REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL JUNE I, 1966

In accordance with Section 2703 of the Muntelpal Code the
City Council met in open meeting. at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met In
regular session at the above place at 7:30 p.m.

Mr. William E. Johnson, 13446 Dunia Street, Baldwin Park, RE 13449 DUNIA ST.
stated there was quite a group present this evening; that VIM. E. JOHNSON,
their problem was 13449 Dunia Street and the many trouble- 13446 Dunia St.,
some things that people who live and visit there are doing B.Pk.
and have done for the pest five 5) months. He enumerated
the problems involved and stated he wanted an answer to
three things: was the homeowner responsible and can they
be moved out, when will this situation be stopped and was
the police force inefficient or what was happening.
Chief Administrative Officer Nordby stated he was familiar
with the case; that he had discussed it with the police;
that the Chief of Police was in the audience and had
followed it step by step.
Mr. Ralph Cruz, 13446 Dunia Street,,Baldwin Park, RALPH CRUZ,
enlarged on Nr.'Johnson's cottments. He stated by the 13446 Dunia St.,
action of these citizens here tonight we" request B.Pk.
adequate police protection to preserve our" lives
and property because we" feel without doubt that
there will possibly be some repercussions from this City
Council meeting; that they requested that decent law
abiding citizens be permitted to rear their children in
a decent moral atmosphere free of narcotics, prostitution,
reckless and dangerous driving and filthy language; that
we" feel that it is the responsibility of this City

Council to stop prostitution and narcotics no matter where
it exists in the City not only on Dunla Street; that they
appealed to the Councils civic responsibility and ask
that the Council take the same action In this case that
they would take if a house of prostitution and narcotics
adjoined their property.
Councilman Morehead stated tonight was the first time that
he had heard of this subject; that there was no doubt
in his mind but that the Police Department had investigated;
that he felt sure that they had crone all in their power
to put a stop to whatever was going on.
Mr. Gil Christman, 13508 Dunia Street, Baldwin Park, stated GIL CHRISTMAN,
he was across the street and down one house. He asked what 13508 Dunia St.,
the citizens could do to protect themselves if they were B.Pk.
not going to get any protection from the police.
Mayor McCaron stated there would have to be a further
report on this in order to make a determination; that
this was new to the Council.
Chief Administrative Officer Nordby stated he had talked
with Mr. Johnson on two or three occasions; that the last
time he was in he had Mr. Cruz with him; that Captain
O'Leary was also at the conference and had reviewed as much
of the information as he could review without destroying
the chain of investigation; that the City was seriously
interested in this case and wanted to resolve it. He asked
the Chief of Police to make comments on the progress and
some of the frustrations involved in this particular
situation.
Chief of Police Adams stated the detectives did not work
weekends; that Mr. Johnson had been asked to notify the
department, not an individual, at any time and whatever
could be done would be done at the moment; that he did
not have enough men that he could station one man twenty-
four hours a day in their back yard to try to avert a
situation; that the Police Department was conducting an
investigation; that it had not stopped at the present
time; that if he were to detail the facts in this case
he was afraid he would explode an investigation that had
been going on since Mr. Johnson brought this to the Police
Department; that information Mr. Johnson had given had been
utilized which had given the Police Department ample Information
to follow up and had proven to be factual; that as Mr.
Johnson had stated, the last time the Baldwin Park Police
had made an arrest the District Attorney refused to issue
a complaint because of lack of showing who the owner of the
contraband was, therefore rather than go into this same
situation again and do nothing more than make fools of
Police Department, there were trying to present to, the
District Attorney with their next case a thorough solid
and complete investigation; that he would not detail what
information was had as this time because it could be very
harmful to the further investigation; that this was not
merely a single house in Baldwin Park involved, it covered
a great area of the San Gabriel Valley.
Mayor McCaron stated the investigation would be continued
and the Council would have to have a complete report to
know what path to take to resolve the entire problem;
that the Council would check for deficiency in the laws
and would also check the procedure used in the investiga-
tion.

