determines and notifies the Department of Housing and
Community Development of the State of California that
said City has and is enforcing a local ordinance or ordi-
nances prescribing minimum standards equal to or greater
than-the following provisions of Division 13, Health and
Safety Code, State of California:
Part 1.5 commencing with Section 17910).
Chapter I commencing with Section 19000) of Part 3.
Chapter 2 commencing with Section 19100) of Part 3.
Chapter 3 commencing with Section 19300) of Part 3.

REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL SEPTEMBER 6, 1967
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Finance Director Duncan led the salute to the flag.

to Chief Adams from the American Automobile Assn., commending CITATION AWARD;
the Police Department for their excellent safety program, FROM AMERICAN AUTO
reducing pedestrian fatalities from one in 1965 to none in ASSOC.
1966 and recognizing the cooperative efforts of Local School
Officials. Mr. John J'a Ciraulo, Automobile Club of So, Calif.,

He explained that this was a format the Director of
the Department of Housing would accept; that this is
formal notice that the City's local ordinances are
enforced and supersede State requirements.

District 67-S-14, for the East side of Azusa Canyon
Road from the General Telephone Company to Arrow
Highway. He stated the City of Irwindale had rejected
Mrs. Basham's petition for the improvement of the West
side between Olive and Nubia, for the reason that funds
are not available for street pavement to be Installed
concurrently with the curb and gutter; that the City
of Irwindale had approved a call for bids for +he
district on September 5th. He recommended approval
of the district.

Regular Meeting of the Baldwin Park City Council
City Engineer French recommended the release of Bonds
for Tract 26067, Benwood and Walnut and Tract 24972,
Benham, North of Walnut; California Property Brokers.
He stated improvements had been installed, however
he recommended that the cash deposit be retained
until a final billing is received from the Southern
California Edison Company for Installation of street
lights and final inspection costs are ascertained.

26067 AND. 24972 BE RELEASED AND THE CASH DEPOSIT
BE RETAINED PENDING FINAL BILLINGS. COUNCILMAN

Planning Director Chivetta reviewed his report on the
Vacation of Monterey Avenue; stating this was an
Interior, future street between Valle Vista Avenue
on the South, Palm Avenue on the North, Walnut Street
on the East and Center Street on the West. He ex-
plained that this portion of the street is no longer
needed because of the school site between Walnut and
Center. City Engineer French recommended the area
be vacated in accordance with Section 8000 et seq
of the Streets and Highways Code.
COUNCILMAN MCCARON MOVED THAT THE COUNCIL CONCUR WITH
THE RECOMMENDATION AND THAT A RESOLUTION BE PREPARED
FOR PRESENTATION AT THE NEXT REGULAR MEETING, COUNCIL-

Regular Meeting of the Baldwin' Park City Council
City Clerk Balkus stated she would be working at the
Registration Desk for the Independent Cities of Los
Angeles County Seminar In San Diego on September 15,
16 and 17; that the matter had been discussed
previously with Chief Administrative Officer Nordby.
There were no objections.

Mr. Edwin Elko, 13057 Bess Avenue, Baldwin Park,
commented on fences being located next to the side-
walks on Baldwin Park Boulevard and suggested that
an ordinance be passed requiring an adequate fence
set back on property frontages, as he felt more than
half of the people would go along with this action.
It was explained that sufficient right of way had
been acquired on Baldwin Park Boulevard to install
the sidewalks, but the fences were on private
property; that as conditional use permits, building
permits, etc., were issued dedications would be
acquired and over a period of time fences would be
relocated.

PUBLIC HEARINGS
8:00 p.m. having arrived it was the time and place
fixed for a public hearing on 65-S-25, a Short Form
1911 Act, on the North East side of Pacific Avenue
between Puente and Mayland, to hear any protests
in regard to the cost for the construction of ourb,
gutter, sidewalk and drive approach on Parcels I,
2, 3 and 4.
Proper.posting5 and mailings had been accomplished.
As there vas np one in the audience desiring to
speak either in behalf of or in opposition to this
Short Form 1911 Act, Mayor` Forehead declared the
Public Hearing closed.

