REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Finance Director Duncan led the salute to the flag.

Regular Meeting of the Baldwin Park City Council
PUBLIC HEARINGS:
The hour of 7:30 having arrived, it was the time and
place fixed for the hearing on I) the Resolution of intention
for Assessment District 67-I, Monterey Avenue, Resolution
No. 67-259 of the City of Baldwin Park; and 2) the
Debt Limit Report Resolution 67-258.
City Attorney Flandrick stated the purpose of the special
assessment proceeding hearing was to determine the debt
limit report, the necessity of Improvements, extent of
Improvements, reasonability of plans, cost of Improvements
estimates, incidental costs; district boundaries inclusion
or exclusion of properties, compliance with statutory
requirements and acquistition of rights-of-way.
City Clerk.Balkus presented the following:
a) Affidavit of Publication of Resolution No. 67-259
b) Affidavit of Posting Notice of Improvenent c) Affidavit
of Mailing Notice of Improvement d) Statement Regarding
Recordation.

OF RESOLUTION NO. 67-259, THE AFFIDAVIT OF POSTING NOTICE
OF IMPROVEMENT, THE AFFIDAVIT OF MAILING NOTICE OF
IMPROVEMENT AND THE STATEMENT REGARDING RECORDATION BE
RECEIVED AND FILED. COUNCILMAN ADAIR SECONDED. There

Mr. Lawrence Bevington reported on the debt limit report
pursuant to Resolution 67-258
City Clerk Balkus presented and read in full two 2) letters
of protest from the following: I) Winston M. Shuck,
13618 East Palm Avenue, Baldwin Park, California: 2)
Bertha Stoskus, 4111 North Walnut Street, Baldwin Park
California. Letters In official files)
City Clerk Balkus stated that one I) letter had been
received in favor of the district from Elnora Young,
4135 Walnut Street, Baldwin Park, California Letter
in official files)
City Engineer French stated the district improvements
consisted of curbs, gutters, sidewalks, drive approaches,
base and paving with asphaltic concrete, sanitary sewers
and house laterals, water mains and house service lines,
storm drains and catch basin, fire hydrants, clearing and
grading and any and all 4rk and materials appurtenant thereto;
that this:improvement would provide access to public dedicated
right-of-ways; That It would open up a landlocked area and
that the area would be developed with an orderly plan.
City Engineer French stated that approximately 21% of the
properties included within the district in terms of
land area was being protested.
City Engineer French stated that he felt that Mr. Shuck had
misunderstood the intent of the letter he had received
dated August 25, 1967; that the letter had requested
dedication rather than purchase of the property.

Regular Meeting of the Baldwin Park City Council
City Engineer French stated that Mrs. Stoskus had
stated in her letter of protest that she did not intend
to subdivide but that later on in the letter she had
stated that she was committed to a subdivider; that this
street improvement was necessary to open up the area;
that the Baldwin Park Ordinance did not allow the
development of interior lots.
City Attorney Flandrick asked if the City Engineer was
familiar with assessment proceedings under the 1911 Act.
City Engineer French stated that he had participated in
many such districts.
City Attorney Flandrick asked if the City Engineer was
familiar with the plans, specifications, and map of
Assessment District 67-1.

Regular Meeting of the Baldwin Park City Council
City Engineer French stated that no work was being done
except on Monterey Avenue; that the only people being
assessed abut on Monterey Avenue; that the 1911 Act had
been used in Baldwin Park for street improvements and
sewers; that some of the streets that had been completed
were Salisbury, Lante, Jerry and Chevalier; that the last
sewer district was an 1911 Act; that 60% of the people
to be assessed had signed the petition; that the petition
required the initiation of proceedings; that Mr. Denning
had not owned this property when the petition had been
signed.
City Engineer French stated that Mr. Denning owned 12%
of the property to be assessed.

signature Mrs. Stoskus had referred to in his letter
as looking the same as a signature from the Tracy
Development Company was his signature.

As there was no one else in the audience desiring to speak PUBLIC HEARING
on behalf of or in opposition to Monterey Avenue Assessment DECLARED CLOSED
District 67-I, Mayor Morehead declared the public hearings MONTEREY AVE. ASSESS-
closed on Resolutions 67-258 and 67-259 MENT DIST. 67-I
Mayor Morehead asked City Engineer French what percentage
of the land area was being protested.
City Engineer French stated all protests together, oral

