In accordance with Section 2703 of the Municipal Code the City Council met in open meeting at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items. The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 pin. Councilman Morehead led the salute to the flag. There were no objections, the motion carried and was so ordered. 00- Chief Administrative Officer Nordby presented a report on C.A.0. REPORT RE V.F.W. an offer made by the V.F.W. to purchase the City's two- OFFER TO PURCHASE thirds interest in property located at Railroad and CITY'S TWO-THIRDS Downing Avenues. He stated that it had been concluded INTEREST IN PROPERTY that the property, an area of 6250 feet, had no future value to the City; that the V.F.W. offer would mean a payment to the City of $3,333.33 for the City's two- thirds interest; that Mr. Jerry Morris, an appraiser hired by the City, had submitted an appraisal that ranged from 880 to 960 a square foot; that at 880 the property would be valued at $5500 and at 960 it would be $6,,000; that these figures are a little in excess of the figures offered by the V.F.W.; that possibly the City might strike the difference between the two appraisals and make an offer to sell at 920 a square foot, or $5750. ROBERT HESS, BLDG. of Baldwin Park, stated that the veterans attending CQUITTEE CHAIRMAN, this Council meeting did not have the authority to V.F.W. OF D. PK. make another offer; that it would have to-be reconsidered by the group; that the V.F.W. had an appraisal made and they had used the results o€ this appraisal in making their offer to the City. Mayor McCaron stated that f the offer by the City was not satisfactory to the V.F.W. perhaps another appraisal should be made. Chief Administrative Officer Nordby suggested that, in view of the fact this had not been discussed with the V.F.W. officials, he would be willing to negotiate with these gentlemen, If the Council wished, and bring back the results to the next meeting on November 20th. 00- Chief Administrative Officer Nordby stated that the C.A.0. PRESENTED next item on the agenda related to the purchase of a THREE ALTERNATIVES video tape recorder and accessories which had been FOR PURCHASE OF demonstrated earlier in the evening; that quotations VIDEO TAPE RECORDER submitted by three suppliers, listed in the C.A.O.'s AND ACCESSORIES memo, had been invalidated by some offers made later; that the offer by Mobile Radio, Inc. for $2,264.22 had been negotiated down to $2,098. this is the offer that the C.A.0. had recommended to the Council); that Chief of Police Adams had added an additional camera which would complete the components for the equipment bring- ing the total cost to $3,672.60; that this amount exceeds the budget appropriated amount of $2,500. He stated that there are several alternatives; 1) accept the $2,098. and re budget next year for the remaining equipment there would be no assurance that the price would remain the same), 2) amend the budget at a later date and accept the total number of pieces of equipment at $3,672.60 or 3) lease the equipment at $200 per month for the first year with the option to purchase the equipment for $1,50Ci at the end of twelve months. This would cost more then out- right purchase. He stated that the primary use for this equipment initially was for picking up Channel 28 train- ing films for the District Attorney for play back, bat It also could be used in Public Nuisance Abatement cases, Chief of Police Adams enumerated the many uses of the machine; that the one hour tape at $39.95 could be used 500 times, that the equipment Is fully warranted on all parts and labor for the first year. This case was continued from the October 16th meeting as Mr. W. P. Garrett, 14535 Ramona Blvd., had written a letter requesting that this matter be held over until the November 6th meeting. City Engineer French reviewed his report and presented CITY ENGR. RES E photographs taken on October 16th, September 10th and STAFF RECOMENDE November 6th of this abandonded service station which REMOVAL OF STRUCTURES does not meet the Building Code or the Zoning Code. A sketch of the property was given to the Council members. He stated that the Staff recommended the removal of the structures from the property. City Attorney Flandrick recommended that this item be held over until the November 20th meeting since it involved demolition of structures, and the property owner had requested that the matter be held over and had objected to our notices. CP-103) TESTIMONY WAS GIVEN by: TESTIMONY Mr. J. James McGee, 5127 Heintz Street, stated that the MR. J. JAMES MCGEE lady to the south of him wanted a wall she could see 5127 HEINTZ STREET over; that since it is in the Resolution that the wall can step down-then this would be all right; that he would remove the pepper tree the first of the year. He explained that he would black top the area when he located the water lines; that the small building in the rear was a wash house