In accordance with Section 2703 of the Municipal Code
the City Council met in open meeting at 7:00 p.m. In
the Conference Room for an informal session with the
staff to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

Under Oral Communications, Mr. Ned Fitzpatrick, 4609 314 NED FITZPATRICK,
Merced, Baldwin Park, stated that he was a Steam Engineer 4605 314 Merced, B.Pk.
for Hoilytex Carpet Mills, City of Industry; that since
he had bought this property in order to be close to his
work he had had nothing but opposition and obstacles to
making any improvement; that It was on an undedicated
unimproved street; with no curbs or sewers; that as far
as he knew the water came from the back of the lots;
that there was an alley in back of the property; that
there was a fence on three 3) sides of the property;
that he worked nights and his wife was home alone; that
he had thought he would put up a five 5) ft. chain link
fence In the front of the property and that was the first
he had known there would be so many obstacles; that he was
told he could only put up a three 3) ft, fence; that he
had put in a three 3) ft. chain link fence; that on one
side of the house, which was only four 4) ft. off of the
property line there was a garage that was only nine 9)
ft, wide at the outside; that with a car in the garage
it was Impossible to open the car doers; that he proposed
to close off the small garage and build a two car garage
n the back; that he had applied for permits and right
away there was opposition; that in this class of property
he could not conform to the Code; that It was too expensive,
but that he would like to make a place that was nice enough
to live in; that anyone was welcome to look at the place and
see the difference he had made n the two months he had been
there; that the house had been empty for three years; that
he had bought at a fair price and was willing to improve It;
that at this time he did not know what to do; that he had
wanted to do the work himself; that the street was only about
twenty 20) ft. wide and no street lights; that on the corners
of Merced Avenue the garages were built right on the street
line; that t would be almost impossible to put n curbs,
gutters, sidewalks and sewers without tearing down the garages;
that if he installed curbs, gutters and sidewalks they would
be the only ones on the street; that there was one set Code
with no deviations whatsoever; that when he had purchased the
property t was full of weeds, and debris which he had hauled
away and paid $12.00 to dump.
City Engineer French stated that his understanding of Mr.
Fitzpatrick's problem was threefold: 1) that when Mr. Fitzpatrick
wanted to take out a permit on the garage he was required to have
a five 5) ft. sideyard setback or build the garage with a one
I) hour fire wall if the garage was built on the property line;
that this was a requirement of the Building Code and it was
standard throughout California; 2) that the Zoning Code required
a twelve 12) ft. paved drive to the garage; 3) the City's
Ordinance required for improvements over a $1,000.00 that curb,
gutter, sidewalk and drive approach be constructed; that he felt
the Building Code regulation was vital and that there should be
no deviation; that the only way to deviate from the installation
of curb, gutter, sidewalk and drive approach was to get permission
from the Council because It would be impractical to establish the
curb line or that the grades would be Impractical to establish;
that this was a private street and t was narrow and that the
conditions did exist; that he recommended until the area could
be developed that the curbs, gutters, sidewalks and drive approach
be waived as impractical to establish alignment; that dedication

was needed in the area; that the way the structures were
situated on the private street did not provide enough
width for a sixty 60) ft, street; that unless many of
the structures were removed there could not be a full
street; that he recommended that in lieu of construction
of curbs, gutters and sidewalks that the portion of
private street under control of Mr. Fitzpatrick be
granted to the City; that this would be the first step
in developing a public street Into the area; that the
area was developed under County jurisdiction and in his
opinion they would probably not ever be able to get a
full sixty 60) ft. dedicated street; that at some time
they should be able to get a modified street, perhaps
on an alley pattern or a partial alley pattern.
City Attorney Flandrick stated that the deviation from
the curb, gutter and sidewalk requirement could be
accomplished, but only upon written application to the
City Council; that he recommended that Mr. Fitzpatrick
write such a letter after he had examined the Code
section to make sure he had covered the points; that
it could then be acted on by the Council.
Mayor McCaron stated he would like a plot map showing
exactly what the difficulty was in the area so that
Council would be familiar with the problem.
Mr. Fitzpatrick inquired if a concrete block wall
would be considered a fire wall.
City Engineer French stated the wall did not have to
be as substantial as a concrete block wall.
Mayor McCaron suggested that Mr. Fitzpatrick contact
City Engineer French again and present his letter to
the Council requesting waiver of curbs, gutters and
sidewalks.

