REGULAR MEETING OF BALDWIN PARK CITY COUNCIL MARCH 16, 1966
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Mayor Crites led the salute to the flag. FLAG SALUTE

Mr. Michael V. Dargus, 13260 East Francisquito, Baldwin MICHAEL V. DARGUS,
Park, stated a teen post was in the progress of being 13260 E. Francis-
organized; that they would like to know if the City would quito, B.Pk.
give financial or moral support; that the government would

that the government would pay $600.00 a month for the
Director and $200.00 a month for the rent; that donation
of services would dive credit toward the thirty-five percent
at the rate of $1.50 per hour; that the present committee
to initiate this program was Reverend Rose, Reverend Porter,
Ed Kirschoff, Mrs. Martin, Mrs. Dargus and Mrs. Lyons.
City Attorney Flandrick stated Howard Thelin, Assemblyman
from Glendale, had recently requested an opinion from the
Attorney General as to the extent to which City's could
participate in the antipoverty program; that this should be
out in the next week to ten days.
Mr. Dargus asked if the City did not at one time have a
fund set aside for youth activities.
Chief Administrative Officer Nordby stated not that he
knew of; that this did not, however, preclude the City's
participation; that he wanted further information about
the program.
Mr. Dargus stated the Chairman of the committee would be
present later in the evening.

COUNCILMAN MOREHEAD MOVED THAT THE CITY TREASURER'S REPORT
AS OF FEBRUARY 28, 1966, BE RECEIVED AND FILED. COUNCIL-
WOMAN GREGORY SECONDED. There were no objections, the
motion carried and was so ordered by Mayor Crites.

At 7:40 p.m. Mayor Crites excused City Treasurer Pugh
pursuant. to her request.

City Clerk Balkus read in full a letter from Harry E.
Bushmiaer dated March 16, 1966, resigning from the
Personnel Board.
City Attorney Flandrick stated he and Chief Administrative
Officer Nordby had met with a representative of the
Employees Association and advised them of the fact that
there were two vacancies; that it was hoped that the
names would be ready by the next regular meeting.
COUNCILMAN MOREHEAD MOVED THAT MR. HARRY E. BUSHMIAER'S
RESIGNATION BE ACCEPTED. COUNCILWOMAN GREGORY SECONDED.
There were no objections, the motion carried and was so
ordered by Mayor Crites.
Councilman Morehead; asked that a letter of appreciation
of his services be written. There were no objections.-

Councilwoman Gregory asked that the City Attorney report
on the last League of California Cities Meeting.
City Attorney Flandrick stated the Quimby Bill as such was
the law that was enacted in 1965 that permits any General
Law City as a condition of approval of any Final Tract Map
to require the dedication of land or the payment of a fee
for park purposes; that this was obviously a compromise
bill; that the initial proposal was that the City could
set any fee the City felt reasonable based on the City's
budget; that there had to be a formula established based
on the City's needs for park purposes and related to the
particular subdivision involved based on the number of
lots and dwelling units on the lots based on a population
study; that the League of California Cities had formed
a committee consisting of two city planners, several recrea-
tion people and Sam Garlick, Attorney from Burbank and
himself as the legal drafters of the committee report and
sample ordinance; that the commitee report gave a pretty
good idea'of the kind of material the Council and Planning
Commission would have to consider before enacting such
legislation; that there was a sample ordinance attached;
that the formula was worked out based on land value of the
land being subdivided; that if the land value was $30,000.00,
raw land value undeveloped, the subdivider would be re-
quired to contribute a fee of approximately $900.00 per
dwelling unit under the existing fee; that the fee was
a flexible thing and could be raised or lowered for the
particular needs of the City but this was the League's
recommendation; that this should be to the Council in
printed form within the next two weeks.

ORDINANCE NO. 449 ADDING SECTION
9247 TO THE BALDWIN PARK MUNICIPAL
CODE RELATING TO SUBDIVISION REGULA-
T IONS
City Attorney Flandrick stated it was proposed to change
the draft of the ordinance for the time for the final
tract map to be filed, approved and recorded from eighteen
18) months to twelve 12) months; that in the 1965
legislation there were changes made in the State Map Act
leaving it to the Council's discretion as to what number
of months the Council wished to set, not to exceed
eighteen 18) months; that the City Engineer recommended
a period of twelve 12) months.

