In accordance with Section 2703 of the Municipal Code the City Council met in open meeting at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items, The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Morehead led the salute to the flag. Jones Planning Director Chivetta stated that this case had been RESUME continued to allow the applicant to resolve some additional problems; that one was whether or not he wanted to maintain the dairy as situated on the property or whether he wanted to apply for a parcel map to split the dairy off from the rest of the property; that the applicant had submitted such a parcel map which would have to be considered by the Planning Commis- sion as there was a street on the general plan affecting the propertyo City Attorney Flandrick stated that subsequent to the last Council meeting, at which time this case came before the Council, the Planning Commission file of 1961 had been reviewed in regard to the zone variance granted at that time to Mr. Jones; that at that time the property was in the A-1 Zone and the use at that time was nonconforming; that at that time Mr, Jones applied for a zone variance which was approved by the Council; that this variance rendered the property to a conforming status; that it was his opinion that this variance, notwithstanding the subsequent change in zone from A-1 to R-1 and now proposed R-3, carries over and the use is not nonconforming, as when the current zoning regulations were adopted, alt prior zone variances granted were validated; that, in view of this, the comments made at the April 1, 1970 Council meeting were inappropriate in that the dairy use was a permitted use by reason of the zone variance; that there was a problem of other single family structures on the property which would become nonconforming once the property was rezoned R-3; that these structures would have to be either removed or a zone variance applied for and received with regard to the struc- tures before any other building permit could be issued; that Mr<, Jones would not have to file a parcel map with regard to the dairy sates; that it would not render the entire property in a nonconforming statuso TESTIMONY IN FAVOR WAS GIVEN by: TESTIMONY IN FAVOR Leonard Jones. 3258 Frazier Street, Baldwin Park, stated that LEONARD JONES he would like to request that the street shown on the general 3258 FRAZIER ST. plan be deleted as it served no useful purpose under the circum- stances; that his engineer had prepared another map showing separate parcel So Mayor McCaron stated that it appeared that this case would not have to go back to the Planning Commission for any determination of the street; that there was a question of a termination date if the dairy sales were allowed to continue; that since title to the property could be transferred to someone else and the dairy use could still continue on under the present zone variance, he would like to know Mro Jones' intentions in regard to this use. Mro Jones stated that he felt a11 objectionable factors of his operation had been eliminated; that it would be desirable if he could operate the dairy sates for a few more years. He asked Mr. Jones whether this was his intention, Mr* Jones stated that it was, that he would continue the dairy sales for at least five or six years, Discussion followed, Mayor McCaron stated that the attorney had suggested that a time limit be set on the dairy sales use rather than stating that title could not be transferred as a dairy use to someone e1se» Mr» Jones requested a seven-year time period for dairy sales use* He stated that eventually the buildings, an R-1 use, would have to be removedβ€ž City Attorney Flandrick stated that if the property were re- zoned R-3, the R-1 buildings would then be nonconforming and no building permit could be issued until a zone variance were obtained or the residential structures were demolished. Mr. Jones requested permission to show the parcel map, prepared by his engineer, to the Council, City Attorney Flandrick advised against this to prevent pre- judging of the case at a later date. He stated that Mr. Jones could proceed with the parcel map and if it were approved it would eliminate the problem. Mayor McCaron stated that for proper development that all of this property should be in one parcel* City Attorney Flandrick stated that City Engineer French, Planning Director Chivetta and he would meet with Mr. Jones and they would present a written statement to the Council o"^ the alternatives and Mr, Jones' desires. As there were no objections, Mayor McCaron stated that the public hearing on Z-320 would be continued to the May 6, 1970 Council meeting. 00- It was the time and place fixed for a public hearing on 69-S-30, a Short Form 1911 Act, on the East side of Landis Avenue between Cavell Place and Olive Street to hear any protests in regard to the cost for the construction of curb and gutter on Parcel Nos. 1, 2, 3, 4 and 5. There were no written protests. TESTIMONY WAS GIVEN by: Leslie Martin, 3225 Rita Street, Pasadena, representing the owner of the property, W. J. Tuscanny, stated that he had seen the lot just prior to the time the work was completed and he thought it looked alt right, that there was grass but not weeds; that since the disc ploughing on the cleanup, a car could not be driven on it; that 90% of the grass was still there and the ground was titled with holes; that he had inquired about the cost of ploughing and had been told it would be $10.00 an hour and it would take about two hours which would have made the cost about $20.00; that he was questioning the whole thing; that if the results of the City's cleanup had been realty good that he would not have had any objections to it; that the place looked worse now than it did before