In accordance with Section 2703 of the Municipal Code the City Council met In open meeting at 7:00 p.m. In the Conference Room for an informal session with the staff to be informed on regular agenda items, The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Crates led the salute to the flag. There were no objections, the motion carried and was so ordered, nn- 1968 04 17 CC MIN ×P% ˜ö0003'758 Regular Meeting of the Baldwin Park City Council Apell 17, 1966 Page 2 As there were no objections, Mayor pro tem Morehead UNFINISHED stated the unfinished business regarding an amendment BUSINESS RE to the Municipal Code relating to fireworks permits AKNDMENiT To would be considered at this time. MUN. CODE RELA_ TING TO FIREWORKS PERMITS CONS t DEBI T' AT THIS TIME Chief Administrative Officer Nordby stated that the Code presently read that permits for the sale of fireworks each year was limited to eleven II) organizations; that these were described in the Code as non profit, patriotic, ete.; that because of the additional appli- cations filed this year an amendment to Section 3157 of the Code had been prepared and submitted to Council removing the limitation of eleven 11) permits; that because applications had to be filed before May 1, 1968 this matter would require an urgency ordinance; that all 14 of the applications filed to date qualified under the Code. City Clerk Balkus stated that all of last year's appli- cants had submitted an application this year. Mayor pro tem Morehead stated that when it appeared there would be more than eleven 11) applications filed this year he had become concerned as to what might be done; that all of last years applications were from worthy organizations, as were the three 3) additional appli- cations filed this year; that they all qualified accord- Ing to the City ordinance; that at one time he had been opposed to raising the number of applications; that four or five years ago the limit had been six; that when t was raised to ten he had been opposed; that he had felt at that time that too many applicants would keep any one from making any money; that if ail applications were accepted that were filed between now and May 1, 1968, the deadline date, possibly some fifteen 15) or twenty 20) organizations might file an application that would qualify; that he wondered where this put the organizations that were trying to make a few dollars; that he did not feel he had the right to tell other worthy organizations that they could not put up a stand; that for the year of 1968 he would consider lifting the present restriction of eleven it) permits and let each organization stand on its own. Councilwoman Gregory stated that she agreed with Mayor pro tem Morehead to some extent; that she knew that all organizations were worthy; that she felt that the concept of the ordinance was to be more protective to the organs- zations that had participated in the past; that at the time six 6) were allowed they might have made about $1500.; that then the number of permits had been increased and possibly they how make $800. or less; that she was reticent about lifting the limit at this late date as mast organizations budgeted for the year; that the veteran organizations did quite a bit in the City, not just for the needy within their organizations, but also for retarded children and sending young men and women In the high schools to boys and girls state; that their philanthropies were quite extensive; that she felt they would be pulling the rug from under these people by disrupting their year's budget; that she thought the organizations could get together durtAg the next year and work this out, knowing full well they would not be making as much money; that she would go along with lifting the limit of applications after this year. Continued) 1968 04 17 CC MIN ×P% ˜ö 000,3'759 Regular Meeting of the Baldwin Park City Council April 17, 1960 Page 3 Mayor McCaron stated he would like some idea what far reaching effect the added applications would have on the applicants that were allowed to sell at the present time; that to know the effect on the budget of these organizations they would have to have more Information; that he doubted the addition of three 3) applications would make much difference; that he did feel that this matter should be approached in a different manner If the results are such that the various organizations could not live with It; that he did not feel it would hurt to let them see exactly what the results would be from re- moving the limitation on the number of applications this year; that the organizations would then be in a better position to see what damage had been done and they would realize that the City was only concerned with the best possible results that could be obtained from this source of revenue. Councilman Crites stated when the few of supply and demand took over, the organizations would not go so far as to have so many fireworks that they ended up selling to each other; that he felt the pressure would cause the matter to eventually take care of Its self; that he would be In favor of removing the restrictions for this year to see what would happen. Councilman Adair stated he agreed with Councilman Crites; that he still believed in free enterprise. ORDINANCE NO. 518 AMENDING SECTION ORD. NO. 318 3157 OF THE BALDWIN PARK MUNICIPAL AMEND. SEC. 3157 CODE, RELATING TO FIREWORKS OF B,P.M,C,, RELATING TO FIREWORKS COUNCILMAN CRITES MOVED THAT FURTHER READING OF ORDINANCE MOTION MADE NO. 518 BE WAIVED AND THAT IT BE ADOPTED. Councilman Crites withdrew his motion to allow testimony MOTION WITHDRAWN from the audience. Mr. Edward J. Watson, Commander of American Legion Post EDWARD J. WATSON, 241 In Baldwin Park, stated that over the last few years CORIANDER, the pie had been getting very thin; that they use to make AMERICAN LEGION some money selling fireworks; that It was bad last year; POST 241, B.PK. that they had had to cut out a couple of the programs they were supporting; that every year they send a boy from Sierra Vista High School and one from Baldwin Park High School to boys state and girls to girls state; that they support Junior Forestry; that their taxes had