The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman King led the salute to the flag. Councilman Gregory stated that this does not include an extension of time. City Manager Nordby stated that the truck yard has existed for five years and two years or less, will not cause more deterio- ration; he believes the two year' phase out is sufficient. He explained that the applicant, at the last meeting, had stated that he could phase out in two years or less. Discussion followed as to the length of time necessary to phase out the usage. Councilman King said he had suggested two years and the majority of the Council had agreed at that time. City Attorney Flandrick stated that on Page 8 of the August 5, 1970, minutes, Mr. Cummings is quoted as having stated that he thought he would be out of there before two years, but he doesn't like to be pushed. City Attorney Flandrick assumed this to be an acceptance of the two year period. As there was no one in the audience desiring to speak either in behalf of or in opposition to CP-146, Mayor McCaron declared the public hearing closed. COUNCILMAN KING MOVED THAT THE CITY COUNCIL CONCUR WITH THE CITY MANAGER'S RECOMMENDATION AND MOVED THAT 18 MONTHS BE GIVEN TO TERMINATE USE OF THIS TRUCK YARD AND THAT NO COSTS BE APPLIED. The report from Sacramento indicated that the vehicles are currently registered. He also said the property owner has refused to accept notification; the department has been unable to verify whether the vehicles are operable or not as the owner refused access to his property. City Attorney Flandrick recomnended that this case be continued to the meeting of September 16, 1970. COUNCILMAN KING MOVED THAT CASE NO. 70-A-34 BE CONTINUED TO THE MEETING OF SEPTEMBER 16, 1970. This was basically cleanup of trash, weeds, debris and boxes. Also, he showed photos taken after the cleanup was completed. Planning Director Chivetta stated that the Planning Commission, at their July 22nd meeting, considered the street renaming and by Resolution No. PC70-30 recommended the name change of those streets under consideration: 1. That Railroad Avenue be-^een Pacific Avenue and Ramona Blvd. should be renamed Bogart Avenue; and, 2. That the portion of Railroad Avenue between Downing and Alderson should be renamed Alderson; and, 3. That Depot Avenue should be renamed Downing. He indicated the streets on the wall map. He stated that at the Planning Commission hearing there was one protest out of fifty- four property owners. COUNCILMAN GREGORY MOVED THAT THE COUNCIL CONCUR WITH THE RECOMMENDATIONS OF THE PLANNING COMMISSION FOR THE STREET NAME CHANGES AND DIRECT THE CITY ATTORNEY TO DRAW UP THE NECESSARY RESOLUTION TO ACCOMPLISH THESE NAME CHANGES. City Clerk Balkus announced that the proper publication and mailing of motices had been accomplished with regard to the hearing. Mayor McCaron called upon the City Attorney for an explanation of the purpose of the hearing. City Attorney Flandrick advised the Council that the purpose of the hearing was to consider whether or not the exterior boundaries of the Virginia Avenue Assessment District should be modified, in the manner described in Resolution No. 70-174, earlier adopted. If so amended, the total area excluded would be approximately 2,000 sq. ft. but that such change would have no effect upon the construction of the improvements, the cost of such construction, or upon the assessments made with respect thereto. That the reason for the proposed boundary change is that a small area, approximately 2,000 square feet, with reference to said Parcels 5, 6 and 48, according to the best information available to the City Engineer's Department, is located outside the boundaries of the City itself. Accordingly, since the City has no jurisdiction to include areas in a special assessment district located outside the boundaries of the City, in the absence of consent of the local agency wherein such property is located, for that reason, it is recommended that the same should be excluded from the District. Such a boundary alteration constitutes a change within the meaning of the Special Assessment District Act, and hence the City is required to conduct such a public hearing. City Engineer French then read a written protest signed by nine property owners the original copy of which is on file with the City Clerk) and advised the Council that notwith- standing any alteration of boundaries that the benefits to be derived by alt of the properties included within the District will remain the same. Mayor McCaron called for protests to the proposed boundary change. CALL FOR PROTEST OATH TESTIMONY City Clerk Balkus administered the oath. TESTIMONY WAS GIVEN BY: Mr. Andrew Nemeth, 1318 Virginia Avenue, stated that the back portion of his property is one of the properties in the county which is included in the district, that he had discovered the fact that county property was included and he had been interested in knowing whether county area could be included in the district and whether this would alter the district. He said he stilt