The City Council of the City of Baldwin Park met in adjourned regular session at the above place at 4:00 p.m. Roll Call: Present: COUNCILMEN CRITES AND MOREHEAD AND MAYOR MCCARON Absent: COUNC i LMAN; ADA I R, CITY-ENGINEER ROLL CALL FRENCH, BUILDING SUPERINTENDENT KALBFLEISCH, PLANNING DIRECTOR CHIVETTA, FINANCE DIRECTOR DUNCAN, CHIEF OF POLICE ADAMS, CITY TREASURER PUGH AND CITY CLERK BALKUS Also Present: DEPUTY CITY CLERK LANGSETH COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL RECESS FOR TEN MINUTES. COUNCILMAN CRITES SECONDED. There were no objections, the motion carried and was so ordered by Mayor McCaron. 00- I At 4:10 p.m. the Council reconvened with Councilwoman Gregory, Chief Administrative Officer Nordby and City Attorney Flandrick present. In preparation for a conference scheduled with Frank G. Bonelii on Monday, June 20, 1966, at 9:30 a.m., Chief Administrative Officer Nordby reviewed his report on parks and recreation stating he had placed before the Council a few questions which had occurred to him regarding the dissolution of the Baldwin Park Recreation and Park District; that approximately two years ago the City of Rosemead had adopted a resolution which reorganized their Park District Board; that they had adopted a temporary interim measure; that the present park and recreation district tax was $.204; that this was identified separately on the tax bill; that they expect to have enough revenue next year so they would not have to levy a tax and still support a city park program. Mayor McCaron asked as far as the tax was concerned would it have to be incorporated with the City tax. City Attorney Elandrick stated it was incorporated In the sense that the Council would set it, but it appeared on the tax bill as a separate item; that it would not be included in the general city tax as such; that it could not be used for anything else as there was an absolute restriction on that. Mayor McCaron stated he was in favor of the parks being taken over by the City rather than taking the method that Rosemead did; that the City should try to consolidate all of the parks and put them all under one jurisdiction. BONELLI ON JUNE 20, 1966, TO DISCUSS PARKS AND RECREATION BIB] 39576-U01 1966-U02 06-U02 16-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116938-U03 DO117001-U03 C4-U03 MINUTES1-U03 5/7/2008-U04 ROBIN-U04 ADJOURNED-U05 CITY-U06 COUNCIL-U06 1966 06 16 CC MINHÄ—@¸—1¯ Í«29'78 Adjourned Regular Meeting of the Baldwin Park City Council June 16, 1966 Page 2 City Attorney Fiandrick stated it was not up to the Council to decide whether or not an election would have to be held for dissolution,it,was a matter for the Board of Supervisors and the Local Agency Formation Commission; that there should be a good strong showing that there was a necessity for dissolution and a showing that the City had programmed it in terms of what the City was going to do and what the schedule was going to be, Mayor McCaron stated it appeared to him that there had not been proper educational programs before the previous elections; that the ballot had simply indicated the dissolution of the park district and anyone who did not have any background on it would naturally assume the parks would be discontinued. Councilwoman Gregory stated at the time the election took place there were approximately 15,000 to 20,000 people in Baldwin Park; that she thought there was enough publicity at that time; that the wording of the ballot was the important item. City Attorney Flendrick stated the members of the Council CITY ATTY. OPINION would have the right to write a ballot argument which RE DISSOLUTION BY went along with the ballot and also had the right of ELECTION approval of the language on the ballot itself; that the ballot could be accompanied by a statement in favor of the dissolution and could include what the Council pro- posed to do and why the Council was asking for dissolu- tion. He further stated If this went to an election he would suggest that it be done on the basis of a Special Election rather than try i ng to comb i a i e i f with the November election because things would be so confused at that time it would get lost in the shuffle; that he would suggest that the ballot argument include the fact that the Council was attempting to get back $168,000 that the County had placed in the General Fund; that if it had been a matter of local control these funds would have been utilized by the City to incorporate in exist- ing parks or for acquiring new parks; that this would not mean that the City would dissolve and eliminate the parks; that the parks would remain and the City had a program for additional facilities and additional parks; that most of the time when there was a situation where it was clearly spelled out and the members of the Council were willing to spend some time making comments to various groups there was not too much trouble. Mayor McCeron stated it appeared the Council was concerned with two things besides the taking over of the parks: the $168,000 for the s e of Barnes Park and the accumula- tion of funds for improvements in Morgan Park and Barnes Park, which the City did not want to lose; that the City would want to derive t`J s benefit if it meant holding off acquiring the parks until this money tins actually spent; that the timing should be considered. City Attorney Flandrick stated that Mr. Norman S. Johnson, Director, Los Angeles County Parks and Recreation, had stated that on this or any other district their recommenda- tion was and would be for dissolution; that they could not service the parks they have; that presumably the Board of Supervisors would go along with this concept; that if there was a dlssoiut?oa the existing physical facilities, CONVEYANCE OF PHYSICAL land, and denteIopmen--s on the land, would be conveyed to FACILITIES, LAND, the City by he nit there