The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Blewett led the salute to the flag. Roll Call: Present: COUNCILMEN BLEWETT. Applicant: Leonard A. Jones Planning Director Chivetta stated that this case had been continued from: April 1. 1970. April 15. 1970, May 6, 1970, May 20, 1970 and June 3. 1970. On June 3, 1970 a 3 page document was sent to the City Council. Copy in official files). This document set forth iin precise statements the applicants desire to devetope his property to accomplish the following: Parcel 2, a guarantee of a undertermined life span for the uses that now exist on the property. Parcel 1, provide a parcel of ground that can be developed to multiple family residential purposes. The Planning Commission recon- sidered the matter and recommends that the entire parcel including Parcels 1 and 2 be classified to R-3. July 1. 1970 Page 2 PUBLIC HEARINGS 7:30 P.M. Attorney for Mr. Jones said although Baldwin Park does have a master plan exceptions could be made to suit the applicant. Mr. Jones has operated a dairy on parcel 2!, for the past 26 years. Mr. Jones has the reputation of being a civic minded man and he has demonstrated this very recently by selling off his herd. Mr. Jones would tike to see parcel no. 1 redassitied from R-1 to R-3 and he would like to'retain the privilege of continuing his dairy operation within a restricted area on parcel 2. He wilt do anything within reason to make the property attractive and to make;it fit in with the existing and the proposed use in this neighborhood. Mayor McCaron asked if there were any questions by Council on this. Councilman King stated he did not think this was good planning as far as the City is concerned. He was in complete agreement, that a man should be able to keep what he has worked for all these years. But the City has to take into consideration what is best. for any particular area; that the two uses would be incompatible. Mr. Raab stated he thought there was some misunderstanding. Mr. Jones has the right to continue his dairy business for an indefinite period. Councilman King stated Mr. Jones has the use and he can continue that use but that he did not think the barn and the house would be good in the development. He suggested that he put a wall around the use that he now has. eliminating the barn and the house artd make all this property R-3 and then at a later date when Mr.i Jones feels that he has obtained the use on this property, then it would be R-3, Mr. Raab stated the barn was necessary for the dairy operation and that no one in the area has complained. The front yard set back requirement in that particular area is 20 feet, however, there is a question as to whether a non-conformity of the barn, by rezoning and requiring dedication on Frazier Avenue, would be created. He had discussed the matter with Mr. Jones and Mr. Raab as to whether they could get a contractor to move the barn and fence and landscape this area. Councilman Btewett stated he had looked the area over, and the houses are basically lower income units. This might be an advantage to the city. He would like to see nice apartment housing there, not junk. You wilt not be able to transform the area by putting-in a few new houses. Apartment housing might be the key to this area and a good portion of our freeway land. He had talked with several of Mr. Jones neighbors personally and they all think it is a great development and quite commendable of Mr. Jones to give up the income off his dairy herd. He thought it would be a good development for the area. Councilman Hamilton stated that if he rehabilitates this barn, or rebuilds, he thought the request was reasonable. His dairy provides a good income, and if he builds apartments it will be a more lucrative business which is good. Mayor McCaron asked Mr* Jones if he had any intention of selling this dairy business in the future and if this was th(* reason for his request. Mr. Jones stated Not necessarily, no". Me^or McCaron stated his suggestion would then be that the entire area be zoned to R-3 and that the variance be allowed for the use of the dairy without any time limit on it. The barn could be rebuilt or rehabilitated and have a design shaped so that in the future the usage could be removed and additions can be made to the complex that would fit in. He stated the reason he asked if they were going to sell the dairy was that it would have to be sold as one parcel. Mr. Jones stated that would be unacceptable to him. It would become 2 separate entities and he could dispose of one or the other* He would like to have an income and has removed the objectional part of his business. He asked what is objectional about his operation now. Mayor McCaron explained that he meant continue with the dairy business and this all would become one parcel. i Mr. Raab stated that if he understood correctly and if next week or next month or next year, Mr. Jones would want to sell off a portion of his property Parcel 1) for a development for R-3 uses he couldn't do it, unless a buyer also wanted to run the dairy. Mayor McCaron said his understanding was that Mr. Jones was going to do the developing and that he had the financing. Mr. Raab stated that there is ho one waiting to buy it if he gets it rezoned. Councilman Gregory stated that this would be mixed uses on the property, as he wants to retain what he has now and the Council would be almost subdividing the property for him. Council