REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Mayor pro tem Morehead led the salute to the flag.

COUNCILWOMAN GREGORY MOVED THAT CITY TREASURER PUGH BE
EXCUSED. COUNCILMAN MOREHEAD SECONDED. There were no
objections, the motion carried and was so ordered by
Mayor McCaron.

City Clerk Balkus administered the oath of office to
Patrolman Roger A. Kaiser, Cadet Barney Reynolds and
Cadet Michael Swinehart. Mayor McCaron presented their
badges.

Mr. Robert Disterdick, Facilities Planning Coordinator
for Los Angeles County, presented schematic plans of the
proposed County Library in Baldwin Park stating they would
be presented to the Board of Supervisors next week with
the recommendation that the architect proceed with the
preliminary drawings; that the building would have 15,320
square feet; that the present library held 24,000 volumes;
that the new library would hold 75,000 adult volumes and
15,000 juvenile volumes; that there would be a multi-
purpose room which could be used for community meetings;
that the parking lot would hold forty 40) cars; that the
estimated cost of the library was $295,000 or $19.2 a square
foot; that this cost included the structure, parking lot,
planting, sprinklers, walks and curbs and gutters; that
it did not include the land or furniture.
Discussion followed wherein Mr. Disterdick stated the entrance
was put on the side so as to be equidistant from the parking
lot and the sidewalk; that the project should be ready to
go out to bid within four 4) months.

preliminary drawings when they were available.

Foremat; that if it was workable the foremat could be
changed by ordinance.

City Clerk Balkus presented a letter from California
Property Brokers dated September 14, 1966, requesting
a one year extension of time on Tentative Tract No.
24972.
COUNCILWOMAN GREGORY MOVED THAT THIS LETTER BE TAKEN INTO
CONSIDERATION AND THAT THE COUNCIL EXTEND THE APPROVAL OF
THE TRACT FOR 180 DAYS. COUNCILMAN MOREHEAD SECONDED.
Mayor McCaron stated this request might not have been
necessary if things had been normal as far as financing
was concerned.
In answer to a question by Mayor McCaron, City Attorney
Flandrick stated the Council was not limited to a number
of extensions that could be granted as long as they totally
did not exceed one I) year.

Chief Administrative Officer Nordby reviewed his report RE N-31
on N-31 stating the City had been concerned with this
property for some time; that the report he had received
indicated there had been substantially no change in the
property from the first time inspection was made to date;
that he concurred with the City Engineer that the City
should proceed with the award of the bid to clean up the
property; that this item appeared later on the Agenda.
As there were no objections, Mayor McCaron stated this HELD OVER UNTIL LATER
item would be held over until later in the Agenda. IN MTG.

Chief Administrative Officer Nordby reviewed his report
on the request of Michael Geraldi to purchase land at the
northeast corner of Maine and Olive stating that the
property was now approximately 1200 square feet; that it

was originally 2500 square feet, the balance having gone
to the right-of-way for the Maine Avenue project; that
he recommended that the City advertise for bids on the 1200+
square feet parcel and sell to the highest bidder; that
anyone who purchased the property would have to take his
chances on whether or not he could proceed with construction;
that there were certain guidelines set up in General Law
which the City must follow including advertising.
In answer to questions by the Council, Chief Administrative
Officer Nordby stated there was at least one other party
and perhaps two other parties who were interested in the
purchase of this property.
City Attorney Flandrick stated one of the comments made
in the notice inviting bids should be that the sale if
made it would be up to the purchaser to render the lot
usable in conformity with the zoning regulations; that
the City did not guarantee anything in terms of a
variance.
COUNCILWOMAN GREGORY MOVED THAT THE CITY OWNED) PROPERTY
AT THE NORTHEAST CORNER OF MAINE AND OLIVE) BE SOLD BY
SEALED BID; THAT THE NOTICE INVITING BIDS STATE THAT IT
WOULD BE UP TO THE PURCHASER TO RENDER THE LOT USABLE
IN CONFORMITY WITH THE ZONING REGULATIONS; THAT THE CITY
DID NOT GUARANTEE ANYTHING IN TERMS OF A VARIANCE; THAT
NO BID BE ACCEPTED FOR LESS THAN $2.60 A SQUARE FOOT.
COUNCILMAN MOREHEAD SECONDED. There were no objections,
the motion carried and was so ordered by Mayor McCaron.
In answer to Councilman Morehead, Mr. Michael Geraldi
stated he had no questions.