Ordinance No. 520 would amend Section 5100 of the No. 520, AMEND SECT.
Baldwin Park Municipal Code in order to adopt the 5100 B,PK. MUN. CODE
Public Health Code of the County of Los Angeles; that PUBLIC HEALTH CODE
the City had an agreement with the County to enforce
the City's health rules In accordance with the County
Code which has been adopted by the City by reference;
that he had a letter from the County Health Officer,
Dr. Heidbreder, which listed the changes in the new

TESTIMONY WAS GIVEN by: TESTIMONY
Mr. Lloyd Riggs, 4418 North Walnut, Baldwin Park, stated LLOYD RIGGS, 4418 N.
that he had received a letter stating that he was In Walnut, B. Pk.
violation of Municipal Code Section 3326 and he requested
an explanation.
City Attorney Flandrick stated that Section 3326 Indicated
that any motor vehicle which was abandoned, inoperative,
dismantled or wrecked as such could be declared a public
nuisance and be removed either by the owner or at his
expense by the City If not done by the owner within a

Mr. Riggs inquired who was to determine if the vehicles Mr. Riggs
were abandoned, wherein City Attorney Flandrick stated
the City Council was to determine.
Mr. Riggs stated that he did not see how this affected Mr. Riggs
the City Council; that this was his private and personal
property; that he felt he was more qualified to state
whether the cars were abandoned or not; that this par-
ticular Issue was resolved last year to the best of his
knowledge; that he would like to know why it was being
reopened.
City Engineer French stated that a complaint had been
received concerning the property last year; that the
vehicles had been closer to the street; that they had
requested that the vehicles be removed; that they were
moved further back on the property; that the vehicles
were partially fenced off from the street by bamboo;
that they were still being stored in violation of the
Zoning Code and other Codes of the City; that the photo--
graphs showed the vehicles were substantially in the
same condition, shape and form as they were a year ago.
Mr. Riggs stated that whatever investigation had been Mr. Riggs
made was a poor one; that no one had spoken with him
personally; that you could not determine the condition of
the cars from the street; that scare one should have come
to the door and talked with him concerning the cars to
see what shape they were actually in; that It had been
stated that nothing had been done; that quite a bit had
been done; that the Ford Coupe had new brakes; that the
Oldsmobile had a timing chain; that this particular car
belonged to his son who had been out of work so he had
not been operating the car; that he had a terrific
investment in the Plymouth, over $2500., and he had had
hardly any use out of it; that the crank shaft on the
motor broke; that he had wanted to put In a new motor,
but circumstances and conditions of health had prevented
him from doing so; that now the car was old enough, he
felt, he could put In a rebuilt motor and get some use
out of It; that his line of work had been a little lax
and he had not had the money to put in as fast as he
would like; that If the position of the vehicles was
offending any one he would like to take care of it by
possibly fencing or enclosing the vehicles all the way
around until he could fix them.
Mayor McCaron Inquired how long the vehicles had been
sitting where they were without having been moved, Mr. Riggs
wherein Mr. Riggs stated the Plymouth Coupe had been
taken by him as partial payment on a job; that he had
a fifteen 15) year old son and felt it was a good Idea
to give him something to work on; that It had a racing
engine and was probably worth more than It looked like;
that he had not licensed the car because he did not want
his son operating the car, only to work on it; that two
2) of the cars had been there since last year; that the
1959 Plymouth was last licensed In 1963.
City Engineer French stated that the area around the cars
should be cleaned up and the cars stored In compliance
with the Zoning Code; that the Zoning Code required that
the cars be stored within a structure,
Planning Director Ch)vetta stated that the usual storage
of dismantled vehicles would be Inside a structure; that
In Mr. Riggs case he was working on the vehicles and trying

