There were no objections, the TO 5/20/70 motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on 69-W-93, PUBLIC HEARING to hear objections or protests to the Report of Work of the City WEEDS Manager, regarding the amount of assessment for 5114 El ton 69-W-93 City Engineer French stated that this case was continued from RESUME the April 15, 1970 Council meeting so that a report could be made by the Engineering Department in respect to the oral protest from Leslie Martin, a representative of the property owner. City Engineer French reviewed his report to the City Manager and stated that, through an error, final photographs of the property had not been taken; that the Inspector had certified that the work had been accomplished; that the department had a statement concerning the property before and after completion of the cleanup. In regard to the complaint by Mr. Martin, that the property could not be traversed by an automobile, Mr. French stated that the property was disced and that this would make traversing of the property by auto- mobile difficult. In regard to the complaint of the cost he stated that the cost of the work represented the lowest price received based upon the competitive bids received. He stated that notifica- tion was made to the property owner, the property was posted and the property owner had sixty days In which to do the work at a lower cost If he desired; that the Engineering Department should have been notified if the owner wanted the work done In some manner other than discing, which is the Department's normal procedure. City Engineer French stated that there was some steel framework on the property; that he was on the property last week and the framework was still there. He presented photographs of the property, Mr» Martin stated that a skip loader was used to turn the weeds over; that it was not successful; that he wanted to go on record that he did not think it was righto City Engineer French stated that the discing was done on March 16, 1970; that he was on the property last week and it looked like it had been disced and not dragged with a drag bucket on the back of a tractor; that the weeds were growing back again and were from twelve to eighteen inches high, Discussion followed., City Engineer French read the certification of the cleanup pre- pared by Robert Palmero Copy of certification in official files a) Mayor McCaron stated that since there was some question regarding the cleanup of this property, a11 of the Council should take a trip out to see the property. In answer to Mr, Martin's question regarding whether there was any comment on the steel. Mayor McCaron stated that he did not think the Council could enter into that point, As there were no objections. NO WRITTEN PROTESTS Planning Director Chivetta stated that the Planning Commission, RESUME at its March 25, 1970 meeting, had denied the applicant's re- classification request by its Resolution No. PC70-13, and it was this denial that the applicant was appealing. He referred to a land use and zoning map posted on the wall and stated that the Commission was of the opinion that to grant the Zone Change for one lot would be granting a special privilege to the property owner not afforded to other property owners in the same zone. TESTIMONY IN FAVOR WAS GIVEN by: TESTIMONY IN FAVOR Mr. Eugene Ouimet, 14330 Gates Street, Baldwin Park. stated that EUGENE OUIMET he was the owner of the property at 4655 Maine Avenue; that he 14330 GATES ST» had put in a request to the Planning Commission a few weeks ago to change this property zone from C-1 to C-2 for the purpose of operating a glass business; that at the Planning meeting there were no major problems connected with making the change, other than the fact that the property was surrounded by R-1 properties; that if more people along the tine would be in favor of going to a C-2 zoning, then the biggest portion of the area could be zoned C-2, and this would be more appropriate He stated that he had obtained signatures from these people and almost 100% were in favor of C-2 along the west side of Maine Avenue, between Olive and Ohio Street; that they felt this should have been zoned C-2 quite awhile ago. He stated that some of the property there did need improving, and it might be a help to the City if the property were rezoned and business were given a chance to build up in the area. In answer to Mayor McCaron's question regarding the type of glass business he had, Mr. Ouimet stated they sell mirrors, table tops and regular household glass; that it was not a noisy business; that they did no manufacturing, only installation work; that he hoped to get a little automobile glass work a little later on, which would be installed on the premises. He said he had a garage which the Planning Commission told him he could keep if it was modified, and he intended to do this. In answer to Mayor McCaron's question regarding the difference in the usage allowed in a C-1 and C-2 zone for the property. Planning Director Chivetta stated that there was a thin tine between the usage if Mr. Ouimet wanted to install mirrors and window pane glass, this would be permitted under C-1, however, if he ventures into the automotive glass business, this would necessitate a C-2 zone. Planning Director Chivetta stated that he had discussed this matter at some length with the City Attorney and they had found there were some discrepancies in the Code; that they were trying to establish a set of uses so as to clarify similar problems. Councilman King stated that, possibly, if Mr. Ouimet wished this particular use, a variance might be in order if it were close to the C-1 use. Mayor McCaron stated that C-2 zoning opened up the area to a much heavier usage than C-1; that it would be better to stick to what is allowed in the C-1 zoning, which would be the majority of the trade Mr. Ouimet was seeking. OUIMET that they did not want spot zoning," but he had found out that the Medical Center across the street had been spot zoned" C-2; that he thought this was being prejudiced to other property owners* In answer to Mayor McCaron's question. Planning Director Chivetta stated that the Medical Center was zoned C-2; that spot zoning" was a polite word for saying a person was being given special privileges; that there is a starting point and a stopping point with spot zoning" and when you are discussing acreage, it was no longer considered spot zoning"; however, a 50 x 100 foot plot would be spot zoning"; that this is the difference. In answer to Mr. Ouimet's question regarding the signatures he had obtained. Mayor McCaron stated that just because the people had