Regular Meeting of the Baldwin Park City Council
It was the time and place fixed for a public hearing on
N-46, to determine whether certain premises, buildings
and structures constitute a public nuisance at 3133
Baldwin Park Boulevard.
Proper postings and mailings had been accomplished.
City Engineer French showed photographs of the premises
stating that the property was unsecured and no clean
up had taken place; that it was recommended that the
property be declared a public nuisance and that the structure
be removed.
City Clerk Backus administered the oath.
Mr. Malcolm Henchcliff, 1024 West Service, West Covina,
stated he was the owner of the property; that he had
several bids to have it torn down; that he had received
approval from the first trust deed holder to tear down
the building but not from the second trust deed holder;
that he wanted to know where he stood if it was torn
down and the second trust deed holder started foreclosure
proceedings.

City Attorney Flandrick stated if the second trust deed
holder had been given notice he had evidenced his lack
of interest by failing to appear to object to the
proceedings.
City Attorney Flandrick stated he took it that Mr. Hench-
cliff had no objection to the proceedings and that he felt
it did constitute a nuisance as it stood.
Mr. Henchcliff stated he felt it should come down; that he
did feel it was a public nuisance as it stood.
As there was no one else in the audience desiring to speak
in behalf of or in opposition to N-46, Mayor McCaron
declared the public hearing closed.

stating that no change had taken place since the
initiation; that it was recommended that the property
be declared a public nuisance; that the building could be
rehabilitated.
City Attorney Flandrick suggested that Section 2 of
proposed Resolution No. 66-255 be amended to read:
That if the owners of said property, or others having
an interest therein, do not abate said nuisance by
removing the debris from said property and secure
the said buildings and structures so as to prevent
access thereto within thirty 30) days hereof, the
Chief Administrative Officer is instructed to abate the
same, as provided in Section 3208 et seq of the Baldwin
Park Municipal Code."

Chief Administrative Officer Nordby reviewed his report RE IBM AGREEMENT
on the IBM Agreement stating the City was at a critical
stage now in bookkeeping, accounting and record keeping;
that the application of the punch card system being
suggested was virtually unlimited; that he had observed
one similar to this in the City of Commerce; that the
rental on the IBM recommended was $829.00 a month; that
this would be in lieu of possibly eight 8) or ten 10)
people within the next year necessary to keep the work
current; that in addition to the rental it was necessary
when commencing an IBM system to have someone who could
program the work of each department; that one procedure
at a time would be taken on; that the assignment of a
programmer was to merely take the objectives of any one
procedure and program them into the machine; that the
City was actually losing money on some of the Gas Tax
Projects by not being able to put together certain
items of an accounting nature; that a rough estimate
of the loss in this one area alone was $10,000.00 to
$20,000.00 a year; that the installation of 2J tons
of equipment, the delivery and freight would be an
additional cost; that there were several other items
that also would be additional; that the possibility
of utilizing IBM equipment had been foreseen and there
was a contingency of $6,500.00 in the budget which was
sufficient to cover these additional costs without asking
for a budget amendment or even transferring funds from
one department to another; that the location of the equip-
ment had not been definitely determined, however it should
remain on the first floor for convenience; that it would
not take much room; that the City of Commerce equipment
took up about as much room as his office; that Exhibit I EXHIBIT I WOULD BE
would be applied now; that Exhibit 2 would probably be APPLIED NOW EXHIBIT
three or four years hence when the capacity of the equip- 2 WOULD BE THREE OR
ment was being reached and some of the components would FOUR YEARS HENCE
have to be added to or changed; that the equipment could
be modified with a very minimum effort.
Councilwoman Gregory stated if she understood correctly
the City would have to have both phases to have them
work correctly; that according to her calculations
the rental on Phase I would be approximately $9,948.00
a,year; that Phase 2 would be approximately $25,308.00;
that by the time the City had the additional personnel in-
cluding a Data Processing Supervisor, key punch operators
etc. and installation it would be something like $51,063.29;
that even if the City did not need the Phase 2 right away
it figured out about $500.00 a week; that she was wondering
if the City of Baldwin Park was ready for this; that figuring
the cost of this installation against hiring a few more
people, she would rather see this type of thing projected
in the budget and phased out so that the City could buy
this more easily; that the fringe benefits of hiring
people had not been taken into consideration; that she was
concerned about the extra cost at this time in using IBM;
that she was not against IBM.

