The City Council of the City of Baldwin Park met in adjourned regular session at the above place at 7:30 p.m. Councilman Morehead led the salute to the flag. FLAG SALUTE ROLL CALL Present: COUNCILMEN GREGORY. HAMILTON. KING. MOREHEAD AND MAYOR MCCARON Ron can: CITY MANAGER NORDBY, CITY ENGINEER FRENCH. PLANNING DIRECTOR CHIVETTA. FINANCE DIRECTOR DUNCAN. CITY TREASURER CODLING AND CITY CLERK BALKUS Also Present: Absent: CITY ATTORNEY FLANDRICK AND POLICE CHIEF ADAMS 00- City Clerk Balkus stated that the City Attorney was attending a regular meeting in another city. COUNCILMAN MOREHEAD MOVED THAT CITY ATTORNEY FLANDRICK BE CITY ATTORNEY EXCUSED. COUNCILMAN GREGORY SECONDED. There were no objections. EXCUSED the motion carried and was so ordered. 00- Ma^yor McCaron stated that the first order of business would be the item regarding the Chamber of Commerce which was continued from the April 15. 1970 Council meeting. He asked Mr. Nordby to present his report* Councilman Morehead stated that, if it did not make any difference to the rest of the Council, he would rather see this matter de- ferred until Mr. Blewett was seated. In answer to Mayor McCaron's question as to whether he would rather have the Application for a Temporary Use Permit for a carnival deferred also. Councilman Morehead stated that he would rather defer all items except the Resolution on Canvassing the Votes for which he was responsible, As there were no objections, the two items were deferred until after the seating of Mr. Blewett. CARNIVAL; C OF C DEFERRED UNTIL NEH COUNCILMEN SEATED City Clerk Balkus announced that this was the time and place fixed for receiving the City Clerk's Certificate as to the results of the General Municipal Election held Tuesday, April 14, 1970. She stated that 3,855 ballots had been cast. in- cluding 47 absentee ballots; that the Certificate of Canvass was attached to Resolution No. 70-96 which indicated the votes cast for a11 candidates; that the following were elected as Members of the City Council: Russell E. Blewett and Virgil V. Hamilton; that campaign statements for the persons so named were filed with the City Clerk's office on April 20. 1970. COUNCILMAN GREGORY SECONDED, There were no objections, the motion carried and was so ordered, 00- Mayor McCaron presented a Special Service Award plaque to out- going Councilman Charles E« Morehead. He read the inscription commending Mr, Morehead for his dedicated service to the City of Baldwin Park. Councilman Gregory stated that the Council was proud to present this attractive plaque, designed by City Clerk Balkus with the cooperation of City Manager Nordby, to its outgoing Council- man. City Clerk Balkus administered the Oath of Office to Council- man Russell E. Blewett and Councilman Virgil V. Hamilton, and presented them with their certificates, 00- Mr» Morehead expressed his pleasure in working with and for alt of the Staff and he thanked them and the employees for the cooperation which they had given to him while he was in office^ 00- City Clerk Balkus proceeded with the reorganization of the City Council. She announced that at this time all of the Council Members were on an equal basis, to nominate and elect, and that voting could be done by roll call or secret ballot, whichever the Council desired and that separate nominations and elections should be held for each office. It was decided that the reorganization would be done by voice vote. City Clerk Balkus stated that nominations for Mayor were now open, COUNCILMAN BLEMETT NOMINATED COUNCILMAN ADELINA GREGORY FOR MAYORa There was no second to the motion. COUNCILMAN HAMILTON NOMINATED COUNCILMAN JOSEPH MCCARON FOR MAYOR, COUNCILMAN KING SECONDED. The motion carried by the following vote: AYES: COUNCILMEN HAMILTON, KING AND MAYOR MCCARON NOES: COUNCILMEN BLEWETT AND GREGORY ABSENT: NONE City Clerk Balkus stated that the ayes" have it, and Councilman McCaron is elected Mayor. GREGORY AND MAYOR MCCARON NOES: NONE ABSENT: NONE Councilman Gregory was elected Mayor pro tern. 00- City Manager Nordby stated that the next item of business was held over from the April 15, 1970 Council meeting, that this concerned the final quarter payment to the Chamber of Commerce of $4,000. which was a portion of the $16,000. allocated in the 1969-70 budget. He stated that this matter had been held over due to a deviation from the contract which existed between the City and the Chamber involving, mainly, submission of reports, that some of this material had been submitted to the Council, that the Council had several courses of action: 1) The Council might terminate the agreement pursuant to Section 4. of the agreement; 2) Defer the quarterly payment pending further detailed information; 3) The Council may approve the payment of $4,000., or a portion thereof, indicating that the Chamber had been in substantial compliance. City Manager Nordby stated that he had met, yesterday, with the President of the Chamber of Commerce and five of the members of the Board of Directors; that he had requested minutes from the Chamber meetings, which were now in the hands of Council; that he realized Council had not had much time to look over these minutes. Lex Lechtenberg, President of the Chamber of Commerce, stated that he would like to have Mitton Hadley, attorney, and past president of the Chamber, present the Chamber of Commerce case to the Council. Milton Hadley stated, in reference to the reports that were to be sent to the City Clerk, they were not aware that this had not been done, but immediately upon notice they were supplied to the City Clerk, through Mr. Nordby; that the Chamber needs the funds the $^p00. to bring the Chamber current with their obligations. Part of this money is to go for the publication of maps; that the manager is no longer with the Chamber, and the secretary had to be replaced at a salary of $400. per month. The Chamber is presently in the process of taking applications for review by the Executive Committee of the Chamber of Commerce, for the purpose of