In accordance with Section 2703 of the Municipal Code
the City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

Chief Administrative Officer Nordby presented Ordinance ORD. NO. 477
No. 477 affecting the reorganization of the City's Civil RE REORGANIZATION
Defense along the lines recommended by the Regional OF CITY'S CIVIL
Director of Ci vi l Defense in this area, Admiral Richmond, DEFENSE
the Executive Officer of Area D; that the purpose was to
effect the elements that he had mentioned in the first
paragraph of his memorandum; that there must be some
authority connected with Civil Defense for giving direc-
tions and promptness of response; that under the existing
Municipal Code, Section 2200, these particular elements
do not exist; that changes were proposed in Section
2210.3 and 2210.5; that all of the other provisions
of the Code would remain the same.
City Attorney Flandrick explained the proposed changes
were in two parts; first the existing ordinance provisions
established the Disaster Council and designated the member-
ship of certain City officials and then there was a pro-
vision that the Council had the authority to appoint such
other persons as it deems appropriate; that the change
would be that the members of the Disaster Council were
not designated by ordinance but by Council direction;
that the Chief Administrative Officer becomes the Director
of Civil Defense and has the authority to appoint an
assistant with the concurrence of the City Council; that
the Assistant would act in conjunction with the Chief
Administrative Officer or in his absence would act.
Chief Administrative Officer Nordby pointed out that the
assumption of the position of Director of Civil Defense
by the Chief Administrative Officer did not take with it
any additional compensation; that the remuneration would
go to the actual coordinator of the Civil Defense activities;
that presently the Director had no authority over the
Departments involved in an emergency which were primarily
the Police Department and Public Works Department; that
directives must, if not officially at least informally,
be cleared with the Administrative Office; that it had
not been resolved whether or not the Assistant would be
someone now on the City staff; that he had certain
suggestions as to the qualifications; that the individual
must be available; that the compensation would be deter-
mined by resolution.

Councilman Crites stated in his dealings with the Disaster
Council from the Regional Level he had had no small amount
of embarrassment trying to explain how the City's Civil
Defense program worked.

Chief Administrative Officer Nordby reported that the RE PURCHASE OF
Council had authorized the staff to negotiate with PROPERTY IN VICINITY
Mr. H. A. Denver who owned property in the vicinity of OF OLIVE AND CENTER
Olive and Center; that an appraisal had been received from
Jerry Morriss of $9,500.00; that today negotiations had
been concluded with Mr. Denver; that he had agreed to
accept the figure of $9,500.00 with the condition that
the City share the cost of the lot split fee and the
escrow costs and title search. He recommended that the
staff be authorized to go into escrow on this property;
that this would be paid out of Gas Tax Funds.
He further stated this property was in the alignment
on Olive between the extension of Olive and Center and
Rivergrade Road and ultimately the City would need the
property to extend the street; that the parcel was quite
large and unfortunately the City had to acquire the im-
proved parcel, the northerly portion on which the house
rests; that the remainder would be retained by the present
owner.

Chief Administrative Officer Nordby explained that the
staff had drafted a resolution to update one that was
drafted in 1963 which authorized the City to obtain
surplus property; that in asking for a draft of the
new resolution the City was sent the old one, the one
which was adopted by the City Council; that it referred
incorrectly to the Federal Statute which has been
amended since 1963.

cases stating the Council had two courses of action:
1. Case No. AZC-23: Consider the Commission's recommendation,

2. Case No. AZC-27: Consider the Commission's recommendation
and amend the Municipal Code to reflect
the same or withdraw the matter from
the Agenda.
Planning Director Chivetta stated the staff recommenda-
tion was that the Council's action reflect proposal No. I;
that either method would accomplish what the Planning
Commission was recommending. He presented a graphic
display of the Planning Commission's recommendations.

Discussion followed wherein City Attorney Flandrick stated
he thought Mr. McCoy agreed that the open and unobstructed
feature should not apply to front and rear yards so to
that extent he assumed he was in favor; that he was not
in favor of the requirement as to side yards.
Mr. Howard Sutterfield, 3779 N. Foster, Baldwin Park,
stated he was appearing as a private citizen representing
himself.
Considerable discussion followed with Mr. Sutterfield
and Mr. McCoy commenting further on their points of
opposition.

Maine Avenue, on the East by Azusa Canyon Road, and
on the North by Arrow Highway.

Planning Director Chivetta presented a resume and stated RESUME
the Planning Commission had adopted P.C. 67-8 on February
2, 1967, recommending approval. He pointed out the map
on the wall.
COUNCILMAN MOREHEAD MOVED THAT THE PUBLIC HEARING ON SP-7 MOTION MADE
BE CONTINUED TO A DATE IN THE FUTURE AND THAT THE MATTER
BE REFERRED BACK TO THE PLANNING COMMISSION TO CONSIDER
THIS IN CONJUNCTION WITH THE ZONING PROBLEMS IN THE AREA.
COUNCILWOMAN GREGORY SECONDED.
City Attorney Flandrick stated the Planning Commission had
not scheduled as to when further action would be recommended
on Z-297.
Mayor McCaron suggested holding this matter until later
in the meeting when action on Z-297 was concluded.
The motion was withdrawn with the consent of the second.

Employees Association and by the Chief Administrative
Officer. He stated the major changes related to the
Educational Program.
A letter from the Baldwin Park Employees Association
indicating their concurrence with the proposed
resolution was read.

