The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Mr. E. A. Cannady, Manager of the Chamber of Commerce led the salute to the flag. There were no objections, the motion carried and was so ordered. 00- City Clerk Balkus presented an application for a Temporary Use Permit from the Baldwin Park Chamber of Commerce for a parade to be held January 27, 1968. She stated that the applicant requested that the fee be waived. COUNCILMAN ADAIR MOVED THAT THE TEMPORARY USE PERMIT BE APPROVED AND THAT THE FEE BE WAIVED. COUNCILMAN CRITES SECONDED. There were no objections, the motion carried and was so ordered. 00- City Clerk Balkus presented a resolution from the Board of Directors of the Baldwin Park Chatter of Coomerce adopted December 12, 1967, endorsing and recommending acceptance of the proposed bond issue for the Baldwin Park Unified School District to be placed before the electorate of this community in 1968. At the request of the City Council, City Clerk Backus read the resolution in full. Copy In official files). 00- Chief Administrative Officer Nordby stated that in the January Issue of the Western City magazine the City wou l d have an article on its Data Processing system; that the Editor, Murray Brown had requested the City to submit the article; that this would give the City a lot of publicity as the magazine was distributed in eleven II) or twelve 12) western states. 00- City Engineer French reviewed his report on the initiation of Short Form 1911 Acts; 68-S-I for sidewalk and drive approach on the northwest side of Baldwin Park Boulevard between Kenmore Avenue and Merced Avenue; and 68-S-2 for sidewalk and drive approach on the northwest side of Baldwin Park Boulevard between Corak Street and Foster Avenue. City Engineer French reviewed his report on the bid opening held December 19, 1967, for demolition of structures and/or yard clean up for Public Nuisance Case Nos. 67-14-56, 67-14-58, 67-1+1-63, 67-14.45 and 67-14-66. He stated that he recommended that an award of contract be made for proposals 1, 2, 3 and 4 to David C. Osti, 923 South 10th Avenue, Arcadia, Calif- ornia, in accordance with their low bid and that the Mayor and City Clerk be authorized to sign the contract. COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL ACCEPT THE RECOMMENDATION OF THE CITY ENGINEER AND THAT AN AWARD OF CONTRACT BE MADE TO DAVID C. OSTI, 923 SOUTH IOTH AVENUE, ARCADIA, CALIFORNIA, IN ACCORDANCE WITH THEIR LOIN BID FOR PROPOSALS 1, 2, 3 AND 4 AND THAT THE MAYOR ANC CITY CLERK BE AUTHOR I ZED TO SIGN THE CONTRACT. There were no objections, the motion carried and was so ordered. 0O- City Engineer French reviewed his report on the bid opening held December 27, 1967, for construction of curbs and gutters at various locations throughout the City. He stated that he recommended that an award of contract be made for proposal No. I to Gilbert Grigolla Construction, 525 West Paramount Avenue, Azusa,, California, in accordance with their low bid and that the Mayor and City Clerk be authorized to sign the contract. Councilmen McCaron asked if the recommendation was for award of contract for a period of one I) year or six 6) months. City Engineer French stated that the recommendation was for one 1) year as their was no difference In Mr. Grigolle's bid for six 6) months or one I) year. He stated that Mr, Grigolla's work had been a little slow; that the work was good; that the new contract had a time limit written Into it; that he did not feel this would be a problem. City Engineer French stated that the Fire Department report stated that the property was a fire hazard; that the structure was occupied; that no Inside inspection had been made; that it was being used as an R-1 residence in an M-l zone. TESTIMONY IN BEHALF WAS GIVEN by: Mr. Andrew J. Rogers, 14539 East Clark, Baldwin Park, stated that Mr. Ellsworth had been buying the, property from him on agreement for the last three or four years, however he held the deed to the property; that Mr. Ellsworth's pay record was excellent; that he held the biggest equity in the property; that after receiving a letter from Mr. Palmer he had cOntaoted:Mr".r.EI t rth and had asked him to start cleaning up and improving the property; that Mfr. Ellsworth had started to clean up the property; that Mr. Ellsworth was not in good health; that he had a heart condlti n and was elderly; that Mr. Ellsworth tried to make a living at circus and carnival rides; that Mr. Ellsworth had moved truck and trailer loads of items off of the property; that the place was now looking quite a bit better; that he was asking Council to allow enough time to move the rest of it and time to clean up and paint the house. Councilman McCaron asked If they would continue to use the house as a residence. Rogers, 14539 East Clark, Baldwin Park, stated that there were two 2) lots; that both lots were about 40 x 75 feet; that the lot that had a small shed at the rear was where most of the items were; that It was a separate lot; that there was a separate deed, tax bill, etc. for the lot; that they were intending to continue to use the house as a residence, which was on the other lot. Councilman McCaron asked If the address, 4246 North Park Place, Included both lots, wherein City Engineer French stated, yes; that Mr. Ellsworth had storage on many more lots than just these two; that if these other lots were not cleaned up very soon, the City would be Initiating action on the other lots in the area also. Mr. Andrew J. Rogers, 14539 East Clark, Baldwin Park, stated that they were requesting ninety 90) days time because of Mr. Ellsworth's health, age, the fact that he must make a living meantime and that he was moving the Items out of state entirely; that it was a distance of approximately 700 miles round trip. Mr. W. T. Ellsworth, 4246 Park Place, Baldwin Park, stated that he was trying to move out everything as fast as he could to Arizona; that this took money and time; that If he were allowed ninety 90) days he could move it all out and clean up the place. As there was no one else In the audience desiring to speak either in behalf of or In opposition to this Short Form 1911 Act, Mayor Morehead declared the public hearing closed. RESOLUTION NO. 68-5 FINDING AND DETERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 67*-N-77) City Engineer French stated that In Section 2 of Resolution No. 68-5 a time limit of 90 days" should be inserted; that ninety 90) days would be a reasonable. length of time as long as consistent improvement was shown. NANCY DOUGLAS, Park, stated that her father owned the property; that 14482 E. Merced, she was representing him; that she had spoken with him B.Pk. today concerning the property; that the owner had not been able to determine whether one of the buildings would be more economical to demolish and move away or to have it moved away at once all in one piece; that the owner would first like to move away the easily portable trash and demolish the shed, however one of the sheds was a garage and he would like to bring this up to standard if at all possible; that he probably could remove the portable trash and demolish the shed within forty-five 45) days, however the house and the restoration of the buildings that he would like to save would probably take ninety 90) days; that he had-been III and had extreme financial pressures at the moment. Councilman McCaron asked if there was commercial activity on the property, wherein City Engineer French stated, yes; that this was a nonconforming use. As there was no one else in the audience desiring to PUBLIC HEARING speak either in behalf of or in opposition to this DECLARED CLOSED Short Form 1911 Act, Mayor Morehead declared the public 67-N-78) hearing closed,. Councilman McCaron asked if the structures that the owner wished to save could be rehabilitated, wherein City Engineer French stated that they did not intend to rehabilitate the house; that they were trying to determine whether they wished to knock down the house and haul it away or haul it away without knocking it down; that there was a shed that they wished to reha- bilitate as a garage; that he felt this could be done; that it was not a big job.