the cleanup; that his car had become stuck on the property due to the way it was ploughed. In answer to Mayor McCaron*s question Mr. Martin stated that he had made all of the pco/ments on this property but that the prop- erty was in Mrs Tuscanny*s name. City Engineer French stated that he had not been on the property; that cleanup work had gone to bid; that the tow bid of $50.00 had gone to Manupt Satinas and that this Dtus the administrative Continued) RES. TO 5/6/70 PUBLIC HEARING WEEDS 69-W-98 POSTINGS. MAILINGS ONE LETTER OF PROTEST, RICHARD N. SCOTT 4/6/70 LETTER, R. N. SCOTT 11/1/69 00- It was the time and place fixed for a public hearing on 69-W-98, to hear objections or protests to the Report of Work of the City Manager, regarding the amount of assessment for 4723 Stewart. Proper postings and mailings had been accomplished. City Engineer French read in full a letter of protest dated April.6, 1970 which was received from the property owner, Richard N. Scott. Mr» Scott indicated that he would be happy to pay the $85.00 figure agreed upon but did not feel that the additional charges were in order., City Engineer French read in full a letter from Mr. Scott dated November 1, 1969o Copy of letter in official fileSo) Mr., Scott requested at that time that the cleanup be delayed until the end of November. City Engineer French stated that the cleanup work had been delayed and the City had received a few complaints from the neighbors; that the property was cleaned up the 9th of March, 1970; that he did not know anything about the $85»00 figure; that the bid was $100. for the cleanup of the property. He requested that the CORPS CONT'D. Mayor sign and endorse the invitation from their organization to the President of the United States and to the fifty Governors to come to Baldwin Park for the President's Youth Parade and for the dedication of the ship on July 5th at Seat Beach. Captain Martin stated that, on behalf of the President of the Naval Booster Society and the Sea-Land Cadet Corps of America, he was making Mayor McCaron an Honorary Plank Member of their organi- zation. Copy of request in official files.) Councilman Morehead inquired as to why this request was being made to the City Council. City Treasurer Codling explained that this was the annual seminar and that she had not attended last year due to illness. Councilman Morehead inquired whether this request had been cleared through her department head and the City Manager in view of the fact that she wore two hats" daily; that it appeared to him that this request should be an administrative action. Councilman Gregory stated that the request was in order from an elected City official; that she saw nothing wrong with the City Treasurer attending the seminar; that there was no budgetary problem. COUNCILMAN GREGORY MOVED APPROVAL OF THE CITY TREASURER'S MOTION TO APPROVE REQUEST. REQUEST Councilman Morehead stated that he was not opposing the re- quest or the expenses, however this appeared to be an adminis- trative not legislative decision. City Treasurer Codling stated that she had given City Manager Nordby and Finance Director Duncan a memo a month ago and that she had discussed her request with the City Manager; that she had been appointed to the Registration Committee and that she was going to attend; that she had receivpd no opposition to the request; that the department head was aware of it; that the prior City Treasurer had always informed the Council that she was going to attend; that the City Clerk, at the last City Council meeting, had requested Council approval to attend a seminar. City Attorney Ftandrick replied, Yes, sir." City Treasurer Codling stated that she was following procedure; that the former City Treasurer had always notified Council. Mayor McCaron stated that he did not want the Council to over- ride the department heads or the City Manager; that if she had their permission then the Council could act upon it but he did not think the Council's permission was needed. Councilman Gregory stated that this was a request from an elected official to elected officials. In answer to Mayor McCaron's question as to whether this would be taking time away from her regular job. City Treasurer Codling stated that it would be four days away from the office* Mayor McCaron stated that this would be where the Council would be overstepping its bounds» Councilman Morehead stated that an elected official did not have to ask the Council for permission to go anywhere unless money was involved; that if she, as a City employee, was asking the Council for time off, he did not think the Council had authority to grant it unless the head of the department and the City Manager had denied it and she had appealed to the Council. Councilman King asked the City Manager to state his opinion on this request. City Manager Nordby stated that the request from the former City Treasurer and this City Treasurer's request to attend a con- ference were not related as the former City Treasurer was not an employee; that he had been hesitant when a City employee ran for office; that he felt ultimately there might be a conflict; that it had been the policy of his office never to override, unless there were some unusual circumstances, the approval or dis- approval of a department head; that there was a shortage of personnel in the Finance Department presently; that this depart- ment was working on the budget which they hoped to get to the Council by the 6th of May; that City Treasurer Codling had spoken to him some time ago and he had suggested that'she either obtain approval of her department head or an ultimate transfer to another department; that he recommended that she obtain the approval of her department head and then he would approve her request.
