REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Councilwoman Gregory led the salute to the flag.

Chief Administrative Officer Nordby reviewed his report
concerning the Workmen's Compensation agreement for
students under the work-study program stating this
involved a $38.50 payment by the City for its portion
of the compensation.

Chief Administrative Officer Nordby reviewed his report
regarding the declaration of surplus property stating
in conformance with the Code it was necessary for the
Council to authorize the declaration of the items listed
as surplus property and authorize their disposition.

CHIEF ADMINISTRATIVE OFFICER THAT THE CITY COUNCIL
AUTHORIZE THE CHIEF ADMINISTRATIVE OFFICER TO ADVERTISE
AND DISPOSE OF THE FOUR ITEMS LISTED IN HIS MEMORANDUM
NAMELY THE DUPLICATOR, MIMEOGRAPH MACHINE, DICTAPHONE
TRANSCRIBER AND THE SCM COPIER. COUNCILMAN ADAIR SECONDED.
Roll Call. There were no objections, the motion carried
and was so ordered.

Chief Administrative Officer Nordby stated $2500.00 had
been budgeted for the purchase of microfilming equipment;
that there were two companies exceptional in the manu-
facturing of microfilming equipment, 3 M and Recordak;
that there were two components, the microfIImer and the
printer reader; that the cost of each was approximately
the same and one complements the other; that it was felt
in looking over equipment in other communities and in
demonstrations in City Hall that the Recordak microfilmer
manufactured by Eastman Kodak Company was superior; that
as far as the reader printer was concerned the one put
out by 3 M was the better of the two; that Council auth-
orization was requested to acquire these items without
bid; that the City was recently informed that there would
be a price change the 1st of March and this would be the
last date the Council could take any action to save from
5% to 10% on the price; that it was a budgeted item and
funds were available; that it was his recommendation that
the Council approve the acquisition of the two items;
that the total price was $2590.17.

In answer to a question by Mayor McCaron, Chief Administra-
tive Officer Nordby stated the mlcrofilmer was a Recordak
Model RP-I, the price $1,067.50, plus an Odometer attach-
ment; that the reader printer was a Filmak Model 400 put
out by 3 M, the price $1380.00; that the total cost in-
cluding tax would be $2590.17.

At 7:53 p.m. Finance Director Duncan left the Council

City Engineer French reviewed his report on an agreement
between the firm of Lockman and Bevington, Civil Engineers,
to provide the Engineering services for District A/D 67-I,
Monterey Avenue. He recommended that the Mayor and City
Clerk be authorized to sign the agreement on behalf of the
City of Baldwin Park.
COUNCILMAN MOREHEAD MOVED ON THE RECOMMENDATION OF THE
CITY ENGINEER THAT THE AGREEMENT BETWEEN THE CITY AND
LOCKMAN AND BEVINGTON, CIVIL ENGINEERS, FOR THE MONTEREY

Avenue and Merced Avenue.

Mayor McCaron stated the Council had had a communication
from the Chamber of Commerce whereby some of the merchants
had stated the speed eastbound from the intersection of
Merced and Los Angeles was excessive; that he believed the
four-way stop at Stewart and Los Angeles would alleviate
some of this trouble until such time as signals could be
put in and the traffic coordinated along the full length
of the street.

City Engineer French reviewed his report on the 1967-1968
budget proposal for State allocated Section 2107 Funds
stating the estimated allocation was $160,740.00; that
there was a project statement attached which should read
Gas Tax Project No. 95; that this budgeted the 2107 Funds
to maintenance and to construction; that the construction
was $64,296.00 for the Ramona-Badi I lo Improvement and the
maintenance was $96,440.00.