had not had an an'swer to this question. He stated the biggest part of the burden would be upon the property owners on Virginia Avenue and they did not ask for the street to be built. He was present to protest the action and he did not think all doors were closed to them yet. He stated he was protesting for the reason that the City has not participated in the project and the people need help, the opening and improving the street was of no advantage to him. Councilman Blewett explained that the City Council is faced with the decision of increasing taxes in the City; that he had had to pay for a11 the assessments for improvements in front of his home and he could not see why people in other sections of Baldwin Park should help Mr. Nemeth. He called attention to the fact that Mr. Nemeth had been in favor of the district and that he had let his protest fan". Councilman King stated he had attended meetings with the property owners and at a meeting the people had asked Mr. Nemeth, If Mr. P. Syhre would give a portion of his property would you be satisfied?", and Mr. Nemeth had said, yes". So, it appeared that Mr. Nemeth wanted the street to go through. Mr. Nemeth said the bonds for the district were discounted at 23% and the contractor said they should have taken the lowest bid. As there was no further testimony Mayor McCaron declared the public hearing closed. PUBLIC HEARING DECLARED CLOSED A/D 70-1 City Attorney Flandrick explained that the action at this point, if the Council wished to approve the change as proposed, would be by motion to overrule the protests as made. Mr. Skaggs read the Charter Study Commission Report of August 6, 1970. The Commission recommended to the City Council a Charter form of government for the City of Baldwin Park. Mayor McCaron thanked Mr. Skaggs for his presentation. Members of the Charter Study Commission in the Audience stood and Mayor McCaron thanked them for their efforts. She said they requested waiver of fees. COUNCILMAN BLEWETT MOVED THAT THE TEMPORARY USE PERMIT BE GRANTED AND THAT FEES BE WAIVED. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- City Manager Nordby stated that the East San Gabriel Valley Hot Line Agreement is the same agreement as the one that was in effect for the first six months of 1970. This agreement covers a one year period from July 1, 1970 to June 30, 1971 at $50.00 a month. The amount of $600.00 is budgeted in the current budget. The motion carried and was so ordered. 00- City Engineer French reviewed the request of abutting property owners to purchase a lot that is designated on the City map as a street, called Siesta Avenue. It was granted to the city as part of Tract 26578. The purpose of Lot 22 was to provide for future access to a large parcel in the rear of the subdivision but the property was not developed for street access. Since that time the Personal Christianity Chapel has acquired these deep lots. They have received permission from the Planning Conmission for development of the lots as a unit. This action negates the need for the proposed street. He recommended that the City Council find that the only logical disposition of Lot 22, Tract 26578 is to be combined with the adjacent property and order the City Manager to properly dispose of the lot to the adjacent property owners. City Attorney Flandrick stated a format moratorium would not be necessary and that the Planning Conmission can take a case under submission. Planning Director Chivetta stated he wilt present a map to the Commission, showing those properties that should be initiated for reclassification to the most appropriate zone in compliance with the general plan and with the goats of the community. These properties are six in number, and the most pressing is Ramona Blvd. The general plan depicts the property for a multiple type of zoning to be applied. 00" Mayor McCaron stated that the Baldwin Park Historical Society had requested that more committee members be appointed. APRIL 1, 1970 The action of the Council at that time was to send the request for a Conditional Use Permit, which had been appealed by Mr. Shatter, back to the Planning Commission. The planning Commission denied his request and the Council tabled case pending completion of area study. COUNCILMAN BLEWETT MOVED THAT CP-141 BE REMOVED FROM THE TABLE AND DIRECT THE PLANNING COMMISSION TO COMPLETE ANY STUDY THAT THEY HAVE AND PRESENT IT AT OUR NEXT MEETING ON SEPTEMBER 2. 1970. He stated the council would then have a11 of the information and be able to irake a decision on this property. He explained that this is a truck yard in the north end of town and there are several neighbors that are complaining about it; the city does not receive any revenue from the operation and the man has been in violation of city ordinances as the man put the tr'jck yard on the property and then came to the city and asked permission to operate. Councilman King concurred with Councilman Blewett's recommendation as he felt this should be acted upon as quickly as possible. COUNCILMAN KING SECONDED THE MOTION.
