BOX 2794 OROVILLE, CALIFORNIA Assistant City Engineer Gordon presented photographs of the property taken on May 25, 1970 and on September 2, 1970. TESTIMONY WAS GIVEN BY: Mr. Jackson R. Baker. Rt. 1, Box 2794, Orovitle, California, stated he had an interest in the property which he had sold to Mr. MatavoUi who was the new owner; that the buyer cannot rent the house because the sanitary facilities are outside; that the structure was solid and had been there about 15 or 20 years; that they are tearing down the barn; that the house has been rented for years; that he paid over $300.00 in taxes for a vacant lot; that if the new owner cannot rent the house he wi11 have to let the property go back; that he had not had a chance to contact the building department and that he had to return to Oroville, but he would return. Mayor McCaron stated the premises would have to be rehabilitated; that the case could be held over to the next meeting so Mr. Baker could contact the building department. City Attorney Flandrick recommended that public nuisance case no. PUBLIC NUISANCE 70-N-61, at 4631 Marian Avenue extreme rear portion lot T5 70-N-61 parcel 38), also be continued. Proper postings and mailings had been accomplished. There were no written protests. Assistant City Engineer Gordon presented photographs of the property taken on July 8, 1970 and on September 2, 1970. He recommended that at 1 out buildings be demolished or brought up to code and that machinery, trailers, trash, etc. be removed. TESTIMONY WAS GIVEN BY: Mr. D. L. Cornelison, 3376 North Frazier asked what he was required to do; that he did not want to tear down his house. City Attorney Ftandrick gave Mr. Cornelison a copy of the staff report on the property. In order to provide time for Mr. Cornelison to read the report, Mayor McCaron stated that the Council would proceed with the remaining public hearings and when they were completed this case would be considered. 00- Assistant City Engineer Gordon requested that 70-A-35, 4862 Lante Street, be continued as mailings had been returned. There were no objections. 00- Assistunt City Engineer Gordon recommended that 70-A-36, 3376 North Frazier Street, be dismissed as the vehicle had been removed. CP-141, J. SAMUEL SHAFER, JR, 5060 ELTON STREET, BE SET FOR PUBLIC HEARING ON OCTOBER 7, 1970. COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on whether or not the provisions of Ordinance No. 562 shall be extended for a period of 90 days, said Ordinance pertains to zoning regulations relating to outdoor advertising structures. Proper publications had been accomplished. City Attorney Flandrick explained that if there were no objections and the Council concurred this additional time would allow the Planning Conmission to complete their study. As there was no one in the audience desiring to speak either in behalf of or in opposition to the 90 day moratorium on outdoor advertising structures. The motion carried and was so ordered. 00- Mayor McCaron stated the Council would resume the hearing on case 70-N-71, at 3376 North Frazier Street, which was under item 2 on the agenda. He asked Mr. Cornelison if he had had an opportunity to read the report and if he would like to have Assistant City Engineer Gordon explain the requirements before the hearing proceeded. Mr. Cornelison said there were certain items in the report which should not be there and he questioned whether the property had been reviewed within the past few days. He asked if he were expected to tear his house down. He stated the report referred to three cars, and one which belonged to someone else) had been disposed of and the other two had been moved out of view. Mayor McCaron explained that the Council was aware that the cars had been removed and the case listed on the agenda as 70-A-36 had been dismissed, so the cars were not under discussion. Mr. Cornelison stated that a year ago he had torn down one shed and painted the other one; that he did not know what was required of him and the property had been torn up for the past 2-3 years He indicated that he felt that people from the city and the flood control had ruined his property for the use it was intended when he purchased it 14 years ago; that he and other people in the city were being harrassed and that he kept the property as clean as he could; and that people were trying to make a living, trying to make the Council a living and that Council was picking on poor people. He stated the case would be continued to September 16, 1970. Assistant City Engineer Gordon stated that none of the recommendations pertain to the house on the property. He read the recommendations as follows: 1. Demolish a11 out buildings or bring up to code. 2. AH machinery and trailers must be moved from property in accordance with zoning requirements. 3. Conduct general lot cleanup including a11 trash, debris, rubbish and weeds. Mr. Cornetison asked if he were supposed to move the farm machinery into the front room of his house and he stated there were other machines stored throughout Baldwin Park. Mayor McCaron explained that the machinery must be moved off the premises or stored out of sight. Councilman Btewett stated that there is machinery stored a11 over town and that this was not the only instance; that at every Council meeting there are numerous hearings on properties throughout the city where people have shown lack of pride and do not keep up their property; that he personally had reviewed Mr. Cornelison's property and it was not proper. i Mr. Cornelison stated that the Council depended upon the people to keep them in office and that the people had to pay taxes to keep them going. Councilman Blewett explained that being a Councilman is not a full time job and he worked for a living, however, he said, Mr. Cornelison's. property was not up to code, and the Council only wanted what was reasonable and the city officers were willing to work with him and help him. Mr. Cornetison stated that his property had been picked on since 1964 and that a11 that is wanted is 30 feet on the west side. He questioned cleaning up his property which would make Councilman Blewett's property more valuable, and why more business did not come into town so people could do something with their property. Councilman Blewett stated he had heard no mention of 30 feet of property; that he did not live anywhere near Mr. Cornelison's property and that he, personalty, and a11 the Council would welcome new business. He emphasized that all that was requested was that the property be cleaned up and the yard be made to look like R-1 property. It was established that the regular representatives would attend: Mayor Joseph McCaron, Representative and Mayor pro tern Adelina Gregory, Alternate, There were no objections and the matter was so ordered by Mayor McCaron. 00- A letter from Mr. John Alcala, 3665 Rhodes Lane, requested waiver of improvements in accordance with Municipal Code Section 8106. Rhodes Lane is a narrow 15 foot wide street. The Atcata property is located in mid-block and construction would create drainage problems. The City Engineer recommended waiver of improvements subject to the offer of dedication and agreement by Mr. Alcala to install improvements at such time as grades are established. COUNCILMAN GREGORY MOVED THAT THE REQUEST FOR WAIVER BE APPROVED IN ACCORDANCE WITH THE CITY ENGINEER'S RECOMMENDATIONS. COUNCILMAN HAMILTON SECONDED. There were no objections. The motion carried and was so ordered. 00- City Clerk Balkus presented a claim filed by Alien Sobel, 1741 North Ivar Avenue, Los Angeles, on behalf of Luis and Marta Vargas and children. He stated the committee had studied th^ speed limit on Badillo. The radar study of the speed indicates 55% of the vehicles travel 31-35 m.p.h., 23% travel 36-40 m.p.h., 12.5% travel under 30 m.p.h. and 9.5% travel over 41 m.p.h.. In the past 60 days 35 speeding citations have been issued for speeds in excess of 40 m.p.h.. No citations were issued for speeds under 40 m.D.h.. The committee reconmended th-t the speed limit on Badillo between Vineland Avenue and the easterly city boundary be increased to 35 m.p.h. and the speed limit westerly of Vineland Avenue remain at 25 m.p.h.. Assistant City Engineer Gordon recommended introduction of an Ordinance to affect the same.