NO. 449 BE WAIVED. COUNCILMAN MOREHEAD SECONDED. There
were no objections, the motion carried and was so ordered

on the award of the Maine Avenue Street Improvement
Contract stating it was the recommendation of the staff
that the bid of F. W. Richter Co., Sierra Madre be awarded
the contract for the sum of $133,066.30.

WITH F. W. RICHTER COMPANY AND THAT THE PROPER OFFICIALS

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Nordby stated at the last
regular meeting the subject of palm trees came up; that
there were six palm trees in the vicinity of Joan-
bridge on Maine; that the construction contract for
Maine Avenue called for the removal but not the
replacement; that the F. W. Richter
Company had agreed to relocate the trees within reasonable
distance for the sum of $200.00 each; that the location
of the westerly end of Ramona was considered, however,
in view of possible work there in the next few years the
trees might have to be relocated; that a permanent loca-
tion was the park site between Badillo and Central along
the Big Dalton Wash.
Discussion followed that the trees were approximately
eighteen 18) inches in diameter and thirty 30) feet
in height; that they were date palms.
Councilwoman Gregory stated when she brought up the
subject of palm trees she was speaking of the tall
palms. She asked if the date palms could be used in
landscaping.
City Engineer French stated this was not the normal type
tree found in the median area; that they were a dirtier
tree than the tall Washintonlans.
Further discussion followed wherein it was decided not
to relocate these date palms; that only the Washintonian
palms and other trees that would lend well to landscaping
were to be considered for relocation.

on the waiver of bid requirement for Auditorium Equipment BID REQUIREMENT FOR
stating this item was an appropriated item for which'funds DIMMER BOARD. FOR
were available; that there was one source of supply which AUDITORIUM
was the Pembrex Theatre Supply Corporation, Los Angeles;
that the item was a dimmer board which amounted to $1,095.00
plus tax; that equipment now in the auditorium, purchased
last year, was this particular type; that this purchase was
to supplement the equipment already there.

City Clerk Balkus announced that it was the'time and
place. fixed for the continuation of a public hearing on
N-22, to determine whether certain premises, and build-
ings and structures constitute a public nuisance at
13240 Emery Avenue.
City Engineer French stated the doors and windows had
been sealed; that the nuisance had been abated and
recommended that the proceedings be dropped.
As there was no one in the audience desiring to speak
in behalf of or in opposition to N-22, Mayor Crites
declared the public hearing closed.
In answer to questions by the Council, City Engineer
French stated the property was owned by a Savings and'
Loan; that it was a habitable"structure;' that it could
be rehabilitated.
City Attorney Flandrick stated rehabilitation was minor;
that the problem was that it was abandoned; that the
dwelling and garage were well boarded up and in its
present condition did not, in his opinion, constitute
a public nuisance; that perhaps the Chief Administrative
Officer could be directed to write a letter to the
Savings & Loan Association indicating the Council's
concern and ask what they intend to do with the property
and when.