to get them back on the road and he would recommend
setae type of leniency as long as they were removed out
of sight and put behind a view obscuring fence or wall.
Mayor McCaron asked if there was any time limit on how long
the cars could remain in this condition; that if this were
allowed to occur in this instance, dismantling so to speak, I
could be started in other areas.
Planning Director Chivetta stated there was nothing stating
that a person had so many days to repair a vehicle,
Mr. Riggs stated there was an error on the list of vehicles; Mr, Riggs
that he had never owned a Chevrolet; that two 2) were listed
that the Wagon in question was a 1959 Plymouth, hot a 1947 Chevrolet
Councilman Morehead asked Mr. Riggs how long he would need
from this date on to put the cars in condition to operate
and park as you would a normal car; wherein Mr, Riggs stated Ar, Riggs
it was not only a matter of time, bat a matter of money; that
he worked alone; that he intended to have them out before the
end of the year; that there was no garage on the property,
City Engineer French recommended that Mr. Riggs be given
thirty 30) days to enclose the vehicles with 6 view
obscuring fence to the satisfaction of the Planning Depart-
ment or removal of the vehicles.
Mayor McCaron stated that he would like to have the Planning
Commission study rules and regulations concerning how much
time should be allowed to restore a vehicle.
Planning Director Chivetta asked if it was the intention of
Council to permit storage of vehicles in R-1 zones) that at
the present time the Code does not permit storage of vehicles;
that It permits the keeping of tenants vehicles and of course
this means other than a disabled vehicle, wherein Mayor McCaron
stated that Council should have some guide lines as to time
allowed for abatement,
City Attorney Flandrick stated that if the Planning Commission
did make the study and recommendations to the City Council In
terms of Zoning Regulations, he would also recaemwand to the
Commission as a part of the regulations that they declare'a
specific period of abatement for existing storage at the
time of the adoption of the regulations, therefor If the
regulations should go into effect, approved by the Commis-
sion and adopted by the City Council, it should be made clear
to Mr. Riggs that notwithstanding what was done an this per.-
tlcular case if the abatement were set at a period of six
6) months or a year or whatever t might be, the City would
be reopening the case again whether the vehicles were en-
closed within a fence or not,

was in County territory adjacent to the City of Baldwin
Park; that it was located on Baldwin Park Boulevard just
southerly of the San Bernardino Freeway; that the second
parcel of ground involved was a small portion that used 1
to be the little league ball field at the terminus of i
Virginia; that the Planning Commission had Initiated
a public hearing to prezone these areas; that the area
contained approximately eight 8) acres; that the purpose
of the prezoning was to establish a zone that would be
compatible with the City's General Plan and also to act
as an Incentive to the property owners to annex into the
City of Baldwin Park; that the Planning Commission was
recommending that the Council adopt the prezoning for
the area; that the prezoning would be of no effect on
the property unless the property were annexed by the
City of Baldwin Park; that It would remain R-A in the
County; that it would be annexed Into the City as MI In

being considered for prezoning was occupied with single

and Park Commission suggested a name for the hall; that
he felt there should be a study as to whether Council
wished to set this type of precedent.
Councilwoman Gregory stated It was always the Intention
of the Advisory Board that when dedication of the hall
took place that one room would have Mr. La's name
on it as a memorial; that Mr. Lem had worked long and
hard with the youth of Baldwin Park.

wished to make a comment on the last Item1 under the City
Engineer's portion of the Agenda, the Traffic Committee
Report, which recommended 35 miles per hour speed limits;
that one of the first recommendations he has made to the
City Council in Baldwin Park, about five years ago, was
to increase the speed limit on major thoroughfares, In-
cluding Pacific, Puente and three others; that the Council
at that time had voted him down five to nothing.
