In accordance with Section 2703 of the Municipal Code
the City Council met in open meeting-at-7:00 p.m. In
the Conference Room for an informal session with the
staff to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

Mayor McCaron stated that the City did have an Interest in this,

that this agreement could bring within a short period of time
tremendous assistance free law enforcement agencies within a
distance of ten 10) miles; that they had an informal agree-
ment last summer when there had been a potential disturbance
in Covina, however this had been accomplished by administrative
agreement; that Chief Adams and he recommended that Council
approve this agreement.

Councilwoman Gregory stated that before the vote was cast she

felt the budget was lacking in many ways and especially in

providing more adequate services for the citizens of Baldwin
Park; that they had made a few gains in salary adjustments for
some of the personnel, but that she felt in some departments
and for some personnel that the adjustments were below what
they should be; that the approval of the budget rested with
the Council, not the staff; that therefor she felt that any
promiscuous spending was the responsibility of the Council;
that the budget reflected some expenditures that she had
questioned and was told that the requests were valid, valid
because of the intangible returns the City would receive from
subject expenditures"; that she did not deal in fantasies,
dreams or intangibles, nor did she represent the people of
Baldwi'n Park on that basis; that the City Attorney had told
her that she must vote for the entire budget or not at all;
that because she was in agreement with part of the budget
she would cast her vote with reservation and only in partial
agreement with the budget.

Mayor McCaron Inquired as to why two different size folding
tables were required. Chief Administrative Officer Nordby
stated that the tables would be used for different purposes;
that one size would be used in the main room for banquets and
the other size would be used in the crafts room.

Mr. Quinn L. Morgan, 4217 Park Place, Baldwin Park, stated QUINN L. MJRGAN
that the owner of the property Mr. Juan Sales had taken out 4217 PARK PL., B.Pk.
a permit to demolish the parts of the building that were not
legal or the parts that were constructed without benefit of
permits; that he did not know what had brought this about as-
far as this particular property was concerned; that as every-
one knew there were vacant houses all over town; that these
properties did not do any harm to anybody; that it was the
people that lived around them that were really the problem;
that there had been eleven 11) windows knocked out of this
house; that he lived across the street and was doing all he
could do to protect the property; that the problem was a lot
of small children and grade school children; that their parents
did not care what happened to the children, let alone the prop-
erty; that he had done some checking on the residents on the
street acrd there were no property owners on the street that had
children; that the people with children were all on welfare;
that he would admit they were living in housing that was not
the best; that he would like the City Council to take some action
to prevent children from living in an industrial area if they were
below the high school level; that the zoning was not safe for child-
ren; that children on tricycles tried to keep up with trucks and
trailers going down the street; that they climbed on the back end
of the trucks; that this particular property would be cleaned up
to the satisfaction of the Building Department; that he wondered
what they were going to do about the broken windows that there
was no end to; that there was a new Buick with a broken windshield,
a 1954 Chevrolet with a broken windshield, 1957 Oldsmobile with
the side window broken and a pick up truck with a broken side
window ail parked on their owners property.
City Engineer French stated that the property could not be used
as a residential structure any longer; that it would have to
be brought up to Code for a commercial or a manufacturing use;
that he felt this would be very difficult.
Mayor McCaron stated that this was one way of alleviating the
problem Mr. Morgan was talking about of residents in an M-1
Zone; that this property could not be rehabilitated for resi-
dential purposes.
Mr. Morgan stated that houses on either side of the property MR. MORGAN
were in much worse condition, but that it so happened there
was someone living In them; that he did not own this property
yet, however the transaction was ail worked out; that if they
were going to work a hardship on Mr. Sales he would like to
see every house on the street have an inside Inspection; that
he did not believe that the houses on either side of this
property were erected with the benefit of building permits;
that it would work a hardship If the house could not be re-
habilitated for residential use; that the main structure was
all right; that It needed to be cleaned up; that the Illegal
structure should have never been allowed to exist as long as
it had.

