He pointed out on a map on the wait the area involved, TESTIMONY IN FAVOR WAS GIVEN by: Paul Frykbergi 4125 Cutler, explained to the Council, the circumstances involved in the purchase of this property. He stated that a11 of the houses on this particular plot of ground are good for about twenty years and the four pieces of property taken a11 together are not really large enough for a proper R-3 development; that he needed approval of the lot split in order to give Mr. Perez his money back. City Attorney Flandrick stated that in the absence of another zone variance all the Council could approve would be Plan 2; that they could not approve Plan 3 unless they imposed as a condition that Mr. Frykberg obtain a zone variance to allow the creation of three interior lots. TESTIMONY IN OPPOSITION WAS GIVEN by: Atfonso Perez, 4054 Vineland, stated that he was no longer interested in the property and just wanted his money back. Mr, Frykberg stated that if lot lines, as in Plan 3, were established then the homes could be sold; that otherwise he could get no more for the two lots than for the one; that if the lot split were not approved he might have to take further recourse. In answer to Councilman Hamilton's question as to whether the two houses were there before the Ordinance was enacted, Planning Director Chivetta stated that they had been there about twenty years. City Attorney Flandrick stated that these ots do not con- form to our existing Code for R-3, for a number of reasons. First they do not have street frontage and secondly the lots proposed to be created do not have a minimum of 10,000 square feet. Since the variance and the other matter are necessarily tied together the Council can not approve the parcel map without a zone variance in the absence of an amendment to the City's R-3 zone regulation. Under the present circumstance all the Council could fo would bp to approve Plan 2. However, if the Council were of a mind to approve the lot split. Plan 3, as proposed by Mr. Frykberg, one of the conditions would have to be that it would not be effective until he obtained a zone variance to permit the deviation from the Code, both as to street frontage and as to minimum lot size. City Engineer French presented photographs of the property taken on December 17, 1969 and on January 7, 1970, TESTIMONY WAS GIVEN by: Eugene Lackey, 12741 Bess Avenue, Baldwin Park, stated that, due to financial reasons, he had been unable to obtain a lot split; that he had thought of applying for a zone variance, that he was witling to clean and fix up the property; that he had spent three weeks cleaning up the rear of the lots; that he did not know this action was being initiated. City Engineer French enumerated the items which would have to be taken care of on this propertyo He stated that he thought Mr, Lackey could take care of every item except Item d). Mr» Lackey stated that he had been told that he could secure the house and not have to do anything to the interior of the house, He stated that he needed about thirty days. Councilman Morehead stated that it appeared it was incumbent upon the Council to start looking for a suitable replacement for Councilman Adair and inquired the procedureo Mayor McCaron stated that the Council could either adjourn this meeting to an adjourned meeting or carry the matter over to the next meeting; that an appointment must be made within 30 days. City Attorney Flandrick stated that the matter could be determined fay the people at the April 14th election; that the only additional cost to the City would be to file a resolutiono Councilman Gregory stated that most appointments are made when a resignation or vacancy occurs mid-term or far from a normal election date; that at this moment there are approximately ninety-six or ninety-seven days until the City election, April 14th; that she believed in a governing body that is elected by the people and suggested to the Council that they wait the allotted time and then set a date for the special election for a person to fill the unexpired term of Council- nan Adair; that this date could be April 14, 1970 the same date as the regular City election; that from that day on the Council would then have a11 elected officials, no appointees, and would reflect the people's choice, not the Councils.
