The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Hamilton led the salute to the flag. Present: COUNCILMEN GREGORY. Proper postings and mailings had been accomplished. One protest was received from Mr. and Mrs. Orvis Fullmer. City Engineer French stated he had met with the property owners and with the exception of one proterty owner, the people would like to save the trees and they prefered the sidewalk adjacent to the curb. As there was no one in the audience desiring to speak either in behalf of or in opposition to 70-S-21, Mayor McCaron declared the public hearing closed. It was the time and place fixed for a public hearing on 70-S-22, a Short Form 1911 Act» on the Southwest side of Cloverside Street between Feather Avenue and Ahern Drive for sidewalk adjacent to curb and drive approach. Proper postings and mailings had been accomplished. One protest was received from Grant C. Wotf. City Engineer French stated that a petition has been filed, signed by 60% of the property owners and that the protest had been received from Mr. Wolf who had signed the petition but now he did not want the sidewalk. i As there was no one in the audience desiring to speak either in behalf of or in opposition to 70-S-22, Mayor McCaron declared the public hearing closed. City Engineer French recomnended that the sidewalks be constructed in view of the City's improvement policies. He explained that there was no format meeting with the property owners; that he went out and talked with the Fullmers but he had not talked with Mr. Wolf. The Fullmers indicated they preferred the sidewalk adjacent to the curb. He explained that after the discussion the following was determined: 1. That the signers of the petition understood what they were signing. 2. The majority of the property owners do not want sidewalks. 3. The type of trees on the street wilt have to be removed eventually to save the curb and gutter. Regardless of the location of the sidewalk, the trees would have to be removed. 4. With the exception of one property owner, the people would like to save the trees. 5. It was agreed that if sidewalk will have to be constructed, preference of the neighborhood is to have the sidewalk constructed adjacent to curb. Mrs, Elma Atwood, 1943 Floradate, El Monte, owner of Parcel 9 on Bleecker Street, asked how this improvement district came about and what the costs would be. City Engineer French explained that where a street is over fifty percent improved by the property owners then it is required that the remainder of the street be improved. He stated that there are many such improvements in progress and that it would cost Mrs. Atwood approximately $180.00, however, this did not include the drive approach. He explained that Mrs. Atwood could select a contractor of her choice to do the work and that the improvements must be installed within sixty days. The violation pertained to the storage of trucks and trailers at that location in variance with Section 9631, subsection 9, 10 and 11 of the Baldwin Park Municipal Code. Mr. Cunnings was informed that the parking of heavy equipment was not permitted on M-1 property unless a Conditional Use Permit was applied for and granted for the use; that if he did not apply for a permit the truck use would have to be abated. At the time of the public hearing there was considerable discussion re: the mixed uses on the land; i.e., single family residence and truck yard, that this problem would have to be resolved. The Commissioners were of the opinion that a continuance of the mixed use would seriously affect the future goals of the community for the area in which the truck yard was proposed. Therefore to resolve the problem a basic condition was inserted into the resolution requiring the applicant, Mr. Cummings, to apply for a Variance and justify the same to permit the habitation of the single family residential structure for a specified period of time or, change the structure's architectural appearance so that it would conform to the M-1 Zoning regulations for office use. Mr. Cummings was agreeable to that condition and all others imposed by the Conmission. He indicated the area on the watt map. Ray Cummings, 1453 Virginia Avenue, Baldwin Park, stated that he had no testimony other than that which was presented to the Planning Conmission. Mayor McCaron stated he felt this is not the best development for the property, as the city is spending funds to develop a portion of the frontage of the freeway with a roadside park within 1/2 mile or less of this property, and the Council feels a better use can be made of this property which would benefit the applicant himself. The applicant should be given a reasonable time to relocate in another location and there are lots in the Northern section of town available. He felt it was better to take this stand now before any money is expended for improvements. He asked how much time Mr. Cummings would need. Ray Cummings stated he felt the best thing to do would be to sell out. Mayor McCaron stated he was talking about four to five years to move the equipment, etc.,. This would be a total of seven years for this usage. The city would be subsidizing this area and he felt two more years should be enough time to find a suitable location and anything over two years is excessive. He hopes the area will show some signs of industrial development. Mr. Cummings stated he thought he would be out of there before two years, but he does not like to be pushed. Councilman Hamilton suggested a three year phase out period. Councilman Gregory stated that a number of conditions had been set down by the Planning Commission and possibly the Council should consider them. Councilman King suggested that A", E" and F" be deleted providing this was a two year termination and he assumed that the City Engineer would delete sub-paragraph D", but he thought the dust should be held down. City Attorney Flandrick stated the Council could require re- surfacing and any of the conditions set by the Planning Conmission. Planning Director Chivetta said a portion of the property is paved and this may have to be added to. Mayor McCaron asked if the storage on the property was in relation to Mr. Cummings work. Mr. Cummings stated this was tile pool coping that was stored by a renter friend. Planning Director Chivetta stated it was the Planning Commission's understanding that Mr. Cummings was the owner and they were not aware that he had additional storage. If this were so, then a variance was necessary. City Manager Nordby suggested that conditions be brought back at the next meeting as the city is thinking of this area as an industrial park and he would like to make some recommendations.
