In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

Chief Administrative Officer Nordby reviewed his re- C.A.O. REVIEWED
port regarding Yellow Cab Company; stating that a REPORT RE YELLOW CAB
study had been made on the condition of the cabs and CO.
several other factors relating to their operation; that
twenty 20) of the cabs had been inspected as of July 11,
1967; that possibly more had been inspected since that
time; that an inspection had been conducted in February
of this year; that a limited inspection should be con-
ducted more frequently; that the cleanliness of the
cab and the appearance of the driver should be checked
more frequently than had been done in the past.
Mayor Morehead stated that the cabs should be in better
physical condition than what they appear to be; that
customers of the cab company complain about the lack
of cleanliness in the cabs.
Councilwoman Gregory stated most of the people she had
spoken with concerning the cabs were senior citizens;
that there had been no reflection on the cab drivers
themselves; that the drivers were courteous; that the
condition of the cabs was the complaint; that a complete
survey of the service in Baldwin Park should be made
and presented to the Council at a future date.
Councilman McCaron stated that a report should be pre-
sented to Council on the cab company°s complete
activities, rates, etc., as compared with other areas.
Mr. Al Rubino, Manager of Yellow Cab Company, 3944
Stichman, Baldwin Park stated that the cabs were washed
once a week; that this had been started approximate-ly six
6) weeks ago; that lately there had been a heavy dew
in the morning and that the men had not had a chance to
clean the cabs off before they get out due to the rush
from 6:00 to 8:00 a.m.; that from 10:00 to 2:00 p.m.
the cabs were in good shape; that the company had pur-
chased new water- cushion bumpers; that all of..their
Chevy 11's would be equipped with these new safety
bumpers; that the only urgency regarding this request
was that the meters would have to be recalibrated and
checked by the Department of Weights and Measures; that
only five 5) meters a day could be done, and all before
September Ist.
At the request of Mayor Morehead, City Clerk Balkus read
Chief Administrative Officer Nordby°s statement regarding
the requested rate change on page 3 of the July 5, 1967
minutes.

Regular Meeting of the Baldwin Park City Council
City Attorney Flandrick stated that Section 6220 of the
Code merely states that the Council shall set and amend
rates to be charged for taxi service by motion carried
by a majority vote; that the Code does not now state
that the Council may reduce rates on their own initiative;
that this could be amended to provide for the authority
of Council to review, amend and modify the rates either
by request of the applicant oh initiation of Council.
Council instructed City Attorney Flandrick to prepare
an Ordinance for the next Council meeting concerning
Council authority to review, amend and modify the rates
for taxi service.
Roll Call. There were no objections, the motion carried
and was so ordered.

Chief Administrati Officer Nordby stated the next item
concerned the propo amendments to the Personnel Rules
and Regulations.
Councilman McCaron asked if there was no limit on sick
leave accrual what kind of a contingency would the City
be involved In in a matter of 15 or 20 years.
Chief Administrative Officer Nordby stated that the
pattern established by employees really does not change;
that the employee that does not use his sick leave very
often and appears to be in good physical health and builds
up the maximum of sixty 60) days was unlikely to abuse
the privilege regardless of how long that they were with
the City; that some employees probably through legitimate
reasons use sick leave quite frequently and have very
little accrued; that he did not feel there would be any
financial impact.
Councilman McCaron asked if the City was liable to pay
all accrued sick leave of an employee upon retirement
or discharge from the City.
Chief Administrative Officer Nordby stated1 no; that the
request from the Employee's Association had recommended
a formula upon which the employee would be paid once a
year for accrued leave over a certain amount; that on
this item a modification had been made and a different
recommendation made to Council, pending a study of what
financial impact this might create on the City; that he
recommended lifting the ceiling on sick leave accrual.
He stated that the employees were aware of the recommen-
dation.
Councilman McCaron stated that in the Employee's Associa-
tion recommendations they had indicated that they wished
the vacation leave to be working days and that this would
work out at maximum accrual to more than a month's absence
of calendar days; that he felt there should be a limit
of one month maximum calendar days vacation leave.

audience desiring to be heard during the meeting.

PUBLIC HEARINGS:
It was the time and place fixed for a public hearing on
67-S-25, a Short Form 1911 Act for sidewalk and drive
approach on the north side of Ina Street between Maine
Avenue and the Easterly end of Ina Street.
Proper postings and mailings had been accomplished.
There were no Written protests.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to this Short
Form 1911 Act, Mayor Morehead declared the public
hearing closed.
It was the time and place fixed for a public hearing on
67-S-26, a Short Form 1911 Act for sidewalk and drive
approach on the south side of Ina Street between Mainei
Avenue and the Easterly end of Ina Street.
Proper postings and mailings had been accomplished.
City Engineer French stated that two 2) written pro-
tests had been received.
The letter from Curtis and Sigrid Johnson, 14458 Ina
Street, Baldwin Park protested on the grounds that
there was not enough walking traffic to warrant side-
walks; that with the sidewalk ending on their property
and not going all around the circle it would look
ridiculous; that it would decrease the value of
property.

