Meyor pro tern Morehead s+a+ed that this was a Joint meeting
of the City Council and the Planning Commission where every-
one should feel free to express their opinions and ask
questions; that he surmised that each one present would
speak up and make the meeting worthwhile.

Chairman McCord stated that they were there to work together
as two bodies for improvements in Baldwin Park; that they
would present pictures; that both bodies could make sugges-
tions to help clean up the City. He suggested that a member
of each body attend the others meetings and relate their
findings; that he feh- this would be helpful In making
decisions*

Planning Director Chlve+ta stated that the slides would
show what the Planning Commission would like to do with
the City; that an enforcement program was underway; that
they were trying to make the businessmen aware of the
problem* He gave a resume of pictures in four ca+agoriess

Deteriorated and Rehabilitated and 4) Structures and
Buildings Receiving Special Awards.

of plans and also the builder? that it is the Building

Planning Commission set conditions, that changes can not
be made without permission from the Building Department,
He questioned whether the Council wanted the Planning
Commission to watch these thingsa

duty of the Council or the Planning Commission^ that
Installations should be checked with the plot pjan^ that
there is a form inspection before pouring the concrete
and whatever is set forth in the conditions should be

Chairman McCord stated that if they had let McDonald's
go ahead they would have had to set back the arch when
Ramona is improved and widened, that even the posted
building permit had disappeared for awhiioo

In answer to Councilman Gregory's question,, Pianning
Director Chivetta stated that the Building Department
does get a copy of the Resolution, that the pians are
stampedp Approved subject to Resolution No—o" He
said he was not sure the inspector understands the
purpose of the Resolution^ that he hopes this can be
overcome by in-service training^ that possibSy prior
training wasp you only inspect what you are cai'ed to
inspect D if you find other violations this might be

Councilman Gregory s+a+ed that what they were talking
about is what is not being done; that she felt this
was an administrative problem of which t^e C^+y Manager
should be made aware.

Councilman Adair stated that this problem lay between the
Planning and Building Departments; that the Building
Department should contact the Planning Department and
see tf they lived up to the agreement, such as in the
case of the Mobile Station and McDonald'So

Mayor pro tern Morehead stated that a competent inspector
should not have to contact the Planning Department and
if they can't read or abide by the conditions then there
Is something wrong.

minutes for the Building Department to consult with the

and whether the Council expected the Planning Commission to
go see them before making a decision*,

the Planning Commission to do whatever was necessary to make
a decision; that if it was necessary they should go and see
the buildings prior to moving; that he personally tries to
avail himself of all information; that he has confidence in

Commissioner King stated that other ci+ies are rejecting
move-Ins, for Instance the city of Santa Ana rejects move-Ins
and is not concerned if they have to go to court on one and
lose one case out of ninety-nine.

Chive+ta explained the presentation would be made to local
businessmen in conjunction with 01 Pnfv students1 study
on urban Ills; that cleanup, upgrading and building cor-
rections were a cooperative effort,

that licensing was revenue; that applications are checked
by the Planning Department; that Ordinances should be
implemented.

In answer to Mayor pro tern Morehead's question regarding
the pictures depicting nuisances as to whether these
nuisances had been cleaned up or why wasn't abatement
started, Planning Director Chlvetta stated that the City
had instituted nuisance abatements; that some were cleaned
up, but the next day litter accumulated againo He stated

that the next action Is to take the matter to the District

on Ramona railroad right-of-way for four days and also

Chairman McCord suggested that this matter be considered
In future budgets; that he was not thinking of himself.
He req.ues+ed that Council consider taking the building
Inspectors and the enforcement officer out from under the
Engineering Department and putting them in another place
where they would be more effective than where they are.
He felt some of the trouble was right In there; that they
are told to go and do a Job; that If they were under their
own department then they would ba more responsible.

Councilman Gregory said Mr. Chlvetta need not leave; all agreed.
Councilman Gregory stated that these were organizational COUNCILMAN GREGORY
problems and should be referred to the City Manager; that
this meeting pointed out discrepancies and problems; that
Mr< Nordby should listen to the tapes and review the minutes
and then, if necessary, a rnee+Ing with staff could be held.
She said she had enjoyed the slIdes and the thought put into
them, that sometimes we are blInd as to what Is in our City.
In regard to hearings, she stated that when there Is testimony
one has the tendency to forget what Is In the Agenda Packet
and only consider the new evidence; that perhaps Planning
Director Chlve+ta should tell the Council that the Planning
Commission had not heard the same Identical evidence^ She
stated that Council needs guidance from the staffo

Commissioner King stated that he felt all of the questions
had been brought out; that he did not think the Planning
Commission should be commended but that In parades
the Planning Commission should ride behind the Council as
a quasi-Judicial body,,

Commissloner Middle+on requested Ideas on thoughts on
interpretation of Ordinances, He stated at times the staff
and the Planning Commission recommendation was denied; that
sometimes the Council had a split vote and sometimes the
Commission and the Council come to the same conclusion,

Mayor pro tern Morehead stated that seven Planning Com-
missioners make a decision and five Councifmen make a
decision; that quite often the Council hears testimony
which had not been given before the Planning Commission;
that when the Councilman votes, that is his opinion; that
Councllmen consider recommendations and evidence and If
they learn nothing different from research or evidence,
then they concur with the Planning Commission's recom-
mendation*

Planning Director Chlvetta stated that In court cases on
appeals, the same Identical evidence was presented to the
appellate court. He read the four requirements to be met
on a Zone Variance and explained If any one item were not
true, the Variance was denied by the Commission. He said
that possibly the same evidence should be presented at
the Council and the Planning level,

Councllman Adair stated that In many instances there are
no protests at Council meetings, whereas Planning Com-
mission minutes indicate testimony, and that new evidence
or testimony or lack of) has a direct bearing on Council's

Chairman McCord suggested the Mayor and the Ci+y Council
Initiate a cleanup campaign again and this would help some-
what +o make the town l,ook better. He felt the Joint
meeting was productive; that the Commission tried to give
good decisions; that the Commission had benefited from the
meeting and hoped It had been of benefit to the Council too,

up campaign*

Mayor pro tern Morehead said that this had been a productive
meeting; that items had been brought out which he had not
been aware of; that some of the problems were administrative
and bear investigation by the City Manager; that Mayor McCaron
and Councilman Hamilton should be given a copy of the minutes.