would be a deed restric- DEVELOPMENT tion that the area could only be used for park purposes; Continued) BIB] 39576-U01 1966-U02 06-U02 16-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116938-U03 DO117001-U03 C4-U03 MINUTES1-U03 5/7/2008-U04 ROBIN-U04 ADJOURNED-U05 CITY-U06 COUNCIL-U06 1966 06 16 CC MINHÄ—@¸—1¯ Í«2979 Adjourned Regular Meeting of the Baldwin Park City Council June 16, 1966 Page 3 that the County had altered that program slightly in that where there had been an incorporation or annexation and dissolution of the district they would convey in that manner but would permit streets to be Out through or widened if the City advised them in advance of what was intended and that the City could do one of two things: set aside x" number of dollars out of the General Fund! or Gas Tax Fund or another fund to put into the park program or buy other land and replace what the City was using for street purposes; that the County was pretty lenient on this; that as far as the funds from the District there was an accounting that would be made prior to the effective date of the dissolution and the surplus would be transferred to the City, again with the restriction as to use only for park purposes; that as far as the $168,000 it was.unlikely the City would get this back in cash; that Mr. Johnson had suggested that as a part of the dissolution program with the County the Council request the Board of Supervisors, and his department would support the request, to have the existing County staff continue at the County's expense for a period of one or two years; that there was no legal obligation on their part to pay back but there was certainly a moral obliga- tion. Councilwoman Gregory asked about the $151,000 that had BUILDING FUND been budgeted towards a new building. City Attorney Flandrick stated he thought this money would be refunded but here again was an aroa of negotiation. Chief Administrative Office Nordby stated if this was accrued from the District tax certainly the County would be legally and morally obligated to return this money to the City. Mayor McCaron stated it showed on the budget as accumulated money for the building. City Attorney Flandrick stated this should be taken up at the time of the meeting with Supervisor Bonelli and Mr. Johnson. Discussion followed wherein City Attorney Flandrick stated from the $168,000 the County had spent $30,000 or $40,000 for minor improvements and the sewer assess- ment on the property; that there was a little in excess of $100,000 left that they had derived from the con- demnation; that Mr. Johnson's attitude on that would be to work through Mr. Bonelli's office and try to obtain the return of that fund from the County Slush" Fund for streets or in the alternative a program of two years free service of County personnel. Councilwoman Gregory stated the Park Board had been working toward a larger park program; that the park sites had gone by the wayside the last ten years by developers and so forth; that the City had not made an effort, until recently, to acquire any land; that the Park Board was desirous of having land returned to them somewhere; that this City was large enough to support more than two parks. Councilman Crites stated he was in agreement to try to get the County to let the City have jurisdiction and con- trol over the parks and recreation; that the City would be getting increased local control; that W. Garrowr of the Baldwin Park Improvement Association had given him the idea that someone named Barnes donated approximately J of the land of Barnes Park; that he believed some of the money could be returned in the way of improvements if the City could not get it back in cash; that improving and obtaining other sites should be upper most in the Council2s mind. City Attorney Fl andr ick stated that Mr. Norman Johnson would not be at the meeting but qtr. Ed Manes, h i s principal deputy, would be. Councilman Crites stated it should be pointed out to the citizens that this would be a disbanding for the purpose or reorganizing. Chief Administrative Officer Nordby stated he was convinced the City had no alternative but to take the action of dissolution; that, in his opinion, it should be accomplished at the commencement of a fiscal year; that there would be a year for an educational program. Mayor McCaron stated there should be a program outlined ahead of time as to how this was to be handled. Councilman Morehead stated he believed as soon as the City could the District should be dissolved and become a City facility; that he would like to see the easiest transition possible; that if it could be dissolved without an election he would be for that; that if the County and the Local Agency Formation Commission thought it should go to an election he would campaign for that; that he would certainly like to feel whatever invested interest that the citizens had was all being returned; that if it came in form of cash, fine, or if it came in the form of salaries for park personnel this was fine; that he would not want the City to lose any of the building fund. He asked if the park district was dissolved and Irwindale, City of Industry and the City of West Covina were asked to deannex and the park district and city boundaries would be the same, how much assessed valuation would the City lose. Councilman Morehead stated if the Park District was dissolved he did not think the City should have any jurisdiction outside of its boundaries wherein Chief Administrative Officer Nordby stated he agreed. Discussion followed that there was some County territory in the Park District also. Councilman Morehead asked what would be the limitation on the Park District Tax. City Attorney Flandrick stated there was no legal limitation. Discussion followed. City Attorney Flandrick suggested, rather than the Council taking any formal action at this