Regular Meeting of the Baldwin Park City Council
City Clerk Balkus announced that it was the time and
place fixed for the continuation of a public hearing
on N-24, to determine whether certain premises, and
buildings and structures constitute a public nuisance
at 4934 Marion Avenue.
City Engineer French stated this property was presently
in the process of being acquired by Keystone Savings and
Loan; that they were or would be in escrow for the sale
of this property; that Mr. Hiker with their firm had
assured the Council that this building would be sealed
March 17, 1966; that it was recommended that this action
be continued to give them an opportunity to seal the
building and complete their sale negotiations; that it
was a rehabitable building.
As there was no one in the audience desiring to speak
in behalf of or in opposition to N-24, Mayor Crites
declared the public hearing closed.
COUNCILMAN MOREHEAD MOVED THAT N-24 BE CONTINUED AND
INSTRUCT THE CHIEF ADMINISTRATIVE OFFICER TO FOLLOW UP
ON THIS AND SEE WHAT COULD BE DONE ABOUT IT. COUNCIL-
MAN MCCARON SECONDED. There were no objections, the
motion carried and was so ordered by Mayor Crites.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
a public hearing on Z-287, an application submitted by
A. K. Agajanian for a Zone Change from Zone R-3 heavy
multiple family residential) to Zone M-I light manu-
facturing), or a more restrictive use, upon parcels of
land located at the southwesterly corner of Dalewood
Street and Puente Avenue.
City Clerk Balkus stated that proper publication, postings
and mailings had been accomplished.
Planning Director Chivetta presented a resume stating
the Planning Commission had adopted Resolution No. PC
66-9 on February 23, 1966, recommending approval of the
request from Zone R-3 to Zone C-2. H'e pointed out, the
map on the wall showing the existing zoning:of the area.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR
CRITES.
Mr. Art Agajanian, 4618 Roxbury, Corona Del Mar, stated
rezoning of the property at Dalewood and Puente was
approved in 1958 with certain conditions, for M-I; that
they had agreed to dedicate the front for the widening;
that there had been a storm drain hazard and they had
proposed to improve this; that there were conditions
that they put a block fence completely around the property
and also the outside improvements; that this would be
improved to a fine C-2 development to which they were
agreeable; that some time ago in M-I a service station
was able to have light tune up and brake repairing.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Planning Director Chivetta stated that C-2 consisted of
retail commercial development; that the uses permitted
would be administrative and professional offices, appliance
stores, bowling alleys, clothing or wearing apparel stores

City Attorney Flandrick explained that there had been an
approved conditional use,permit application for a portion
of this property for a service station; that this applica-
tion was approved subject.. to approval of this zone change
proceeding.
Discussion followed regarding the necessary ten 10) foot
dedication.
As there was no one else in the audience desiring to speak
either in behalf of or in oppsition to Z-287, Mayor Crites
declared the public hearing closed.

fixed for a public hearing oh CP-72, an appeal from denial
of the Board of Zoning Adjustments, an application sub-
mitted by A. K. Child, Agent, for Dalewood Properties,
for a Conditional Use Permit for the erection and use of
a service station in the C-2 heavy commercial) Zone upon
a parcel of land located at 14600 Dalewood Street.
City Clerk Balkus stated that proper publication, postings,
and mailings had been accomplished.
Planning Director Chivetta presented a resume stating
that the Board of Zoning Adjustments had adopted Resolu-
tion No. BZA 66-8 on February 9, 1966, denying the request.
He pointed out the map on the wall showing the existing
zoning of the area and a plot plan.

and erroneously created the impression that it was going
to be an independent service station and. that the future
maintenance of the service station would be questionable;,
that the second problem was the proximity of the service.

sketch of the plot plan stating since the Board of Zoning
Adjustments meeting he had had a chance, to talk with the
neighbors and hear what their main objections were; that
they had finished negotiations with American Oil who had
a reputation of fine service and they wQu(d take care of
the maintenance and upkeep; that Mr. Ray Davi'ion with
American Oil Company was present to answer quesfioris per-
taining to the engineering layout, etc.; that the second
objection, the adverse effect of a filling station on a
residential area was a matter of transition; that on the.
plot plan they had moved the service station to the east
forty-five 45) feet doubling the vacant area as a buffer.

they were prepared to accept the conditions. He read the
conditions a) through q) stating they felt by complying
with all of these conditions and by moving the facility
to the east they had overcome any adverse effect on the
surrounding neighborhood. He stated the neighborhoods
main objections was the fact that two curb cuts'on Ituni
would drop traffic onto Ituni which was basically a
nieghborhood type of a street and incapable of handling
additional traffic, and also a stop sign on the northwest
corner created a hazard; that by moving the service
station to the east and eliminating the curb cuts obviously
they had eliminated at least fifty percent 5090) of the
objections to the traffic; that the two curb cuts as shown
on the amended drawing were considered by traffic specialists
to be the ideal type to handle..traffic flow. He further
stated the property had no conditional use restriction
right now with the exception of a service station; that
the revised plan overcomes any adverse effect that it
might have on the surrounding neighborhood by the very
nature of the conditions imposed; that the property
being zoned C-2 was exposed to any type of a development
within the scope of C-2; that-at-this point conditions
and restrictions provided the highest and best control
over what went into that locatl.ion; that the'very character
of the land itself was commercial because of the existing
service stations and restaurant on adjacent properties.

