REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL
CITY HALL COUNCIL CHAMBER) 1403 East Pacific Avenue
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Councilwoman Gregory led the salute to the flag.

Mr. Wallace C. Hannah, 8)41 S. Hollenbeck, West Covina,
stated he was speaking regarding 3832 Foster Avenue
Baldwin Park; that the property at one time was R-2 and
by choice of his own he rezoned it to R-3; that he
anticipated developing the property and had taken off
two dilapidated houses; that he had not been able to
obtain financing and since then the zoning restrictions
were such that now he could not adequately build four
units as he would have to build two up and two down to get ample
parking space; that he would then be the only one in the
neighborhood that would not have a one story dwelling;
that when he applied for a building permit he was told he
had to build four units on R-3 property; that he did not
want to build a two story dwelling and was asking for a
variance to have three units on one level.
City Attorney Flandrick stated that the Council could not
grant a variance; that the Code did not permit the waiver
of the fee for a variance.
As thereowere no objections, Mayor McCaron stated it would
be necessary to apply to the Board of Zoning Adjustments for
any variance from the Zoning Code.

Mr. Allen Bunnage, 9220 Sunset, Los Angeles, attorney
retained by Mrs. Gaylin and Mr. Frank, stated it was requested
that Mr. Frank be granted a temporary use of the property
situated at the off ramp of the an Bernardino Freeway at
Francisquito; that Mr. Frank had leased this property and
would like to use it for the business of repairing engines;
that this property was currently C-2 zoned; that it had been
used for many many years as an automatic repair service;
that s was the only use; that there were a couple
of small buildings on the land. He showed maps of the area
and pictures prior to:Mr. Frank's repair of the property; that
Mr. Frank had a business which would be taking place entirely
within the building; that 50% of his repairs would be mobile
and 50% would be repaired at this location; that he under-
stood that the Planning Commission had recommended a
resolution to be passed in the near future by the Council
allowing conditional use permits when the circumstances
warranted.
City Attorney Flandrick stated there was no provision in
the Code for any temporary use of the type requested;
that the Planning Commission had not adopted a resolution
of any sort; that they had indicated at their last meeting
that they would favorably consider this matter as a clarifica-
tion of ambiguity; that the Council had a copy of the draft
of the proposed resolution which would be submitted to the
Commission at their next regular meeting; that under the
Code for clarification of ambiguity the Commission must
pass on it first and make a recommendation to the Council
and thereafter if the Council sees fit they may approve;
that if the particular item were approved by the Council
at the next regular meeting after the Commission's action
then it would be a temporary interpretation of the Code,
thereafter the Commission would initiate proceedings to
formalize their action and make it a part of the Code; that
he assumed what the gentleman was requesting was in effect
an amendment to the Code by way of an urgency ordinance to
permit this use along the lines suggested by the Commission;
that this would be the only action the Council could take
this evening if they so desired.

Regular Meeting of the Baldwin Park City Council
As there were no objections, Mayor McCaron stated that the
application should be made to the Pllanning Commission for
recommendation to the Council, wherein City Attorney
Flandrick stated this matter was on the Planning
Commission's Agenda for March 22, 1967.

City Clerk Balkus presented a letter- from George Vine,
15018 Arrow Highway, requesting waiver of curb and
gutter.
City Engineer French stated the grading plan did not
indicate the problem as indicated in the letter between
the existing street surface and what would be the lip of
the gutter.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL HAVE
THE APPLICANT PUT UP THE CASH DEPOSIT IN LIEU OF INSTALLA-
TION OF CURBS AND GUTTERS UNTIL HIS NEIGHBORING PROPERTIES
WOULD WARRANT THE SIDEWALK IMPROVEMENTS AND THE CURB AND
GUTTER. COUNCILMAN MOREHEAD SECONDED. There were no
objections, the motion carried and was so ordered.

Chief Administrative Officer Nordby reviewed his report
on the request for authorization to purchase two 2)
motorcycles from the City of Montebello. He stated
they were 1965 models; that the cost would be $1,000.00
each.
COUNCILMAN. MOREHEAD MOVED THAT THE BIDDING REQUIREMENTS
BE WAIVED PURSUANT TO THE PROVISIONS OF THE CODE AND TO
AUTHORIZE THE PURCHASE OF THE TWO ITEMS OF EQUIPMENT
AS OUTLINED IN THE CHIEF ADMINS TRATIVE OFFICER'S REPORT
OF MARCH 9, 1967. COUNCILMAN ADAIR SECONDED. Roll
Call. There were no objections, the motion carried and
was so ordered.

Chief Administrative Officer Nordby reviewed the report
on the eleven II) applications filed for fireworks
permits.
Mayor McCaron stated it would appear that the first ten
qualified and the eleventh one had obtained a permit
last year; that the City should have some regulations
and actual method of selection from year to year; that
his suggestion would be that we possibly change the
ordinance to allow eleven applicants at the present
time and that they would be the only ones that could
come in the following year for a permit; that in case
any one of them in any year dropped from the list this
would leave an opening for someone else to apply; that
if applications were not filed one week before possibly,
the first of May this would allow an opening for someone
else; that they could be contacted as to whether they
were going to come in or not or wished to be dropped.
Councilman Morehead stated some two or three years
back our ordinance allowed eight 8) and it was changed
to read ten 10); that he had opposed the change at
that time; that to keep increasing would result ih
lowered revenue for the organizations; that Mayor
McCaron would like to see this eleventh application

on February 23, 1967, recommending approval. He pointed
out a map on the wall.