indicated they wanted it, it did not indicate that the area should go to C-2; that this area had been C-1 for years and had never been developed to C-1 usage but had been used as residential. Mr. Ouimet stated that, actually, neighborhood commercial was MR. OUIMET obsolete; that no one wanted to run a small business anymore; that big business was running them out; that the people ip the area, more or less, had to pool together and get their land zoned so that if they sell they can sell three or four pieces; that to justify their taxes on Maine Avenue the zoning should be changed. Z-322 Mayor McCaron stated that to open up the entire area to justify one heavier use was not good planning. Councilman King stated that possibly Mr. Ouimet could come in for a variance, but that he did not feel the Council should spot zone." COUNCILMAN KING MOVED THAT THE COUNCIL DENY Z-322. Mayor McCaron suggested that Mr, Ouimet might return to the Planning Commission to see if a variance would be allowed for the extra glass work, which would deviate from the C-1 zoning, rather than apply for a zone change. 00- It was the time and place fixed for a public hearing on a Mora- torium on Outdoor Advertising Signs. City Engineer French stated that Mr, Berthel was facing a problem of a use which was permitted some time ago by the creation of an interior lot; that Mr. BertheTs letter essentially answered all questions to meet the Code requirements for variance from regula- tions. There were no objections, the motion carried and was so ordered. 00- Alastair M. Ross, stated that he worked for the County of Los Angeles, in a special project known as Health Education for Senior Citizens, that he had been assigned to Baldwin Park and had been working here for a number of weeks; that he was seeking to establish himself in the Baldwin Park community and was hoping to bring health services, sponsored by the California Commission on Aging through Supervisor Dorn) to the older people in Baldwin Park; that this would fill a need for emergency treatment for senior citizens. He stated that he did not feel he wa^; getting the support that he needed; that he was trying to reach those people who realty need the help that this service could provide; that he wanted to utilize every possible opportunity and every facility to bring health services to these older people in need. Mayor McCaron suggested that Mr. Ross contact the Baldwin Park Service Council, and if the aid of the City were needed on some- thing definite, it could be brought to the attention of City Manager Nordby. Mr. Ross stated that it would be an annex of the existing Health Center and would deal with gerontology and geriatrics. 00- James Melancon, 4937 Cutler Avenue, Baldwin Park, stated that he had a business located at 20 North 4th Avenue, Arcadia, called Small World Amusement Rides, which consisted of six small kiddy rides for children up to the age of eleven years; that most of his work is working for PTA's, churches, charitable organizations, etc. He stated that he had been approached a couple of weeks ago by the Lioness Club of Baldwin Park regarding Mother's Day activ- ities at Morgan Park; that he was informed today by Mrs. Alii son, Lioness member, that it would take six weeks to take care of the paper work in order to bring the rides into Morgan park; that it had never taken that long to obtain approval to have the rides on school grounds; that he had contacted Councilman Blewett about this matter; that he would like to know if he could obtain the waiver of the fee and a permit for one day, for the purpose of raising money for the Lioness Club on Mother's Day. In answer to Mayor McCaron's question as to whether he was a member of the Baldwin Park Lions Club, Mr. Melancon replied that he was not. Mayor McCaron, after finding no member of the Lions Club present, stated that the application should be applied for by the Lions Club; that the Council should have an application before them for approval. City Manager Nordby stated that most organizations in the com- munity are aware of what is required when applying for a permit proper insurance coverage, permission of the property owner to place the activity on the property and the background of the applicant checked out by the police department. Councilman Blewett stated that it was unfortunate that the application was not made in time; that he did not think it took six weeks to take care of the paper work. Mayor McCaron stated that, in the future, the proper procedure would have to be followed on any application for a permit for rides so that everything is in order when it is presented to the Council; that Council would not be able to act upon this matter this evening. 00- City Clerk Balkus presented two applications for Temporary Use Permits to paint house numbers on curbs from the Sea Land Cadet Corps of America and the Church of Jesus Christ of Latter Day Saints Morman). Mr. Beckham stated in his letter that perhaps something could be done about Nubia Street; that trucking companies and service garages, in the vicinity of Arrow Highway, often road-test a truck along Nubia Street; that the street was narrow and many small children walked to and from school on this street, which has few sidewalks; that. on the northwest corner of Nubia and Lante, there are large avocado trees with limbs that hang out over Nubia Street causing a traffic problem. Councilman Hamilton inquired whether the police department could be directed to install No Trucks" signs and enforce it, also whether the department had checked into the tree problem. Mayor McCaron stated that this could be referred to the Traffic Committee for a report. He inquired whether Mr. Beckham had been approached on circulation of a petition for sidewalks on this street; that perhaps a meeting of the residents on the street could be held, so they could be informed how the street could be developed; that streets such as Baldwin Park Boulevard can be improved with gas tax money, as it is a major boulevard, but that the money to improve Nubia would have to come from property taxes and general funds from the City; that this was the reason the improvement had not been done; that when people dedicated and put in their curb, gutter and sidewalk, the City had been paving out the street. 00- City Clerk Balkus informed the Council she would be on vacation from May 9, 1970 through May 17. 1970. 00- Councilman Hamilton stated that,at the April 21, 1970 Council meeting^there had been a question raised by Letcher Bishop re- garding the legality of the Council members belonging to the Chamber of Commerce and voting on Chamber issues.
