In accordance with Section 2703 of the Municipal Code the City Council met in open meeting at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items. The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilwoman Gregory led the salute to the flag. MARTINEZ, Atlas Sewer Company stating it was recommended that $19.00 DBA ATLAS SEWER CO. be refunded, $21.00 less $2.00 to cover the transfer of location. There were no objections, the motion carried and was so ordered by Mayor McCaron. 00- City Engineer French reviewed his report on a request of REQUEST TO CIRCULATE Mr. Cutter, 4829 N. Bleecker Avenue, to circulate a 1911 ACT PETITION 1911 Act petition for North Downing Avenue stating that N. DOWNING AVE. this was now a private street; that there was a map in the Council Agenda folders indicating the area; that there was a problem with street width; that the section of North Downing for the first 300 feet off of Bleecker would be dedicated to a forty-five 45) foot width with thirty-five 35) foot of pavement on this proposal; that the reason for this was that there now existed structures that would not allow a sixty 60) foot dedication for this section of street; that the people in the area seemed to be acceptable to the forty-five 45) feet. In answer to questions by the Council, City Engineer French stated the hatched areas on the map would have to be dedicated; that a great section of this was an existing private street; that this would require dedication for the entire street; that Downing now existed for approximately six hundred 600) feet in length, three hundred 300) feet westerly of Bleecker and approximately three hundred 300) northerly as a private street used as forty 40) feet in width; that there could be parking on both sides and still move two cars through, however it would be very very tight. Mayor McCaron commented that there were streets now where STREETS NARROWER THAN there was parking on both sides and the width was 35 FT. There were no objections, the motion carried and was so ordered by Mayor McCaron. 00- Planning Director Chivetta reviewed his report on the TRACT NO. 29239 modification of a wall for Park West Tract No. 29239, REQUEST FOR MODIFICA- Badillo Street, Developer L. R. Neufeld stating that a TION OF WALL REQUIRE- communication was addressed to the Council from the MENT developer requesting that the perimeter wall requirement be modified; that this matter was referred to the Planning Commission and their recommendation was as follows: 1. That the masonry wall requirement be modified to that design sub- mitted by the developer; i.e., combined wood and masonry; and 2. That the wall be permitted to be installed in stages so as to deter damage to street improvements while additional construction is under- taken. The first stage for the wall shall be developed along the westerly property lines of Lots I, 32 and 33 at the present time; and 3. That the second stage and remainder of the perimeter wall, as per Council Resolution 66-28, as modified, shall be installed immediately after final completion of the remaining 42 houses to be constructed in accordance with the modified design, except in those areas abutting residential properties wherein there exists a masonry wall along a common property line. Mr. Bob Miller, Canoga Park, stated the wood that would be BOB MILLER, used was pecky cedar; that it should last many many years; Canoga Park that it would do nothing but weather; that it would not decay; that they would protect it by putting some kind of a spray on it although it really did not need protecting. Proper publication had been accomplished. City Engineer French stated this hearing concerned a change in Resolution No. 66-121 due to a request from the attorneys for the contractor for the district; that the street lights would be eliminated as part of the 1911 Act and would be put in as part of the Lighting District. As there was no one in the audience desiring to speak either in behalf of or in opposition to the changes and modifications, Mayor McCaron declared the public hearing closed. Lante. copy in official files) In answer to a question by Mayor McCaron, City Engineer French stated there were two property owners involved in this district; that Mrs. Martinez had ninety-four 94) feet of frontage. Discussion followed that if this district was formed it would be sixty 60) days before construction and the following year in November before it would appear on the tax bill; that evidently Mrs. Martinez wanted to have the work done by her own contractor. Mayor McCaron asked if there was any way of giving Mrs. Martinez consideration for additional time wherein City Engineer French stated if the Council wished to give her an extension this could be done; that there was a one year time limit by law. Councilman Morehead stated since there