The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman King led the salute to the flag. Present: COUNCILMEN BLEWETT. Proper postings and mailings had been accomplished. City Engineer French stated that Mr. &Mrs. Ralph Farmer protested the district on the basis that they were financially unable to handle the improvement and at the time Francisquito Avenue was constructed the County agreed to put in curb, gutter and sidewalk. This matter was referred to the Engineering Department to obtain a report in respect to the Counties obligation in this improvement. The Engineering Department sent a letter to the County, received a phone call from the County informing them they would answer by letter. The County has no record of an agreement made by the County to put in these improvements. In fact, the dedication was made as part of a Tract No. 11224 recorded in February of 1937 and a review of the Tract Map indicates that the developers came to the County, the County did not come to them. That is an indication that there was no agreement made at that time. The cost of improvement on this property will be approximately $500. If this was allowed to process through normal 1911 Act, the payment would go with the taxes. One half in November of 1971, and one half in April of 1972. Just by delaying the report of work the Council could extend this time to one half in November 1972 and one half in April of 1973. The cost could be spread over a considerable amount of time. City Clerk Balkus read a tetter of protest from Mrs. Ralph Farmer, 3090 N. Maine. Copy in official files.) In the letter, Mrs. Farmer requested again that the curbing be postponed and that they be given a commercial zoning so they can sell the property. Mayor McCaron suggested this matter be continued until Mrs. Farmer can be contacted to see if a solution to her problem can be worked out. Planning Director Chivetta stated that 1-327 and CP-149 had been continued from October 7, 1970 to discuss the possibility of walls, access to the property, and to study a petition that was filed by the protestants to the proposed use of the property. He stated that the proposal by the applicants is to use the property as a service station if approved for red ass- ification, however, if the reclassification is not approved the Conditional Use Permit, which is required, for the service station is of no consequence. Planning Director Chivetta stated that a petition had been presented, October 21, 1970, signed by 22 property owners in the area stating they have no objection to the service station development. He stated that one question that was brought up at the last meeting concerned the affidavits that were to be submitted by the property owners who have their property up for sale. He pointed out the three parcels of land on the map and stated that the Planning Department has a copy of an option that was acquired by Mobil Oil, with a 180 day exercise on the option, and was signed by the property owners on May 12th, 1970. This means that the option has until November 12th for the applicant to pick up the option. One of the property owners that signed the petition against the development also signed the option. Mayor McCaron asked if any property owners that signed the petition in favor had also signed the petition in opposition. Planning Director Chivetta stated that there were two names that were on both petitions. City Clerk Batkus stated that the petition in favor had arrived approximately 4:20 p.m., October 21, 1970 and there had not been time to determine whether the petitioners were property owners, or not. TESTIMONY WAS GIVEN BY: Mr. Ray Duty. Mobil Oil Corporation representative, stated that the property owners are concerned about the possibility of children climbing the wall to the freeway. He stated that there is no possibility of this occurring and the wall will provide more protection than what is there at the present time. He stated that the traffic controls wilt prevent a traffic hazard which was another concern of the property owners. He stated that the petition that was received by City Clerk Balkus this afternoon was circulated in the immediate neighborhood and the people that have no opposition to the station cannot understand why the other property owners are opposing the development. He stated the people were paid, in excess of, what the County feels the property is worth. TESTIMONY WAS GIVEN BY: Mr. William Guihan, 3575 Patritti Avenue, stated that their property was involved with Mobil Oil, but that they own other property also. He stated that they had tried to get out of the deal with Mobil Oil but had been informed it was going into escrow immediately. He wanted to know how they had the confidence to go into escrow. Mayor McCaron stated that he would like to interrupt because Assemblyman Harvey Johnson and Senator Alfred Song were in the audience and there was to be a Plaque Award presented to both gentlemen. Councilman Btewett presented the plaques and both gentlemen expressed th^ir gratitude and appreciation. Mayor McCaron stated that Assemblyman Harvey Johnson and Seiator Alfred Song had helped Baldwin Park in legislation at a time when it was really needed and this was appreciated. Assemblyman Harvey Johnson stated that a few years ago he was involved in a hassle" over a cigarette tax, with El Monte on one side and Baldwin Park on the other. He stated he was on Baldwin Park's side because we were right, in his opinion, even though he had lived in El Monte for years. Councilman Blewett stated, that for the benefit of the people of Baldwin Park in the audience, that Mr. Johnson's vote and the fight he made for the City of Baldwin Park amounted to about $115,000. a year, which is money that the tax payer is not paying in property tax. 00- Mayor McCaron asked for further testimony in opposition to 1-327 and CP-149. TESTIMONY IN OPPOSITION: Mr. Clarence Hartman, 3545 Patritti Avenue, stated that he and his wife in the last year had spent $7,000. on their home, including construction of a gtassine room in the back. Now that the freeway is going up behind them a11 they will see there is an off-ramp and if Mobi1 Oil comes in they will see a 7' wall, so in his opinion that is $3,000. wasted. He stated they have lived at this address for 16 years and when they bought the property it was zoned R-L He stated it was a nice residential area and that is how they want to keep it. He said that they do not need a service station in that location. He stated that since it wilt be a 24 hour