Jones City Attorney Flandrick explained that the applicant's attorney had submitted a tetter today. The letter proposed various items with regard to this zone change. The applicant preferred to have the case continued to July 1» 1970 to allow the Council, if it so desires, to submit the proposals to the Planning Comnission for their comments and report. The motion carried and was so ordered, 00- AZC-43 Amendment to the Municipal Code regarding on-premise signs. Initiated by the Planning Commission. Continued from May 20. 1970. Mr. Chivetta stated that the staff report delt with the proposed changes in the ordinance dealing with the changes on pages 5, 10. 11, 12 and 14. One facet of the reoort covers definitions of awning signs, marquee signs; also painted siqns on the sides of buildings. This section has been changed to read that painted signs would not be permitted; that awning signs would be left at 2 sq. ft. of background face area, and marquee sfgns would be permitted to have 50 sq. ft. of sign face area. Diagrams depict the different types of sirms. There are definitions of back- ground area of signs, building facade, marquee sions, free stand- ing siqns. and directional sinns. Councilman Btewett requested that the Traffic Committee also check the traffic at Los Angeles and Walnut. Councilman Gregory explained that this was a hazardous intersection due to the parking of trailer trucks and the large telephone poles on Los Angeles Street which obscure the view when approaching Los Angeles Street from Walnut Street. It is also hazardous for school children crossing at this intersection. 00- City Attorney Flandrick explained that bids for Virginia Avenue had been received and opened and that the low bidder, Louis S, Lopez had made a mathematical error in his bid. The effect of the error was that his bid was $44,000.00 less then it should have been. Mr. Lopez has requested that his bid be rescinded. The City Engineer met with the property owners in the district and they agreed to accept the bid of VI do Samarzvich Company, of Arcadia, in the amount of $194,895.80. He recommended that the V1do Samarzvich Company's bid be accepted. Mr. Nemeth objected to the water line being installed as part of the assessment district, since they already have a water tine. He also objected to the water line being sold to the water company. Discussion followed that it is too late to change the proceedings and that the water line is part of the construction. City Attorney Flandrick stated that the water facilities had no direct effect on the bid. He recommended that the Council act on the bid award and direct City Enqineer French to make a written memorandum of what he proposes to do as far as the details of water service, and make a report at the next meeting. City Attorney Flandrick explained that the State Planning Act requires action by the Planning Commission and/or City Council. or Board of Zoning Adjustments, or City Manager. Some Cities designate the Planning Director to make a determination on minor variances. However, he felt this could be invalidated. Charter Cities do have some administrative deviation. CITY ATTORNEY Councilman King stated the Planning Commission had made a study COUNCILMAN KIMG two years ago and at that time they were aware of the limitations under the State Planning Law. They considered the costs to the Planning Department and the City Clerks office, also esthetics, safety, etc. Planning Director Chivetta stated the 1965 state legislation allowed certain permissive acts to the general law cities for variances if hardships were determined. The variances we have in this city follow that law and most peop1e(are applying for a one or two foot encroachment into a rear yard or a side yard. They usually have a contractor that they have hired to do the job, they have financing set up, and then thev find out that they can't get a building permit because of this encroachment. They have to wait 30 to 45 days for a public hearinq before the Planning Commission and sometimes they loose the financing. Sometimes they loose their contractor because he can't wait around 30 to 45 days without anything to do pehding the outcome of the Planning Commission's decision. It is something that is usually a rubber stamp and is given to the applicant, however, they do not like to wait this length of time. The city tries to give the best possible service at the lowest possible cost. Councilman Hamilton suggested that possibly the commission could consider a modification type of a variance and some type of procedure could be set up so that we can give the citizen better service. Discussion followed. Mayor McCaron directed that the Planning Commission re-evaluate the sections of the code pertaining to variances and bri^g back a report and their recommendations to the City Council.
