In accordance with Section 2703 of the Municipal Code
the City Council met in open meeting at 7:00 p.m. In
the Conference Room for an informal session with the
staff to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

conducted at the General Luncheon at 12:15 p.m., Oct. 16, 1968, BILTMORE HOTEL
at the Biltmore Hotel, and the League has requested that REQ. VOTING REP. AND

Chief Administrative Officer Nordby presented Resolution C.A.0. REC. ADOPT RES.
No. 68-204 regarding Proposition 9, the tax limitation NO. 68-204 RE PROP. 9
amendment, which is taming up for a vote on November 5th.
He stated that he and the City Staff along with other
cities felt that it could be very detrimental to local
government In many ways; that it would take too much time to
elaborate on each of the defects In the Resolution such
as the limiting of taxing powers of the City to property
related services and the limiting of the bonding power
of the City. He recommended that the Resetutl6ni be
approved.

Mayor McCaron stated that It appears the more one MAYOR COMMENTS RE
studies Proposition 9, the more trouble it seems to PROP. 9
engender; that the City Council recognizes the need for
tax relief on property taxes in its Resolution; that there
should be a ceiling on the amount that could be transferred
over to that area for a repayment of debts, bonds or anything
else; that to segregate the area in which the funds must be
expended seems to also generate confusion. He stated that he
felt the City Council had taken the proper steps in expressing
their opposition.

Councilman Hamilton stated that he had given Proposition COUNCILMAN HAMILTON
9 much study and that at first he could not oppose the
Proposition but, with what had been brought out tonight
and he had found out the same, he now felt this Resolution
was the right step to take. He stated that he did not
feel that Proposition I-A was the right one but we all
recognize the need for a tax reform. He felt it was
up to the City, the City Council and all the responsible
citizens to bring pressure on our laymakers In Sacramento
to work oat a better tax reform than we have coming up on
the ballot, even though Proposition 9 is defeated, but he
stated that he would have to oppose Proposition 9 because
it is too drastic.

Councilwoman Gregory inquired whether this would render
the street on the north side of Ramona a more narrow
street by taking the ten feet from the south side.
City Engineer French replied It would not, but that it
would be narrower than the ultimate development. He
stated this development would provide one lane In each
direction with no parking on the south side, north of
the tracks.
Councilwoman Gregory asked If there was a street width
limit that necessitates tax gas money and would this be
a street that could ever be maintained by other than
City funds by being more narrow than sixty feet.
City Engineer French stated that this street would not
meet the minimum width for these funds; that It is
not eligible for these funds now.and it probably never
would be a major thoroughfare. He also stated that in
some areas this action would widen the street over what
it is now and in some areas the street will remain almost
the same as it Is now.
Mayor McCaron stated that he felt that regardless of
whether there is parking on one side or both sides we
should go to the maximum paved width, thirty eight feet,
as a narrower width always creates problems.
City Engineer French stated that if we go to the thirty
eight foot street, this section would be wide enough so
that we could spend money on it, subject to special approval,
under present gas tax criteria. This section, which does
not give as great a landscape buffer, would be wider than
it is now.

It was the time and place fixed for a public hearing on PUBLIC HEARING
68-A-9, to determine whether certain vehicles consti-
tute a public nuisance at 5036 N. Stewart. 68-A-9

City Engineer French stated that this item had been held CITY ENGR.
over from the September 18th Council meeting as two RESUME
notices had been returned unclaimed; that photographs
had been taken of the property as of October lid which
showed that three vehicles were not there on this date
that had been there previously! a 1942 Dodge, a 1957
Buick, and a 1955 Chevrolet; that three vehicles were
not on the Resolution so formal action cannot be taken
on these tonight; but he requested that the Council
continue on with the hearing and take testimony and
action. He stated that Mr. Deigel, the property owner,
had been given a copy of the Zoning Code Amendment
that the Council is presently adopting; he was told
that to abate the nuisance he would be required to
conform with this Ordinance, and he was referred to
the Planning Department for preparing and having a
site plan approval which Is required by the Ordinance,
TESTIMONY WAS GIVEN by; TESTIMONY
Mr. John Deigel, 5036 North Stewart Avenue, stated MR. JOHN DEIGEL
that he had been checking on fence prices to close off
the area six feet high according to the City Code, and
that he had been out of work and had just started back
this week. He requested sixty days to obtain funds,
construct fence and eliminate more cars.
Mayor McCaron asked Mr. Deigel whether it was his
intention to just fence in what he had or did he
intend to proceed with fixing up the automobiles and
take them off the property.
Mr. Deigel replied that he planned to eliminate some,
fence off others and get rid of a couple more later
when he can sell them.
Mayor McCaron inquired whether it had been explained
to Mr. Deigel that according to the Code there Is a
certain time limit, even behind a fence, that this
type of activity can continue.
City Engineer French replied that Air. Deigel had been
given a complete copy of the Ordinance, and ail of the
information is in it. He stated that, right now, there

four other automobiles that are in another photograph
which are in use now. He stated that the concern is
with the twelve that are not in use; that a Lincoln,
License #HQW 746 has shown up on the property since
the action was started and was either inadvertently
overlooked or was in a different location. He explained
that even the Ordinance that we have given Mr. Delgel
to comply with requires site plan approval by the
Planning Department and requires storage inside a
structure of some of the parts that are piled loosely
on the property. XIsq the site plan review will give
a time limit to eliminate a certain number of these
vehicles.

