He stated that the property owner had started cleanup and was requesting some additional time. City Engineer French stated that photographs had been taken on May 22, 1969 and July 16, 1969. He stated that some work had been done on the property; that this property had been the subject of a previous public nuisance initiation last year, City Clerk Balkus again administered the oath. TESTIMONY WAS GIVEN by: Ruben Duran, 4936 N. Lante, Baldwin Park, stated that the trucks he had on the property were not abandoned; that he would like an extension of time in repairing them; that he was having financial problems; that he would like six months to repair and remove the trucks. City Engineer French stated that this property had been before the Council for a public nuisance hearing on April 17, 1968 and was cleaned up by the first of the year in 1969; that he could not recommend more than ninety days for cleanup and that the property is 266-1/2 feet deep by 66 feet frontage, Planning Director Chivetta stated that this property was zoned M-l, but there was R-I use on it; that he had been out to the property four times this past year due to complaints; that he had sent two or three letters to the occupant to clean up the property and remove the vehicles; that he felt this property presented a serious problem and that mixed uses are not permitted even thouah the zone permits a business in an M-l zone. Rogers, president of the Baldwin Park Jaycees, 4726 Larry Street, stated that his organization had sub- mitted to the City Council a typewritten letter with two enclosures asking the Council to waive all dance permit fees for the coming year 1969-70). Copy of letter in official files.) He explained that part of the money raised, after expenses, was to be spent on the Baldwin Park Little League diamond; that one of the enclosures was the budget including the approximate cost of the field, estimated Income from the dances and how much of this was expected to be expended on the field; that the second enclosure was a list of the dates and a tentative schedule of where the dances would be held. Chief Administrative Officer Nordby reviewed his recom- mendation following a similar request In May for refund of dance permit fees. He pointed out the added cost to the police department to check out the background of the people participating in these dances. He commended the Jaycees for their project but stated that there were numerous charitable, religious and other groups in Baldwin Park, and the City could not afford to indirectly support all of them in this manner, He recommended that the fee not be waived, A copy of Chief of Police Adam's memo was given to Mr. Rogers to read. Mayor McCaron stated that it appeared some extra surveillance would be required at all of these dances; that this would be an added expense to the City and was tantamount to the City participating in the expenses of these dances. He stated that each dance should have its own separate permit and if an undue amount of trouble were encountered, the dances should be discontinued, Mr. Rogers stated that the Jaycees' first dance was held at Landis School last month, that approximately 125 teenagers attended; that the dance was one of the quietest he had ever been to or heard of; that they were attempting to give the teen' agers what they wanted. City Engineer French stated that to properly assess Mr. Marshall's request it would be necessary to include the complete property as part of the hearing and the findings; that the County of Los Angeles had problems with building code violations on this property in the past when it was owned by Mr, Beneke; that he would not have a problem recommending a variance on ceiling height if corrections had been made on all of the other building violations, for instance sheds, car ports and patios are overspanned and electrical installations do not meet the code. Mayor McCaron suggested that Mr, Marshall consult with the City Engineer and bring the matter back to the next meeting. 00- Captain Arthur Martin, Commandant of the Sea-Land Cadet Corps of America, gave a brief history of the naval youth group stating that they were now located at 14500 Pacific Boulevard; that they were planning a grand opening of their headquarters, September 6, 1969, with a parade and luncheon. HISTORICAL SOC t ETY Councilman Gregory stated that she was in favor of this being a committee with citizen participation and that this was a good choice of people. 00- Discussion followed regarding allowing the Planning Director and the City Engineer to make decisions on minor variances. DISCUSSION RE MINOR VARIANCES BY STAFF Chief Administrative Officer Nordby stated that some years ago the problem of administrative variances had been con- sidered, as the procedure to grant a variance many times took several weeks; that in many instances the variances were granted for a relatively minor deviation. He stated that some kind of a guideline had to be drawn to what should be granted administratively and what should go to the Planning Commission and the Council; that he felt this could be more appropriately considered at the next Council meetina. Councilman Gregory stated that she could not think of anything in our building code, unless it was so minor it didn*t make any difference, that the City Council should not be at least a part of; that the Council becomes an apathetic one when they do not know what is going on; that some very minor vari- ances could be given to the Staff but that the Council should keep abreast of all that is going on in the City. Mayor McCaron stated that the Council should still handle zone violations but that minor items in the way of setbacks and building code variances should be allowed. Councilman Hamilton asked if the Staff were granted the privilege of taking care of minor variances to save time, could this matter be brought before the Council at the preceding meeting after the recommendation was made. Mayor McCaron answered that the procedure would have to be changed. Council- man Hamilton stated that he felt some amendments were needed on some of our building codes. Mayor McCaron suggested that Counci Iman HamiIton enumerate the items he had in mind, give them to the Planning Commission and have the Commission give the Council a report on them. Mayor McCaron stated that the cost of a public hearing is about $100; that this was what the Council was trying to avoid and also a delay in handling cases; that he would like to see an ord- inance brought up for study at the next meeting.