were only two property owners involved he thought some consideration was in order but he certainly did not want this particular consideration to take precedent over future improve- ments. Mayor M,cCaron stated he thought the Council should give a person a little latitude as long as they were not objecting to the construction; that there should be a time limit set within four to six months or whatever the Council deemed sufficient. Councilman Adair suggested that Mr. French discuss a one hundred and eighty 180) day time limit with Mrs. Mart i nez As there was no one in the audience desiring to speak either in behalf of or in opposition to this Short Form 1911 Act, Mayor McCaron declared the public hearing closed. Councilman Morehead suggested that the City Engineer and City Attorney be directed to contact Mrs. Martinez and handle the matter in a reasonable and realistic way. He stated he certainly did not want this extension to be a guideline to keep extending the time limit on future improvements. There were no objections, the motion carried and was so ordered by Mayor McCaron. 00- It was the time and place fixed for a public hearing on a Short Form Act for curbs, gutters and drive approach on the north side of Olive between Azusa Canyon Road and La Sena. Proper postings and mailings had been accomplished. City Attorney Flandrick read a protest dated October 19, 1966, from Mr. John E. Arkley, 33 E. Huntington Drive, Arcadia, concerning the parcel on the northwest corner of Olive and Azusa Canyon Road, Parcel No. 1. City Attorney Flandrick stated he and the City Engineer would agree that since the owner had objected that the driveway approach aspect should be deleted; that Mr. Arkley was not correct concerning the sidewalks and curbs question. Mayor McCaron asked if this property would be affected by the petition for the improvement of the west side of Azusa Canyon Road, circulation of which was approved earlier in the meeting. City Engineer French stated yes; that it would tie in with this parcel. TESTIMONY IN OPPOSITION TO THE PROPOSED SHORT FORM WAS CALLED FOR BY MAYOR MCCARON. Mr. John E. Arkley, 33 E. Huntington Drive, Arcadia, stated he understood that his parcel of property was the only one affected by this Short Form District; that immediately to the west there were seven 7) apartment buildings consisting of approximately forty-three 43) units; that the only sidewalk as indicated in the declaration was in front of the apartments; that he believed a sidewalk throught this area and through this lot which was now just sand and gravel, would encourage small children to run their bicycles off down toward a busy intersection, Azusa Canyon Road and Olive Street; that the rock quarry had a chain link fence around it which was within three 3) feet of the edge of the pave- ment and it came down to a rather blind intersection; that this property was vacant and level with the street and provided an emergency exit for cars; that he felt rather than helping the public or the area that it was derogatory instead; that if there was another petition for Azusa Canyon Road this would mean another ninety-four 94) feet. Mayor McCaron stated as Mr. Ark ley was undoubtedly aware the City's project was to try to develop and improve all of the streets within the City; that in the block Mr. Arkley was in over 50% of the block was improved so it becomes incumbent on the balance of the property in the block to also improve their frontages; that he did not believe the reasons Mr. Arkley stated would be important enough to offset the necessity of sidewalks for the residents in the area to be able to walk off of the street rather than October 19, 1966 Page 8 MOTION MADE AND CARRIED THAT MATTER BE HELD OVER TO NEXT MTG. He asked if Mr. Arkley had any other objections. Mr. Arkley stated he felt the burden would be double on this single piece of property; that the street deadended into the Consolidated Rock quarry which was way back out of sight; that south there was another rock quarry; that he felt legitimate pedestrian traffic was insignificant; that presently the property would still terminate all sidewalks. Mayor McCaron stated the property across the street was in the City of Irwindale and Baldwin Park had no control over that property. As there was no one else in the audience desiring to speak either in behalf of or in opposition to this Short Form 1911 Act, Mayor McCaron declared the public hearing closed. COUNCILMAN MOREHEAD MOVED THAT RESOLUTION NO. 66-267 BE ADOPTED AND FURTHER READING WAIVED WITH THE DELETION OF THE DRIVEWAY APPROACH. COUNCILMAN CRITES SECONDED. Roll Call. There were no objections, the motion carried. 00- Mayor M,McCaron stated it had been requested that names be brought in for possible appointment to the Planning Commission and the Board of Zoning Adjustments.
