In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.

RESOLUTION NO. 67-315 OVERRULING
AND DENYING PROTESTS AFFECTING
ASSESSMENT DISTRICT 67-1
City Attorney Flandrick stated that proposed Resolution
No. 67-315 was before the Council because at the last
regular meeting the Council had completed the hearing
on Assessment District 67-1 and by resolution had over-
ruled protests; that by inadvertence In the resolution
in which that action was taken there was no reference to
the Debt Limit Report; that Resolution No. 67-315 would
correct this clerical error.

Chief Administrative Officer Nordby stated that City REC. PURCHASE OF
Engineer French recoemended the acquisition by the SIX 6) TAX DELINQUENT
City of six 6) tax delinquent properties at a cost PROPERTIES FOR STREET
of $1.00 each for street purposes. PURPOSES
Councilman McCaron stated that some of these properties
were areas that should bane been dedicated for street
purposes under Lot Splits; that he wondered if the Lot
Splits were ever consummated.
City Attorney Flandrick stated that probably people had
failed to dedicate; that no one had been interested In
paying taxes on these properties; that they had now come
up for tax sale.
Councilwoman Gregory asked Councilman Crites if the
property on Monterey, Tract No. 4624 was his neighbors;
that she understood this property had been dedicated.
Councilman Crites stated that It was his understanding that
this property had been dedicated; that the houses on this
property faced the driveway, which made him think that a
lot split had not been completed on this property.
Councilman McCaron stated that if this property was shown
as separate lots on the tax rolls the Lot Split map must
have been recorded.
Councilman Crites stated that the property owner of Lot 46
had not dedicated; that they had granted the City an easement
for the sewer line, etc.
Mayor Morehead stated that the purchase of these properties
should be considered and that the City Engineer and Planning
Director should be instructed to report back to Council on the
status of each parcel.

Assistant City Engineer Gordon reviewed the report regarding REPORT RE REQ. FROM
a request from Mrs. Day, 3354 Barnes Avenue, Baldwin Park MRS. DAY, 3354 BARNES
for waiver of curb, gutter and sidewalk. He stated that AVE., B.PK. FOR WAIVER
City Engineer French recommended that the installation of OF CGS
sidewalk and drive approach be waived, subject to an agreement
whereby the same would be installed within one year after
the date of the execution of the subject agreement; that the
curb and gutter be required now.
Councilwoman Gregory inquired if Mrs. Day had been advised
of the City Engineer's recomrgendatlon.
As there were no objections, Mayor Morehead stated that HELD OVER TO NEXT
this matter would be held over to the next regular meeting REC. MTG.
so that It could be determined that Mrs. Day had been advised NOV. to 1967
of the recommendation.
Assistant City Engineer Gordon reviewed the report regarding REPORT RE REQ. FROM
a request from Mr. Sllppey, 13125 Dart Street, Baldwin Park, SLIPPEY, 13125
for waiver of curb, gutter and sidewalk. He stated that DART STREET, B.PK.
City Engineer French recommended that the curb, gutter and FOR WAIVER OF CGS
sidewalk be delayed in accordance Section 3 b) of the Planning
Comeission's resolution which approved Lot Split No. 411;
that Mr. Slippey be required to connect to the public sewer
in accordance with, the City's policy and regulations at such

Assistant City Engineer Gordon reviewed the report on the P.N. BIDS OPENED
bid opening held September 28, 1967, for demolition of SEPT. 28, 1967;
structures and clean---up for Public Nuisance Case Nos. 6741--38, 67-M-20
67-N*38, 6741-20, 67-M-27, 6744-211 and 67-N-34. He stated 67-11.27, 67-4+1-21 AND
that he recommended that an award of contract be made 6741-34
for proposals 1, 2 and 3 to David C. Osti, 923 South 10th
Avenue, Arcadia, in accordance with their low bid and
that the Mayor and City Clerk be authorized to sign the
contract.

