REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue
In accordance with Section 2703 of the Municipal Code
the City Council met in open meeting at 7:00 p.m. In
the Conference Room for an informal session with the
staff to be informed on regular agenda items.
The City Council of the City of Baldwin Park met In
regular session at the above place at 7:30 p.m.
Councilman McCaron led the salute to the flag.

City Attorney Flandrick stated that approximately three
3) months ago the Supreme Court ruled that the oath
currently in use was Invalid for a number of different
reasons; that In his opinion the oath could not be admin-
istered If an employee or officer objected.
Mayor Morehead stated he would like Council to establish
a policy regarding administering the oath; that he would
support the taking of the oath.
Councilwoman Gregory stated she would support the contin-
uation of administering the oath.
Councilman Adair stated he also concurred.
Councilman McCaron stated that the Council might find it-
self in an embarrassing position sometime; that he felt
It was unfortunate that this had occurred; that It had
been a custom and he felt a very good one.
Councilman Crites stated that he felt it should be contin-
ued; that he was In favor Of It.
Mayor Morehead stated that In the event someone who would
normally take the oath refuses to do so then whatever
would be required could be administered at that time.
MAYOR MOREHEAD MOVED THAT THE COUNCIL CONTINUE THE OATH
AS THEY KNOW IT UNTIL SUCH TIME THAT SOMEONE PROTESTS
OR OBJECTS. COUNCILMAN ADAIR SECONDED. Roll Cali.

City Clerk Backus administered the oath of office to
Reserve Police Officers Max Eugene Darling, Stephen
Brent Lockage and Gordon LeRoy Williams; and to Patrolman
Janes Wesley Kuntz. Mayor Morehead extended his congrat-
ulations to all,

COUNCILWOMAN GREGORY MOVED THAT THE MINUTES OF JANUARY 17,
1968 BE APPROVED. COUNCILMAN ADAIR SECONDED. There were
no objections, the motion carried and was so ordered,

RESOLUTION NO. 68-45 ALLOWING CLAIMS
AND DEMANDS AGAINST THE CITY OF BALDW I N
PARK
COUNCILMAN ADAIR MOVED THAT RESOLUTION NO. 68.45 BE
ADOPTED AND FURTHER-READING'BE WAIVED. COUNCILMAN
CRITES SECONDED. Roll Call. There were no objections,
the motion carried and was so ordered.
Commander Jack Roath of VFW Post 3197 Baldwin Park
stated that he and some of his fellow officers and
comrades were present to express gratitude to Mayor
Morehead and the Employees Association of Baldwin Park
for their help and assistance on the annual VFW Christ-
mas dinner party for hospitalized veterans; that their
Christmas project was to bring some of the hospitalized
veterans who were very lonely at Christmas time and away
from home to their post and furnish them with Christmas
dinner, entertainment and gifts; that the Baldwin Park
Employees Association had furnished them with the trans-
portation for the veterans from the Long Beach Veterans
Hospital to their Post and back again; that 1.t was
due In great part to their help that it was a success.
He presented a certificate of appreciation to Mayor
Morehead and to Mr. Lyman Baker, President of the
Employees Association.
Mayor Morehead stated that Mrs. Nadja Cole, Past Pres-
ident of the Employees Association was present and that
she had been President at the time this event occurred.

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Nordby stated that for the
life of the City of Baldwin Park It had been served by
the Los Angeles County Fire Department; that Robert
Parsons had been Division Chief during all of the time
that he had been with the City; that recently Chief
Parsons had been transferred to the outlying areas of
the County which Included everything from Catalina
Island up to Lancaster; that he had enjoyed working
with him'and felt sure that members of the Council felt
the same. He introduced the new Division Chief, Stan
Barlow who was In the audience. Mayor Morehead wel-
comed Mr. Barlow.