Chief Administrative Officer Nordby stated Phase 2 was
several years in the future; that Phase 2 was not a part
of Phase I but was a separate proposal entirely; that
there would be one programmer; that the punch card
operators would be trained from the present clerks.
Councilwoman Gregory stated they must go to school and
this was an additional cost.
Chief Administrative Officer Nordby stated delay could
place the City in an extremely critical position; that
it was his opinion the more delay the City faces the
more costly it was going to get; that the program he
was suggesting was not experimental; that the Council
could meet the man from IBM the City had been working
with if they so desired; that he was very strongly in
favor of avoiding employing more people for he felt
it was not necessary.
Councilwoman Gregory mentioned the meeting she had
attended on EDP and stated Mr. Joseph had mentioned
the machine he had in West Covina and that he found it
very difficult to feed this machine adequately with the
staff that he had and that they were bogged down and
this was the reason this community was so Interested
in the EDP system; that she thought this was something
that required understanding, and to get an understanding
of this type of thing she thought it would take study;
that the Council should be aware of the program; that
they did represent the people and this was a substantial
amount of money that would be expended for this.
Mayor McCaron stated this would merely take care of the
items of bookkeeping that the City had at the present
time; that the reports from the City's examiners stated
that the Department was becoming inadequate to handle
the present work load; that the idea was to get the
program under way to handle what the City had at the
present time; that he did not think any further study
was needed.
Chief Administrative Officer Nordby pointed out that he
had just received a financial report as of August 31, 1966,
which was at this time obsolete; that since August 31, 1966
the City had spent over $100,000.00; that it was difficult
to control expenditures unless the reports were current;
that virtually every financial report given to him was so
obsolete by the time it reached him that it had no value;
that the IBM study had been going on for a period of months
by the people who do the work in the City and by the experts
of IBM; that the people here know what they want and they
know what they do not have and should have and can not
get with the procedure they use now; that the IBM man
has had experience with this kind of equipment and states
it fits the City's needs; that it would take from now until
July 1, 1967, to gear-up for implementing the first procedure;
that he did not present this to the Council saying he thought
it would work, he knew it would; that it was programmed over
a long period of time.
Councilwoman Gregory stated there was a charge for the retire-
ment on the claims and demands this evening; that the Bank
of America was doing the payroll; that she did not feel with-
out a lot of contemplation and budgeting that the City should
get into this right now.

City Engineer French reviewed a report on the bid opening
held September 26, 1966, for the improvement of Los
Angeles Street between Maine Avenue and the east City
Boundary stating that nine 9) bids were received; that
it was recommended that the award be made to Big M"
Construction, 1046 East Meda, Glendora, California, in
accordance with their bid. He further commented that
on this project the City started exchanging curb and
gutter in return for dedication; that out of thirty-
five 35) property owners concerned all but two had
dedicated at no cost to the City for this improvement.
COUNCILMAN MOREHEAD MOVED THAT THE CONTRACT BE AWARDED
TO BIG M" CONSTRUCTION COMPANY, GLENDORA, CALIFORNIA,
FOR THE LOS ANGELES STREET IMPROVEMENT FROM MAINE AVENUE
TO THE EAST CITY BOUNDARY IN THE AMOUNT OF $32,344.30
AND AUTHORIZE THE MAYOR AND CITY CLERK TO SIGN THE
AGREEMENT. COUNCILMAN ADAIR SECONDED.
City Engineer French stated there was a low bid of
$32,344.30; that it was a unit price bid; that regard-
less of what the low bid was the City would pay on
actual quanitities; that basically it was not a flat
award.
Councilman Morehead asked if his motion was in order
wherein City Engineer French stated yes."

City Engineer French reviewed a report on the bid opening
held September 16, 1966, for the demolition of structures
and cleaning of premises at 13415 Valle Vista Avenue, 3139
Marlinda Street and 12732 Torch Street. He recommended
that the award be made to the low bidder, David C. Osti,
923 S. 10th Avenue, Arcadia, California, for the bid of
$1,525.00.
Mayor McCaron commented that N-3I was held over from the
Chief Administrative Officer's portion of the Agenda;
that it had been held in abeyance for over one year;
that he understood the person requesting the delay was
not the actual owner.