Councilwoman Gregory stated that this proposal was slightly
different than in the past; that the City was asking the
people of Virginia Avenue to assist in a street improvement
that would probably financially benefit the owners of this
particular piece of property and not so much the people
of Virginia Avenue; that this piece of property that begins
and ends on private property owned by the Initiator of the
petition would certainly gain by opening up this area for
commercial development; that this was the largest piece of
property and would certainly have something to do with the
percentage of signers; that there were 35 or 37 pieces of
property; that the people in the area that did sign were
not altogether home owners, but people that have businesses,
trucking and construction companies; that in the past
developers have always developed their own streets; that
the street circulation plan was necessary; that she was
also objecting to the fact that the street alignment would
open on Dalewood which was the entrance to the freeway; that
the trucks that were parked in this area were sixty 60)
feet in length; that the width of the street was about
sixty 60) feet; that if they were making a left turn
to Baldwin Park Boulevard there would be a complete stop
no matter how this was aligned; that this was a busy street;
that this would be a very bad entrance or exit to this
particular street, Virginia on Oalewood.
City Attorney Flandrick stated that if the Council were
to establish this as an assessment district, notwithstanding
the size of the district and all the properties to be
assessed, the great majority of the cost would be assessed
against the properties directly benefited by it.
Mayor Morehead stated that the petition stated that the
signers constituted the owners of more than 60% of the
area involved..
Councilman Crites stated that the people a little farther
up Virginia Avenue would be benefited by this because
if a brand new access were made for trucks to a truck
route as of right now this would take the truck traffic
off of Virginia and this would be a benefit in itself.
City Attorney Flandrick stated that if Council were to
proceed with the matter and at the protest hearing the
people on Virginia Avenue felt that the cost was too
much or that it would not solve a traffic problem they
would have the right of protest; that if there was a
majority protest it would automatically be terminated;
that even if there were not a majority protest the
Council would still have the prerogative- of terminating
it after they had seen the finalized plans; that this
could be held ovet to the next meeting so that City
Engineer French could report concerning whether the
people on Virginia were in favor and whether it would
or would not solve the traffic situation.
Councilwoman Gregory stated she would like to see this
held over as she had already received three 3)
telephone calls in opposition; that she would like a
survey of this area to see just how many people would
be in favor of opening up this street as presented
here or otherwise.

Regular Meeting of the Baldwin Park City Council
It was the consensus of Council opinion that the petition
for the Improvement of Virginia Avenue would be held over
to the next regular meeting for a determination of how
many people might be objecting to the assessment district,
and also a report on the traffic flow going Into Dalewood
in conjunction with Baldwin Park Boulevard.
Planning Director Chivetta stated that the Engineering and
Planning Department had submitted a study relative to
three proposed routes to this street to connect into
Baldwin Park Boulevard; that the route as shown on
the map in Council's packets was the most desirable.

City Clerk Backus administered the oath to those in the
audience desiring to be heard during the meeting.

PUBLIC HEARINGS
8:00 p.m, having arrived it was the time and place
fixed for a public hearing on CP-92, continued from
September 20, 1967, an appeal from the decision of
the Board of Zoning Adjustments. An application for
a Conditional Use Permit submitted by Jackson R.
Baker, in accordance with Section 9472, subsection
13, of the Baldwin Park Zoning Code, to allow a riding
academy upon property in the M-1 flight manufacturing)
Zone, at 4631 Harlan Avenue.
TESTIMONY IN BEHALF OF THE REQUEST WAS GIVEN by:

Regular Meeting of the Baldwin Park City Council
Councilmen Crites stated that he did not see any special
reason not to allow Mr, Baker to have the Conditional
Use Permit to operate his business; that he should have
a proper business license; that he should be allowed the
same number of animals that he had at the time of
Incorporation of the City.
Councilwoman Gregory stated that this should be referred
to the Board of Zoning Adjustments and the Planning
Director for certain stipulations such as the humane
aspects to animals, fire standards prevailing In the
area for the protection of the animals; that the Fire
Department should consider the assemblying of people
In their meeting room; parking, etc.; that this would
Involve more than the Council would probably retamaber
to stipulate; that she agreed with the one year conditional
use permit.
Councilmen Adair stated that he agreed with the one year
conditional use permit; that Mr. Baker should obtain
a City business license; that he should be allowed the
same number of horses he had had at the time of incorporation.
Councilman Crites stated that there was a 1969 moratorium
on horses in Baldwin Park; that various ordinances stated
that one horse for each riding member of a family on a
property would be allowed; that he intrepreted this to
mean for those who live on the property; that all horses
be corraled, etc.; that there was another ordinance that
stated how many horses per acre were allowed.
Councilman McCaron inquired if the 1969 moratorium regarding
horses was in the City ordinance; that If it was he felt
it would require some study.
Councilman Crites stated that Section 9551, Ordinance No.
357, adopted June 1, 1964, entitled, Permitted Uses In
R-1 Zone", was on the City's ordinance to begin with.
City Attorney Flandrick stated that this could be imposed
as a condition on this permit, however this permit related
primarily to M.-l property.
Councilman Crites stated that Section 9521, Termination of
Lawful Nonconforming Uses By Operation of Law shall be
terminated within five 5) years effective date of this
Ordinance", which was June I, 1964; that he would prefer
to see the Conditional Use Permit granted to the limitation
date of the Ordinance,

City Attorney Flandrick stated that If the Council were to
approve Councilman McCaron's motion; that Planning Director
Chivetta and he would work out some proposed conditions and
check out the time to see exactly what the date would be and
report this back to Council as a part of the resolution.
Mayor Morehead stated that It was a fact that Mr. Baker
was In violation; that Mr. Baker had made Improvements
on the authority or advice of certain people; that these
people had been wrong; that Mr. Baker had been unable to
obtain a building permit; that Mr, Baker had violated his
nonconforming right by enlarging his usage; that he did
not feel that this violation should be corrected overnight;
that Mr. Baker should have some time to correct this
violation, however this violation could not stand from
here on out; that he agreed with Councilman McCaron.

against the unsightliness of some of the property in
Baldwin Park; that the Council was interested in developing

Planning Director Chivetta stated that the Board of Zoning
Adjustments recommended a total refund for a Zone Variance
filing fee, Case No. ZV-183, Receipt No. 4537, as a variance
was not required.