Mayor Morehead stated that at the last regular Council
meeting of January 17, 1968, Council had authorized
Chief Administrative Officer Nordby and himself to
appear before the Executive Board at the League of
California Cities meeting on January 25 and 26 regard-
ing the distribution of the 30 cigarette tax; that at
this hearing the Board had voted 24 to I to support
the-50-50 distribution; that from all indications a
recornendation from the League of California Cities
was just about all the Legislature was waiting for and
also the Governor; that at this time It looked very good
for cities such as Baldwin Park that have a low Income
tax base that the formula would be changed; that it was
estimated If the new formula was approved of by the State
Legislature that our City would receive approximately
$127,000.00 revenue.

City Attorney Flandrick stated that proposed Ordinance
No. 513 would modify slightly the existing provisions of
the Municipal Code concerning the abatement of public
nuisances; that these particular provisions would spell
out the procedure for abatement of motor vehicles or parts
thereof which were abandoned, disabled and inoperative
before the same became a public nuisance.

City Attorney Flandrick stated that concerning this same
ordinance there were several cases pending that would
Involve prospective public nuisances Involving motor
vehicles; that he would recommend strongly to the Council
that they also entertain this ordinance as an urgency
ordinance and adopt it this evening so it would become
effective Immediately; that this could be accomplished
by separate Ordinance No, 514.

City Attorney Flandrick stated the purpose of the pro-
posed service agreement between the City Of Baldwin Park
and Title Insurance and Trust Company was to allow the
City to take advantage of their reduced rate for supply-
ing the City with condemnation title reports, lot book
reports for public nuisance cases and allied services;
that Title Insurance and Trust Company dealt only in
this type of service in addition to issuing land title
policies; that In order to give to a public agency the
reduced rate for this type of service a written service
agreement was necessary in order to satisfy the Insurance
Commissioner; that the agreement merely stated that if
a title report was ordered it would be In accordance
with the provisions of the agreement; that it would not
preclude ordering from another source; that he recom-
mended approval of the service agreement.
COUNCILMAN CRITES MOVED THAT THE CITY COUNCIL ENTER INTO
THIS AGREEMENT WITH TITLE INSURANCE AND TRUST CONPAIY
AND AUTHORIZE THE MAYOR AND CITY CLERK TO SIGN ON BEHALF
OF THE CITY. COUNCILMAN ADAIR SECONDED. Roll Call.
There were no objections, the motion carried and was so
ordered.
Councilman McCaron Inquired If this agreement had a
cancellation clause, wherein City Attorney Flandrick
stated that he did not believe there was; that there
was a cancellation clause relating to an individual
order as made, but not as to the service agreement It-
self.
COUNCILMAN MCCARON MOVED THAT A CANCELLATION CLAUSE BE
INCLUDED IN THIS AGREEMENT.
City Attorney Flandrick stated that if this was accept-
able to Council the agreement would be amended as sub-
mitted by Title Insurance and Trust Company to add as
Paragraph II a cancellation clause upon the giving of
ten 10) days written notice by either the City or Title
Insurance and Trust Company.

Chief Administrative Officer Nordby reviewed his report
concerning the appointment of a Broker of Record for
the City's health and accident Insurance. He stated
that Mr. William Ebaugh had been appointed three or
four years ago; that since that time Mr. Ebaugh had
moved from Baldwin Park; that this had presented prob-
lems in gaining assistance in filing claims; that he
recommended that the part of the agreement that the City
had with Mr. Ebaugh concerning five 5) days written notice
be exercised and that the agreement be cancelled; that he
felt the City should have a local person, someone easily
accessable who understood the business; that the City had
had experience with Mr. Elkin Baer of Baer Insurance Agency
concerning other insurance coverage of the City;

that Mr. Baer had always given the City good service;
that he maintained an office in Baldwin Park and his
interests were here; that he further recommended that
Council appoint Mr. Elvin Baer as the Broker of Record
for the City's health and accident insurance.
COUNCILMAN ADAIR MOVED THAT THE RECOMMENDATION OF CHIEF
ADMINISTRATIVE OFFICER NORDBY BE ACCEPTED. COUNCILMAN
CRITES SECONDED. Roll Call. There were no objections,
the motion carried and was so ordered.