Florence Strelneck, 4477 North Stewart Avenue, Baldwin FLORENCE STRELNECK,
Park, stated she presented a letter to the City Clerk 4477 N. Stewart Ave.,
pertaining to a redress on her sewer assessment. B. Pk.
Mayor McCaron stated the Council had a copy of the letter. RE SEWER ASSESSMENT
64-A-1
City Engineer French stated the basic problem as pointed
out in the letter was the fact that as part of her assess-
ment on 64-A-I she was assessed for two frontages of her
property; that she had an extremely deep lot which ran
between two streets, Stewart and Cutler; that her main
objection was that she had an assessment for all of her
frontage on Stewart plus a lateral, half of her frontage
on Cutler without a lateral and a quarter of her property
was assessed acreage; that she felt this was unfair and
that she did not want an assessment on Cutler; that all
of the other properties within the district that could be
divided and fronted on two streets and had sewer services
to two frontages were assessed accordingly; that her assess-
ment was reviewed by the Assessment Engineer, was reviewed
by the attorney for the district and was found equitable.
City Attorney Flandrick pointed out that this protest was
considered at the protest hearing for the district and was
overruled by the Council; that at this point there was no
action the Council could take with reference to the protest;
that the lady would be required to pay the amounts due under
the bond or in the alternative she had the prerogative, un-
less the time had elapsed and he believed that it had, for
the filing of any civil litigation she may feel appropriate.
Florence Strelneck extensively reviewed her problem.
Mayor McCaron stated he could write a letter stating the
facts in the case and the exact position the property
was in at the present time; that the Council had been
advised that they could take no further action.

Mayor McCaron stated the procedure this evening and for PROCEDURE
the future regarding Oral Communications would be: if a ORAL COMMUNICATIONS
person wanted to speak on something on the Agenda that
did not pertain to him or her personally and was not
under Public Hearings they should speak under the Oral
Communications portion of the Agenda. There were no
objections from the Council.

Councilman Crites introduced Mr. Malcolm Lincoln, Scout- TROOP 666
master, and Troop 666 sponsored by the Presbyterian INTRODUCED
Church.

Councilman Crites reported he had attended a meeting of REORGANIZATION
the Economic Youth Opportunity Agency of Greater Los MEETING FOR
Angeles; that this was a reorganization meeting in which AREA ECONOMIC
two or more groups were reorganizing in a single larger OPPORTUNITY COUNCIL
group with an area wide responsibility; that Carmen Ortiz
from El Monte was elected Chairman; Lindsey Whitmore,
from Bassett, Vice Chairman; Dorothy Davis from La Puente,
2nd Vice Chairman; Mr. James Garrow from Baldwin Park,
Secretary; Holister Ross from El Monte, Treasurer; Peggy
Kidwell from La Puente, Public Relations Secretary;
Reverend Seger from Baldwin Park, was elected member
at large to represent the area.

Councilman Morehead reported he had attended the regular
monthly meeting of the East San Gabriel Valley Planning
last Thursday; that Councilwoman Gregory had been elected
Chairman for 1966-67.

Mayor McCaron announced the hour of 8:00 p.m. having PUBLIC HEARING
arrived, this is the time and place fixed for the hearing 8:00 P.M.
on the Resolution of Intention for Assessment District
66-1, Resolution No. 66-121 of the City of Baldwin Park. JERRY AVENUE
ASSESSMENT DISTRICT
66-1
City Attorney Flandrick stated this was the time and
place for the protest hearing on the Jerry Avenue Assess-
ment District, 66-I; that on the wall was a copy of the
Assessment District Map; that this was a proposal initiated
by the property owners in the area by petition that has
been filed heretofore; that it proposed the construction
of curbs, gutters, sidewalks, driveway approaches, street
paving, utilities, street lights, sewers, storm sewers
and right-of-way acquisition in and along the area shown
on that map as a heavy blue line including an easement;
that the purpose of this hearing is to consider the
protest if any made by any of the property owners affected
by the district.
City Clerk Balkus presented the affidavit of publication,
posting Notice of Improvement, mailing Notice of Improve-
ment and a statement regarding recordation.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL ACCEPT AFFIDAVITS AND
AND FILE THESE VARIOUS AFFIDAVITS PUBLICATION, POSTING STATEMENT ACCEPTED
NOTICE OF IMPROVEMENT, MAILING NOTICE OF IMPROVEMENT) AND FILED
AND THE STATEMENT REGARDING RECORDATION). COUNCILMAN
CRITES SECONDED. There were no objections, the motion
carried and was so ordered by Mayor McCaron.
City Clerk Balkus presented and read in full a protest ONE WRITTEN PROTEST
from Harry A. Hoffman Sr., 3522 North Merced Avenue. HARRY A. HOFFMAN SR.,
3522 No. Merced Ave.,
ASSESSMENT I, PARCEL 6
City Engineer, Dwight French, stated the thirty 30) feet
by one hundred thirty-two 132) feet Mr. Hoffman was
referring to was the area that would be necessary for the
street dedication; that he did not believe Mr. Hoffman
was against the improvement; that the problem was that
Mr. Hoffman did not feel he was in a financial position
to pay for the improvement.
City Attorney Flandrick asked if the City Engineer had
examined the written protest by Mr. Hoffman and if so
what percentage approximately did it represent of the
properties included within the district in terms of
assessed value.
City Engineer French stated it was less than ten percent