gone from 164.96 in 1960 to 11,070.37 today; that If too many applications were allowed for fireworks stands there would not be enough for everybody; that they also gave a Christmas party for needy children; that they help out Cerebral Palsy victims; that they tried not to turn away anyone who was really dean and out. Mayor pro tea Morehead Informed Mr. Watson that maybe some time In the near future his organization might be asked for some counseling on how this matter should be handled in order to assist other organizations that were worthy. Mr. Larry Brown from the Optimist Club stated that he LARRY BROWN FROM also had belonged to the American Legion for twenty-.one OPTIMIST CLUB 21) years; that the Optimist Club was one of the extra applications that had been filed this year; that In pre- vious years the Optimist Club had had a stand In Baldwin Continued) 1968 04 17 CC MIN ×P% ˜ö0003'760 Regular Meeting of the Baldwin Park City Council April 17, 1968 Page 4 Park; that they were doing good too, the same as. the American Legion, which he was all for; that they had different areas of charity; that Independence Day was for every American, not just for veterans; that he felt they were just as much entitled to make extra funds selling fireworks as anyone else; that ail organiza- tions would bring business from out of Baldwin Park; that at their stand probably of the business would come from La Puente, West Covina, Covina and El lllonte; that it was true if they did not make any money they would not take the stand next year; that they had had a stand when six 6) stands were allowed and they had made approximately $1500, to $1600. for the year; that when there had been eleven 11) stands allowed they had made approximately $1500. to $1600. a year; that chances were when there were twenty 20) stands they would, still make $1500. to $1600. a year. Mr, Thomas Dickens, 4925 La Rica, Baldwin Park, bar of MR. THOMAS the American Legion Post, stated that If an organization DICKENS, 4925 made $800. they were very fortunate; that It took 12 to LA RICA, B.PK., 14 hours a day to get the material in and out; that it MEMBER OF THE was pretty rough putting In 7 or 8 days to make $800.; AMERICAN LEGION that they were a tax paying charitable organization and POST they took care of many things; that if they let every organization that came In undercut a tax paying charita- ble organization they were doing the citizens of Baldwin Park an injustice. Mr. E. A, Cannady, Manager of the Baldwin Park Chamber E. A. CANNADY, of Commerce, stated that he worked in close harmony with MGR. B.PK. CHAMBE many of the organizations in town; that the question of OF COMMERCE discriminating one against the other had came up before; that he concurred that the limitation on the number of fireworks permits to be issued should be removed; that competition in organizations was healthy the same as in business. Councilwoman Gregory stated that sometimes the producer of fireworks wilt offer a sum of money to an organization to use their name and man the booth with hired personnel or from their own company; that in this case many times the bulk of the proceeds would go to the company rather than the organization; that possibly Council might consider identification cards; that she was not against removing the limitation to allow all organizations to come in, but by allowing It to happen this year they would be hurting the organizations which had already budgeted. City Attorney Flandrick stated that the ordinance required that no one other than a licensed organization could operate the stand; that he felt that Councilwoman Gregory's point was that this was difficult to enforce, Councilman Crites stated that the sister organization of the Legion had been included last year and there had been no objection at that time. Mr. Summers, Vice Cctieargander, American Legion Post 241, MR. SUIYWIERS, VICE Baldwin Park, stated that he had been a resident since COMMANDER, AMER~ 1927; that the American Legion had had a fireworks stand ICAN LEGION POST in this town back In the 301s; that he understood that 241 other cities allowed only the veteran organizstibns to sell fireworks. Mayor McCaron stated that Mr. Duran had stated that they were using the two story structure for storage; that he wondered If Mr. Duran was protesting against the building being demolished. City Engineer French stated that It was not considered that anyone was living In the structure; that the building was In violation of the Zoning and Building Code; that it was very dilapidated and In a serious stated of disrepair; that It was a hazard whether It was occupied or not and he rec- oerrnended demolition. Mayor pro tem Morehead asked Mr. Duran If he understood that the structures would be demolished if the Resolution were adopted, wherein Mr. Duran stated that it could be reinforced in the east corner, Mayor pro tem Morehead stated that the hearing was to determine whether the two story structure should be demolished, whether the front property should be brought up to building regulations and to remove all weeds, trash and debris. City Attorney Flandrick asked City Engineer French If It would be possible to reconstruct the shed so that it would be in compliance with the building regulations, wherein City Engineer French stated that In his opinion It would not be economically feasible. COUNCILMAN ADAIR MOVED THAT RESOLUTION N0. 