was not objecting to t'he sale, but they were trying to determine whether or not one piece of R-3 would be a letter project. Councilman King stated that just because there are deteriorating homes in a particular area doesn't mean apartments will solve the problem. He felt that apartments should be along freeways and major arteries. Councilman Gregory asked if this were to be as proposed by the applicant what problems of ingress and egress would result, Planning Director Chivetta explained that first we would have to know the proposed development of the property and where they are being placed. Secondly, after they are placed, we would have to determine the access for street traffic. The major access would be off Waco and off Frazier. The Interior Is more or less land locked It would be a private roadway or parking area. Councilman Gregory asked what would be the buffer Zone there. Planning Director Chivetta explained that along Frazier the front yard set back would be 20 feet and along Waco 20 feet, with 10 feet rear yard set back. The side yard set back there is 5 feet, however, we would have to work something out to protect abutting properties depending on the development plan. The maximum height is 45 feet or 4 stories. He stated that there is a general planned street thru the center of the property. However this is predicated OP R-1 development not on R-3 and has no bearing on the redassification at this point. In the future it win. Any developer would have to approach the Planning Commission for one or two things. Do we need the street or some other type of access or shall the street be deleted in its entirety? Councilman Gregory stated a main concern should be the traffic flow, width of the street, how much traffic is on it, for R-3 the circulation should be good and adequate off street parking considered. Discussion followed regarding access and holding second reading of the Ordinance. In answer to Mayor McCaron's question, Mr. Jones said it was not necessarily his intent to sell the property. Mayor McCaron explained that second reading of the Ordinance would be held until such time as Mr. Jones is ready to develop the property and at that time the Zone change would be completed. City Attorney Flandrick stated that this is a very irregular shaped parcel and there would be problems determining the necessary yard areas because the code is designed for regular square lots or rectangular lots. He suggested that an amendment to the code, which would not hold up Mr. Jones plans, be made to require that whenever a lot is 1/2 acre or more ir size and has an unusual configuration, that the interior development in so far as vehicle access is concerned as well as yard area shall be designated pursuant to a public hearing conducted by the Commission or Council an overlay type zone which would solve 2 problems and preserve the Citys right to control the interior flow of traffic. As there was no further discussion Mayor McCaron declared the public hearing closed. COUNCILMAN HAMILTON MOVED THAT THE ZONE CHANGE BE GRANTED; THAT AN ORDINANCE BE DRAFTED AND SECOND READING BE HELD UNTIL SUCH TIME AS THE APPLICANT IS READY TO DEVELOP THE PROPERTY. COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. City Attorney Flandrick stated he would draw up the Ordinance indicating that Parcel 1 would be shown as one parcel and Parcel 2 as one parcel. PUBLIC HEARING DECLARED CLOSED 1-320 ZONE CHANGE GRANTED ORD TO BE DRAWN SECOND READING TO BE HELD CITY ATTORNEY TO DRAW UP ORD INDICATING SEPARATE PARCELS 00- As the nuisance at 4650 Edra Avenue, 70-A-29, was abated this case was deleted from the agenda. 00- It was the time and place fixed for a public hearing on 70-S-21, a Short Form 1911 Act for sidewalk adjacent.to curb and drive approach on the Northeast side of Ctoverside Street between Feather Avenue and Ahern Drive and on 70-S-22, a Short Form 1911 Act for sidewalk adjacent to curb and drive approach on the Southwest side of Ctoverside Street between Feather Avenue and Ahern Drive. Proper postings and mailings had been accomplished. City.Engineer French stated that letters were received from Orvis F. Futlmer, 14239 Ctoverside Street and Grant C. Wotf, 14232 Ctoverside Street, protesting the installation of sidewalks next to the curb. Letter in official files) TESTIMONY WAS GIVEN BY: Mr. Orvis Futlmer, 14239 Ctoverside, one of the signers of the petition, asked if the sidewalks were set back three feet would the trees require relocation. He said that no one on the street wanted sidewalks; they do want to keep the trees. Also, placing the sidewalk at the curb would cause a dip at every driveway. City Engineer French explained that everything possible would be done to save the trees and that whether the sidewalk was set back three feet or adjacent to the curb some tree removal would be necessary and these would be replaced bv smaller trees; that a petition signed by 60% of the property owners was required and that one protest out of eight amounted to about 12-1/2%. The petition read, adjacent to the curb". He presented photographs of both sides of the street. The oath was again administered. Mrs. Kay Futtmer, 14239 Clovers!de, stated she did not believe anyone wanted sidewalks and that the petition was misrepresented Mr. Futtmer stated he could not see why everyone had to put in sidewalks because someone made an addition to their home; that the cost would be a hardship. Wolf, 