Mrs. Fritzie Darval, 1305 South Halinor, West Covina, stated FRITZIE DARVAL,
the main objection was there was absolutely no need for 1305 S. Halinor,
this service station at this location; that if the pro- W. Cov.
posed gasoline service station went in it would mean
three 3) service stations within seven hundred forty-four
744) feet on the same side of the street; that the service
road was only forty 40) feet across; that accidents had
been bad enough on that particular stretch of freeway which
she thought police records would prove; that it was bad
enough before Howard Johnson's came in and it was even
worse now; that one of the gentlemen on the board, she
believed it was the City Engineer, when questioned''by the
Chairman admitted that this,street was too narrow and
a traffic hazard; that the same gentleman who-admitted
existing traffic hazards later voted for the station permit;
that this she could not understand; that later traffic
was ignored and they talked about the number of planters
and trees required, but the fact remained that this was
going to be a service station; that the traffic was also
ignored in the conditions to be imposed if the permit was
granted; that her property was most affected by the pro-
posed service station; that the proposed pumps would,
according to the new plot plan, be one hundred 100) feet

from her bedroom; that entrances and exits on Ituni for
neighborhood business would not do any good, in her opinion;
that this would put extra traffic on Halinor; that many
children play in the street. She asked what good would
this station do anyone except the promoters.
City Attorney Flandrick stated any comment concerning
the economic desirability of the station was nota
proper concern for this Council; that the question was
also improper.
Mrs. Darval stated the public had no need for the station
there; that the neighborhood did not want it and the
traffic could not take it and this was the main concern.
Mr. George Whittpenn, 1319 South Halinor Avenue, West GEO. WHITTPENN,
Covina, stated he would assume that the maps that were 1319 S. Halinor
submitted were incorrect because the angle of Ituni was Ave., W. Cov.
more definite than shown; that there was a traffic
hazard at Dalewood where traffic was making a deliberate
fast right turn to get onto the freeway; that he knew
that the City could tell from the police.reports the
number of accidents that had occurredat.that particular
curve between the entrance of the freeway and three
hundred feet west; that both the Richfield'and Texaco
Service stations had been there a number of years, changed
managers several times and been closed for long periods
of time.
City Attorney Flandrick stated that the question of
whether this was a desirable thing from an economic
standpoint was not an issue to be considered by the
Council in connection with a conditional use permit.
Mr. Ross Messina, 14324 Walnut Creek Parkway, Baldwin ROSS MESSINA,
Park, stated the gasoline station would create more 14324 Walnut Creek
cars; that they would come down Halinor to get to Puente Parkway, B.Pk.
Avenue; that this was a nice residential street and he
would like it to stay that way.
Mrs. Walter Day, 1860 Halinor Avenue, Baldwin Park, stated she MRS. WALTER DAY,
did not want the gacolfne s::rvice station to be put 1860 Halinor Ave.,
in because of the children; that they purchased their B.Pk.
home because the street was quiet; that there were
many children who rode their bicycles,on the street;
that the traffic would come down Halinor,Avenue to
avoid the two stop signs on Puente Avenue.
Mr. Charles Mallette, 1851 Halinor Avenue, Baldwin Park, CHARLES MALLETTE,
stated he was opposed to the gas station. 1.851 Halinor Ave.,
B.Pk.
Mr. Charles Hesson, 1310 South Siesta, West Covina, CHAS. HESSON,
stated perhaps the Council could not consider the matter 1310 S. Siesta,
from an economical standpoint but perhaps the Council had W. Cov.
a moral or ethical consideration; that the Council had
already approved.one variance for a service station
approximately one I) block away at Dalewood and Puente;
that directly across the street from that there was a
Shell Station; that there were two service stations
adjacent to the proposed location; that a saturation
point would be reached in this particular area; that
perhaps these stations would be public nuisances in the
future; that the plot plan did not show the street at
the proper curve. He stated some consideration should
be given to the rest of the property since the plot plan
had been revised to show the service station moved to
the east seventy-three 73) feet from the original plan.
Polly Ferrell, 1309 South Halinor, West Covina, stated POLLY FERRELL,
approximately twelve 12) feet of the end of her lot was 1309 S. Halinor,
taken to make the service road; that her trust deed stated W. Cov.

