The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilwoman Gregory led the salute to the flag. There were no objections, the motion carried and was so ordered. 00- Chief Administrative Officer Nordby reviewed his report concerning the Workmen's Compensation agreement for students under the work-study program stating this involved a $38.50 payment by the City for its portion of the compensation. COUNCILMAN CRITES MOVED THAT THE CITY COUNCIL AUTHORIZE THE MAYOR AND CITY CLERK TO SIGN ON BEHALF OF THE CITY. COUNCILWOMAN GREGORY SECONDED. Roll Call. There were no objections, the motion carried and was so ordered. 00- Chief Administrative Officer Nordby reviewed his report regarding the declaration of surplus property stating in conformance with the Code it was necessary for the Council to authorize the declaration of the items listed as surplus property and authorize their disposition. COUNCILMAN MOREHEAD MOVED ON THE RECOMMENDATION OF THE CHIEF ADMINISTRATIVE OFFICER THAT THE CITY COUNCIL AUTHORIZE THE CHIEF ADMINISTRATIVE OFFICER TO ADVERTISE AND DISPOSE OF THE FOUR ITEMS LISTED IN HIS MEMORANDUM NAMELY THE DUPLICATOR, MIMEOGRAPH MACHINE, DICTAPHONE TRANSCRIBER AND THE SCM COPIER. There were no objections, the motion carried and was so ordered. 00- Chief Administrative Officer Nordby stated $2500.00 had been budgeted for the purchase of microfilming equipment; that there were two companies exceptional in the manu- facturing of microfilming equipment, 3 M and Recordak; that there were two components, the microfIImer and the printer reader; that the cost of each was approximately the same and one complements the other; that it was felt in looking over equipment in other communities and in demonstrations in City Hall that the Recordak microfilmer manufactured by Eastman Kodak Company was superior; that as far as the reader printer was concerned the one put out by 3 M was the better of the two; that Council auth- orization was requested to acquire these items without bid; that the City was recently informed that there would be a price change the 1st of March and this would be the last date the Council could take any action to save from 5% to 10% on the price; that it was a budgeted item and funds were available; that it was his recommendation that the Council approve the acquisition of the two items; that the total price was $2590.17. COUNCILMAN MOREHEAD MOVED ON THE RECOMMENDATION OF THE CHIEF ADMINISTRATIVE OFFICER AND DUE TO THE TIME ELEMENT INVOLVED AND THE INCREASE IN PRICES EFFECTIVE MARCH I, THAT THE CITY COUNCIL AUTHORIZE THE EXPENDITURE OF THESE TWO ITEMS, TOTAL OF $2590.17, WITHOUT ADVERTISING FOR BIDS. There were no objections, the motion carried and was so ordered. 00- At 7:53 p.m. Finance Director Duncan left the Council Chambers. 00- City Engineer French reviewed his report on an agreement between the firm of Lockman and Bevington, Civil Engineers, to provide the Engineering services for District A/D 67-I, Monterey Avenue. He recommended that the Mayor and City Clerk be authorized to sign the agreement on behalf of the City of Baldwin Park. COUNCILMAN MOREHEAD MOVED ON THE RECOMMENDATION OF THE CITY ENGINEER THAT THE AGREEMENT BETWEEN THE CITY AND LOCKMAN AND BEVINGTON, CIVIL ENGINEERS, FOR THE MONTEREY AVENUE PROJECT BE AUTHORIZED. Mayor McCaron stated the Council had had a communication from the Chamber of Commerce whereby some of the merchants had stated the speed eastbound from the intersection of Merced and Los Angeles was excessive; that he believed the four-way stop at Stewart and Los Angeles would alleviate some of this trouble until such time as signals could be put in and the traffic coordinated along the full length of the street. 00- City Engineer French reviewed his report on the 1967-1968 budget proposal for State allocated Section 2107 Funds stating the estimated allocation was $160,740.00; that there was a project statement attached which should read Gas Tax Project No. 95; that this budgeted the 2107 Funds to maintenance and to construction; that the construction was $64,296.00 for the Ramona-Badi I lo Improvement and the maintenance was $96,440.00. Planning Director Chivetta presented a resume stating the Planning Commission had adopted Resolution No. PC 67-6 on January 25, 1967, recommending approval Plan E. Planning Director Chivetta pointed out and extensively reviewed Plans A through E. TESTIMONY IN OPPOSITION TO SP-6 was given by: A. E. Moore, 13434 Tracy, B.Pk. Paul James, 202 S. Estelle, West Covina owner of 13449 E. Tracy, B.Pk. Mrs. Fred Wright, 13444 Francisquito, B.Pk. Mayor McCaron stated there would be quite a taking of land; that if it was to go to R-3 an effort should be made to maintain as many large. parcels as possible; that if this was the case then it became a problem of the development