REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL NOVEMBER 2, 1966
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Councilman Adair led the salute to the flag. FLAG SALUTE

Mayor McCaron explained that these propositions were merely
changes in procedure in handling of the departments; that
there would be no tax change.

Regular Meeting of the Baldwin Park City Council
City Attorney Flandrick stated the Baldwin Park Unified
School District had recently commenced condemnation pro-
ceedings for a school site; that during the course of
these proceedings they would be requesting that the City
authorize the execution of a Stipulation for Judgment
releasing any interest the City has which was as Trustee
of the various Sewer Assessment District bonds that existed
with reference to these properties; that approval was
requested to sign these stipulations subject to the approval
of the bond holders; that there would be at least eight
to ten; that in each case Mrs. Duncan's office would check
to see that the amounts were correct and the bond holder
would in fact sign the stipulation first and thereafter
with the Council's approval Mr. Nordby would sign on be-
half of the City.
Councilman Morehead asked if the School District would be
paying the existing assessments.
City Attorney Flandrick stated yes; that they would be
required to be paid in advance of the acquisition of title
by the School District.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL AUTHORIZE
THE CHIEF ADMINISTRATIVE OFFICER TO SIGN THE STIPULATIONS
FOR JUDGMENT ON THOSE PROPERTIES BEING CONDEMNED BY THE
SCHOOL DISTRICT WHERE THE CITY HAS AN INTEREST BY REASON
AS A TRUSTEE UNDER THE SEWER ASSESSMENT DISTRICT BONDS.

no objections, the motion carried and was so ordered
by Mayor McCaron.

City Attorney Flandrick stated the Governor's office had
written a letter to each member of the Council and to the
Chief Administrative Officer and City Clerk requesting
that the City of Baldwin Park comment to the Commission
that the Governor had appointed on the question of
preemption as to what the problems of the City had been
in the past several years in terms of State legislation,
which had precluded action by the City in terms of penal
action or otherwise; that permission was requested to
answer that letter indicating the various areas.

THE CHIEF ADMINISTRATIVE OFFICER TO SIGN SUCH A LETTER
AND THE CITY CLERK, CHIEF ADMINISTRATIVE OFFICER AND

City Attorney Flandrick stated there was a request for a
Release of Claim involving an automobile accident which
occurred on October 13, 1966, on Ramona Boulevard at the
bridge approach near Puente Avenue and Ramona; that the
City had an offer from the insurance company to settle
in the amount of $800.00 and the City Engineer had indicated
this was the amount of the damage caused; that it was
recommended that the City Council authorize signature on
the release and payment by the insurance carrier.

10027 Canoga Avenue, Chatsworth, California, for the low
bid of $830.00

Regular Meeting of the Baldwin Park City Council
City Engineer French presented a report of work com-
pleted on Short Form 1911 Acts for sidewalk and drive
approach on the west side of La Rica Avenue between
Baldwin Park Boulevard and Ramona Boulevard; curbs and
gutters on the northwest side of Vineland Avenue between
Badillo Street and Central Avenue; curbs and gutters on
the southeast side of Big Dalton Avenue between Channing
Street and Stockdale; curbs and gutters on the southeast
side of Pacific Avenue between Ardilla Avenue and Puente
Avenue; curbs and gutters on the northeast side of Pacific
Avenue between Puente Avenue and Mayland Avenue.

Regarding 66-S-41, City Engineer French stated the
request was that the property owner have more time
for the construction of the improvements;'that he had
written a letter to the property owners at the instruc-
tion of the City Council; that the property owners did
not have a telephone and he had gone to their house;
that the husband was not at home during the week and
the wife was supposed to let him know how much of an
extension they needed but she had not; that she seemed
to think her husband would be agreeable to a time at
the end of February.
City Attorney Flandrick recommended that the City Council
adopt the resolution ordering the construction and permit
the City Engineer to set construction for a time con-
venient to himself and the property owners.

AND OVERRULING PROTESTS AND OBJECTIONS
AND ORDERING THE SUPERINTENDENT OF
STREETS OF THE CITY OF BALD1`JIN PARK TO

City Attorney Flandrick stated in accordance with the
Council's instructions if this resolution was adopted the
City Engineer would work it out with the property owner so
far as time and construction was concerned.

Mayor McCaron suggested that the City Council adjourn to
an Executive Session following the public hearings to dis-
cuss appointments to be made.

Councilman Morehead commented on the heavy traffic flow in
Baldwin Park the past few weeks during the hours of 4:30 to
6:30 p.m.
Chief of Police Adams stated that they had been running a
survey the past several weeks with the radar unit between
6:00 and 10:00 a.m. and 3:00 and 7:00 p.m.; that the aiy
answer they had come up with was that so many people were
searching for work.
City Treasurer Pugh commented that there were streets
outside of Baldwin Park being worked on causing cars to
come through Baldwin Park to by pass the construction.
Chief Administrative Officer Nordby commented on the
congestion as one traveled west on the north side of
Ramona Boulevard from Bogart to Maine caused by the
combination of an automatic traffic signal at Maine and
an arterial stop at Bogart.