had occasion in the past to deal with assessment districts
in contemplating the same type of improvements as in this
district.
City Engineer French stated yes sir".
City Attorney Flandrick asked if the City Engineer and
Walsh-Forkert, the Consultant Engineers working under
the direction of the City Engineer, were satisfied that

there would be benefits to the various properties included
in this district by reason of this construction.
City Engineer French answered yes sir".
City Attorney Flandrick asked the City Engineer if he
believed there would be an increase in value of the
properties in the district by reason of the assessment
district if it is fulfilled as proposed.
City Engineer French stated yes sir".
City Attorney Flandrick stated there was an estimate from
the City Engineer and Consultant Engineers working under
his direction; that the estimated cost of construction and
allied Items would be approximately $75,000.00.
Mayor McCaron asked if anyone wished to speak in support
of the written protest.
Mr. Harry A. Hoffman, 4522 North Merced, Baldwin Park, HARRY A, HOFFMAN,
stated he could not promise to do something which he was 4522 N. Merced,
unable to do; that he understood the cost would run B.Pk.
approximately $37.00 a foot; that for 132 foot that would
be quite a little bit of money; that he did not think
he would live long enough to pay the assessment.
City Attorney Flandrick explained that the cost of the
district would be spread upon each property in propor-
tion to the benefit derived from the improvement.
City Engineer French stated some of the district cost
would be spread by footage and some of it would have to
be spread by square footage and proximity to the improve-
ment; that there were interior lots; that there were lots
fronting directly on the street; that at this time an
exact determination as to the exact benefit to each lot
had not been determined; that the Assessment Engineers
were working on this now; that some of the these lots were
created by lot splits for which there were lot split
agreements stating the degree of liability and the
responsibilities that these lots had to the street; that
some of the area by nature would have to be spread on
the front foot, some by area basis and various other
means; that special units would have special benefits;
that there was more than just a street going in; that
the method of spread on a water line might not be the
same as the method of spread on curb, gutter and side-
walk.
Mr. Hoffman stated he was not worrying about the thirty-
two 32) foot being taken off; that he could not expect
to be assessed as low as a person who had a lot smaller
than his. He asked if he would have time to finance.

a nine 9) year period; that in addition, from what Mr.
French had said, that as to Mr. Hoffman's parcel It was
proposed to acquire the right-of-way from Mr. Hoffman
and others by way of condemnation so Mr. Hoffman would
receive some funds from that.

Mr. Bill Leave, 4455 North Bresee, Baldwin Park, stated he BILL LEAVE, 4455 No.
initiated the petition for this project; that he moved Bresee, B.Pk.
into Baldwin Park approximately two 2) years ago; that
his house faced this proposed street on the edge of the
cul-de-sac; that his front door faced the large vacant
lot; that when he bought this property he was told of
the proposed street; that there was a bond posted for
this street of over $700.00 to be used for this project;

City Attorney Flandrick indicated to the interested parties
in the audience that the Council had now ordered the work
to proceed; that the City Engineer would shortly prepare
the specifications; that the Notice Inviting Bids would
be published shortly; that the acquisition of right-of-way
would proceed; that there would be a second hearing after
the completion of the work at which time all property
owners within the district would be advised of the pro-
posed assessment, the total amount of the cost of work,
incidental expenses; that this hearing would determine
whether the work was accomplished in accordance with the
plans and specifications for the district and whether the
assessments as proposed were fair and equitable.

