Planning Director Chtvetta gave a resume of the case, He stated that the Planning Commission had denied the request for this variance by their resolution No, PC69-9 as no hardship to the property Itself was shown to exist; the applicant had created his own problem; there were no exceptional or extraordinary circumstances on the property Involved which did not apply generally to other properties In the same zone and vicinity, and It was this denial that was being appealed. He presented a photograph of the signs In question showing their visablllty from Baldwin Park Boulevard, the San Bernardino Freeway and Franclsqulto Avenue. He indicated on the wall map that the property Is on the northwesterly corner at Baldwin Park Boulevard and Tracy Street; that the applicant had agreed In writing to remove this sign prior to final approval of a new free- standing sign, which was to take the place of the existing sign. He also named five stations which are similarly situated who enjoy the privilege of additional signs: I) The American Oil station at 15755 Franclsqulto possessing two freestanding signs, 2) The Standard Oil station at 1158 Baldwin Park and Dalewood with two freestanding signs and a large canopy roof sign, 5) Shell station, 15477 Dalewood, with a freestanding sign and a large sixty-five foot freestanding sign, 4) Texaco at 3220 Frazler and Garvey having a small freestanding sign on the corner and a sixty-five foot freeway sign on the property and 5) ShelI station, 12999 Bess having a sign on the corner and a freestanding freeway sign. He stated that a sign was being requested for business purposes; that proximity to the San BernardTno freeway was Important to service station business} that he felt they could acquire and maintain a substantial amount of business which would help them and also help the City of Baldv'In Park in that the station would be kept open. Planning Director Chlvetta stated that of all the service stations located in the City of Baldwin Park, they are for the most part non conforming In accordance with service station requirements which were adopted in October 1966; that the service stations listed by Mr. Brook were In existence In 1966 and they are non- conforming stations; that when the service station ordinance was adopted It was agreed that the non- conforming stations should conform with the Code with- in a five year period after adoption. In answer to Councilman Morehead^ question, Mr. Brook stated that he had agreed to remove the existing sign when the new sign was Installed; that he had been remiss In not filing the variance until Mr. Chlvetta proceeded; that he had been led to believe there would be no problem In obtaining this variance. He also stated that they had a canopy sign which they did not feel was as attractive as the rotating ball on the corner and this was the reason they would prefer to keep the rotating ball. As there was no one else In the audience desiring to speak either In behalf of or In opposition to 2V-210, Mayor McCaron declared the public hearing closed. Mayor McCaron stated that since other stations have the same condition and based on the fact that It didn't appear they were objectionable provided some standard was set for heighty that possibly some study could be made on allowing a second freestanding sign If they do not have a roof sign, and also a study on separating the two signs were one Is for freeway benefit and one Is for local traffic benefit. In answer to Councilman Morehead's question, Mr. Chlvetta stated that the permit for sign #2 was Issued on condition that sign #1 the rotating ball) would be removed In compliance with the service station regulations upon completion of sign #2, However, It had not been removed as agreed to by the applicant. Councilman Morehead stated that the Planning Commission and the staff had surveyed the situation} that, to him no hardship had been proven; that the subject company had agreed to the removal of the sign? that an agreement was an agreement and an ordinance an ordinance, but that he would not stand in the way of returning this case to the Planning Comfsslon for further study, Councilman Hamilton stated that he felt It was not objectionable with the signs that far apart} that It appeared removing the sign would be a hardship on the dealer, that the dealer's request for a variance was reasonable, Councilman Gregory stated that she thought the Planning Commission had covered all aspects of this case} that she felt they had given a fair summary and were only carrying out the agreement; that there were other marks of distinction besides signs to Identify stations, Planning Director Chlvetta stated that one of the primary reasons the variance had been denied was because there was no hardship shown and economics was not a hard- ship} that It had to be shown that other people In the same zone and vicinity had been granted two freestanding signs In variance with the City's service station ordinance In order for this variance to be granted. CounciIman Adair stated that the company had agreed to remove the sign, and he felt an agreement was an agree- ment. Mayor McCaron stated that he was sure that the point of location had not been considered at the time the ordinance was drawn up. MAYOR MCCARON MOVED THAT CASE ZV-210 BE RETURNED TO THE PLANNING COMMISSION FOR FURTHER STUDY, COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered, 00- Counci(man forehead stated that he and his wife and City Clerk Balkus and her husband had represented the City of Baldwin Park at the City of Hope Program in the City of Rosemead honoring Mr. Richard Miller^ who assisted In setting up the Charter Circle of Hope In Baldwin Park In 1960.