of the parcel itself as to whether access for vehicular traffic should be from the front or from a secondary access in the rear; that there would be a tendency if streets were opened up in the rear to want to lot split the lots and continue on with other than R-3 development; that the circulation through Robinette might be necessary to consider at the present time, however there were not too many people in that area at the present time; that if this develops to apartments, R-3, Frazier and Baldwin Park Blvd. would be the reasons why most of the property was rented because of easy access; that it was not far from the San Gabriel River Freeway; that there would have to be secondary streets on three sides; that he felt this matter should be held in abeyance until the rezoning matter, Z-294, had been resolved; that if the property was rezoned on item 2 this should be sent back to the Planning Commission for some plan of development; that it could possibly be that any parcels that were developed where an alley or street was to be put through that some means should be obtained to have each developer post funds with the City to be held in abeyance for the future improvement; that at the present time most of the people February 15, 1967 Page 6 PROPOSED AMENDMENT TO COMPREHENSIVE GENERAL PLAN, COMMUNITY DESIGN STUDY, FOR CITY OF B.PK.,RE: ST. As there were no objections, Mayor McCaron stated that the public hearing on SP-6 would be held open until action was taken on Z-294. 00- It was the time and place fixed for the continuation of a public hearing on Z-294, an application initiated by the Baldwin Park Planning Commission to initiate a Zone Change from Zone R-I single family residential) to R-3 heavy multiple residential) or more restrictive use upon parcels of land bounded on the northeast by Francisquito Avenue, Robinette Avenue to the northwest, Waco Street to the southwest and approximately 570 feet northwesterly from the centerline of Baldwin Park Boulevard. Planning Director Chivetta stated it was the Planning Commission's recommendation after extensive study that the rezoning be accomplished in accordance with the map. He pointed out a land use map on the wall. TESTIMONY IN FAVOR OF THE REQUEST WAS CALLED FOR BY MAYOR MCCARON. Mr. Paul James, 202 W. Estelle, West Covina, stated he owned property at 13449 E. Tracy Street, Baldwin Park, and asked if the new R-3 Zoning Ordinance had been adopted by the City Council. Planning Director Chivetta stated that second reading was held February I, 1967, after which it would be effective in thirty 30) days; that if the single family structure located on R-1 property was conforming at present, this would allow the property owner to add to this structure without the necessity of going through the variance pro- cedure. Mr. James asked if the area was zoned R-3 would the new developer be required to build a masonry wall. Mayor McCaron stated not unless it was next to R-I property. Mr. James stated he had had quite a few community meetings regarding the Code changes and the Zone Change. City Attorney Flandrick stated in the absence of an assessment district if the property owner was willing to proceed In that fashion, yes; that recently the Supreme Court had approved an ordinance of the City of Los Angeles that required as a part of the Issuance of a building permit not only the construction of curbs, gutters and sidewalks, which was the same as the City's ordinance, but dedication; that the Council might wish to consider this as a possible amendment to the Code, He stated this would not cover street Improve- ments, per se, but it would cover curbs, gutters, side- walks and dedication; that If the Council wished such an ordinance it would apply only where the Council had designated the width of the street by either Specific Plan or Master Plan of Streets and Highways. Councilman Morehead commented that every member of the Council had visited this area recently; that if this rezoning was concurred with by the Council this would create what he would call spot development"; that at the present time there was M-i property in that area that was undeveloped; that some of the il-1 property that was being used was unsightly; that, in his opinion, the adjustment needed was to change the A-I to R-l and leave it in that category. Councilman Crites stated he would be in favor of the proposal suggested by Councilman Morehead with the additional idea of taking California Avenue and running it through Cragmont cutting out at Sandstone and making that a boundary limit for manufacturing territory; that this would give cross town access that had been spoken of and limit encroachment. Councilwoman Gregory stated that California had been excluded from this particular area; that there were nicer homes In this area.