It was the time and place fixed for a public hearing
on a Short Form 1911 Act for curbs and gutters on the
south side of Estella Street between Maine Avenue and
Phelan Avenue.
Proper postings and mailings had been accomplished.
No written protests had been received.
City Engineer French stated that over fifty percent 50%)
of curbs and gutters were in.
As there was no one in the audience desiring to speak in
behalf of or in opposition to this Short Form 1911 Act,
Mayor McCaron declared the public hearing closed.

City Attorney Flandrick stated the Council had copies of a
written opinion from Mr. Norman Oliver which was secured
at the Council's request; that he was not suggesting any
action be taken merely that it be noted and filed; that
this was with reference to the Irwindale Raceway.

Regarding the Jerry Avenue project, City Attorney Flandrick
stated for the record that the City had hired an appraiser,
Mr. William Wallace, 1371 North Gordon, Pomona; that the
appraisals would be coming in shortly; that the City
Engineer had the Title Reports and would commence acquisi-
tion immediately so that the contract could be completed as
soon as possible.
City Clerk Balkus presented an application for a Temporary
Use Permit submitted by John A. Profumo, Citizens Committee
to Elect Jack Soloman for a car caravan on June 5, 1966,
from 1:00 p.m. to 2:00 p.m. She stated that they requested
that the fees be waived; that the caravan would be entering
the City on Ramona Boulevard at the westerly City limits
and disbanding at Morgan Park.

City Clerk Balkus presented a report from the City Engineer RE REVISION OF
and Planning Director regarding the revision of an access ACCESS EASEMENT
easement with respect to Lot Split 315. The report stated LOT SPLIT NO. 315
that Mr. Tracy Bousman had acquired control of the property
concerned in Lot Split No. 315 and because of existing uses
he had requested a revision in the ingress and egress re-
quirement established by the lot split approval; that approval
of the lot split required a sixteen 16) foot easement
adjacent to the northerly line of Parcels B and C; that
Mr. Bousman would like to modify this requirement as follows:
Instead of the sixteen 16) foot easement, he proposed to
create a twenty 20) foot easement the center line being the
northerly line of Parcels B and C and the southerly line
of Parcel A; that this would locate the easement six 6)
foot northerly of its intended location; that this would
provide better access to the property, that it was
recommended that the request be approved.
City Attorney Flandrick stated it would be required that
the property owner finalize and formalize the easement by
an appropriate document to be recorded.

regarding the Southern California Association of Govern-
ments membership stating the Council had received in the
past several weeks quite a bit of information on this
organization; that it had been his suggestion that the
City affiliate with it; that there were some eighty-two
82) or eighty-three 83) cities that had joined and
five 5) of the six 6) counties in the area involved were
presently members; that he had spoken with Mr. Dan Gamber,
Secretary of SCAG; that the estimate for Baldwin Park's
membership was $400.00; that the first estimate of $350.00
was predicated on full membership, however, there were some
one hundred forty 140) or one hundred fifty I50) cities
in the area and only eighty-two 82) or eighty-three 83)
were members; that he suggested that the membership be
effective July 1, 1966, since It had been appropriated for
in the 1966-67 budget.

that the resolution was a protest to the ruling and unless
the officials In Washington rescinded the action the Post-
master in Baldwin Park would have no authority.

Ramona Boulevard be modified so as to provide two hour

Planning Director Chivetta presented a report on the Shell
Oil service station sign at 1870 Puente Avenue stating that
the Shell Oil represein ative, Mr. Fletcher, had been con-
tacted as to the illumination of the sign; that the Shell
Oil Company had replaced the sign with a yellow background
with red characters; that this appeared to have solved the
problem; that there had been no firther complaints on this
sign as to its illumination on the surrounding properties;
that the staff recommended that this matter be dropped.
There were no objections.
Discussion followed that there was not sufficient time to
set the matter of the service station moratorium for June
15, 1966, wherein the Council agreed to,set the public
hearing for July 6, 1966.