Mr. Gordon B. Severance, 117 West Garvey, Monterey Park,
stated he was an attorney-at-law and President of
Constitution Savings and Loan; that he was requesting
that the City Council consider extending the time for
at least six months relative to the condemnation of a
property located at 13227 Fairgrove Street, Baldwin Park;
that being a lending institution they were as concerned as
the Council was about the improvement and upgrading of the
area; that it had been their policy with real estate, which
they acquired after foreclosure, to rehabilitate the

Regular Meeting of the Baldwin Park City Council
property spending approximately $1,000 to $2,000 and
then list it for sale; that they had approximately 35
such properties at the present time; that it took a
little time to get the properties cleaned up and ready
for sale; that a long list of items was sent to them
by the City and they had gone down that list and per-
formed all of the corrections suggested; that Mr. Barry
LaFloom, their Senior Appraiser, was here this evening;
that Mr. LaFloom had looked over the property and did
not feel that it should be demolished but that it could
be rehabilitated.
City Attorney Flandrick stated the Council had already
ordered the buildings demolished; that if Mr. Severance
was raising a question in this respect, and if the
Council agreed that the matter should be reopened the
Council should reset this matter for public hearing.
Mr. Severance stated he respectfully requested that
the matter be set for public hearing.
City Attorney Flandrick stated that City Engineer French
advised that at the time this matter came before the
City Council for public hearing, the Savings and Loan that
Mr. Severance represented was notified of the public hearing;
that the direction of the Council had been that the
structures on the property be demolished.
Mr. Severance stated some of the remedial steps were
taken after the public hearing; that there had been a
change in management at approximately the time the
public hearing was held.
Mayor McCaron commented that another public hearing would
entail additional costs.
City Attorney Flandrick stated that it would be reasonable
to request the applicant, Mr. Severance, and his Savings
and Loan to pay the cost of the necessary publication,
postings, and mailings.
Mr. Severance asked approximately what the costs would be.
Chief Administrative Officer Nordby stated the average
costs for the various expenses was approximately $50.00
for each hearing.
Mr. Severance stated they would be willing to pay that
cost.
As there were no objections, Mayor McCaron stated this
matter would be set for public hearing on December 7,
1966, subject to the payment of $50.00

Planning Director Chivetta presented a resume stating
the Planning Commission had adopted Resolution No.
PC 66-33 on October 6, 1966, recommending approval of
the request. He pointed out the zoning map on the wall.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR MCCARON.
Mr. Jay Angelo, 14317 Ramona Boulevard, Baldwin Park,
stated he was Mr. Robert Graziani's agent; that the
properties had been in escrow subject to the rezoning
from C-I to C-2; that the developer was in the audience;
that he had a long term lease signed by a reputable
company; that the building would cost over $100,000.00;
that it would bring more tax dollars in the retail
business and more employment in the City; that they felt
being near the C-2 area it was compatible and would
enhance the area and, of course, be in the general
direction of progress in Baldwin Park; that the Council
could see the lease and the bank committment if they
desired. He exhibited a photograph of a similar
development.
Discussion followed that it would be a Goodyear store;
that the street was under consideration at the present
time for future widening in accordance with the Select
Street System.
Mr. Angelo stated the owner had dedicated the necessary
land; that there would be no recapping in the store; that
it was retail service only; that there would be no
manufacturing; that it was similar to the Firestone store.
City Clerk Balkus administered the Oath.
Mr. Simon Stayer, 1246 N. Hayworth Avenue, Los Angeles,
stated they had a fifteen year lease with the Goodyear
Company; that they presumed this would be for the benefit
of the community and there would be more employment; that
it would be a $100,000.00 building and 10-15 people would
be employed; that this would be for the public interest; that
they had a loan committment; that both parcels would be
developed as one.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-295, Mayor
McCaron declared the public hearing closed.
Mayor MCCaron stated this change should be by intent.
City Attorney Flandrick stated the Council had handled
a recent case by adopting a resolution of intention to
rezone once certain conditions were met; that the Council
could certainly do this again and he again advised that
there was some doubt concerning that procedure.