Councilman McCaron inquired if the easement for drainage
did not cut down the size of someone's property.
City Engineer French stated that no lots had been cut down
in width by easements.
Mrs. Redwine, 4158 North Center,
Baldwin Park
City Engineer French stated that the district consisted
of sixteen 16) parcels; that some were dividable parcels.
The Council concurred in that it appeared the petition
circulator, who had no affiliation with City Hall, had
made misleading statements and this reflected badly on
the City and the staff.
Mayor Morehead stated that sixteen 16) properties were
involved; that four 4) official protests had been registered.
City Attorney Flandrick stated at this point the Council
could terminate the district, overrule the protests or
alter the boundaries of the district.
City Engineer French stated that for the Hardcastle property
which was now the Denning property, Parcel 12, that the
right-of-way acquistion cost would be $2,160.00, leaving
an estimated assessment of $9,599.90; that the Bennett property,
Parcel No. 13, right-of-way acquistion cost would be $1,080.00,
leaving an estimated assessment of $4,720.00; that the Raivo
property, Parcel No. 2, right-of-way acquisition cost would
be $892.00, leaving an estimated assessment of $6,365.00;
that the Stoskus property, Parcei No. 6, right-of-way
acquisition cost would be $1,584.00, leaving an estimated
assessment of $7,134.00.
Councilman McCaron stated that five 5) homes already face
the future street; that there was no access except to the
future street; that none of the property in the rear could
be developed; that if any development was to be done the
street would have to be put in; that the protests should be
overruled; that if the market for lots at the present time
was $5,000.00 that this must be the condition of the lot
that deteriorated the value; that the area would be enhanced
by the street being put in.
Councilwoman Gregory stated that she agreed with Councilman
McCaron; that she was sorry about any misinformation and
sorry for any harassment; that she would like the minutes
of this meeting to reflect that no members of the City staff
were responsible.

City Engineer French stated that Mr. Raivo would have two
2) 57 1/2 ft. wide lots if he could acquire a variance;
that it had been indicated to Mr. Raivo that in the past
variances had been granted; that the only way to obtain a
firm answer would be to file for a variance; that the final
determination would rest with the Board of Zoning
Adjustments and the City Council.
Mr. Ed Denning, 4428 Bresee, Baldwin Park inquired as to MR. ED DENNING
which sides of Center and Walnut had signed the petition.
City Engineer French stated that the petition was signed
by the people being assessed only.

the intended cul-de-sac was approximately 700 feet long;

Councilman Crites read in full a letter he had received
from Mr. Geller of the Los Angeles County Public Library.
He stated that the plans were ready to be presented to
the County Engineer; that Baldwin Park qualified for
a Federal Grant and that possibly Baldwin Park would
have a new library by January of 1969.

Councilman Crites stated a letter had been received from
Assemblyman Harvey Johnson extending his sincere thanks
to the City, for assistance to the Assembly Interim Committee
on the day of their meeting In Baldwin Park, September
22, 1967.
Mayor Morehead stated that the City had been happy to host
the Committee; that he would like to add his thanks to the
City staff.

City Attorney Flandrick reviewed his report regarding
Municipal Code Section 4507, Nudists. He stated that
he recommended that this Section be repealed; that he
had discussed this with Chief of Police Adams; that this
Section had been included In 1956 when the Municipal Code
had been adopted; that this Section was preempted by State
Law.

Chief Administrative Officer Nordby stated the newspaper
coverage regarding the inequitable allocation of the
Cigarette Tax had been good; that the Daily Breeze published
in Torrance had had a story above the masthead on page one;
that a Long, Beach newspaper had covered the story and the
San Gabriel Valley Daily Tribune; that there would be a
meeting of the League Board of Directors in San Francisco;
however the majority of the Board represented cities that
were gaining under the present tax allocation.

Chief Administrative Officer Nordby stated that a Federal Law
regarding Real Property Transfer Tax was due to be lifted
January I, 1968; that the 1967 State Legislature had passed
Senate Bill No. S.B. 837 providing for a Real Property
Transfer Tax-as a direct replacement of the Federal Tax,
that the tax would be at the rate of $.55 per each $500.00;
that the County of Los Angeles had adopted an Ordinance
regarding this tax; that the City could adopt an Ordinance
and share in this tax with the County.

City Engineer French reviewed his report on the initiation
of Short Form 1911 Acts; 67-S-41 for curb and gutter on the
east side of Sierra Madre Avenue between Nubia Street and
Joanbridge Street; and 67-S-42 for curb and gutter on the
northwest side of Puente Avenue between Channing Street
and Pacific Avenue.

Chief Administrative Officer Nordby introduced Mr. Mike
Carmel, new Reporter from the San Gabriel Valley Daily
Tribune.
Discussion followed that Mr. Rick Nielsen, Reporter from
the San Gabriel Valley Daily Tribune had given the City
excellent coverage; that he be nominated for Newspaper
Man of the Year Award at the League of California Cities
meeting in San Francisco; and that a letter of commendation
signed by the Mayor be sent to Mr. Nielsen's employer and
to Mr. Nielsen.

Mayor Morehead stated he had been receiving complaints
concerning churches from out of the City holding rummage
sales in the City of Baldwin Park; that some of these
rummage sales had been held without a permit.
Councilman Adair stated that when the Police Department
was aware of these sales being held without a permit they
should be stopped and the people cited.
Chief Administrative Officer Nordby stated that enforcement
of this should be the duty of the City Enforcement Officer;
however he did not work on Saturday or Sunday;.that no
later than next budget, provisions for two 2) Enforcement
Officers should be made and the dui ies of the Enforcement
Officers defined; that at this time a rummage sale being
held on Saturday or Sunday without a permit was the re-
sponsibility of the Police Department.

Councilwoman Gregory stated that parking on vacant lots
in the City was getting out of hand; that many of the
cars were in a state of disrepair; that another Enforce-
ment Officer was needed, that this situation should be
attacked with vigor.