comprehensive General Plan, Community Design Study, for
the City of Baldwin Park regarding: Street circulation
for the area bounded on the NE by Francisquito Avenue,
on the SW byFairgrove Avenue, on the NW by Frazier
Avenue, and on the SE by Baldwin Park Blvd.
Proper publication and postings had been accomplished.
Planning Director Chivetta presented a resume stating
the Planning Commission had adopted Resolution No. PC 67-6
on January 25, 1967, recommending approval Plan E.
Planning Director Chivetta pointed out and extensively
reviewed Plans A through E.
TESTIMONY IN OPPOSITION TO SP-6 was given by:

Mayor McCaron stated there would be quite a taking of land;
that if it was to go to R-3 an effort should be made to
maintain as many large. parcels as possible; that if this
was the case then it became a problem of the development
of the parcel itself as to whether access for vehicular
traffic should be from the front or from a secondary
access in the rear; that there would be a tendency if
streets were opened up in the rear to want to lot split
the lots and continue on with other than R-3 development;
that the circulation through Robinette might be necessary
to consider at the present time, however there were not too
many people in that area at the present time; that if
this develops to apartments, R-3, Frazier and Baldwin Park
Blvd. would be the reasons why most of the property was
rented because of easy access; that it was not far from
the San Gabriel River Freeway; that there would have to
be secondary streets on three sides; that he felt this
matter should be held in abeyance until the rezoning
matter, Z-294, had been resolved; that if the property
was rezoned on item 2 this should be sent back to the
Planning Commission for some plan of development; that
it could possibly be that any parcels that were developed
where an alley or street was to be put through that some
means should be obtained to have each developer post
funds with the City to be held in abeyance for the future
improvement; that at the present time most of the people

Regular Meeting of the Baldwin Park City Council
who were asking for the rezoning were not ready for
development; that until they were possibly they would
not have the necessary funds unless a 1911 Act was used
to start development at the present time; that it might
be that some other plan would have to be devised in
order to allow time or disposition of the property; that
he realized people did want to obtain the best price for their
property; that some were not prepared to sell and others
were.
As there were no objections, Mayor McCaron stated that
the public hearing on SP-6 would be held open until
action was taken on Z-294.

It was the time and place fixed for the continuation of
a public hearing on Z-294, an application initiated by
the Baldwin Park Planning Commission to initiate a Zone
Change from Zone R-I single family residential) to R-3
heavy multiple residential) or more restrictive use upon
parcels of land bounded on the northeast by Francisquito
Avenue, Robinette Avenue to the northwest, Waco Street
to the southwest and approximately 570 feet northwesterly
from the centerline of Baldwin Park Boulevard.
Planning Director Chivetta stated it was the Planning
Commission's recommendation after extensive study that
the rezoning be accomplished in accordance with the map.
He pointed out a land use map on the wall.
TESTIMONY IN FAVOR OF THE REQUEST WAS CALLED FOR BY
MAYOR MCCARON.
Mr. Paul James, 202 W. Estelle, West Covina, stated he
owned property at 13449 E. Tracy Street, Baldwin Park, and
asked if the new R-3 Zoning Ordinance had been adopted
by the City Council.
Planning Director Chivetta stated that second reading
was held February I, 1967, after which it would be
effective in thirty 30) days; that if the single family
structure located on R-1 property was conforming at present,
this would allow the property owner to add to this structure
without the necessity of going through the variance pro-
cedure.
Mr. James asked if the area was zoned R-3 would the new
developer be required to build a masonry wall.
Mayor McCaron stated not unless it was next to R-I
property.
Mr. James stated he had had quite a few community
meetings regarding the Code changes and the Zone Change.
He presented a list of names in favor of the rezoning
to R-3 stating that a majority of them Indicated their
willingness to dedicate their land if they were sure
it would only be used for purposes shown on the current
map which was Plan E at that time, He stated he only
found two people who might be interested In a 1911 Act;

Planning Director Chivetto stated the property would
still be nonconforming and could remain so until the
property was sold.
Or. David Chadbourne thanked Planning Director Chivetta
for spending one evening explaining what they could and
could not do with the property.

