City Engineer French stated the applicant felt the taking on the corner cut off had as great an effect as the whole take. In answer to a question, Mayor McCaron, City Engineer French stated all the City had where Moody's Market was located was just enough to get In the curb return and the traffic signals. He stated that originally the taking was set up to take all the way back on the corner properties so that the City could get a better transition on some of the intersections; that the money set up for acquisition of right-of-way was not sufficient to do this; that all of the acquisition was limited just to Maine Avenue and for this reason all that was taken was just enough to get around the corner. In answer to Mayor McCeron's question, City Engineer French stated the funds for this request would come out of the Maine Avenue Project funds; that the City was not putting in any improvements; that the curb and gutter would stop just exactly where it stopped before. Mayor McCaron asked if the applicant had the proper set- backs for this type of take. City Engineer French stated the building setbacks were proper. Mayor McCaron asked what The property value was per square foot. City Engineer French stated $2.60; that there was no severance damage figures in the $2.60. Mayor McCaron asked why the figure was set so high when some of the property in the City could not be sold for this prick. City Engineer French stated this was rig"' that except for one piece on Los Angeles, the City could have acquired the full eighty 80) feet without taking some houses; that he believed the acquisition of right-of-way on Olive could be acquired without too much problem except where the Werner Tract pump was. Mayor McCaron stated the pump would not be any problem because it was abandoned. In answer to a question by Mayor McCaron, City Engineer French stated the City would be using seven 7) feet of the fifteen 15) feet proposed to be taken; that the curb on Olive was going in thirty-two 32) feet off of the centerline; that it would be sixty-four 64) feet curb to curb. In answer to a question by Councilman Morehead, City Engineer French stated the $1,990.00 was the appraised value for the corner radius of 703 square feet at the southeast corner of Maine Avenue and Olive Street; that the $6,093.58 was the appraised value of the complete take along Olive Street and the corner cut off. Mayor McCaron stated it would appear to him if Maine was valued at $2.60 per square foot that Olive would not be as valuable because the property was around the corner. City Engineer French stated the full parcel was appraised facing Maine; that the zoning and the proximity to the area was considered by the appraisers; that the appraisers were Mr. Jerry Morriss with O'Brien Mawhenney & Long; and Mr. Vern Cox with Vern Cox Company; that the City was accepting the lowest appraisal. City Engineer French stated that City Attorney FI4ndrick would prepare the Stipulation for Judgment in accordance with this agreement if it was approved. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE CITY ENGINEER IN REGARDS TO THE SETTLEMENT OF PARCEL Nv. 47'D MAINE AVENUE GAS TAX PROJECT NO. 12.9 RIGHT-OF-WAY CONDEMNATION FOR THE TOTAL SUM of $6,500.00. The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, GREGORY, CRITES AND MAYOR MCCARON NOES: NONE ABSENTS COUNCILMAN ADAIR 00- At 8:08 p.m. Special Counsel Martin left the Conference Room. 00- Chief Administrative Officer Nordby stated he had given the Council a two or three page report on the Human Relations Commission. No action was required at the at the present time. 00- Chief Administrative Officer Nordby stated that the Council had before them the product of the first attempts on the multilith; that it was hoped that the budget would be printed on the multiiith. 00- Mayor McCaron stated, In his opinion, if the Council created any more groups in an advisory capacity that they should be referred to as committees rather than commissions; that If the City was going to continue to have requests for remuneration for services rendered the City would be over-burdened. Councilwoman Gregory stated she recalled distinctly stating the Board of Zoning Adjustments would work without remuneration; that the Council did not have to grant this remutiergtion; that she felt what little the Planning Commission received from the City was due them for the time they put in. Mayor McCaron stated what started the pay for the Planning Commission was for insurance coverage In case of an accident while on City business; that this was supposed to be a token amount In order to be able to have them covered; that it appeared with the creation of the Board of Zoning Adjustments the Planning Commission was left with hardly anything on their Agenda; that the Council should have some study on this; that there was another matter that had come about from the creation of the Board of Zoning Adjustments, the fact that Planning Commission created an ordinance to take care of certain Items and the Board of Zoning Adjustments had authority to override what they had done; that there was no communication to decide In particular ns•tances what tts P 9a a ti;ryg Commission had in mind when they decided o nak airy rues and regulations regardin Continued ORD. Councilwoman Gregory stated the reason for the Board of Zoning Adjustments was to allow the Commission to plan the City as it should be planned; that she thought there was room for improvement and many areas where the Planning Commission should be working; that without joint meetings she did not believe there could be proper communication. June 22, 1966 Page 6 Mayor McCaron asked for a report on work loads for both REPORT REQ. ON the Planning Commission and the Board of Zoning Adjustments WORK LOADS OF and then the Council could make a determination as to what P.C. AND B.Z.A. procedure was needed to correct what was transpiring; that if combined meetings were needed then there should be definite dates set for them, possibly every two or three months when every group adjourned to a certain date; that there should be a regular agenda set up and items for discussion; that if it became impossible to coordinate the activities something else would have to be done. Councilwoman Gregory stated the Council had been receiving action sheets of the Planning Commission, Board of Zoning Adjustments and Personnel Board. Discussion followed regarding a case which had been before the Board of Zoning Adjustments where a block well had been deleted for a water company. Chief Administrative Officer Nordby stated we" feel he' Council sometimes is overworked; that generally it was the trend of most Councils to avoid putting the stamp of approval on every action of every commission. Mayor McCaron stated it could be considered that the actions of the Board of Zoning Adjustments could be appealed to the Planning Commission if both bodies were continued; that one should go to the other to have an understanding of what they had in mind. Councilwoman Gregory asked if perhaps a joint meeting with the Board of Zoning Adjustments and the Planning Commission would be helpful at this time. Chief Administrative Officer Nordby stated when there was a joint meeting there should be an Agenda with certain objectives and not get together just to exchange ideas because invariably someone would accuse someone else of not fulfulling their responsibilities. Mayor McCaron stated the discussions should be based on matters that would contribute to formulating procedure. Councilwoman Gregory stated she did not feel the problem was In communications this way"; that there was an overlapping of trouble spots within the Board of Zoning Adjustments, Planning Commission and Council; that there was something wrong In the system; that if the Council was going to have to appeal cases somewhere along the lines the proper ruling had not been stipulated. Mayor McCaron stated there were certain Informative meetings carried on by the Planning Congress that he thought would be very informative to both the Board of Zoning Adjustments and the Planning Commission; that this was very educational and would help them in making their decisions; that constant attendance was required. Councilwoman Gregory stated the Planning Commission and Board of Zoning Adjustments had had very good attendance at the East San Gabriel Valley Planning Committee meetings; that'recently some of the Planning Commissioners had been attending the Planning Congress meetings; that some of the problem with the attendance at the Planning Congress meetings was the distance to be traveled to the meetings. She further stated if the representing members attending would report back to the Planning Commission of the Board of Zoning Adjustments this would be helpful. Chief Administrative Officer Nordby stated whenever a staff member went to a meeting he always required a report; that the Council also adhered to this policy.