Regular Meeting of the Baldwin Park City Council
The letter from Carl W. Burks, 14452 Ina Street,
Baldwin Park protested on the grounds that Ina
Street was a short, one way street and that there
was little or no foot traffic; that he did not
need a drive approach as the garage could not
be entered from the front.
City Engineer French stated that if both districts,
67-S-25 and 67-S-26 were formed that the sidewalk
would not stop at the Johnson's property as in-
dicated in their protest; that a drive approach
would not be constructed in front of Mr. Burk's
property unless he desired it.
As there was no one in the audience desiring to
speak either in behalf of or in opposition to this
Short Form 19.11 Act, Mayor Morehead declared the
public hearing closed.

City Attorney Flandrick stated that there had been
a telephone call from the applicant requesting that
ZV-178 be held over to the next regular meeting.

City Engineer French reviewed his report concerning
the modification of the Uniform Building Code as it
relates to Fire Zones. He stated that when the last
building code was adopted all zones with the exception
of residential zones were incorporated within Fire
Zone No. 2; that this had an effect on uses of the
property and well as the construction materials that
were to be used; that a user had come into the City
who purposely and with all intent had had his property
zoned M-2 in order to have an operation that he was
currently conducting; that the Citys present Fire
Zones eliminated this operation; that the fire zones
within the City of Baldwin Park were a little more
restrictive than normally encompassed within the
County of Los Angeles and other communities; that
the Engineering Department had requested that the
Fire Department Research and Planning Section state
in their opinion proper zoning for fire zones
throughout the City; that the zoning would not be
based as much on land planning but on projected
land use, density factors and setbacks incorporating
the zone and also street widths and street development;
that he expected to have this information in time to
incorporate it into the next major change in the-$uild-
ing Code which would be the forthcoming 1967 Edition
of the Uniform Building Code. He recommended that
Ordinance No. 491 be amended in subparagraph p) I)
to include C-2A-and M-R and that Ordinance No. 491 be
adopted.,

City Engineer French reviewed the Traffic Committee
Report stating that during the years of 1965 and 1966
there were ten 10) accidents at intersections on Palm
Avenue between LaRica Avenue and Hornbrook Avenue;
that the Traffic Committee recommended the adoption
of Resolution No. 67-215.

Councilman McCaron stated that Resolution No. 67-215
included a stop sign for east and west bound traffic
on Palm Avenue at Bresee Avenue and a stop sign for
east bound traffic on Palm Avenue at LaRica Avenue;
that he wondered if this would not be too many stops
for Palm Avenue; that he wondered why the traffic
on Bresee Avenue going north and south should not
be stopped instead.
City Engineer French stated that this related back to
Item No. 2, cause of accidents, excessive speed; that
stop signs do cause the automobiles to stop; that with-
out the stop signs at Bresee Avenue they have a four
block run; that this sometimes encourages speeders.
After further discussion City Engineer French stated
the Traffic Committee would reevaluate the intersection
of Stewart and Palm and report back to the Council.
Roll Call. There were no objections, the motion
carried and was so ordered.

Planning Director Chivetta reviewed his report concerning
Clarification of Ambiguity regarding Deep Lots. He stated
the Planning Commission had adopted Resolution No. PC
67-2.7 on July 6, 1967 recommending to the City Council
this clarification.
Planning Director Chivetta stated that deep lots were
regulated by the department through a site plan review;
that an application was reviewed and if there was a street
either on the General Plan or one that should effect the
property they would not approve a deep lot; that this pre-
cluded developing a lot that might be 400 ft. in depth.
He further stated that the authority to reject an application
was In the Code at the present time under Site Plan Review;
that the applicant could appeal to the Board of Zoning
Adjustments.
As there were no objections, the City Attorney was Instructed
to prepare a,resolution approving the clarification of
ambiguity, concurring with the Planning Commission for
presentation at the next regular Council meeting.

voting on this ordinance due to the fact that he had
been absent at the time 61f the hearing.
City Attorney Flandrick explained that an ordinance
required three affirmative votes to carry; that Council-
woman Gregory had abstained at the last meeting and
apparently would again this evening; that he suggested
this ordinance be held over to the next regular meeting.
As there were no objections, Mayor Morehead stated that
Ordinance No. 490 would be held over to the next regular
meeting.