14232 Ctoverside Street, stated he had signed the petition but felt the construction of sidewalks would spoil the beauty of the street and that on this short street sidewalks were unnecessary. If sidewalks are installed he prefers to have them next to the curb. Mayor McCaron explained that eventually sidewalks will be installed on every street throughout the entire city. The Council has to provide for the safety of pedestrians. The petition was signed by over 60% of the people in the block and Mr. Wolf was one of the signers. He suggested that sir)ce there appeared to be a minunderstanding that the case t^e continued until the property owners make a decision. However, sidewalks will be installed in the future. City Engineer French said that at the present pace sidewalks would be installed throughout the city within five years. One property owner has a building permit and is obligated to install sidewalks. This sidewalk will be put in according to plan with a set back and a parkway. With the set back some of the trees can be saved. Mayor McCaron said the Council wished to go along with the wishes of the people, but the owners should get together and settle the problem among themselves. The letters of protest from Grant Wolf and Orvis and Kay Fu Timer were read. Mr. Wolf asked if the installation could be postponed as he was paying for sewers at the present time and another assessment would be a hardship. Discussion followed. RESOLUTION NO. 70-161 ORDERING THE CONSTRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO SECTION 5870 ET SEQ. OF THE STREETS AND HIGHWAYS CODE. 70-S-23, 70-S-24 AND 70-S-25) City Engineer French stated that in Section 1. c) the word no" should be inserted. COUNCILMAN GREGORY MOVED THAT RESOLUTION NO. 70-161 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on 70-C-2, to determine whether certain premises constitute a public nuisance Failure to Construct) at 3159 Frazier Street. Proper postings and mailings had been accomplished. There were no written protests. TESTIMONY WAS GIVEN BY: Mr. John Pickard, 3159 Frazier Street, stated that he felt that curb and gutter should be paid for a11 one way, either a11 by the property owners or all by the City. He stated he was subject to getting a ticket for parking in the driveway and here Mr. Jones' barn sets on the street. His sewer line had cost him $800.00 and it was not connected and he was not going to pay for the curb and gutter. Mayor, McCaron asked that Mr. French clarify the system'for installation of curbs and gutters. City Engineer French explained that Mr. Pickard was issued a building permit for a home improvement and the municipal code required the construction of curb, gutter and sidewalk. Mr. Jones paid for the improvements which the City had installed in front of the dairy and he dedicated and he had posted a bond to guarantee the improvements. He did not pay for curb and qutter in front of his house because this had not been dedicated about 1925 as par! 6f A IrAflt. Gas Tax Funds are used for street improvements only on major streets and this street is on the select system of streets. Mr. Pickard explained that it was necessary for him to make repairs to his home due to fire damage and he wanted Travelers Insurance to pay for this and he had signed the agreement to install improvements with the thought that the insurance company would pay for them. Mayor McCaron explained that Mr. Pickard's situation was not the same as Mr. Jones*; that if Mr. Jones were making improvements on his property he would also be required to install street improvements. The motion carried and was so ordered. 00- Mrs. Marie Lane, President of the Baldwin Park Women's Club, stated that she and her organization were very'anxious to be of assistance to the City of Baldwin Park and if there was anything her Club could do the City should feel free to call on them. Councilman Blewett indicated that mutual feelings were shared and if the City could be of any assistance, to please ca11 on the City Council. Mayor McCaron totd Mrs. Lane that it went without saying that in trying to improve the City, cooperation 1s an excellent foundation for doing so and that she would find that the City would make every attempt to be cooperative. 00- Coundlman Gregory called attention to the letter the Council had received from Mrs. Ada T. Deal, of the International Heritage Club, a letter saying they wanted to be recognized as an organization. He recommended that a Resolution be drawn designating the name. COUNCILMAN GREGORY MOVED THAT THE REST AREA BE DESIGNATED AS BALDWIN PARK ROADSIDE REST" AND THAT A RESOLUTION BE DRAWN DESIGNATING THE NAME. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Manager Nordby explained that the City Employees Association had recommended that James Speer be their appointee to the Personnel Board to replace Mr. De-ffenderfer. The motion carried and was so ordered. 00- City Manager Nordby presented a proposed agreement between the School District and the City of Baldwin Park concerning the development of the Elwin School Site as a neighborhood Satellite" park. The agreement is essentially the sa.ne as the one the Council approved some months ago for th? Pleasant View School. There is no change is the language, with the exception of the word satellite". This satellite" neighborhood park development is an implementation of the recreation element of the City's General Plan. He recommended approval.