Further discussion followed regarding number of patients,
and driveway width, wherein City Attorney Flandrick
suggested should the Council wish to continue this matter
to the next regular meeting that a complete staff report
be prepared and brought back to the Council including
possible conditions of approval.
COUNCILWOMAN GREGORY MOVED THAT CONDITIONAL USE PERMIT
NO. CP-86, BE CONTINUED TO THE FIRST MEETING IN APRIL.
COUNCILMAN MOREHEAD SECONDED. There were no objections,
the motion carried and was so ordered.
Mr. Hadley was to receive a copy of the conditions of
approval.)

It was the time and place fixed for a public hearing
on AZC-28, an intent of the Planning Commission of the
City of Baldwin Park to amend Section 9620, subsection
2, relating to a caretaker dwelling in the C-M commercial
manufacturing) Zone.
Proper publication and postings had been accomplished.
City Attorney Flandrick stated that the staff recommendation
along with the Planning Commission's was that the Council
concur and delete this as a permitted use in the C-M Zone,
which would have the effect of deleting it in all industrial
zones.
As there was no testimony either in favor of or in opposition,
Mayor McCaron declared the public hearing closed.
COUNCILMAN CRITES MOVED THAT COUNCIL CONCUR WITH THE PLANNING
COMMISSION AND THAT AN ORDINANCE BE PREPARED TO DELETE THIS
SECTION. COUNCILMAN MOREHEAD SECONDED. There were no
objections, the motion carried and was so ordered.

It was the time and place fixed for a public hearing on
67-5-7, a Short Form 1911 Act for curb and gutter on the
northwest side of Vineland Avenue between Foster Avenue and
Rockway Drive.

City Engineer French stated that in Section I, sub-

It was the time and place fixed for a public hearing
on 67-S-8, a Short Form 1911 Act for sidewalk and
driveway approach on the southeast side of Vineland
Avenue between Durness Avenue and Merced Avenue.

City Engineer French explained the procedure of the Short
Form 1911 Act and stated that the hedge was in dedicated
right-of-way and right in line with the sidewalk; that out
of a total of IZL properties 3 were without sidewalks.

Mayor McCaron stated that an indication should be obtained
from Irwindale as to what they would be willing to do
wherein City Engineer French stated that the City should
Indicate to the State Division of Highways that the
City would prefer that the sign say tower Azusa Road
Los Angeles Street with a sign ahead that says Baldwin
Park next exit.
Mayor McCeron suggested that there be a sign that says
Baldwin Park next four exits northbound and south-
bound. There were no objections.
As there were no objections, SP-8 was noted and filed. SP-8 NOTED AND FILED

City Attorney Flandrick reviewed the report of the
Planning Commission recommending that the second
reading of Ordinance No. 478 regarding Z-294 be
held pending the Planning Commission's study and
report of the street pattern for this area; which
the Commission expects to present to Council within
the next thirty 30) to forty-five 15) days,
Mayor McCaron questioned what course would be followed
to enforce a street plan.
City Attorney Flandrick stated that Planning Director
Chivetta was preparing a proposal to submit to the
Planning Commission which by Ordinance would be
Imposed in the same manner as our curb, gutter and
sidewalk on building permits requiring: dedication for
streets under a specific plan.
Mayor McCaron questioned the handling of outlet streets,
wherein City Attorney Flandrick stated either by
assessment district or from general funds as the
nature of the streets would probably not permit the
expenditure of Gas Tax Funds.
Discussion followed that the Planning Commission
recommended Plan E, wherein City Attorney Flandrick
stated the Planning Commission could be requested at the
time they submit their revised street plan that they
indicate what programs could be utilized to facilitate
the construction of the streets.
Chief Administrative Officer Nordby stated he would
oppose contribution of General Fund money for
development of private propertyj that it should be
treated Ilk* an assessment district.
Discussion followed regarding dedication wherein
City Engineer French Indicated perhaps the applicant
would be willing to dedicate between now and the next
Council meeting.

regarding curb and gutter on Belgate and Cutler,
wherein City Engineer French stated that this was
a requirement¢a lot split with one of the old
agreements, which are quite a problem to enforce; that the

for to construct on the property.

City Attorney Flandrick reviewed the recommendation
of the Planning Commission concerning the change of
name for Interstate Highway 605 and stated that Council
also had before them a copy of the Senate Bill which
has been introduced by Senator Song.
Mayor McCaron stated in view of the reasons he has
seen stated in studies concerning the renaming of
freeways he would be against the renaming of any
more freeways.
COUNCILWOMAN GREGORY MOVED THAT WE CONCUR WITH THE
COMMISSION'S RECOMMENDATION AND ADOPT A SIMILAR
RESOLUTION FOR PRESENTATION TO THE CHAIRMAN OF
THE EAST SAN GABRIEL VALLEY PLANNING COMMITTEE
AND THE SENATOR OF OUR DISTRICT AND ASSEIABLY14EN

City Engineer French reviewed the Planning Commission's
report which recommended dental of street renaming
Los Angeles Street to Lower Azusa Road) Case No.
SP-B; that the State Division of Highways had been
contacted and they;.,had indicated that the City of
Baldwin Park could have a choice of signs% south-
bound on 605 they have programmed that the sign
would read Lower Azusa Road Baldwin Park; that
they would change that naming at the request of the
City to read Lower Azusa Road Los Angeles Street and ahead
of off ramp they would have a sign that said Baldwin
Park next exit but they can not put all three Lower
Azusa Road Los Angeles Street Baldwin Park
on the one sign.
