The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Gregory led the salute to the flag. Applicant: Dolphin Club Schools and Day Camps, Inc. Continued from March 4, 1970, April 1, 1970. May 6. 1970 and June 3, 1970) Planning Director Chivetta recommended that Case No. CP-142 be dropped as requested by Dolphin Club Schools. This matter concerns the proposed amendment to the Baldwin Park Municipal Code re: regulations pertaining to on-premise signs within the City, Initiated by the Planning Commission. After considerable discussion relative to location of wall signs, roof signs and the number of siqns allowable upon a parcel of land, the ordinance was referred back to the Planning Commission for futher study relative to these items and also to consider an amortization period for phasing out non-conforming signs. 00- It was the time and place fixed for a public hearing on 69-S-34, a Short Form 1911 Act for curb and gutter on the Southeast side of Depot Avenue between Pacific Avenue and the Southwesterly Terminus of Depot Avenue. TESTIMONY AS GIVEN BY: Mr. Henry Chipres, Lincoln Heights Investment Corp. Los Angeles, stated that he had recently purchased the property, and that he did not know that it was in this condition; that a man, who calls himself Tex" and who had once rented the property, had moved into the rear of the property without their knowledge; this man, Tex". is living In the cars back there and is causing the nuisance, not the gentlemen who is living in the front house; that when this man Tex" leaves, the owner guarantees he wi11 clean up the property. City Attorney Flandrick explained that the matter of someone living on the property without the owners consent was a legal problem between the landlord and the tfinent. He suggested that Mr, Chipres consult an attorney. As there was no further testimony either in behalf of or in opposition to 70-N-55, Mayor McCaron declared the public hearing closed. Mayor McCaron called for testimony in opposition. There was none. Council discussion then followed relative to permitted locations for off-premise signs. Planning Director Chlvetta stated that the CM zone in the city is occupied with Single Family Structures and the; Commission was considering abolishing this type of zone. Mayor McCaron asked what areas In the city are used for off- premise signs, and why the Commission did not recommend the Conditional Use Permit procedure. Planning Director Chtvetta explained that at the present time only those areas located along Ramona Boulevard by Auction Village and Arrow Highway and some parts of Live Oak are being utilized for off-premise signs. Also. that the Commission did consider the Conditional Use Permit approach, but felt that an Increase 1n the sign setback radius next to A, Ri C-1, CP or CM zones would be more effective methods of control, In relation to Mayor McCaron's questions and the explanations, Councilman King asked City Attorney Flandrick to clarify the reason for the setback radius regulation. City Attorney Flandrick stated that the city would have difficulty enforcing regulations for off-premise signs near the above zones with just a Conditional Use Permit; that an overlay zone would also create the same problem. However, the sign setback radius regulation would not, because then industry would know what is expected of them and therefore this approach is more feasible. As there was no one else in the audience desiring to speak either in behalf of or 1n opposition to AZC-44, Mayor McCaron declared the public hearing closed, COUNCILMAN GREGORY MOVED THAT THE COUNCIL CONCUR WITH THE PLANNING COMMISSIONS RECOMMENDATION TO ADOPT THE AMENDMENTS TO ORDINANCE NO. 547. AND INSTRUCT THE CITY ATTORNEY TO DRAW UP AN ORDINANCE. COUNCILMAN BLEWETT SECONDED. There were no objections. John Budge, for their assistance and kindness to her at the time of Mr. Bowman's death. Councilman King said he feels that the Police Department does a good job, and commended them. After considerable evaluation it was determined that the bid of Industrial Asphalt, Van Nyys was the most acceptable, This bid was selected based upon the quantities used last year, travel.distance and travel time.