Councilwoman Gregory stated that she would like to have
the City Attorney review the City's ordinance concerning
the nuisances of animals in Baldwin Park; that she had
received a number of calls concerning barking dogs,
etc.; that midway on Merced between Los Angeles and
Ramona sometimes there were two ponies and sometimes
seven or eight; that they should not be there; that
Mr. Palmer had gone out there on several occasions;
that when Mr. Palmer was there the noises and animals
disappear.

City Attorney Flandrick stated that the Penal Code makes
it a misdemeanor to conduct a public nuisance; that the
District Attorney's°office has difficulty getting people
to testify1hat there is, in fact, a nuisance; that in
view of the fact that the District Attorney's office
had now set up a special individual to handle prosecution
of this type case; anyone who has such a problem should
be advised to contact the Deputy District Attorney in
West Covina; that they have a procedure where they have
an office conference with the complainant and the
supposed violator for the purpose of trying to abate the
nuisance without the necessity of filing criminal action;
that they do file where they have a strong case and
witnesses willing to testify.

Chief Administrative Officer Nordby stated that the Board
of Supervisors had set the date of election for the
dissolution of the Baldwin Park Park and Recreation
District for August 8, 1967; that the City would get some
coverage in the newspaper; that the way the proposition
would be placed on the ballot would probably not be to
the City's advantage; that he expected to appear at various
meetings to try to overcome this with the blessings of
the Council; that the newsletter containing comments would
be printed and mailed before the election.
Mayor Morehead stated that this forthcoming election should
have the publicity; that each member of Council had been
requested to give a statement to the paper as to why they
think the Park District should be dissolved.

Councilman McCaron asked if a statement could be
included in with the ballot itself.
Chief Administrative Officer Nordby stated the City
would be permitted a statement of 100 words; that
this would be prepared.
City Attorney Flandrick suggested that by motion
the Council authorize Chief Administrative Officer
Nordby to formally request and file a ballot measure
in the name of the City Council.

Mr. Robert N. Heath, 1244 East Garvey, West Covina,
asked when the ordinance for Z-303 would receive
second reading.
City Attorney Flandrick stated that the policy of the
City Council was that prior to second reading that
the applicant submit a building application; that
once this had been received and plan checked that
second reading on the ordinance would be held;
that zoning was not a contractual matter; that the
policy had been to issue the building permit with
the statement on=the face of the permit that it was
subject to thefinaiization of zoning; that If the
permit were either not followed through to the point
where i t was actually issued or if it were I n fact
issued and then ekpi'red and within thirty, 30) days
the applicant did not tike advantage of the re-
institution"df°t e'"permit; that the staff would
come back before Council and ask that the Council
give serious consideration to declaring a moratorium
on any building permit or any zoning on the property
and instruct the Planning Commission to initiate a
hearing to,rezone the property back to what it was
prior to the most recent change; that in some
Instances a Resolution of Intention had been approved.
He stated the Ordinance would be on the next Council
Agenda for second reading.

ORDINANCE NO. 491 AMENDING SECTION 8101,
SUBPARAGRAPH P) OF THE BALDWIN PARK
MUNICIPAL CODE, RELATING TO THE UNIFORM
BUILDING CODE
Councilwoman Gregory stated that the reference that
Mr. French had made to a user coming Into Baldwin
Park was causing her concern as she felt this should
be considered a move-in; that no matter how a build-
ing was dismantled in another city and brought into
this city that it was a move-in;,that this particular
building was not anything that she would like to see
moved into this city even in an industrial area; that
the building was something of a monstrosity and al-,
though the applicant had stated that he would build
an office in front it could be anything from a two
by four of lath and plaster which would never hide
a building of this size; that it was quite a large
metal building; that by changing the fire zone the
City would be allowing something to happen that
should have gone through Planning.
Mayor Morehead stated that it was his understanding
that nothing official had been received concerning
the building Councilwoman Gregory had referred to;
that the Information that the City Engineer had had
caused him to reevaluate the fire zones and had
caused him to recommend this particular ordinance.
Mayor Morehead directed City Engineer French to
notify the person involved that he would have to
apply for a move-in permit.
City Engineer French stated that a fire zone was on
the property whether there was a building on It or
not; that the fire zone had a relation to land use;
that it was not the same as land use zoning; that
the City was limiting land use by fire zone; that
this was not the intent of fire zones; that the
fire zones were to zone areas where it could be
expected to have fires of a large magnitude that
would have to be controlled; that by building
standards fire breaks were incorporated; that the
user, Cantrall Steel had an operation where steel
was moved by cranes; that the working structure
as it was now could not come into the City under
any circumstances in Fire Zone No. 2; that it
would have to be built out of concrete; that this
would not be practicable; that he felt the fire
zone for the area was restrictive.