It was the time and place fixed for a public hearing
on 67-S-31, a Short Form 1911 Act, for sidewalk on
the East side of La Sena between Anniston and Olive
Street, 67-S-32, a Short Form 1911 Act, for curb,
gutter and sidewalk, on the Northeast side of
Foster,between Frazier and Torrey.
Proper postings and mailings had been accomplished.
There were no written protests.
As there was no one In the audience desiring to
speak either in behalf of or in opposition to 67-S-31,
and 67-S-32, Mayor Morehead declared the public hearing
closed.

CONSTRUCTION OF CERTAIN IMPROVEMENTS
PURSUANT TO SECTION 5870, ET SEQ, OF
THE STREETS AND HIGHWAYS CODE 67-S-31

COUNCILWOMAN GREGORY MOVED THAT RESOLUTION NO. 67-268
BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCIL-
MAN ADAIR SECONDED. There were no objections, the
motion carried and was so ordered.

It was the time and place fixed for a public hearing
on ZV-18I, application submitted by Keith Garrick,
Agent Town Squire, Inc., and Don-Kay Corporation
for a Zone Variance to vary with the Baldwin Park
Zoning Ordinance No. 357, Section 9552, Standards
of Development, to create two parcels of land
containing less than 6,000 sq. feet each as required
in the R-I single family residential) Zone.
The address being 4522 Jerry Avenue.
Proper publication, postings, and mailings had been
accomplished.
Planning Director Chivetta presented a resume stating
that ZV-181 was a request for two substandard lots
containing 5,280 sq. feet each, in the R-I Zone in
lieu of fhe 6,000 sq. feet required; that BZA Resolution
67-23 denied the request for lack of a hardship, He
indicated the area on the wall map, stating the area
was surrounded by R-I Zoned property, and that LS-653
which would have created an interior lot, Parcel 3,
had been denied; that applicant had sold parcel 3 in
violation of the City's Lot Split Ordinance No, 415.
He stated the house on Parcel A existed prior to any
Lot Split applications.
City Clerk Bal-kus again administered the Oath.

City Attorney Flandrick explained that Title Insurance
Co., approved the description; that they make no
guarantee on Zoning.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to ZV-181,
Mayor Morehead declared the public hearing closed.
Discussion followed that the case should be held over
until City Attorney Fiandrick and Planning Director
Chivetta could check the exhibits; that applications
for building permits be checked and the dates of
application and also check to see if a plot plan was
presented.
Mr. Garrick gave his permission that the exhibits be
held for examination.

UNTIL THE NEXT REGULAR MEETING, SEPTEMBER 20, 1967.

Discussion followed concerning the requirements; that
the variance be exercised within six months; vacation
of the alley subject to a report from the Planning
Commission and the staff; that item d) could not be
waived as it was a part of the code; that usage does
not fit the area; hours and days of operation; a three
year time limit; that there was considerable traffic
and curb and gutter would help; possible dust; and
combining property into a single lot.
COUNCILMAN MCCARON MOVED THAT ZV-182 BE APPROVED UPON
THE SAME TERMS AND CONDITIONS AS SET FORTH IN THE BZA
RESOLUTION WITH THE EXCEPTIONS OF PARAGRAPHS C I J AND

into a single lot. He stated that section D)
must be complied with or an application be made
for a Zone Variance.

Í«Regular Meeting of the Baldwin Park City Council
Planning Director Chivetta presented a resume stating
that the Board of Zoning Adjustments had considered
the request on August 9, 1967 and had conditionally
approved the variance as the M-I Zoning for the
property which first permits the type of use re-
quested) could not be obtained because of the
adverse effect the same would have on surrounding
R-I and C-2 properties and the General Plan; that
the structure on the property was unsuitable for
those uses permitted in the C-2 heavy commercial)
Zone. He stated the applicant had appealed the
Board's decision contending that the conditions
in Resolution No. BZA 67-24 would impose a hardship.
Conditions were as follows: Paragraph C install
street improvements; i.e., curbs, gutters, sidewalks,
drive approaches; Paragraph D Install paved drive-
way access to structure from Street; Paragraph I
improve dedicated alley; Paragraph L public
utility tie-in from pole to building. He indicated
the area on the wal l map.