68-02 BE ADOPTED RES. NO. 68•.82 AND THAT FURTHER READING BE WAIVED. COUNCILWQAAN GREGORY ADOPTED SECONDED. W6 It was the time and place fixed for a public hearing on PUBLIC HEARING 67-N-42, to hear objections or protests to Report of Work of Chief Administrative Officer regarding amount 67-N-42 of assessment for 3515 Patritti Avenue, 3515 Patritti Ave. COST $150.00 TESTIMONY WAS GIVEN by: TESTIMONY Mr. L. L. Baxter, 1321 Siiverbirch Place, West Covina, MR, L. L. BAXTER, stated that he had contacted the Police Department and 1321 Siiverbirch the Motor Vehicle Department concerning what was to be Place, West Covina done regarding removal of the motor vehicle; that he had received no aid either place; that he had contacted a couple of junk dealers, but without the pink slip was unable to do anything; that he told the Police Department he intended to push the automobile into the street and that they would then do something about It; that the Police Department had told him not to do that; that as far as the removal of weeds and debris someone had disked the property, however the weeds were not removed; that if there was a contract awarded and money owed he would be willing to pay a portion of It; that he felt a total of $150.00 was out of proportion. City Engineer French stated that he had photographs of the property after completion; that the property was disked; that this was the method of weed abatement; that the property was boarded up; that this was the $100.00-- cost; that the $50.00 administrative cost was an estab- lished cost to reimburse the City for the public hearings, the title reports and the preparation of the resolutions required; that this was the second hearing on the property; that this was the fourth resolution typed and sent by certified mail; that he did not feel that the $50,00 administrative cost was at all unreasonable; that they had received bids on the property twice; that the $100. was the lowest bid In both instances. REVIEWED concerning legislation pending before the State Legislature, REPORT RE PENDING He stated that two Items were taken up at the last meeting LEGISLATION AS 11 of the League of California Cities at the Los Angeles County AND AB 101 Division level, AS II and AS 101; that the League endorsed AS 101, which would permit a levy of 1/2# sales tax in the Counties with a population over one million; that at the present time Los Angeles and San Diego County were the only two; that currently this tax would be levied by 60% of voter approval; that AS 11, which was a companion bill to AS 101, which the league opposed, would lower that approval from 60% to a simple majority; that amendments to the Brown Act, AS 202, would extend the provisions of the Brown Act to AS 202 Include all advisory and ad hoc committees of any county or city; that he felt this would make the use of citizens committees quite impossible because of the procedure necessary to call and conduct a meeting; that generally there were no final actions taken by these committees; that he felt this bill would be totally unnecessary; that if there were no dissenting comments from the Council he would express the City's opinion to the City's representatives In Sacramento; that AS 678 was the Public Employment Relations Bill; that the AS 678 bill would subject to negotiations items which were included In the CItyts Personnel Rules and Regulations and were handled on the local level; that he did not feel any State Legislation was needed to accomplish this; that he had checked with some of the other cities and they too were opposed to this 8111; that the phrase he had quoted in his written report Indicated that a walk out Continued) 1968 04 17 CC MIN ×P% ˜öRegular Meeting of the Baldwin Park City Council April 17, 1968 Page 10 or a work stoppage would be possible under the language in the Bill; that certain things would have to come about within a period of thirty 1301 days following a fact finderts recommendation; that the fact finder would be appointed by a labor relations board of public employees, which would also be created by this bill. City Attorney Flandrick stated that he agreed with Nordby's analysis; that It was another area where cities, at least 956 of the time, had set up there oven civil service or personnel rules and that there had been no particular problem; that in his opinion this was just another inter- ference on the part of the State with local government. Chief Administrative Officer Nordby stated that he felt there was a good relationship between the Administrative staff, the City Council and the Employees Association; that many of the benefits now enjoyed by the employees had been initiated on the administrative level; that they also kept an ear open to employees suggestions and recom- mendations; that AB 684, Cigarette Tax Bill, had passed the Revenue and Taxation Committee with one dis- senting vote; that it had been referred to the Assembly Ways and Means Committee; that it would then go back to the Assembly for a vote and then on to the Senate; that he felt the City should continue to push for passage just in case something happened on route. Chief Administrative Officer Nordby reviewed his report relating C.A.O. REVIEWED REPORT RE POLICY to'the policy of expenses of Boards and Commission Members. He stated that his written report did not express his complete OF EXPENSES OF thoughts on the matter; that after he had submitted the 1968- BOARDS AND 69 Budget to the Council, which he proposed to do on the 1st COMMISSIONS of May, they could get into more specific matters of policy relating to expenses; that he would extend his thinking on this matter at budget conferences. Mayor pro tom Morehead stated that every time that Council had considered a closed session it had been on the advise of the City Attorney; that he felt that the Brown Act could probably be improved, however he would not go along with the restrictions that AB 202 would impose; that if the proposed amendment were passed the Chief Administrative Officer, City Engineer and the Chief of Police who were the Traffic Safety Committee could not get together unless it were a scheduled meeting or advertised in the paper 24 hours ahead of time; that at the present time the Chairman of the Park Commission could call a meeting at any time; that if the amendment became law the Commission would have to set regular meeting dates and not meet outside those dates as a quorum unless they went through the same procedure as the City Council; that he did not feet the proposed amendment should apply to any group unless they were a legislative body. 00- City Clerk Balkus stated the Atrusa Club, a women's service DONATION FROM organization, from Covina, West Covina had donated $25.00 ALTRUSA CLUB to the City for the development fo the Big Dalton Wash Park; $25.00 FOR that if Council accepted the donation the Altrusa Club would DEVELOPMENT OF like a small permanent marker in the park.