selecting a new manager. They anticipate that they will have the man replaced within approximately the next thirty days. They cannot do this unless they do have the balance of the funds pursuant to contract with the City. They feel thatjthrough the projects that he Chamber had throughout last year, they have complied with the contract with the City: The Citizen of the Year banquet; Anniversary festival days, January 1969; Fourth of July celebration; Booth at the Los Angeles County Fair; The Christmas decorations throughout the City. They changed the year-end festival and the Citizen of the Year banquet and installation of officers into a three-day festival, which was quite successful and profitable and brought a lot of people into the City. Referring to a portion of the contract, keep- ing the office open eight hours a day, Mr, Hadtey stated that the office was closed only one day; that the President of the Chamber was not notified of this until the Sunday preceding this Monday; that the Chamber has been active in attempting to Continued QUARTERLY P'MENT $4000. The Board is striving to make the Chamber of Commerce of Baldwin Park better each year. Mr. Hadley requested that the full sum of $4,000. be allocated to the Chamber, on the basis that they have complied with the contract. He extended the apologies of the Board to the Chamber and to the City for not supplying documents. Mr. Hadtey thanked the Council and asked if there were any questions. In answer to Councilman Blewett's question, Mr. Hadley explained DISCUSSION the salary of the manager, last year, was $11,200., plus the usual taxes that are applied to that. The secretary*s salary was $5,200. This is approximately $100, per week for the secretary and the net salary to the manager, last year, after payment of the payroll taxes, etc., and the deduction from his salary was approximately $800. per month. Total salaries and total taxes on payroll amounted substantially to between $18,000. to $19.000. He stated that Community promotions was an in and out" item; funds received from merchants donations are used for merchant promotions they are given the same amount donated and then 1-1 goes right back into the merchant or Community promotion. The Citizen of the Year is an in and out" itemo tha ticket sates cover everything on that; that the money the City was giving was going to staff the office to keep the office open, answer telephone calls and to see that people were referred to proper places, etc, Councilman King stated that, at this point, he thought the Council should consider whether the Chamber has lived up to its obligation and whether the City wishes to allocate the $4,000. to t^.Q Chamber. Councilman Btewett said he had read all the Chamber minutes and did not believe the City was getting its monies worth and that he would like to see an activity sheet, possibly just the correspondence of the past year on the contacting of commercial and industrial organizations. Mr. Hadley stated that a review of the contract referred to handling of inquiries^wetcoming new businesses into town, and things of this nature; that as far as the contractual obliga- tions of the Chamber to go out and bring in new business, there is no one person that can do that. Councilman Blewett read from the contract as follows: Section I. Contact commercial and industrial organizations to solicit the establishment of businesses and industrial concerns within the City," Councilman King stated that there have been inequities as far as the agreement Is concerned, but that prolonging the discussion would not solve the problem of the $4,000. Councilman Hamilton said he has been a member of the Chamber for a number of years and also served on the Board of Directors. The question of whether the people have received value for the $16,000. during the year of 1969 and 1970 is the $64.00 question"; that with all the volunteer hours this Board of Directors and the various Committees put in on some activities that go on in the City, they are not compensated. She sympathized with all the problems they are having but said her responsibility, as an elected official, was not to the Chamber and to the good men who work in it, but to the people of Baldwin Park; that she, in all good conscience, could not be a party to giving the $4i,000<,, without real knowledge of what has been going on, that she felt an active Chamber would be working with some staff and get the minutes out every month, and give this Council activity reports and breakdowns on the budget; then vilatever problems would arise would be the Councils. She stated that the Council had also been negligent; that this money was public funds and that she could not vote yeSo" Councilman King explained that.his second to the motion was supposedly to fulfill the contracts He stated that his feeling was that this Council should compel the Chamber to comply with- in a limited times that was why he had seconded the motion, Councilman Blewett stated that he was disturbed with the agreement; that the Council could be faced with the same problem next year and he could not see any reason to be faced with the same problem again; that this $16,000^ is being taken from public funds and he did not believe we did receive our monies worth. In clarification, Mayor McCaron stated this money was coming from business licenses and it was the businessmens' moneyc Councilman Blewett stated that it is the consumer, the people, that are paying this moneyo Mayor McCaron asked for a roll call on the motion, The motion carried by the following vote? Btash Amusements, that there had not been sufficient time for an investigation; that she would suggest approval, pending investigation and approval by the Police Depart- ment, and insurance coverage, City Manager Nordby stated that this application had been sub- mitted this afternoon and there had not been time to investigate the background of the operator; that he would recommend approval subject to the investigation and approval of the Police Department.