Mrs. Clark questioned why this work should be done now;
that it would not help or be any advantage, as where there MRS. ESTA CLARK

In answer to Mayor McCaron's question as to whether Big
Dalton was narrower on the north side or whether it
continued through at forty feet, City Engineer French
stated that the street is programmed for forty feet curb
to curb.
City Engineer French stated that he thought the problem
to which Mrs. Clark referred was that the other side of
the street Is not Improved and the property is not kept
in as nice a condition as hers, so she probably feels we
should be concentrating on the opposite side of the street.
He explained that the City's problem relates to the use of
the assessment district in that the other side is not over
50% improved, so the City cannot initiate an assessment
district at this time, but we are trying to get the property
cleaned up.
Mayor McCaron Informed Mrs. Clark that more than 50% of the
people on her side of the street have the improvements in
and for this reason we are able to continue the development
for the balance of that side of the street; that we can
only take one side of the street at a time; that we cannot
be governed by what one side of the street does and force
the other side to do the same; that we have to wait until
the other side has a 5016 or more improvement and then the
work will be ordered.
Mrs. Clark inquired where were the people going to drive
after the sidewalks and curbs are In and the street Is
built out.
Discussion followed.
In answer to Councilman Hamilton's question as to why the
development of the street would make it more narrow, City
Engineer French replied that it is wider where the curb
and gutter have gone In because we have to pave out to it,
but the problem is that the center line of the street,
because of the pavement area, Is a little off-set. He
showed the Council a phwtograp~ showing how much room is
between two vehicles which happen to be parked on both
sides of the street. He stated that he thought Mrs. Clark
was referring to the fact some line work would have to be
done on the street.
In answer to Councilwoman Gregory's question as to whether
moving the line would solve the matter of street width and
safety, City Engineer French stated that he was satisfied
that there will be two lanes of traffic and parking allow-
Ing for safe operation.

much work as the law will allow and that It would be
necessary for the owners to petition in order to pave
the entire street; that improvements are being Install-
ed as fast as possible with the money that is available.
City Engineer French stated that the cost to the City
is every bit as much as it is to the property owner and
most of the time it Is more,
In answer to Mr. DeGreve's question as to who does the
work, City Engineer French explained that the City has
a private contractor who does the work; that if the
Council orders the work, the property owner is given a
sixty day period to have the work done himself or arrange
with the City to have their contractor do it; that if the
City goes through the procedure of installation,
construction and final hearings the property owner will
be charged an incidental expense that reins around 258
which is paid with the taxes.

made and that this should be made more clear. He stated
thet he understood the City could do the work and the
cost would go on his tax bill and that no other charges
would be made but in September he received a bill for
$170.88 for the installation which includes a 25% Incidental
charge. He said that he had curb and gutter put in on his
other property on Vineland and was charged $1.95 a llrteaa
foot plus permit fee and no additional charge was made.
Mr. Powell stated that at the December meeting Mr, Odem
asked the price of the installation and was quoted $120
and he is now being asked to pay $150; that another home-
owner In the area Mr. Sivins) had a 25% charge discounted
on a corrected bill when this charge was protested to the
Street Superintendent. Mr. Powell felt this was showing
partiality; that he had measured 217.5 square feet of
sidewalk and he was being billed for 242 square feet
which he felt was an overcharge of $8.58.

City Engineer French explained that his office made an
error on Mr. Bivin's billing and there was no way. to
justify this. Mr. French read excerpts from the
December 6, 1967 Council minutes at which time costs
were explained. The excerpts were as follows: if the
installation was arranged for prior to February 6, 1967
the cost would be approximately $121.60; that this would
include the permit fees; that assuming that this would
go to collection as a part of the taxes there would be
cost at that time would be $150.78; that this was based
upon what the current costs were; that the City was out
to bid now for various concrete installations; that by
either February or March the City would have a different
cement contractor; that the City did not know what the
prices would be then.".
that in the event the district was formed the payment
for the sidewalks could either be handled by the property
owner by their arranging for a contractor of their choice
to do the work prior to the end of the sixty 60) days;
that the City had a contract with a contractor to do
the work for a certain amount of money; that the contrac-
tor must perform for that amount of money; that the City

tor; that all the City did was act as a clearing agency;
that If the City were required to perform as part of the

cost plus the incidental costs, that it could be paid
off at this time or it could be collected as part of
their taxes; that if it became part of their property
taxes half of it would'be pai'd in December of 1968
and half in April of 1969." He stated that he felt
the City was right on the square footage on Mr. Powell's
property, but that It would cost more to hold this over
than discount the amount.