Regular Meeting of the Baldwin Park City Council
City Engineer French reviewed a report on the release
of bonds for Tract No. 29417; that the developer was Henry
Levin; that this was the tract where there had been a pro-
blem with a sewer easement; that the problem had been solved
as part of the agreement between the City and Mr. Elmer
Howard Benson which was signed August 8, 1966. He stated
it was recommended that the improvement bond be released,
but that the cash deposit be retained until all charges,
including attorney fees, have been submitted and paid.
COUNCILMAN MOREHEAD MOVED THAT THE IMPROVEMENT BOND FOR
TRACT NO. 29417 BE RELEASED BUT THE CASH DEPOSIT BE
RETAINED UNTIL ALL CHARGES HAVE BEEN ASCERTAINED.

dated October 5, 1966 stating that the following was the
recommendation of the Traffic Committee:

crosswalk be installed at Tracy Street and Frazier Street.
2. That the west side of Walnut Street from the
south side of Olive Street to a point 145 feet southerly of
the south property line of Olive Street be initiated as No
Parking from 8:00 a.m. to 5:00 p.m.".
3. That a stop sign be posted on Channing Street
stopping the eastbound traffic at Vineland Avenue.

City Engineer French stated there was a request to
circulate a petition for the construction of improve-
ments under the Improvement Act of 1911 and waiver of
requirements of Division 4 of the Streets and Highway
Code of the State of California; that this was for
the improvement of the west side of Azusa Canyon Road
from Olive to Sandstone; that the construction would
take place within the street which was all within the
City of Irwindale but the property owners in Baldwin
Park who front the street would be assessed.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONSENT TO
THE CIRCULATION OF THE PETITION AND THE FORMATION OF THE
DISTRICT AND SUBSEQUENT TO THE CIRCULATION OF THE PETITION
IF THEY ARE SUCCESSFUL A FORMAL RESOLUTION WOULD BE BROUGHT
BACK TO THE COUNCIL. COUNCILWOMAN GREGORY SECONDED. There
were no objections, the motion carried and was so ordered

Planning Director Chivetta presented a resume concerning
the clarification of an ambiguity relative to auto dis-
mantling in the M-l Zone; that the City had an either/or
regulation which had created problems to the staff for
some time in that a permitted use for auto dismantling
in the M-1 Zone should be inside of a building but then
the Code further states that this use could be out in
the open; that the Planning Commission determined that
the use should be wholly within a building and not out
in the open; that this was their recommendation submitted
in Resolution No. PC 66-32.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL APPROVE
THE CLARIFICATION OF AMBIGUITY AS SET FORTH IN PLANNING
COMMISSION RESOLUTION NO. 66-32. COUNCILMAN CRITES
SECONDED.
Mayor McCaron asked if the Code did not say that the
storage could not be higher than the wall.
City Attorney Flandrick stated this was already covered
by the Code; that the problem was whether the actual act
of dismantling could be conducted within the building or
the storage area.
In answer to a question by Councilwoman Gregory, City
Attorney Flandrick stated that dismantlers were subject
to State regulations which related primarily to registra-
tion and what they could and could not do with parts.
There were no objections, the motion carried and was so
ordered by Mayor McCaron.

Planning Director Chivetta stated the Planning Commission
on September 28, 1966, reaffirmed their original recommenda-
tion with only one exception, i.e. Location of Accessory
Buildings, which should not be allowed to build to the
property lines because of water run-off problems.
Discussion followed wherein the following amendments were
made in accordance with the Planning Commission's
recommendations):
Section 9552 2b) Change from 55 feet to 60
feet for the interior lot width.
Section 9552 4) Minimum Dwelling Unit
Size would read: The minimum gross floor area, excluding
garage area, for dwelling units shall be as follows:
1 bedroom family units 850 sq. ft.
2 bedroom family units 1000 sq. ft.
3 bedroom family units 1350 sq. ft.
4 bedroom family units 1450 sq. ft."
Section 9553 Add Paragraph 3 Buildings,
Proximity to Lot Lines. No building or structure shall be
located in such close proximity to a lot line so as to
cause roof drainage on a lot other than that on which
the same is located."

Regarding ZV-158, Schavoni, which had been continued from
September 21, 1966, Mayor McCaron stated it would not
benefit the other properties around it; that the zoning
was set up as such to attempt to provide a reasonable
or a proper development in the entire area; that by allow-
ing the development according to this zone variance it
would make the interior property suffer; that they would
not benefit by it and it would not be in line with the
intention of the zone change in the first place which was
requested by the property owners in the area.
In answer to a question by Councilwoman Gregory, Planning
Director Chivetta stated there was no change in the lot
lines; that this was a separate parcel and there was no
creation of a division of a line that effects this property
in any way; that Mr. Schavoni was buying a complete
parcel which was approximately 1/3 of an acre.