THE PREPARATION OF A RESOLUTION OF INTENTION TO REZONE
UPON THE CONDITION THAT IT WOULD BE REZONED IF WITHIN

Regular Meeting of the Baldwin Park City Council
In answer to a question by Mayor McCaron, City
Attorney Flandrick stated the only condition stip-
ulated in the Planning Commission resolution was in
reference to the time for development.
Mayor McCaron stated he did not think the zoning should
be granted at the same time the building permit was
issued; that he felt the zoning approval should be some
time later.
City Attorney Flandrick stated the last resolution of
intention indicated the applicant had to submit plans
fcr a building permit within the time set; that he would
propose to prepare the resolution along the same line if
this was acceptable; that it did not mean the Council
would do anthing until they have submitted plans and
then the Council would introduce an ordinance and there-
after adopt after they had received the Building Permit.
Roll Call. There were no objections, the motion carried.

It was the time and place fixed for a public hearing on
Z-296, and appeal from denial of Planning Commission
and application submitted by Ruth H. Casperson, et al
for a change of zone from Zone R-1 single family
residential) to Zone C-I neighborhood commercial) or
more restrictive use upon a parcel of land located at
13629 Francisquito Avenue and 3109 Maine Avenue.

P,Mr. John H. Cook, 15545 Benny Street, Hacienda Heights,
stated he was appearing for Mrs. Casperson; that it was
felt that the property could be better used by the City
as a C-1 zone by the Tic Toc Market; that Mrs. Casperson
owned a 50 x 160 piece of property on the corner; that
she had a 70 x 160 piece of property in escrow that tied
together with the final sale to Tic Toc Market; that the
house existing on Mrs. Casperson's property was at the
present time condemned by the Health Department; that the
replacement of that house was not feasible; that if
Francisquito was widened there was ten 10) feet to come
off of that property making it a thirty 30) foot property;
that property was not feasible to ever be developed as R-I;
that it was their understanding that the people who owned
the corner spot zone on Baldwin Park Boulevard also owned
two or possibly three of the other properties and it was
their intent to eventually ask for C-I on those properties;
that they felt that a majority of Francisquito being C-I,
that this would be a very good thing for the City of
Baldwin Park.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-296, Mayor
McCaron declared the public hearing closed.

Councilman Morehead stated he agreed with the Planning
Commission that the property in question would be spot
zoning due to the fact that between that corner and
the corner on Baldwin Park Boulevard there were three
R-I properties for which at the present time there was
no indication that there were any developments or zone
changes forthcoming; that he had been considering another
recommendation on this property to refer this back to the
Planning Commission for another study and recommendation
for possible C-2 for all of that property, the section in
question and the three R-I lots in between the C-2 on the
corner; that it appeared to him a C-2 development would be
far better than this single R-I development for which these
two lots would be combined if the zoning was changed.
In answer to a question by Mayor McCaron, Councilman
Morehead stated there was C-2 on the corner of Baldwin
Park Boulevard and Francisquito and directly west across
the street in front of the subject property was all C-2
on the codition to develop acre lots; that there was
other C-2 property in both directions on Francisquito Avenue.
Mayor McCaron stated the request this evening was C-I and
it would be more compatible to that side of the street than
C-2 would be; that this was right adjacent to the residential;
that the other side of the street had nothing and the opposite
side from that was not properly developed and was still in
residential use; that he could not see where C-2 or any
portion of the commercial should be expanded.
City Attorney Flandrick stated the action first should be
to act on this particular case, to either approve or deny,
and thereafter if the Council wished to refer or initiate
a zone change that could be done.
Councilwoman Gregory stated she did not see it reflected
anywhere in the minutes of the Planning Commission as to
why the other property owners did not join in this applica-
tion. She asked if it had been suggested to the applicant
to ask the other property owners to join in the application.
Mayor McCaron stated the amount of commercial in the area
was more than ample to take care of what was in demand at
the present time; that he could not see classifying addi-
tional commercial area when it was not warranted.
Councilwoman Gregory stated there were two people involved
in the C-I request now and if the other people had indicated
that they wanted C-I she questioned why all of it was not
brought up at one time.
Planning Director Chivetta stated he did not know why the
others were not added into the application.
Mayor McCaron stated there needed to be further develop-
ment and an actual need shown for additional commercial
in the area before the Council should consider any more;
that he could not see transferring the entire area into
commercial when none of it was being used and properly
developed.
Councilwoman Gregory stated the area now was really not
R-I; that it was almost abatement material.
Mayor McCaron stated that was up to the property owners
themselves; that they were creating the condition in order

used as a leverage to change the zone when the zone itself
was not required.

Regarding the area involved in Z-296 and the three lots
adjoining, on Francisquito, Councilman Morehead stated
his thinking about this area going C-2 was that there
was some commercial development in close proximity
already; that there was other C-2 development on both
sides of Francisquito Avenue; that a commercial zone
had been created across the street for which there had
not been any development to speak of; that to change the
area involved in Z-296 would be spot zoning; that it was
his thinking if the other three lots were included and
this went C-2, the C-2 would be more compatible for that
area due to the C-2 across the street; that if it was
developed C-2 from corner to corner it might have some