time, that the only points Supervisor Bonelli was concerned with were the problems concerning the return of funds derived from the condemnation and the dissolution. Discussion followed regarding a spokesman for the conference. Councilwoman Gregory commented that as far back as July 18, 1955, park land had been taken for the San Bernardino Freeway. Mayor PM1cCaron asked if Councilwoman Gregory had anything to show how Barnes Park was acquired. Councilwoman Gregory stated the Board of Supervisors HOW BARNES PARK records showed that in 1954, with the help of Elwin School WAS ACQUIRED P.T.H. and the citizens, the property now known as Barnes Park was acquired by Los Angeles County from General Funds; that because the policy of the Board of Supervisors was not in developing local parks with money from the General Fund, the Board of Supervisors accepted and passed on the recommendation from the Los Angeles County Department of Parks and Recreation to authorize the Baldwin Park Recrea- tion and Park District to proceed with the development of Barnes Park from District Funds. She stated she had this information in legal letters; that there were no figures as to what the County paid for the property but approximately a total of $50,000 was expended from District funds for the development of Barnes Park; that these two parks were operated under the authority of the Public Resources Code; that on January I, 1962, by State Law, this Park District reorganized; that this revision allowed certain contractual leniencies; that the title to Morgan Park was now in the name of the District but the Board of Supervisors was the governing and the legal board and the boundaries of the Baldwin Park Recreation and Park District were generally or approximately the same as those of the Baldwin Park Unified School District. P;'tayor McCaron suggested that the Council should discuss the three main items at the confernece and forget the small details. Councilman Morehead asked, in the event the Park District was dissolved and became a City park, how could the City get zone code areas not in the Park District now into the City Park District, for instance the Americana Homes. Discussion followed that the Administrative overhead of the County ran 28% to 30%; that the Board of Supervisors as the supervising authority would convey title of Morgan Park to the City; that the Board of Supervisors would convey the title of Barnes Park. City Attorney Flandrick stated the Council would want to outline a program, stating what would be done if the dissolution was approved; secondly the Council would want to get the Park Board, or at least a majority of the members, to go on record, by resolution or otherwise, saying they were in favor of the proposal as such; that once this was accomplished the Council would want to conduct an informal hearing asking people to come in and explain what the Council was proposing to do describing it as being the unveiling of the Baldwin Park Park and Recreation program; that after these three items were accomplished the Council could state the City Council, the Board of Supervisors, the County Park Department and the Baldwin Park Park Board had all agreed that this should be accomplished without an election; that the Council had held a hearing, the opposition constituted, however many it was; that then the Council had the basis of stating there was no need for an election. Councilwoman Gregory stated she thought if was advisable SUGGESTION OF to have an adjourned meeting with the Park Board after ADJ. MTG. WITH the Council had met with Supervisor Bonelli and have the PARK BOARD program straightened out in their own minds. She stated when the Park Board had met with the Council they had indicated they would like to have an Advisory Board which possibly still could be done. Discussion followed regarding the members of the Park Board; that this particular group was probably the major force in petitioning out the election the last time; that the pro- cedure for dissolution would take approximately four or five months, however there would be internal problems if the parks were taken over before the next fiscal year; that the extra time could be used to educate the people as to what was going on thus possibly obviating the necessity for an election; that the newsletter would be a real help in this regard. It was decided to meet for a no host breakfast prior to the 9:30 a.m. meeting scheduled with Supervisor Bonelli on Monday, June 20, 1966. 00- Chief Administrative Officer Nordby asked for an adjourned REQ. June 16, Page 7 1966 00- i Councilwoman Gregory stated she would like to discuss RE HUMAN RELATIONS the matter of a Human Relations Council; that there was COUNCIL one council for La Puente, West Covina and Covina. She stated It was her opinion that the City should have such a Council working as a department within the City Hall under the jurisdiction of the Chief Administrative Officer; that the reports of this Human Relations Council would also come to the City Council and then the City Council would know of any problems arising within the City; that also any department Involved could be alerted to problems; that the Human Relations Council would be in touch with the minority groups and would also be in touch with other Human Relations Councils and be aware of problems through- out the valley. Mayor McCaron stated he would like to see a brief resume of the function of this group; that one reads about Human Relation groups having trouble among themselves and creating dissention; that there should be a pro- cedure set up to where this could be avoided. Councilwoman Gregory stated having a Human Relations Council in this City would show the people that the City Council was interested in the minority groups; that she thought the Council would avert more problems and trouble by having such a Council.