Building Superintendent Kalbflelsch stated there was a
drawing of the proposed construction of the wail; that
there was a permit granted some time back for twenty-
four hundred 2400) feet which was allowable under the
present Code; that the total, if the variance was granted,
would now be thirty-two hundred 3200) feet, forty 40)
by eighty 80) additional; that there would be a minimum
separation of forty 40) feet between all property lines;
that it was a G" occupancy, therefore there was a minor
fire hazard involved within the building itself while it
was under operation; that it was recommended that the per-
mit be granted.

Planning Director Chivetta stated that a proposal had
been submitted by the City Engineer, at the request of
Mr. Benson, to develop Adour Lane to relieve certain pro-
blems relative to Tract No. 29417 and Mr. Benson's
property; that the proposal was that Mr. Benson would
dedicate to the City some 11.7 feet of property for
future widening of Adour Lane and sixty 60) foot of the
rear portion of the property for future widening of
Grace; that the Council referred this matter to the
Planning Commission; that Mr. Benson was now amenable to
dedicate to the City 15.7 feet instead of 11.7 which
brings the total right-of-way up to 40.7 with a transi-
tion by the existing structure to the 11.7 dedication
which would bring it to 36.7 feet of right-of-way and
that he would insert into the CC and R's on the sale of
property that the new property owner would dedicate the
additional land needed for the right-of-way to 40.7 feet when
the house was razed; that this would give two traveling
lanes of twelve 12) feet plus an eight 8) foot parking
lane; that the City Engineer and he felt this was the
best proposal that could be obtained; that this would
alleviate the problems.

Regular Meeting of the Baldwin Park City Council
Mayor McCaron stated he believed that thiy§ problem started
back quite a few years when Tract No. 29437 was put in;
that there was not adequate street allowed at that time.
He asked if it was possible for them to.dedicate•-even
under the house with an understanding with the City that
the house could remain and would not be used until such
time as the house was removed.
City Attorney Flandrick stated it could be accommodated
in that matter; that this was not Mr. Benson's proposal
however; that Mr. Benson's suggestion was that as to
that transition area thatif it was approved that a condi-
tion be imposed upon the property suitable recorded so
that it was a valid condition running with the land that
when the house was destroyed or removed or relocated or
any other construction was taking place on that property
that it would be destroyed or at least that portion of it
in the public right-of-way would be eliminated. He stated
if the Council were to approve this street location, the
condemnation action pending would be expanded by stipula-
tion to include this and this would be an express condi-
tion; that it would also require that he record, as a
condition relating to the property, that when the existing
house was destroyed or any substantial structural alteration
took place that that portion of it within the proposed
right-of-way would be eliminated and dedication should
take place at that time.
Mayor McCaron stated he would think that the procedure
at the present time would be to draw up a resolution
indicating the restrictions and whatever was necessary.
City Attorney Flandrick stated there would have to be
a lot split on this in any event and this aspect would
be accomplished by the Stipulation for Judgment prior to
the submission of the parcel map.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL APPROVE
THE ALTERNATE PLAN AS RECOMMENDED BY THE STAFF AND THE
PLANNING COMMISSION PERMITTING THE DEDICATION FOR ADOUR
LANE IN THE MANNER SHOWN ON THE MAP DESIGNATED ALTERNATE
PLAN" AND THE AREA FOR THE WIDENING OF GRACE AVENUE.
COUNCILMAN ADAIR SECONDED.
Mayor McCaron stated he realized this was not the best
for development but this was certainly better than what
the City had at the present time.
The motion carried by the following vote:

Councilman Crites stated he believed he would defer
on the trip with the Southern California Edison Company
because of the importance of the public hearing items
on July 6, 1966.
City Attorney Flandrick stated that the service station
moratorium would expire unfortunately on July 4, 1966,
therefore it was suggested that the June 15, 1966
meeting be adjourned to June 22, 1966, for the purpose
of that hearing.

the sale of a portion of Bar•ne.s Park to the Division of
Highways, and the proposes reorganization of the Baldwin
Park Recreation and Park District.