Mayor McCeron stated there had been more then sufficient
area zoned C-2 in the Frencisqulto area at the present time;
that if they did not went R-3 possibly the best thing to do
would be to leave It R-I'; that regarding the property on
Tracy, the property on Robinette had been developed not
too for in the past; that at the present time it had R-I
usage and there was R-1 usage on the other side and, in
his opinion, It would be premature to consider that por-
tion.
Councilmen Morehead stated he did not know of any Indica-
tion of C-2 development In that area but he did know of
indications of R-3 development in that area.
Councilman Crites stated if Frencisquito was going to be
a possible C-2 development or a hoped for proposition if
this area did go to R4 It might point up a need for
additional commercial facilities.

Regular Meeting of the Baldwin Park City Council
Mayor McCaron stated he would be In favor of deleting the
Francisquito frontage and the Robinette frontage.
City Attorney Hendrick stated the Council could approve
part and disapprove part; that there would have to be a
Planning Commission report.
COUNCILMAN MOREHEAD MOVED ON THE RECOMMENDATION OF THE
PLANNING COMMISSION THAT Z-294 BE APPROVED. COUNCILMAN
CRITES SECONDED. The motion carried by the following
vote:
AYES: COUNCILMEN MOREHEAD, CRITES, ADAIR,
AND MAYOR MCCARON

The Council returned to their consideration of SP-6.
Mayor McCaron stated there had been objections to
dedicating streets. He asked If it was possible,
after there was a property development plan and new
future street plan, that the cost be determined and the City
ask for a cash deposit to take care of the proportionate
share of any property developed in R-3 for development
of future streets.
City Attorney Flandrick stated in the absence of an
assessment district if the property owner was willing
to proceed In that fashion, yes; that recently the
Supreme Court had approved an ordinance of the City of
Los Angeles that required as a part of the Issuance of
a building permit not only the construction of curbs,
gutters and sidewalks, which was the same as the
City's ordinance, but dedication; that the Council
might wish to consider this as a possible amendment to
the Code, He stated this would not cover street Improve-
ments, per se, but it would cover curbs, gutters, side-
walks and dedication; that If the Council wished such an
ordinance it would apply only where the Council had
designated the width of the street by either Specific
Plan or Master Plan of Streets and Highways.
Mayor McCaron stated whatever plan was adopted the
burden should be almost equal among all property owners
compensating for both land and paying for the improvements.
Further discussion followed.
MAYOR MCCARON MOVED THAT SP-6 BE REFERRED BACK TO THE
PLANNING COMMISSION AND HAVE A DEVELOPMENT STUDY AND
REPORT MADE; STUDY WHETHER THE CIRCULATION PLAN IS
NECESSARY AND IF THE PROPERTY DEVELOPMENT ITSELF CAN BE
SUCH THAT THE SECONDARY ACCESS IS NOT NECESSARY.

no objections, the motion carried and was so ordered.

cause of a protest entered by Mr. Hahn; that'he had dis-
cussed this improvement with Mr. Hahn and Mr. Hahn thought
this improvement was going to be good for the area and
would like the Council to adopt the resolution ordering
the Improvements,

of Azusa Canyon Road and south of Arrow Highway.

accomplished.
Planning Director Chivetta presented a resume stating the
Planning Commission had adopted Resolution No. PC 67-5 on
January 25, 1967, recommending approval. He pointed out
on the well an Existing Zoning and Assessment Value Map,
a Parcel and Land Use Map, an Age of Structures Map, a
Land Assessment Values Map, and a map showing the
suggested Rezoning and Future Circulation.

