Baldwin Park School District had assured-fte.'46mmittte
that he would go as far as he could legally:.
Councilwoman Gregory stated it was her understanding that
the'Balduwin Park Chamber of Commerce had written a letter
to the City of Baldwin Park in support of their stands'
Chief Administrative Officer Nordby-stated some time ago
Mr. Cpnnady,had submitted to him a draft of a resolution
supportfng.-tbe cause and had stated when the time was
approprt,at:e,the Chamber of Commerce Board of Directors
would adopt this resolution. He further stated he had
not received a letter from Dr. Skaggs regarding this
matter'.
Mr. Moreno stated that Mr. Cole of the Board had assured
that at least two Board members would be present at the
hearing.
Chief Administrative Officer Nordby cautioned Mr. Moreno
that the City of Baldwin Park had an anti-litter ordinance
and asked him to be sure and check the rules and regula-
tions governing the distribution of literature.
Mr. Moreno stated the literature was being placed in
the hands of the recipient; that they were not being
left at the door.

City Attorney Flandrick presented Ordinance No. 439
stating that the Chief of Police had requested a draft
of an ordinance relating to dance and entertainment
permits.

City Attorney Flandrick reviewed his memorandum dated MEMO FROM CITY
January II, 1966 regarding Salaries of Councilmen stating ATTY. RE SALARIES
in 1965 the legislature, at the request of the League of OF COUNCILMEN
California Cities and other groups, adopted a section of
the Government Code which permits the setting of salaries
for Councilmen based exclusively upon population; that
now the way the Section read it had the effect of saying
as of April 19, 1966, if a City had not adopted an ordinance
which sets a salary exactly in accordance with that section
Councilmen would receive no salary dispite the fact that
Baldwin Park had an ordinance which had been approved by
a majority of the electorate in this City some years ago
setting the salaries for Council at $50.00 and the Mayor
at $75.00; that this ordinance, in the absence of further
action by this Council, would be void as of April 19, 1966;
that therefore unless the Council took action either to
adopt an ordinance which would have to be in conformity with
the existing section which would set the salaries of this
Council at $200.00 based upon population; that in the
alternative the Council could submit the matter to the
electorate at the next election that there would be an
elimination of salaries for Councilmen; that the Council,
in essence had three choices; the Council could do nothing
and hope that the legislature at the Special Session would
amend this section so that it did not have the effect of
repealing preexisting salary ordinances, adopt between now
and April 19th and have in effect an ordinance which sets
the Council salaries at the rate set forth in the Govern-
ment Code or place on the ballot a measure as to what the
salaries of Councilmen shall be; that if the Council
decided to take the third alternative the salaries could
not be set at the $200.00 figure; that it must be greater
than or lesser than $200.00.
Councilman McCaron stated it would appear to him that this
matter should be set before the electorate and have them
reaffirm the present pay schedule.

Councilwoman Gregory stated that most of the cities,
except San Gabriel, had been going along with accepting
the salary set by State Law; that there would be other
Councilmen following and future Councilmen should be
considered; that, in her opinion, the State Legislative
step should be followed.
Mayor Crites stated that it was time for the pUbl'.ic hearings; MATTER HELD OVER
that this matter would be held until after the public UNTIL AFTER PUBLIC

salary.

City Attorney Flandrick stated in 1965 the legislature RE AMENDMENT TO
made another amendment to the Elections Code permitting ELECTIONS CODE PER-
the City Clerk to conduct the canvass of the election MITTING CITY CLERK
in terms of the counting of the vote with a Board TO CONDUCT CANVASS
established by her; that both the City Clerk and he- OF ELECTION
recommended this procedure since it would speed up the
process and merely makes official the unofficial returns;
that this would be in lieu of having the City Council canvass the
votes, some members of'whom who were obviously Involved; that
the City Clerk would perform the ministerial function of
opening the envelopes, counting the ballots and checking
the tally sheets and making sure the election is properly
conducted and declaring the results; this would permit
the Council on the 19th of April to have a Council Meet-
ing if the Council so desires and swear in the new members.
In answer to a question by Councilman Morehead, City
Attorney Flandrick stated the reason the League of
California Cities had recommended this change in the
Election Code for many years was that it sometimes
could be rather difficult when you consider that the
City Council when it sits as a Canvassing Board as
the sole judge of the election returns and in this
particular case there were two members of the City
Council who would be up for reelection; that when the
City Clerk was concerned with the election the law
would still apply but he would assume that when Mrs.
Balkus was up for reelection that she would undoubtedly
appoint her Deputy who would be authorized to canvass
the returns in that event.

Councilwoman Gregory stated that last year there were quite
a few solicitors who had come in from other areas and asked
what would be done this year to prohibit this.
Chief of Police Adams stated there would be several plain-
clothesmen to work the hawkers; that there would be men
working with the band as it goes through the parade route
to eliminate the problems there.
Finance Director Duncan stated her Department was follow-
ing the same precedurefthis year as last year; that there
were no business licenses being issued to any outside firms.

