In accordance with Section 2703 of the Municipal Code the City Council met in open meeting at 7:00 p,m, In the Conference Room for an informal session with the staff to be informed on regular agenda items. REPORT Project 95-S, He stated that this drain was being con- RE STORM DRAIN PROJ. structed on Ramona Boulevard; that the contractor had 95-S made a request to move the drain 10 ft, northerly in order to miss the Southern California Edison Company poles along Ramona Boulevard; that this would allow the contractor to begin construction prior to the relocation of the poles; that the contractor had agreed to bear all costs resulting from this change; that to accomplish this it would be necessary for the City Council to approve a right of entry with the railroad; that the drain would be within the ultimate right-of-way of Ramona Boulevard; that the drain was designed to intercept all of the water at Ramona and Maine; that because of the tracks being in the way they would have to jack a tunnel under the tracks; Continued) 1968 07 17 CC MIN ×P$m˜ö00038'.78 Regular Meeting of the Baldwin Park City Council July 17, 1968 Page 4 that for this reason they had stopped the drain short of Maine; that the railroad had indicated that they may allow the tracks to be severed for the construction of the storm drain; that the contractor was agreeable to extending the drain based upon the unit prices in the original contract; that he recommended that the Mayor and City Clerk be authorized to sign a right of entry, subject to the same conditions of the right of entry between La Rica and Maine; and that the City Council authorize the extension of the project in accordance with the unit prices in the original contract. He further stated that he had checked the Building Department records; that the records Indicated that the server had been constructed on the property; that there had been a minimum depth stub out at the deepest structure; that the lateral had been laid at 1/4 Inch per foot; that it could have been reduced by permission of the building official at the time to 1/8 inch per foot, which would have made a sewer 2 1/2 ft, shallower at the property line; that the sewer district was designed to serve to a lot depth of 150 ft,; that the sewer on this lot had a composite run of 240 ft, He explained that at the time of the formation of the sewer district and the time the construc- tion of the sewer district was programmed notification had been sent out to all of the property owners in accordance with the last equalized assessment roll. Mayor McCaron stated that the line was a quarter of an inch flow per foot; that because of the depth of Mrs. Eskue's lot and the distance it had to run was the reason for going deeper. Mayor McCaron stated that everyone was notified in order to ascertain where the sewer line had to go; that Mrs Eskue had acknowledged the fact that she had been notified and that the notification was also to cover anything that might be unusual on a particular piece of property, MAYOR MCCARON MOVED THAT THE CITY COUNCIL DENY THE REQUEST MOTION MADE AND DUE TO THE FACT THAT EVERYONE WAS REQUIRED TO NOTIFY THE CARRIED THAT COUNCIL CITY OF ANY INSTALLATION, AND WHERE THE INSTALLATIONS DENY THE REQUEST,- WERE; THAT MRS, ESKUE WAS NOTIFIED; THAT SHE HAD NOTIFIED DUE TO THE FACT THAT THE CITY WHERE TO PUT THE LINE, BUT HAD NOT MENTIONED THE EVERYONE WAS REQUIRED OTHER PROBLEM. In his letter to Mr. Byerley dated June 14, 1968; that he had remeasured the distance today; that he believed the distance that Mr. Byerley was presenting was the distance from the eave overhang to the proposed sidewalk; that the eleven 11) ft. he had called out in his letter was from the structure to the proposed sidewalk; that there was approximately 460 to 470 ft. of existing sidewalk on this block at the present time; that Mr. Byerley would be required to install approximately 110 ft. of sidewalk; that he recommended the sidewalk be constructed according to plan. AMERCED, B.PIC. office one day last week In regards to why these autos were considered a public nuisance as they were well off the street; that for three 3) of the vehicles he did not have a title; that he had been In business in a gas station and they have been left there; that he had written to Sacramento to try to get a title clearance so that he could sell the vehicles; that it had been almost five 5) months since he had written to Sacramento and he had not heard from: them yet; that there were only two 2) of the vehicles he wished to keep; that he had been told to get in touch with the Piannlng Department regarding building a fence to enclose the vehicles. City Attorney Flandrick stated that If the vehicles were declared to be a public nuisance the City could remove them with or without title. City Attorney Flandrick asked Mr. welters if he had a 1963 Pontiac Coupe on the property. Mr. Welters stated no". City Attorney Flandrick asked Mr. Welters if he had a 1955 Mercury 4 door sedan and 1946 Ford pickup. Mr. welters stated yes". Mr. Walters stated that he did have a 1959 Pontiac, a 1936 Ford truck and a 1946 Ford truck on the property; that the two 2) trucks were the vehicles he desired to keep. City Attorney Flandrick suggested that this matter be held over to the next meeting and in the interim Mr. Walters might meet with the Police Chief and see If perhaps the City could send a communication to the Department of Motor Vehicles and see if the titles could be straightened out.
