M. JANSSEN 3914 VfNELAND Mrs. Mary Janssen, 5914 VIneland, owner of the property, answered questions In regard to storage In the home. Councilman Morehead stated that If this Conditional Use Permit were allowed he would like Section k) to Include the statement that no other uses would be allowed on the property; that It would be restricted to the use of a guest home. Councilman Gregory stated that the Resolution did not state what type of ambulatory patient would be allowed. She questioned the fact that there was no overhead cover- ing between the main house and the small house to the rear. Discussion followed. DISCUSSION Cl+y Attorney Flandrick stated that the term rest home" in the Code would preclude any type of mental patient; that in any home for aged persons senility will set in from time to time, and there is II+tle that can be done about this. Mayor McCaron stated that this location is In a strictly residential area; that the nearest rest home is a considerable distance away, that the home was built for family use and not to accommodate patients; that a Conditional Use Permit stayed with the property and that he did not see that this was a favorable usage to be allowed. In answer to Councilman Hamilton's question as to whether this type of home had to have a license from the State and meet Its requirements as well as those of County welfare, City Attorney Flandrick stated that was correct. Mr. Hadley stated that, as he had pointed out previously, there were apartment buildings and rest homes not too far away; that the taxes were $250,00 on I) parcel and $450,00 on the other parcel; that the applicants were suffering a hardship by not being allowed to benefit from development of this property. Mayor McCaron stated that taxes would not be sufficient reason to change the use of a property, As there was no one else in the audience desiring to speak PUBLIC HEARING either In behalf of or In opposition to CP-128, Mayor DECLARED CLOSED McCaron declared the public hearing closed. CP-128 Councilman Gregory stated she sympathized with the applicant, however, there are many property owners in the City who have deep lots on which they pay taxes but are unable to develop due to zoning, etc. COUNCILMAN GREGORY MOVED THAT THE COUNCIL CONCUR WITH THE CP-128 DENIED PLANNING COMMISSION'S RECOMMENDATION AND DENY CP-128. Case continued from October I, 1969,) Planning Director Chivetta reviewed his report on Case ZV-216. He stated that the Planning Commission had denied the request based on the fact that the applicant failed to justify a hardship; that the granting of the variance would seriously affect the Comprehensive General Plan; that the area is proposed for M-l uses and that to have the person reoccupy the structure would seriously affect the M-l Zone; that the structure itself was substandard and was posted In excess of a year ago as substandard and that there were corrections to be made, He stated that all the lots were under one ownership. TESTIMONY IN FAVOR WAS GIVEN by: Vincent Arnerich, 659 So. Spring Street, Los Angeles, stated that at the prior meeting this matter had been presented, fundamentally, on the basis of whether or not he had received notice; that there was no evidence Intro- duced at that time with respect to the elements of a nonconforming use and he wanted to present that at this time; that there are presently two structures located on the'property, one of which Is rented; that one structure was apparently posted as not being occupied for six months; that at the time of the posting It was occupied; that he had Introduced a letter from the State at the hearing which showed that It was occupied up until June 5, and h® had acquired title on June 2, He stated that thereafter he was represented by Mr. Shuban; that he was in a position to say he had not received notice through the mall as to the posting. He also stated that the same use requested under the Variance Is the use being enjoyed by adjacent property; that if the Council granted the variance he would agree to conditions Imposed by the Council; that a type of limitation could preserve the Master Plan; that he recognized that ultimately the greatest use of the property'would be M-l. Mayor McCaron explained that these lots were an accumulation of remnants of lots purchased by the Highway Department for the Freeway, He stated that to allow this property to be rehabilitated would mean that the usage could continue Indefinitely, and it would take the owner a longer time to recoup whatever initial Investment he had made by allowing him to spend more money on the property. He noted that other properties In the area were deteriorating,. Councilman Gregory suggested that the matter could be sent back to the Planning Commission to see what stipulations and time limit would be placed on this property and that this could be a way to improve the area, Mr. Shuban stated that a time limit could be figured on the basis of the amount of money spent for rehabilitation and the amount of time to get the money back; that If the City rezoned In a shorter period of time it would be to their advantage as the Increase in the value of the land would more than pay for their improvements. Mayor McCaron stated that all lot lines should be erased as one of the requirements and keep the property as one parcel, As there were no objections.
