He explained that some of the signers of the original petition were wives whose husbands had not seen the petition. He asked whether this work required a licensed contractor.. City Engineer French stated that the ordinance required that any work done within the street area must be performed by a licensed contractor. He commented that one of the circu- lators of the petition.had signed the petition against it. Upon the recommendation of the City Attorney, Mayor McCaron declared this case would be continued to the February 18, 1970 Council meeting. City Attorney Flandrick asked City Engineer French whether he was familiar with the plans and specifications and diagrams relating to the district to which he answered, Yes sir*" In answer to whether there was any change of grade involved in this proceeding which would affect the street openings. City Engineer French stated that there is a new street which will be designed, and there is no change in the grades of the existing street., City Attorney Flandrick then asked hi.m, Based on your familiarity with the plans and the specifications of the work proposed, is it your opinion that all properties included within the district will receive benefit from the improvements as proposed?" City Engineer French replied, Yes s1r»" In answer to what the nature of the benefits would be. City Engineer French stated that the greatest benefit to the area would be added circulation, that the whole area was now zoned M-1» and a large part of the area cannot obtain vehicular access except through an R-1 area; that there was heavy truck traffic which, by this district, would be provided direct truck routes; that at present th6 area was not adequately served with water for manufacturing uses when water demand and fire flow were considered; that the district will be provided with adequate water for fire flow and manufacturing demandso He stated that this district benefits the property to the extent that appraisals made by the City in the area, which essentially is landlocked M-1, $how that there is an apparent sizeable increase in property values, when they have direct access to the freeways, which more than exceeds the assessment to the area, City Attorney Flandrick asked whether the nature of the improve- ments would be curb, gutter, sidewalk, storm drains, water lines and street Improvements as such. City Engineer French replied that alt properties would not get the same improvements; that the streets would be developed to a manufacturing standard so side- walks would not be constructed along a11 property frontages; that they would be constructed in accordance with City standards thereof; that sidewalks would be at the intersection of Dalewood only; that water would service all of the properties; that curb and gutter would be installed on all properties which do not now have curb and gutter; that the street section would then be adequate to serve a manufacturing area, which it does not now do. City Engineer French stated that as part of this district a requirement would be a railroad crossing, with signals and gates, which would open up the area; that it had taken approximately two years to obtain the permit for this crossing from both the railroad and the Public Utilities Commission. In answer to Mayor McCaron's question. He said he could see new curbs and gutters on Virginia Avenue and a new blacktop street but that he could not see a whole new street and opening up this property for Mr. Syhre when it was costing him nearly $3,000, JULIAN WILKES CONT'DJ FRED MERCER 1312 VIRGINIA AVE. PARCEL NOS. 5 & 48 Andrew Nemeth, 1318 Virginia Avenue^ Parcel NOc 6)9 stated that land mass was the criteria for the formation of this district; that of the ten signers on the original petition, four were protesting and requesting that their signatures be withdrawn, another was now deceased and the property sold; ANDREW NEMETH 1318 VIRGINIA AVE PARCEL NO. 6 another had sold two out of three parcels committed to the proposals^ He stated that the street was in poor condition; that he and some of his neighbors could not see a total cost on their street of $154g326o18 plus; that heavy equipment now usiirg the street was not helping matters; that although the area is in a period of attrition and needs to be modernized, the entire area is not ready for the development proposed; that at the present time, with present money conditions^ the tremendous amount of money involved for the value to be received and the method in which the project would be financed were not conducive to create enthusiasm from the eleven resident prop- erty owners; that if the petitioner proposes to open the area at the dead-end of Virginia Avenue^so that it is usable property, he should do so the way any developer wouldo He stated that opening up the area would only create a traffic problemo City Clerk Balkus agains administered the oatho Gerald Courtemarche, 1663 No Virginia Avenue;, Parcel 36), asked City Engineer French whether lights would be installed at the end of Vinetand so that the people who would be using that street would be able to get out as it is almost impos- sible to do so the way it is now; that opening up the traffic to Vineland would put an added burden on a forty«foot wide streets City Engineer French stated that this district did not go to Vineland, did not include any improvement on Vineland and there was no proposal for a stop tight on Vinelandc He stated that under this proposal there will be a direct access to the freeway and there will not be the heavy traffic coming down through Whitsett and the surrounding area; that the Vineland traffic would not be reduced or increased^ L^ M, Janseng, Jansen Transportation Company 9 4843 Cecilia Street, stated that he and his brothers felt this assess- ment was more than they could afford, that the street going through would not help them in any way; that they had purchased the land for a truck terminal; that although they would receive $50,000og they would be giving up $45,000.; that they would be giving up an acre of ground for practi- cally nothing. Councilman Morehead stated that he concurred with this to the extent there was nothing wrong with the procedure but that it would delay the filling of vacancies; that he did not think any mistakes had been made in his nominations for vacancies except that some people had made a mistake in not fulfilling the obligations, which he had thought they would, so that an application would not have done much good in making the selectionso Councilman Hamilton stated that there had been many good men appointed to the commissions and he had heard of no complaints but that there had been two appointees who had never attended a meeting, that if his suggestion were followed the City would acquire a good potential of people who were Interested in serving.