City Engineer French stated that this was a residential
structure in an M-1 Zone; that this was about the fourth
hearing for public nuisance on Park Place; that 4246 Park
Place was Initiated this evening; that the next hearing
was on 4214 Park Place.
Mr. Juan Salas, 3605 Barnes, Baldwin Park, stated he was JUAN SALAS, 3605
paying on the property and that Mr. Morgan was buying the Barnes, B.Pk.
property from him. He stated he had not erected the build-
Ings.
City Attorney FlandrIck stated that the staff report indicated
that the building in its present state was structurally unsafe.
Mr. Morgan stated that the only part of the building that was MR. MORGAN
unsafe was the part that was erected without benefit of permits.
City Engineer French stated that the report from the Building
Department stated that the entire south side of the building
and portions of the rear end had been added illegally; that
the side portion was located too close to the adjacent property
line and structural framing In ail illegal portions was sub-
standard; that the roof and wall members were overspanned;
that the building contained exposed electrical wiring of an
improper type; that the water heater was vented Improperly and
did not have a gas shutoff valve; that the laundry trap was
plumbed without a P Trap, etc.; that the Fire Department and
the Health Department reports stated that the property was a
health hazard; that the Planning Department report stated that
it was a nonconforming use; that the overwhelming evidence was
that it was an illegal structure in the wrong zone.
Mr. Morgan stated that there were certain parts of the structure
that could be renovated for office purposes.
Mayor McCaron asked Mr. Morgan If they were to allow sixty 60)
days on the portion of the property that was to be rehabilitated
if plans could be brought in and shown to the City Engineer, Mr.
Morgan stated he could.

that the City lacked at the present time an underground utility
ordinance that was adequate for the co munity; that the proposed
amendments would result in uniform standard utility lines; that
the construction of underground utility lines would promote and
preserve the health, safety and general welfare of the public
and would assure the orderly development of the City of Baldwin
Park in complying with the Public Utilities Commission Case No.
8209 and result in the negation of a specific situation that
had arisen over the years; that the staff recommended that the
Council conduct a public hearing and undertake the necessary
steps to amend the Municipal Code to reflect the same; that the
proposed amendments to the Municipal Code, which would include
underground utility installation was not an underground utility
d?strict ordinance in itself, however it would lay the framework
for the proposal in the future,

for an explanation of Section 9802, subsection c), concerning
3906 N. Hornbrook,
the 10 years.

Planning Director Chivetta explained that if an underground
utility district were formed in any particular area within
ten 10) years and an exemption were given to the property
owner he would have to comply with the.conditions of the
district and at his own expense; that if the property owner
were adding to a present structure on an existing property
the utilities would either have to go underground or the
property owner would have to sign an affidavit that he agreed
to go underground if such a district were formed within ten
10) years.
Planning Director Chivetta stated the proposed ordinance
would only effect proposed developments withih the community;
i.e., new developments, reconstructions or relocations; that
this would be for residential, commercial or industrial prop-
erties; that if because of circumstances, topography, all the
surrounding properties were serviced from overhead or It would
create a hardship to go underground, they would be given an
exemption; that if a district were formed this would have to
be by ordinance of the City Council in a specified area with-
in a specified time limit; that at that time it would be the
responsibility of the property owner to pay the cost from
his existing house to the street right-of-way; that on a
reconstruction the property owner would pick up the entire
cost and the City would not share In it; that the City would
draw from the funds that were set aside by the utility companies;
that from these funds the existing overhead would be installed
underground, however the property owner would be required to make
the change from the weatherhead to below grade.
Councilwoman Gregory stated that she understood that this was
an ordinance which would allow the City of Baldwin Park to
draw funds that had been set aside by the utility companies.
Planning Director Chivetta stated that this ordinance would
qualify Baldwin Park for the money.
Mayor McCaron stated that the returns were based on population;
that the amount was $38,000.00 per year; that at this figure
it would take a number of years to accrue sufficient funds to
put very much service underground.
Councilman Crites stated that the basic idea was to be able
to eventually get rid of the unsightly overhead; that this
ordinance was needed to get started and it could be amended
if there were difficulties at a later date.
