He stated that his depart- ment had contacted Mr,, Syhre who agreed to sign dedication papers, easement deeds for the right-of-way with the understanding that the district would be formed and that the assessment would be spread equitably. He stated that now withdrawal of protests had been received for 18«2% of the property owners, leaving 27.9% protests; that his department had been in contact with a couple of other property owners who had agreed that they would withdraw their protests but they did not, that one other property owner had been contacted who must have property acquired from him for street purposes and he had stated that, with a majority of people being for the district, he would not fight the district but he would not support it; that the property could be acquired without a condemnation fight. City Engineer French recommended that the district be formed. There were no written protestso Planning Director Chivetta stated that on January 28, 1970, the Planning Commission had approved a Conditional Use Permit for the operation of a Day Camp at 13247 Garvey Avenue. He stated that this property was located on the northerly side of the San Bemardino freeway between Fairgrove on the east and Frazier Street on the west; that the building existing on the property was previously utilized by the Peppermint Palace Bar; that the applicant desired to operate a Day Camp for children of working mothers. He stated that the Planning Department had been working with the applicant and the property owner since that date and they had explained to the City that there was a possibility of working out the difficulty on the dedication if the City would offer a proposal which would allow them to use the land for a fifteen" or twenty-year period in which the building would be amortized, and the build- ing would be removed from that portion of land to be dedicated to the City; that this was acceptable to the Staff, Planning Director Chivetta stated that the applicant still desired to appeal, that it was his understanding that the applicant now desired an additional thirty days continuance or longer to work out other problems because he felt that the site was not adequate in size or shape for this particular use; that perhaps if a larger parcel of ground were found, they could then apply for a new Conditional Use Permit and this property could be used for a secondary Day Camp a RESUME CP-142 CONFD. Commission, at their March 25, 1970, meeting, reevaluated the case in accordance with the Council's directive and it was their consensus of opinion that the yard would be detrimental to the surrounding area in as much as the area is predominately utilized for single family residential uses; that the Commission was reaffirming their previous denial of the truck storage yard, but that if it was the desire of the Council to approve this particular use, they were recommending eleven 11) conditions to be Imposed upon the granting of the Conditional Use Permit. List of conditions in official files) In answer to Mayor McCaron's question in regard to a study of zoning in this area, Planning Director Chivetta stated that the Commission had undertaken such a study, that it would take awhile as there were some two hundred 200) properties involved, that a land-use survey of the area had been completed which showed a high percentage of residential uses, even though the property is zoned for manufacturing; that a majority of the properties were in a deteriorated state,, The Commission was taking two steps, one to recommend to Council conditions for the truck yard, so as to clear the docket of that particular item and second, to undertake the study and then make a recommendation to Council which would encompass the possibility of legislation which could be enacted, rezoning and other steps which could arrest the deterioration and blight, and put the property in that area back on a paying basis. He stated that the Commission was proposing to recommend to the Council, along with their study, a new circulation element in the area; that at one time, after a five-year study, the Planning Commission had submitted to the Council a report for reclassification in the area with recom- mendations to arrest blight along with a circulation element; that this had been held in abeyanceo He enumerated several reasons for the deterioration in the areao He stated that the Commission felt that this item of the truck storage yard should be taken care of and then no matter what the outcome of the study» this item could then be either rendered conforming or nonconforming by their recommendations, if accepted by the Councilo He stated that of the 200 properties in the area, approximately 150 are nonconformingo He informed the Council that in addition to the land-^use study which had been completed, there were approximately another eight to nine different studies to be completed in the area; that they hoped within the next 90 to 120 days the report should be completed, perhaps sooner,, MAYOR MCCARON MOVED THAT CASE CP-141 BE TABLED.
