He referred to Item c) of the Planning Commission Resolution NOo PC70-4 regarding the need for street improvements stating that now that he had purchased the property he would be more than happy to make the improvements and make the necessary dedi- cation to the Cityo Referring to Item d) regarding the need for a comer-radius dedication for the future street, namely, Boret Street, he stated that, to his knowledge, there was no dedicated section of Borel Street now and since the people on Cragmont Street wished to get their street dedicated as a City public street sometime in the futures he stated that he would like to see Item d) stricken and brought up at a future times In reference to Item e) that the property was being used as a truck yard with two temporary buildings on the property which had not been approved by the City, he stated that this was true but that he had applied for a permit for the building and he had been advised by the Engineering Department that a Conditional Use Permit must be obtained first.. Regarding Item f) that Eiton was not of sufficient width or construction to carry the type of traffic proposed, Mro Shafer said that they did not store anything in their yards except the empty trucks; that he did not feet their use would be detrimental to the mechanical aspect of Eiton Street. Referring to Item g) that the facts required by Section 9473, of the Baldwin Park Zoning Ordinance, were not present; he stated that he felt they were present; that he did not feel there was a truck yard anywhere in Southern California as neat and meticulously kept as theirs; that the City of Baldwin Park had sent them a letter oh September 16, 1969, commending them on the maintenance of their property, He read the letter in fullo Copy of tetter in official files.) Councilman King questioned why Mr. Shafer had taken approxi- mately nine months to come in for a Conditional Use Permit. He stated that he would uphold the recommendations of the Planning Commissiono Planning Director Chivetta stated that the Conditional Use Permit procedure was not enacted when the other three yards were started and therefore no Conditional Use Permits were required; that equipment storage yards at the present time do require these permits. He stated that this area was deteriorating and the more uses which come in and create deterioration, the less that the residential owners will take care of their property; that the City is constantly in the process of filing nuisance abatements in this area. He stated that this property had been used for a trailer and boat storage yard and not as a truck storage yard; that the Planning Department had been working with Mro Shafer and hoped he would work with them, Mr a Shafer stated that they did not intend to just park trucks on this lot. He presented plans of the building, which he said they planned to put on the property. He stated that they were just waiting for the permit; that this development would bring a larger tax base which would give the City more income. He quoted sections of the State Subdivision Act which indicated to him that the tract was not eligible for an extension. City Attorney F1andr1ck stated that City Engineer French had advised him that the final tract map for Tract 25587 had been timely recorded; that the request from Mr.. Sutterfield was for an extension of time on the Improvements which he was required to put in as part of the conditions of the approval of the tract map, that this was covered by a written agreement which was supported by a surety bond.