Chief Administrative Officer Nordby presented'a redraft REDRAFT OF ORD. NO.
of Ordinance No. 438 incorporating the thinking of the 438 RE RELOCATIONS
Council in the changing of the language and the assign-
ment of responsibilities; that, in his opinion, the
ordinance in the present form.could be effective.
Discussion followed regarding item c) on page 6 and
Section 7913, however no changes were made.
City Engineer French recommended, and the Council accepted, SECTION 7902 d)
a filing fee of $25.00 on page 2 Section 7902 d).
Regarding Section 7908,;-t.he relocation fee, Building Super-
intendent Kalbfleisch stated the existing ordinance required
$15.00 for investigation fees plus a $75.00 fee which is a
requirement of the Planning Department; that presently $15.00

City Attorney Flandrick stated the $35.00 and the $75.00
would be $110.00 which would go in Section 7908.
City Attorney Flandrick stated, if he recalled, the Plan-
ning Commission recommended no appeal fee to the Council so
in Section 7913 the sentence A fee of shall
accompany any such appeal." should be deleted if the
Council concurred with this recommendation.
Chief Administrative Officer Nordby made a suggestion that
all fees be removed from the Municipal Code in all sections;
the reason being that policy was established by ordinance
and becomes a part of the Municipal Code; that many cities
felt that fees were flexible and more of a temporary
nature; that therefore they adopted a resolution which
includes all fees listed alphabetically; that he did not
suggest a change in this present ordinance but ultimately
he would like to consider removing all fees from the
Municipal Code and by reference in each section adopt
those fees by resolution.
Discussion followed regarding the appeal fees; that this
would be a public hearing and would have to be advertised;
that there would be additional time required in giving
notice and preparation of the material for the Agenda;
that there was an appeal fee of $50.00 to the Council
from the Board of Zoning Adjustments with regard to
lot splits.
Councilwoman Gregory suggested $50.00. There were no
objections.
City Attorney Flandrick stated that Section 7913 would
be amended by inserting $50.00 figure in the blank space
under the heading of appeal.

January 17 and 18, 1966, by the Criminal Procedures
Committee of the State Assembly on the subject of pre-

and their staff expressed much gratitude to the City

had been or attempting to enforce the limited parking
signs; that citations had been given.

Councilwoman Gregory indicated this problem should be
watched more closely.
City Engineer French stated the Traffic Committee would
bring this to the attention of the Police Department.

City Engineer French reviewed his report on a proposed
1911 Improvement Act on the east side of Kenmore between
Illinois and Frazier which stated that the Engineering
Department had supplied a property owner a 1911 Improve-
ment Petition for the improvement of Kenmore with curbs,
gutters, sidewalks, street paving, street lights, drive
approaches, and right-of-way acquisition; that no action
was required if the Council was in agreement with this
improvement.
There were no objections.

City Engineer French reviewed his report on a request for
a 1911 Improvement Act on the west side of La Rica Street
between Olive and Nubia which stated that the proposed
improvement consisted of curbs, gutters, sidewalks, street
paving, street lights, drive approaches and right-of-way
acquisition, all in accordance with the map attached; that
no action was necessary if the Council was in concurrence
with the circulation of the petition.
There were no objections.

City Engineer French reviewed his report on the initiation
of a Short Form 1911 Act on the east side of Vineland be-
tween Merced and Cloverside which stated it was the finding
of the Street Superintendent that over 50% of the curb
and gutter was existing on the east side of Vineland be-
tween Merced and Cloverside; that it was recommended that
the City Council adopt Resolution No. 66-21 setting a
hearing date of February 16, 1966, for the creation of
the Short Form 1911 Improvement District.

City Engineer French reviewed his report on the Maine
Avenue Gas Tax Project which`recomnended that the City
Council approve the bid date ofFebruary 28, 1966 and
the hiring of Harold L. Johnson Engineer to provide the
inspection and surveying in accordance with the attached
proposal.
City Attorney Flandrick stated the Council could, by
motion,. approve the bid date and authorize the execution
of the agreement; that the agreement would be the same
form as that used in the last sewer district with a change
in the name of the Engineering Firm and the amounts.

City Engineer French stated if the Council would remember
at the time of adopting the amendment to the General
Circulation Plan on Baldwin Park Boulevard and the core
area a question arose as to the final treatment of the
intersection of Baldwin Park Boulevard and Sierra Madre;
that at that time it was the opinion that a 900 inter-
section could be provided and`a'lso a leg that would be
one way traffic to the center core area with a triangular
landscaped area between these two legs; that a problem
had been created by this~pian that was not foreseen at
that time because precise plans had not been prepared;
that there was a complex of apartment units here; that
the people who would be served by this area would be led
into a very hazardous left turn at the point of intersection
of the two legs if they were going to go south and onto the
freeway; that otherwise they had to go to a very indirect
route to get back and go down to the freeway; that a plan
had been developed to create a T" intersection which would
be signalized allowing a very good direct access to the
central core area on the existing Baldwin Park Boulevard;
that it would be a 900 intersection and left turns off of
Sierra Madre off of Baldwin Park Boulevard; that the area
that serves the apartment units would be a cul-de-sac so
that these people could come back on Baldwin Park Boulevard,
go up and wait for the signal and make a legal U turn and
go on down to the freeway; that this would eliminate one
point of conflict and would eliminate the temptation of
making an illegal left turn by these people and would give
them better service to the traveled area; that he was pre-
paring to go ahead on this plan unless the Council had an
objection.
Discussion followed that the cul-de-sac had been twisted and
would come in at basically a 901 angle to Baldwin Park Boule-
vard; that the signals would go, in the Ramona phase rather
than this phase; that it would require a very complicated