hooked up to the sewer and hot and cold water. Mr. McGee stated that he had rented the front house on his property and he lived in the rear; that he would have his property surveyed so he could find the lines; that he had bought a tractor skip loader and cleaned up the southwest corner; that when he had the tree out and the surveying done, he would come in to get approval on the walls and pavement to be put in. He stated that he lived in the two houses, he would get his permit and move the trucks in. He asked Mr. McGee if he understood what wall Is required on the south side of the property. Mr. McGee replied that was where he had the easement MR. MCGEE and along the buildings in back. Mayor McCaron stated that he had looked at the property and it appeared that there was a solid wall toward the rear of the front house; that this would call for a wall along the rear and the side of the house that is on the front of the property. Mr. McGee stated that he would like to put a wall around MR. MCGEE the front of the house acid that the curbs and gutters were in. Planning Director Chivetta explained that the wall suggested as a condition would go along the southerly side property line. He stated this would run along the driveway area, then bend at right angles along the rear of Mrs. Shumaker's house for some 43 feet then bend in a westerly direction and continue for 150 feet to the end of the lot. Mr. McGee asked f the wail was required down next to MR. ACGEE the building. Planning Director Chivetta replied that this was what the Resolution stated; that as far as the street improve- ments were concerned, that curbs, gutters and sidewalks were required on all development of property throughout the City; that, if curbs and gutters are in, the only re- quirement would be sidewalks. Mayor McCaron stated that he imagined the drive approach would just about cover that. He Informed Mr. McGee that he would have six months to put in the necessary Improve- ments; that if there were any changes to be made they would have to be done during the public hearing and the hearing would have to be held over; that otherwise the conditions would have to be acceptable to him at this time. Mr. McGee stated that he planned on doing everything that MR. MCGEE was in the Resolution. Planning Director Chivetta presented his resume on CP-104, PLANNING DIRECTOR an appeal on an application from B. J. and Nadine Rautert RESUME CP-104 for a Conditional Use Permit to change the nonconforming status of an existing trailer park to a conforming use in accordance with the Municipal Code. He stated that Mr. Rautert is concerned with sub section g in Section 2 of the Board of Zoning Adjustments Resolution 68-21 which requires the installation of underground utilities within a two year period, however he is in accord with other sections of the Resolution. TESTIMONY WAS GIVEN by: TESTIMONY Mr. B. J. Rautert, 1670 Mira Valle, Monterey Park, MR. B. J. RAUTERT, stated that he had agreed to the conditions set forth 1670 MIRA VALLE, at the first hearing with the exception of the instal- MONTEREY PARK lation of all new underground utilities including the telephone lines; that this would cost approximately $11,000; that if this were new property he could under- stand why all utilities should be underground,- but that since this park has been in existence since 1946, Instal- lation now would create a hardship. Mr. Rautert, point- Ing to a map of the area, explained the difficulty In installing the underground utilities due to existing pipes, trees, concrete areas and the necessity of moving trailers and digging by hand. He stated that he agreed to the installation of the block wall and the enclosure of the trash area. Planning Director Chivetta stated that the trailer park was checked out by Mr. Levie and himself, and that every- thing wiring, pluming, etc. complied with the Municipal Code at that time. He stated that Mr. Rautert would put In all street improvements, curb, gutter and sidewalk, on the entire frontage. Mr. Rautert said that the only thing he is contesting MR. RAUTERT Is the underground wiring requirement; that as long as most of the other businesses in the City and single family residences had lines on top of the ground and his wiring was safe and not creating a hazard, he did not see why the underground wiring should be required at this time. He stated that he had been told by the State Department of Housing Inspector that if in the future his wiring is declared unsafe, then he would be required to put It 40 underground and he had agreed. In answer to Mayor McCaron's question as to whether under- ground wiring would be required automatically If this Mobile Home Park is ever rebuilt for any reason, Planning Director Chivetta answered, Yes." He pointed out that Mr. Routert's park is one of four in the City that Is a member of the Western Mobile Home Association and that this speaks well for the' type of park that Mr. Rautert has.