Mayor McCaron stated the Planning Commission was short
one I) member. He also stated that the term of Jack H.
Stafford on the Board of Zoning Adjustments would be
expiring November 4, 1966. He asked that each member
of the Council bring back a recommendation for each of
the vacancies; that any discussion would be handled in
Executive Session.
Councilwoman Gregory stated she had handed out to the
Council information sheets regarding the manner of
appointments; that it was her suggestion that Baldwin
Park do as other cities had done by advertising and
taking applications; that she thought there were many
people in Baldwin Park who would like to be active; that
the Newsletter could be used to advertise in.
Mayor McCaron stated he would not like to subject anyone
to some of the questions on the form applications for
employment.

Councilman Morehead stated that he felt the candidates
appointed while he had been on the Council had been
worthy and qualified for their positions; that none of
them had been removed by the request of the Council;
that at this time he felt the present procedure of appoint-
ment was adequate.
Councilman Crites suggested that possibly both procedures
were workable; that in no case should the recommendation
and appointment be made on the same night; that he felt
the privilege of an application to be considered would be
worth the trouble.
Councilman Adair stated he would like the Council to
bring in recommendations.
Mayor McCaron stated the procedure of the Council bringing
in recommendations would be used for this time.
Councilwoman Gregory asked if the Council was adverse to
advertising in the Newsletter.
Mayor McCaron stated the Council would still consider
Councilwoman Gregory's suggestion but for this time the
Council would submit names.
Councilwoman Gregory asked if the advertisement could be
included in the next Newsletter for future appointments.
Mayor McCaron stated that each member should think about
this between now and the next Council meeting and make
the recommendation at that time.

Chief Administrative Officer Nordby stated the League of LEAGUE OF CALIF.
California Cities Meeting in San Diego was October 16-19, CITIES MTG.
1966; that he had the item in his budget and had already OCT. 16-19, 1966
registered; that he did not believe this would effect
the Council Meeting of October 19, 1966, as the meeting
would break up early in the afternoon.
There was NO ACTION REQUIRED. NO ACTION REQUIRED

City Clerk Balkus stated she had received a letter from LETTER FROM LIONEL R.
Lionel R. Neufeld regarding one of the requirements on NEUFELD RE TRACT NO.
Tract No. 29239, dated October 4, 1966; that it had been 29239
explained that this letter was received too late for this
Agenda.
Planning Director Chivetta stated the Construction Fore-
man, Bob Miller, representing Mr. Neufeld approached him
requesting that perhaps the Council could modify the
wall requirements on the peripheral edges of the subject
property; that one of the original conditions of the
tract was to have a six 6) foot high masonry wall
completely enclosing the tract; that there were some
problems involved in that Mr. Miller felt if the wall had
to go in at this time it would hamper the rest of his
development because he did not want to bring in the heavy
equipment over the new streets; that he wanted to bring

it in from the rear of the property off of Ramona or
San Bernardino Road; that a modification was requested to
put in half of the wall at this time and later on when
the rest of the tract was completed to put in the other
section; that because of the architectural design of the
structures they would like a modification on the wall so
as to have the wall partially masonry and partially wood;
that Mr. Neufeld had a design he would like to submit for
consideration.
Planning Director Chivetta stated that Mr. Miller was
in the audience and could state what the urgency would
be; that he thought one of the prime urgency factors was
that he wished to sell the homes and would not be able
to get a Certificate of Occupancy until the wall was
installed.
In answer to a question by Mayor McCaron, Planning Director
Chivetta stated thts'would be a permanent installation; that
instead of a solid masonry watt six 6) foot--high his proposal
was to,put up columns six 6) foot high spaced equally apart
with the-center portion filled in with wood.
City Attorney Flandrick recommended that the Council take
no action until the next Council meeting.
Discussion followed.
As there were no objections, Mayor McCaron advised Planning REFERRED TO P.C.
Director Chivetta to submit the letter outlining the proposal FOR REPORT BACK
to the Planning Commission for a report back to the Council TO COUNCIL AT NEXT
at the next regular meeting. REG. MTG.

Councilman Crites stated in his school involvements they
had gone into IBM processing a long long time ago starting
off first by contracting services; that the processes were
completed many times faster than by hand.
Councilwoman Gregory stated that schools operated on a
budget of 51 million dollars a year and the City was
operating on a budget of 11 million dollars.
Councilman Crites stated this was quite true but there
was also quite a difference in immediate need over
handpower of work.
In answer to a question by Councilwoman Gregory, City
Attorney Flandrick stated the Council had before them
a sample form agreement; that if the Council was to
approve the proposal he would like to redraft the agree-
ment; that if the Council so desired they could approve
the program as such and an agreement would be brought
back to the Council at the next meeting.