RESOLUTION NO. 67-57 AMENDING
CERTAIN PROVISIONS OF THE PERSONNEL
RULES AND REGULATIONS OF THE CITY
Regarding Section 252, City Attorney Flandrick stated
the employee.would fill out an application form at
the time he desires to enter the tuition paid program;
that it would state that he agreed if he terminated his
service with the City for any reason within a period
of one I) year after commencing, that that amount would
be withheld from his final check; that if his final
check was not sufficient to cover the amount then Small
Claims Action could be taken.
Discussion.
Chief Administrative Officer Nordby explained that
the maximum number of holidays an employee could
have was 9 1/4; that in some years the number of
holidays was reduced unless this particular section
would be included depending on how many of the holidays
fell on Saturday; that this section would not be adding
any holidays, it would remain constant every year at
9 1/4.
Mayor McCaron stated the theory for the future was that
with the exception of one or two holidays that all holidays
should be on Monday. He suggested that those holidays
falling on Saturday or Sunday should be taken on Monday.

City Engineer French reported on the acquisition of a
sewer easement at the Olive Street school site stating
that the Baldwin Park School District had indicated that
it would be advantageous to them if they could grant the
City a six 6) foot easement that would traverse the
northerly limits of their property from Center Street to
the extension of Walnut Street; that this tied into a
six 6) foot sewer easement which was previously granted
to the City that ran from Olive Street to their north
property terminous along the projection of Center Street;
that it was recommended that the Council accept this
offer with the instructions that the Engineering Depart-
ment is to prepare the proper legal description and that
the City Clerk be instructed to accept the easement.
COUNCILMAN CRITES MOVED THAT THE CITY COUNCIL ACCEPT THIS
OFFER AND INSTRUCT THE PROPER PEOPLE TO PREPARE THE

City Attorney Flandrick stated that the Planning Commission
had tentatively indicated their des Ire to restudy the area
and make further recommendations to the Council at some
future date; that the adoption of this resolution merely
would indicate that as to these specific recommendations
that it be denied; that the Council had indicated they
wished to further study the area to consider other
possibilities in terms of zone classification.
Councilman Morehead stated that SP-7 could be continued
until such time as there was another hearing held on
this.
City Attorney Flandrick stated that any Commission study
in terms of reclassification other than Zone M-R or at
least all M-R would entail a substantial revision of that
specific plan; that it might be that the specific plan
should be referred back to the Commission for them to

and resubmit both matters for the same date. He
suggested closing the hearing and referring back to
the Commission.
Mayor McCaron stated that the Council had stated their
position that the development in the area itself was
not conducive to improvement in the area; that this
should be denied at the present time; that this does
not mean that it is the feeling of the Council that it
should not ever be rezoned but if it was to be developed
it should be developed properly.
Councilman Crites stated this was somewhat what he had
meant at the last meeting when he indicated there should
be some definite line of delineation along there with
different access to the area.

Mayor McCaron stated it was the feeling of the Council
to refer this matter back to the Planning Commission for
further study along with any further studies they have
in that area; that from the discussion of the Council
indication has been made that perhaps it might have to
be developed in smaller parcels with the concurrence
of the property owners in each block, properties facing
both sides of one street; that to be redeveloped properly
it would need the cooperation of everyone involved; that
there should be some indication from the people themselves
as to exactly what they want to do.
Councilman Morehead stated the Planning Commission should
consider tighter controls on M-I as to how unsightly
one would be permitted to keep their premises.

they agreed or disagreed. He stated if the Council wished
to accomplish this without further delay on the matter the
Council could amend the ordinance prior to its introduction
by deleting Lots 18, 19, 20, 21, 22, 24 and 25 of Tract No.
11801 from the description in the ordinance and introduce
the ordinance this evening and refer it to the Planning
Commission for report and then bring it back to the Council
for adoption at the next meeting.
Councilwoman Gregory stated there were requests from some
of the people who appeared before the Council that Francis-
quito be considered for other than R-3 because of the
traffic flow and the accessibility as a truck route and
to the freeway.
Mayor McCaron stated there was sufficient C-2 in the area
at the present time unless a need could be established.
Councilwoman Gregory commented she would like to see an
ordinance in Baldwin Park restricting, deleting or omitting
R-3.
Mayor McCaron stated this would not solve the problems;
that there were nuisances al I over town in the R-I zone;
that there were other problems also; that this should not
be considered.
Councilwoman Gregory stated the people who asked for the
R-3 consideration were primarily from Robinette; that if
everyone was satisfied with the recommendations perhaps
the R-3 should be denied as was the M-R.
Mayor McCaron stated rather than denying it he would
prefer to send it back to the Planning Commission
and have a new hearing started.
Councilman Crites stated he made the motion to get this
matter on the Agenda by making a motion to bring back
the ordinance for approval.
Councilman Morehead stated as well as he could remember
there were not too many people objecting who had property
facing Robinette so apparently they were not present or
approved of the rezoning to R-3; that he did not see
any need of eliminating the houses facing on Robinette.
Planning Director Chivetta stated this had been brought up
to the Planning Commission to consider conducting an
additional public hearing to delete those parcels
fronting on Robinette and the motion died for lack of
a second.

Discussion followed regarding 10) under Section I as
to limiting the number of employees to 10 wherein City
Attorney Flandrick stated this could have been an
attempt to reduce in terms of size the type of business;
that this would be in the C-I section but would also be
carried over to C-2.
Planning Director Chivetta stated this would prohibit the
sale of used items in all zones; that a code amend-
ment would have to be made to include this type of use
under a conditional use permit or some other method.