signal system at this time, the same as at Maine and
Ramona; that It was proposed to set up. for landscaping
of this right-of-way and to curb around it; that median
curbs were proposed and what irrigation and landscaping
systems could be put in with the use of Gas Tax Funds and
with the City's budget, plant trees and so forth; that the
church,who had indicated a possible protest. at the public
hearIng, had not been supplied the f.ina,l.,plans yet; that
the proposed street was further from their building than
indicated at the time of adopting the General Circulation
Plan; that the street would have a one hundred 100) foot
right-of-way; that only a ninety 90E foot, right-of-way
would be obtained under the first phase.; that curbs and
gutters would be put in to the eighty 180) foot right-of-
way with a sixteen 16) foot median which allowed for two
thirty-two 32) foot lanes or two lanes of traffic and
one parking lane on each side of the medi_an;, that Baldwin
Park Boulevard going into Pacific would not be cut off at
all; that the cul-de-sac would be the length.of the apart-
ment units across from Sterling Savings,and Loan and serves
just those apartment units; that this would not take any
of Sterling Savings and Loan land.
City Attorney Flandrick stated there was a proposed
amendment to Ordinance No. 436; that the staff recommends-
tion was that it be amended to read on the last line which
now reads from 12:00 noon until 3:00 p.m.," to add at
that point and every day appointed by the President or
the Governor for a day of public fast or holiday".
COUNCILWOMAN GREGORY MOVED THAT ORDINANCE NO. 436 BE
INTRODUCED AS AMENDED. COUNCILMAN MOREHEAD SECONDED.
The motion carried by the following vote:
City Attorney Flandrick stated that Ordinance No. 436
would be submitted to the Council at the next regular
meeting for second reading and adoption.

Councilwoman Gregory stated it had,.been brought to her
attention by several people who live in the area of
Clark Street that people who walk along this,stree-t. had
to walk in the street because of the abWce.of sidewalks
and fences that were built out to the curb; that she was
hoping that the Traffic Committee could take Clark Street
under consideration as to Mat could be done for the
pedestrians; that perhaps the No Parking" Zone near the
post office could be extended from Bogart or at least maybe
to Alderson.
Mayor Crites suggested that the City Engineer and the
Traffic Safety Committee look into the encroachments
on the entire length of Clark Street and what could be
done to alleviate the problem.
City Engineer French stated there had been complaints
in regard to the street width; that it was a thirty 130)
foot curb to curb width which was too narrow; that he
would check Into the encroachments in the, public.right-
of-way and take care of that item; that the other item
would be turned over to the Traffic Committee for study
and recommendation to the Council.
Discussion followed regarding the new apartment buildings
and the parking spaces required at the time they..;wer.e built.

Councilman McCaron stated that Mr. Tice was in.the audience;
that he would like to hear from him direct as there was some
concern indicated earlier this evening that Mr. Tice was to
have a motorcy.,cle.brigade attending the hearing in Irwindale
and that possibly there might'have to be police protection.
Mr. Willard Tice, 13813 Calais, Baldwin Park, stated he
had no knowledge of this whatsoever.

Councilman Morehead questioned the legibility of the sheets
attached to the claims resolution.
Finance Director Duncan stated this was copied on the
Xerox Machine, however it was not the fault of the
machine; that in order to get the Council a copy of
the information they need, copies were being reproduced
from the register of audited demands; that there was a
carbon that went over the warrant total that draws the
check at the same time and this was the reasonl.this
was somewhat blurred; that the use of the accounting
machine could be discontinued and go back to the stencils
if this was not giving the Council the information needed;
that this was the best that could be done with the reproducing.

Association had met and elected Mr. Paul Duncan to fill
the unexpired term of Frank Campuzano on the Personnel
Board. He asked Mr. Paul Duncan, who was in the audience,
to stand up.

in Baldwin Park; that this n3orning he had received a call
from Assemblyman Harvey Johnson who again confirmed their
appreciation.
Mayor-Crites stated that the Chairman, Assemblyman Pierce
Young, as he was leaving, made a Special effort to thank
the City again for the hospitality and the use of the
facilities.
Mayor Crites stated he and the other Council members would
like to personally thank the staff who participated in
making this a great adventure and the Chief Administrative
Officer who directed thq activities.
Councilman Morehead stated that public hearings in the
future could now be held with dignity and pride using the
tables which were built for this hearing.