Planning Director Chivetta stated that the single family
structure that fronts on Francisquito, plus the two 2)
properties fronting on Maine should not be a part of the
reclassification.
Councilwoman Gregory stated she felt the Francisqulto
frontage was to have been abated as a general clean up#
Mayor Morehead stated that the property on the corner
had been abated; that It had become a nuisance before
It was developed; that It was still not developed; that
it was still R..1; that it would remain R-l until development
had taken place; that this property and the property
adjacent to the corner should be left out of the rezoning..
Councilman McCaron stated that concerning the two properties
that had been abated; that dedication for street widening
should be obtained for these properties.
Mayor Morehead stated that at the time development took
place dedication would be obtained.
City Attorney Flandrick stated that proposed Ordinance
No. 472 could be amended to delete the other properties;
that a separate ordinance could be prepared for the
other properties for second reading as if and when
development takes place.
Councilman McCaron stated that perhaps changing the zone
for the other properties should be considered before
development takes place providing that dedication could
be obtained.
City Attorney Flandrick stated that if Council wished to
amend Ordinance No. 472 in this way; that they would check
with the applicant and advise him of the Council's proposed
action.

the installation of the Baldwin Park Jaycees. He stated
that he had Invited the President to keep in touch with

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Nordby stated that he had
made distibution of the first quarterly financial report
of the City for the fiscal year 1967-68; that prior to
the installation of the City's electronic data processing
equipment the report would have required about three 3)
days; that the current report had been produced in about
three 3) hours; that this meant a savings in money; that
the system had been worked out now; that the next report
would take about one 1) hour; that the preliminary work
on the bills Council had approved this evening was about
the same, but that the preparation of the claims and
demands, bills and vouchers prior to this time had taken
about a day and a half; that the ones Council had approved
this evening had taken about ten 10) minutes; that this
was a fantastic piece of machinery; that quite soon they
would like to invite members of the Council to watch the
machine operate when they have a report to run off.
Chief Administrative Officer Nordby stated that he felt
that the City of Baldwin Park had been instrumental in
southern California in stirring up some action on the
cigarette tax allocation; that they were not completely
satisfied with What the League of California Cities had
done in San Francisco, however the League did recognize
that S.B. 556 was very inequitable; that he did not feel
that they had made any positive or constructive recommen-
ations; that they were recommending to the State Legislature,
which would begin in January, some extensive modification
of the cigarette tax allocation; that he hoped this would at
least double the amount originally allocated to Baldwin
Park, which would bring the amount up over $100,000.00,
Mayor Morehead stated that Assemblyman Briggs from the 35th
District had called a meeting Friday night in Placentia;
that Mrs. Duncan had communicated with the City Manager's
office of Placentia and had received an invitation to
attend; that they had attended; that several cities in
attendance had felt that they had a good formula to be
presented to the League or the Legislature; that Assemblyman
Briggs had agreed that the inequities of the cigarette tax
allocation should be corrected,

City Attorney Flandrick stated that this afternoon the
City had been served with a Municipal Court action against
the City; that it was a contract claim against the City;
that no amounts were stated; that in his opinion it was
not a valid claim; that it was by Mr, Richardson, a
contractor for Mr, Henry Levin; that he would like author-
ization from the Council to appear and defend the action;
that the insurance company would not undertake defense,

Regular Meeting of the Baldwin Park City Council
Planning Director Chivetta stated that Reverend Porter, of
the Minister's Association of Baldwin Park, was utilizing
his church, the First Presbyterian Church, located on
Stewart and Lab Angeles, as the center of choice for a
Goals and Objective Comittee to be conducted in the
cc unity in cooperation with the City of Los Angeles'
Goals program; that citizens were welcome to attend
and present their views at subsequent meetings; that
the next meeting would be held October 23, 1967.

Planning Director Chivetta stated that Mr. Crafts would
be allowed to have trucks pull in for servicing inside
of an enclosed building; that W. Crafts would not be
allowed to park trucks there; that this would require
a Conditional Use Permit; that only the uses that were
listed would have to comply within a specified time;
that this would be signs only.