Chief Administrative Officer Nordby stated that in order
to keep the costs down for the construction of the Morgan
Park Community Building the architect had designed around
the sidewalks and approaches around the structure to try
to preserve some of the old walkway; that they believed
in erecting a building of this kind, which would cost ap-
proximately $125,000.00, that they should replace the en-
tire walk which consists of 1,950 square ft.; that the
cost quoted by the contractor was $1,425.00; that the
sidewalks would be Installed near the time of completion
of the building, which at this point was estimated to be
May 15, 1968; that the architect had recommended accept-
ance of the quotation of Hassett Construction Company;
that the City Engineer and he both recommended this change
order.

CHANGErORDER FOR $1,425.00 FOR THE INSTALLATION OF NEW
SIDEWALK AND REMOVAL OF THE'OLD SIDEWALK. COUNCILMAN

Chief Administrative officer Nordby stated that Chief of
Police Adams had forwarded to him for the City a check
for $2,053.00, which represented the 1967 reimbursement
from.the California Peace Officers Training Fund; also,
that the*Ordinente Which imposed areal property transfer
tax, effective. January 1, 1968 had already brought in over
$600.00 to the City.

amendments as suggested at the regular meeting of
Council on January 17, 1968.

Regular Meeting of the Baldwin Park City Council
Mayor Morehead cuaaented concerning AZC-31; stating
that last summer when the Planning Commission began
study on AZC-31 rumors had circulated causing many
people to become concerned and retain counsel; that
Council had only been trying to upgrade M-i zoning;
that with everyone working together things had been
worked out very realistically. He commended Planning
Director Chivetta for the professional manner In which
he handled the matter.
TESTIMONY WAS GIVEN by:
Mr, Arthur Sandow, representing Prudential Savings
and Loan, 526 West Las Tunas, San Gabriel, thanked
Mayor Morehead and the Council for their patience in
considering the case. He stated that Planning Director
Chtvetta and he had been in contact concerning the
conditions of approval; that he did not know how the
resolution would read; that this was entirely up to
Council; that he would like to point out that his
projection of time for the sales program for the Palm
Villa was eighteen 18) months,
Planning Director Chivetta stated that the staff
recommended that one sign be permitted not to exceed
240 square ft, of sign face area and 23 ft. In height;
that the sign comply with all the structural codes of
the City; that the sign would be located on the property
in accordance with Exhibit A" of sign number one which
was submitted originally; that the sign would not contain
any blinking, rotating, flashing lights, physically
animated parts, flags, etc; that Prudential Savings and
Loan Association be required to post a cash deposit in
the sum of $200.00 for the removal, of the sign within
one year or eighteen months.

the Award of Public Nuisance Contract would be held over.

City Engineer French reviewed his report on the bid
opening held November 8, 1967, for a Sanivac Truck.
He stated that this was a budgeted Item; that the
budgeted amount was $25,000.00; that the bid had
come in in excess of the budgeted amount.
Chief Administrative Officer Nordby stated that when
the bids were received the equipment which would
best serve the City was quoted at $29,992.20; that
the budgeted amount had been $25,000.00; that this
purchase could probably be handled from the existing
budget without the consideration of additional sources
of revenue; that the City could probably anticipate
another $25,000. or $30,000 for the remainder of the
fiscal year from cigarette tax; that the City had
accrued prior to December 31, 1967, $45,000. In the
black; that this would be an all purpose unit; that
It would be valuable In the cleaning of the City's
storm drains and catch basins; that the estimated
life of the vehicle would be approximately twenty t20)
years; that he concurred with City Engineer French in
recommending the purchase.

Planning Director Chivetta stated that in order to
complete a comprehensive study the Planning Commission
and the staff recommended the adoption of an urgency
ordinance declaring a 90 day moratorium which would
prevent the filing and/or approval of any application
for any permit to allow the construction and operation
of residential uses within the area bounded on the east
by Maine Avenue, on the West by La Rica Avenue, on the
North by Clark Street, and on the South by Ramona Bou-
levard.