no ingress and egress to the service road but Mr. Cook
could, Howard Johnson could and the Richfield Station
could; that there were nine buses that picked up children
on the service road to take them to school; that the
traffic would be worse when Ituni was opened up; that
there would also be more noise.
Mrs. Elise Mallette, 1851 Halinor Avenue, Baldwin Park,
asked if the Council did not have a moral responsibility
to the taxpayers of Baldwin Park to see that what went
in was going to succeed so that the taxes were lowered;
that we" have one of the highest tax rates in Los Angeles;
that she was concerned about the children; that there
would be more cars than there were now racing up and down
the street.
Mr. James Lorenzo, 1304 Halinor Avenue, West Covina,
presented the bus schedule for the school children
grades one through five showing five pickups at the
corner of Ituni and Halinor; that the plot plan as
shown was not the way the street actually was; that
Mr. Child gave a nice speech about what he would do
and if he complied with all restrictions he certainly
would be creating a first" in gas stations; that he
did not think anything materially had been done to
alter the decision of the Board of Zoning Adjustments
in denying this request.
Mr. J. C. Morosan, 1841 Halinor, Baldwin Park, stated
this would cause a great problem; that since Howard
Johnson had moved in the traffic had increased at least
fifty percent 50%) on Halinor and with the gasoline
station it would be a real problem.
Mrs. Wallace E. Stevens, 1305 South Siesta Avenue, West
Covina, stated that half of her property would be facing
the gas station; that she could already hear all of the
ding-dong" bells from the Richfield Station; that
she did not care to hear them any closer; that there
would be additional traffic and also the corner as
others had stated was incorrect on. the plot plan; that
they already looked out on a sea of neon signs; that
she objected to the service station because of the
lights, additional cars and noise.
Dee Lorenzo, 1304 South Halinor, West Covina; Lucille
Barr, 1317 South Siesta, West Covina; Mr. Elmer Kerns,
1320 Siesta, West Covina; Mr. Jack Darval, 1305 South
Halinor, West Covina; and Mr. James Eddy, 1315 Halinor,
West Covina, also wished to go on record as opposing
the proposed use.
IN REBUTTAL, Mr. A. K. Child asked if C-2 zoning in
Baldwin Park allowed for a service station.
City Attorney Flandrick stated yes with a conditional
use permit.
Mr. Child stated he could put any of the following on
the C-2 property: bowling alley, turkish bath, drive-in,
pool hall, gymnasiums, reducing salons and food locker.
He stated they would accept the conditions imposed by
the Planning Commission in the event the Council saw
fit to issue the conditional use permit.

stated she had just come from a meeting of the Teen Post; 13260 E. Francis-

meeting she had just come from were: Mr. Talley, Presi-
dent of the Service Counsel, Ed Kirschoff, Mr. and Mrs.
Sorto, Jane Lyons, Grace Martin, Father Rose and Reverend
Porter; that they would have to have funds; that she
understood that after June the community would have to
furnish 35% of the expenses; that with all of the clubs
and organizations in Baldwin Park she did not think it
would be too much trouble raising money; that possibly
the City could help them in_some way.

Councilman McCaron stated the Council had received two
letters concerning emergency treatment at Hartland
Hospital; that the Council should receive further informa-
tion as to what could be done to alleviate the problem.
Discussion followed that the Police Department and Rescue
Squads had been highly praised in the letters received.
City Attorney Flandrick stated if it was found that there
was a situation of nonconformity with standards for a
hospital of this type, emergency service, there was a
State Agency it could be referred to for investigation
in the Department of Vocational Standards.

Councilman McCaron stated he would like to see the public
hearing continued to the next:regular meeting; that it
might be possible to have some further information; that
he would like to have a report from the traffic committee
as to what the conditions were in the area.
Chief Administrative Officer Nordby stated that he had
learned this afternoon that the Planning Director of West
Covina, who was expressing the informal opinion of the
City Council of West Covina, had also informally requested
that this matter be continued; that it appeared that the
West Covina City Council was somewhat concerned about
the compatibility of this development with the R-1
development across the City border.
