COUNCILMAN ADAIR SECONDED. Councilwoman Gregory stated that before she cast her vote she wished to state that she was not in absolute agreement with the budget, that she understood she could not vote against any particular segment of the budget, but must either cast a vote either for" or against"; that she would cast an aye vote but wished to state for the record that she disapproved of the introduction of the IBM operation for this City as she felt the cost far exceeds the need of such an installation; that she had stated her objection last year when the matter was brought up and that she still felt the expenditure was excessive, premature and totally unfair to the taxpayers of the City. There were no objections, the motion carried and was so ordered. 00- Chief Administrative Officer Nordby explained there had been a request from Mr. Walter Heidmann to purchase a well site 30' X 50'; the location being on the southerly side of Francisquito between vine land and the freeway; that the City was presently acquiring as twenty feet was required for street purposes; that as the City did not have title no action was possible at this time; that an equitable price would have to be agreed upon at the proper time. No action was necessary. 00- Mr. Nordby stated that the following legislative bills were pending and Council support was recommended: SCA 54 making power line easements subject to taxes; ACA 74 re- storing the revenue to cities and counties by, placing tele- phone utilities in same position as other utilities with respect to payment of a fee for using public rights of way; AB 399 Cigarette tax. There were no objections, the motion carried and was so ordered. 00-- City Engineer French reviewed his report on installation of curb and gutter on Select System Streets stating that on February I, 1967, the Council had adopted a policy whereby subdivisions that have been developed adjacent to Select Streets and where driveway access was denied to the street and where street improvements were not required as part of the subdivision, that the City would at no cost to the property owner install curb, gutter and street paving; that the only area affected by this policy was Sierra Madre Avenue between Olive Street and Live Oak Avenue, that the property owners have offered to dedicate in return for the improvements. 00- 67-S-21 S.W. There were no objections, the motion carried and was so ordered. 00- City Engineer French reviewed a report on an offer to dedicate right of way for street purposes. On May 3, 1967, Mr. Cornelison appeared before Council offering to dedicate a portion of Tracy Street, Mr. French stated the property could be subdivided and dedication would be required at the time of filing a subdivision map. He did not recommend acceptance of dedication at the present time. Mayor Morehead, with the approval of the Council, stated the report would be received and filed. 00- City Engineer French reviewed the Traffic Committee report, making the following recommendations: 1. Passenger loading zone south side of Tracy Street from Frazier Street to a point 458 feet easterly of Frazier. 2. No parking from 6 a.m. to 10 a. m. north west side of Baldwin Park Boulevard, adjacent to lots 19 and 20 of Tract No. 11007 adjacent to freeway off ramp). 3. Not sufficient traffic at Bresee Avenue and Palm Avenue to warrant a four-way stop intersection. 4. Revision of Maine Avenue, Pacific Avenue intersection creating 25 parking stalls between City Hall and Flag triangle with installation of temporary burros painted white. Discussion followed. Steele for a Zone Change from Zone R-3 heavy multiple residential) to Zone C-2 heavy commercial) or more restrictive use upon parcels of land located on the southwest corner of Ramona Boulevard and Monterey Avenue, the address being 13544 Ramona Boulevard. Proper publication, postings, and mailings had been accomplished. Planning Director Chivetta presented a resume stating that Z-302 had been continued to this meeting in order to ascertain two 2) things: I. What the Board of Zoning Adjustments would do with the Zone Variance request before them. 2. What the Planning Commission would recommend in terms of strip zoning along Ramona Boulevard, At the last regular meeting of Council on May 3, 1967 a report had been given from the Plan- ning Commission stating that they recommended maintain- ing the status quo on Ramond Boulevard and that the Board of Zoning Adjustments at their last regular meet- ing denied the Zone Variance request; that the Planning Commission by their Resolution No. P.C. 67-13 and the staff recommends that the property be rezoned from R-3 to C-2 and that second reading of the Ordinance be held until such time as the property develops with the stip- ulation that the same shall take place within one year. TESTIMONY IN FAVOR of the request was given by: Mr. Jay Angelo, Agent for the Applicant, 14317 Ramona Boulevard, Baldwin Park As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-302, Mayor Morehead declared the public hearing closed. Councilman McCaron stated that the parcel that was under consideration was adjacent to some property that had been developed R-3 in the last year or so; that this would be putting C-2 uses next to R-3 uses that have not outlived their purpose; that to allow C-2 in this particular place does not conform to the present plans that the Council has agreed to for the future develop- ment of the area and of the Pacific Electric right- of-way providing that everything proceeds along under favorable conditions; that he felt it would be premature to change the zone at this time In case that plans for the area were not consummated. The motion carried by the following vote: AYES: COUNCILMEN GREGORY, ADAIR, CRITES AND MAYOR MOREHEAD NOES: COUNCILMAN MCCARON ABSENT: NONE 00- It was the time and place fixed for a public hearing on AZC-30, an intent of the Baldwin Park Planning Commission to consider a proposed amendment to the Baldwin Park Municipal Code to amend Section 9610, subsection 7, relating to truck repair as a permitted use in the C-2 heavy commercial) Zone, subject to the approval of a Conditional Use Permit, and to add to Section 9472 said amendment. Proper publication and postings had been accomplished. Planning Director Chivetta presented a resume stating that the Planning Commission by their Resolution No. P.C. 67-14, adopted March 22, 1967, recommended a Clarification of Ambiguity regarding auto and truck repair as a permitted use in the C-2 Zone; that on April 5, 1967 the Council concurred with the Planning Commission's recommendation by their Resolution No. 67-108, however it was Council's desire that all truck repair in the C-2 Zone be subject to the issuance of a Conditional Use Permit; that on April 26, 1967 the Planning Commission conducted a public hearing to consider amendments to the Municipal Code, Section 9610 A 7) and Section 9472 to reflect the following: Section 9610 A 7) Auto and Truck Repair. a) Automobile repair garage. There were no ob- jections, the motion carried and was so ordered. 00- City Attorney Flandrick requested that the City Council re- cess into Executive Session for discussion of Baldwin Park vs. Smith. 00- Mayor Morehead stated that after the Council meeting of May 3, 1967 the City Manager of Irwindale had spoken with him regarding the City Council of Irwindale desiring to meet with the City Council of Baldwin Park to discuss a few items that might at this time or in the future be of mutual Interest; that at that time he had been receptive to the Idea; that since his initial discussion he had given this further consideration and that he now felt this would not be advisable. Councilwoman Gregory stated that any business that had to be transacted between the City of Irwindale and the City of Bald- win Park could be transacted through the City Administrators of both cities and be brought on the Council Agenda in the usual fashion. Councilman Crites stated that he had a meeting of the School District on Monday the 22nd day of June and would be unable to attend the proposed meeting. The City Council concurred that it would not be in either City's best interest to hold a joint meeting and the Count II directed Chief Administrative Officer Nordby to convey this message to the City Manager of the City of Irwindale. 00- Councilman McCaron stated he would like permission from the Council to be absent from the next three meetings. City Attorney Flandrick stated that this was a non- conforming structure; that there were regulations concerning the type, nature and extent of repair work that could be accomplished in the absence of a Zone Variance; that he felt this was something that would have to be explored with the Building and Planning Department to determine whether the regulations would apply or not. Councilman McCaron suggested that the hearing be held open until the next meeting and that there be a further report so that an exact determination could be made as to whether the building should be razed or not. City Attorney Flandrick suggested that the hearing be continued and that the report from Building and Planning be examined to determine whether the building could be rehabilitated.
