Mro Later feels that this action should have been initiated tour years ago when he bought the building and not nowo As there was no-one in the audience desiring to speak either in behalf of or in opposition to 70-N-49 Mayor McCaron declared the public hearing closed, RESOLUTION NO. 70°35 FINDING AND DETERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N°4) City Engineer French stated that in Section 2o a time limit of 60 days" should be inserted and that the Staff Report should be amended to reads Complete demolition or take out permits in compliance with the Codes within 90 days 6" Mayor McCaron stated that it should be brought out that the applicant had merely made an application for a business license; that the licensing department is a different depart- ment from the building department so the building department would not be aware of the license and it is not the procedure to check out buildings which are to be occupied for a business to see whether they conform to the Codec He stated that as far as the timing was concernede a number of buildings in Baldwin Park werecyo^Ci^g a nuisance and it takes a period of time to cover all of them and it just happened to hit this particular time for'this action, that it was still incumbent upon the property owner-to watch his own property and see that it meets the Code if it 1s going to be occupiedo COUNCILMAN MOREHEAD MOVED THAT RESOLUTION NOo 70»35 BE ADOPTED AND THAT FURTHER READING BE WAIVED. He pointed out that some action has to be taken in the near future if the City is going to be able to save access to the area, that it had taken two years of negotiations with the railroad to obtain a rail crossing, that if action is not taken in the near future it would be virtually impossible to obtain a crossing anywhere along the track in this area for an outlet streeto A/D 70-1 VIRGINIA AVE. PARCEL NOS. 10. 17. 18. 19. 20. 21, 27 AND 28 TESTIMONY GEORGE TAUBE 4928 WALNUT GROVE SAN GABRIEL TESTIMONY WAS GIVEN bys George Taubeg 4928 Walnut Grove,, San Gabriel., owner of property at 1324^ 1328 and 1332 Virginia^ stated that he had purchased this property with the thought that there would be no objections to improving the streets, that they had hopes of possibly moving their business from San Gabriel in the future, that they hoped to increase their investment by improving this property, that they felt this assessment district would increase values; that without the street the area will not developo In answer to Councilman Gregory°s questions as to whether they rented^ Mr^ Taube stated that the people he purchased the property from were stilt using the properties for stor- age in the back but that no business had been operated thereo Fred Mercerg 1312 Virginia Avenue 3 Parcel NoSo 5 and 48)9 stated that he wished to speak in favor and in opposition to this assessment districto He stated that he was in favor of putting in a street, that he would like to see the street improved as it would help his business;) but it should be worked out in a different way and cost less than the way it is now; that vacant lots could be purchased and a sixty-foot street made straight into Vineland which would open up this whole district, that the Council could make all of the prop- erty there M°1e not R°1 which It Is now down on the tower end. and put in a beautiful industrial park, that you would then have business therec Robert So Funks 1402 and 1408 Virginias Parcel Nos. 14 and 15)e stated-thai although the Council had received a protest tetter from him, he would tike to make a statement in favor of the assessment district; that he was convinced that the basic engineering was right| that there waSe however a no way in which he could benefit as his property was futty developed; that the reason for his objection to progress in this case was the manner in which it was being handled; that the improve- ment would be desirable as everyone within a half mite radius would obtain some benefit by the freeway access but that this would be a minor benefit and the City Engineer had pointed out that they might not always have that possibilityc He stated that the real problem was that there were only forty parcels with an assessment of $302e000c which would come close to bank- rupting them; that he an^cipated an increase of at least $500, in taxes if the street were pavedo He suggested a compromise Continued) FRED MERCER 1312 VIRGINIA AVE, PARCELS 5 & 48) ROBERT S. Virginia Avenue and the people with larger parcels would be A/D 70-1 CONT'D, allowed to sells factories could be built and as each build- ing Is constructed, curbs and gutters would be required; that when 502 is reached, curbs and gutters would be re- quired of the whole street. He stated that the existing street is not a bad street, that if the rebuilding of the existing Virginia were elimlnatedg, it would save $1800, per each 100 square-foot frontage and the property owners who are not ready for this would be given a four-year breathing spell"; that at present the property owners were In no position to finance a project of this kindo He sug- gested that perhaps there was a way to obtain the exit and greatly reduce the cost for building the road or carry the road only from Datewood over the tracks through Mro Syhre's property, then stop and make no further development on Virginia Avenue until there was enough building to justify it; that under some compromise, where costs can be cut greatly, he would withdraw his objections on that basis. In answer to Mayor McCaron, City Engineer French stated that his Staff would be willing to meet with the objecting property owners and do anything possible to save the district; that it was their opinion that without the water for industrial use and without access, this property would never develop to an M-1 standards Andrew Nemeth, 1318 Virginia Avenue, Parcel NOo 6), stated ANDREW NEMETH that 902 of the people who live on this street are objecting to this district; that his street was gerrymandered into this district; that this petition was originated by Mro Syhre; 1318 VIRGINIA AVE.