Mr. Seay asked if fire destroyed the house would it be
possible to rebuild the house wherein Planning Director
Chivetta stated he could not rebuild if it was nonconforming and
was more than 50% destroyed,
City Attorney Flandrick stated lot size as such would not
be the basis for nonconforming status; that if it were to
be rezoned to M-R and if no change were to take place In
the M-R regulations and if a building on one of the lots
was destroyed, the gentleman could not rebuild an R-I
use; that recently an amendment was put into the R-3
regulations to accommodate the same situation in
conjunction with R-I; that many areas were zoned R-3
that were presently in usage as R-l; that the amendment
was that that particular type of structure, R-I, would not
be deemed nonconforming if it existed in conformity with
the R-I regulations prior to the time it was rezoned. He
stated that the lot sizes only applied to new lots created.
Mr. Seay stated he recommended that this particular area
between Bleecker and Elton Street and at least three
hundred 300) feet north be deleted from this zone change.

City Attorney Flandrick stated the application was M-R
or more restrictive; that A-I was more restrictive than
M-R but under the circumstances perhaps It would be
wise to make that a subject of a separate hearing as
all of the testimony had been related to the question
of Industrial rather than residential.

City Attorney Flandrick stated a resolution of denial

Councilman Morehead stated he would like the Planning
Commission to receive Instructions to consider the
A-1 to R-1 and give Council a report on this.
Mayor McCaron stated he would like to add to this that
they consider some remedy for the M-1 development in
that area at the present time.
Planning Director Chivetta stated the Planning Commission
was reviewing the Municipal Code Zoning Regulations on a
zone by zone basis.

available for the City employees and other interested persons
to examine; that through page four 4) of the draft DRAFT OF PROPOSED
of the proposed Council resolution the changes had been COttCIL RESOLUTION
incorporated substantially in the form proposed by the
Personnel Board, however, commencing on page five 5) PERSONNEL BOARD
of the proposed resolution was the educational program AMENDMENTS
which would permit, after the employee had been with the
City for one 1) year, that subject to the approval of the EDUCATIONAL PROGRAM
Chief Administrative Officer that he be eligtble.for formal
educational instruction in a field related to his work;
that assuming this rule was adopted, cost of tuition,
books, and other material muld be a charge against the
City; that if the employee failed to complete the pro-
gram or if he was terminated etc. prior to the comple-
tion that the total cost expended by the City was a charge
against the employee as such and he must repay the City;
that the third section provided in the cases of termina-
tion of an employee who had completed the program of
instruction but has failed to continue in the service
of the City for a period of at least one 1) year that
he must also repay the City for the costs involved in
such program; that this resolution was merely in draft
form for the Council's consideration and perhaps adop-
tion at the next regular meeting.
Chief Administrative Officer Nordby suggested that the
public hearing be held open. He stated that the final

As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-297, Mayor
McCaron delcared the public hearing closed.
Councilman Morehead commented that every member of the
Council had visited this area recently; that if this
rezoning was concurred with by the Council this would
create what he would call spot development"; that at
the present time there was M-i property in that area that
was undeveloped; that some of the il-1 property that was
being used was unsightly; that, in his opinion, the
adjustment needed was to change the A-I to R-l and leave it
in that category.
Councilman Crites stated he would be in favor of the
proposal suggested by Councilman Morehead with the
additional idea of taking California Avenue and
running it through Cragmont cutting out at Sandstone
and making that a boundary limit for manufacturing
territory; that this would give cross town access that
had been spoken of and limit encroachment.
Councilwoman Gregory stated that California had been
excluded from this particular area; that there were
nicer homes In this area.
Mayor McCaron stated there was considerable M-I In this
area that had R-1 usage on It; that some of the R-i usage
was abusing the rest of the area by having M-1 usage as
well as R-i usage on the same property; that it appeared
there should be a reconsideration of the M-I and have
some restrictions as to how it may develop with R-l usage
along side or perhaps rezone It to M-R; that anything
created new should be within an enclosed yard; that possibly
the wall should not only be view obscuring but a masonry
wall; that there was no reason why a truck yard should be
unsightly; that a study should be made on M-I development;
that to correct the damage already done should be first
in line; that he would suggest rejecting this for the