station there wilt be noise, servicing trucks, working on equipment and once the station is in there will be nothing that can be done about the situation. FURTHER TESTIMONY IN OPPOSITION: Mrs. Myrtle Sturdy, owner of property at 3569 Patritti Avenue, was in the audience but asked that her letter of opposition be read by City Clerk Batkus. TESTIMONY IN REBUTTAL: Mr. Ray Duty, Mobi1 Oil representative, stated that Mobi1 Oil had exercised their option a week and a half ago, saying they were going into escrow pending building permits from the City. They would not consider this until building permits had been issued. In answer to the question as to what Mobi1 Oil paid" for a petition, Mr. Duty stated they did not pay. He stated they would endeavor to design the wall so it would be aesthetically attractive and conducive to good city management. He stated that as far as traffic is concerned, at the time the freeway is completed the boulevard will be controlled by traffic signals. Mr. Duty stated he felt the service station will serve a useful purpose to the City and Mobi1 Oil intends to have this as a show case in this section of the San Gabriel Valley, run as efficiently ds possible. He stated that a good deal of thought was put into the location and they expect a reasonable return on the investment. In regard to the noise problem. Mr. Duty said he does not feel there will be any more noise than is already there. Furthermore, he stated that the property in the surrounding areas will not depreciate but rather appreciate in value. In answer to a question about a guard rail, he stated there would be a guard rail made of steel. He concluded with the fact that they would do every- thing possible to keep the dirt and noise problem under control as they would hope that the property owners in the area would become customers. City Attorney Flandrick asked Mr. Duty if it was understood and acceptable that should any litigation occur, it would be at the expense of Mobil Oil and Mr. Djt.y answered that this was acceptable. In answer to Councilman Gregory, City Engineer French stated the lot would have to be filled in and graded to City Code requirements. As there was no further testimony on Z-327 and CP-149, Mayor McCaron declared the public hearing closed. COUNCILMAN KING MOVED THAT THE CITY COUNCIL SUSTAIN THE RECOMMENDATIONS OF THE PLANNING COMMISSION AND THAT THE CITY ATTORNEY BE DIRECTED TO PREPARE A RESOLUTION OF DENIAL ON ZONE CHANGE CASE NO. Z-327 AND A RESOLUTION OF DENIAL ON CONDITIONAL USE PERMIT NO. CP-149. MAYOR MCCARON SECONDED. Roll Call. There were no objections. He stated that he could not vote on this case because he had handled the cement work for Mr. Howard in connection with the Boy's Home and he could not understand how the City could be assessing Mr. Howard when he had a private contractor do the work. City Engineer French stated that the same contractor did the work for the City as well as for the Boy's Home,Mr.Howard is connected with. He seated that when the contractor takes out the permit, if he does not tell the City that he is doing the work for the Boy's Home and he bills the City based on the City's order, the matte,r will require investigation. City Attorney Ftandrick recommended that the Resolution be held over because once the Resolution is adopted the City has declared this to be a lien on the property, for all technical purposes. Since the public hearing in regard to this matter was declared closed, it wilt appear under Unfinished Business, on the next aqenda with an explanation. 00- It was the time and place fixed for a public hearing on Z-328, a request for zone change from R-1 to M-1 on property located at 5005 N. Lante. Applicant Horace and Patty Long. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Chivetta pointed out the area on the wall map and stated that the Commission considered the request on the 23rd of September, 1970 in accordance with the City's General Plan and their report entitled Area Analysis of a Neighborhood in Transition." The property would be used for a paving contractors business. The applicant has dedicated on Nubia and Lante and installed curb, gutter and sidewalk. It was the Planning Commission's determination that the property should be reclassified from its present zone of R-1 to M-1. Planning Commission Resolution PC70-36 was adopted to that affect. The property is located on the Northwesterly side of Lante and Nubia Street. The large parcel of land contains approximately 2 acrea and a plot plan of the property has been submitted by the applicant, as well as a proposed Spanish motif remodeling of the structure on the property. TESTIMONY MAS GIVEN BY: Mr. Horace Long, 4465 Stewart, stated that it was his plan to run a small business from this property. He stated that he and his wife own several properties in this end of town and they have always tried to improve the property. He stated that at the present time they reside on Azusa Canyon Road in Irwindale but they want to move here. They want to remodel the house that is on the property and make a yard, although he pointed out that they wi11 only use about'one-half of the property sice they have a small business. He stated that he didn't know whether Council was aware of it, but that in this entire section of town there are many instances of R-1 property being used for M-1 purposes, with no view obscuring fencing. He stated that this condition exists from Nubia to Arrow and it is the same thing from El ton to Bleeker. They have future plans to build a mail and Mr. Long stated they feel it will look much better than it does at the present time. Councilman Blewett asked Mr. Long if they intend to black top the area and Mr. Long replied that they will black top all the parking area and that all parking wilt be behind fencing. They do not want to black top the entire area because in the future when they start building, they would just have to take the black top out again. Councilman Blewett stated there were problems in the area and he asked if Mr. Long would object to conditions being imposed, such as a block wall. Mr. Long stated that the property is valuable if it is M-1, but as it is now, they cannot do anything. He stated that half the houses on Lante are running a business out of the back, and although he keeps hearing about laws and ordinances, it is still going on. Mr. Long stated that although he does not object to the requirements that are being made of him, he does feel that there is need of a clean up program in that entire area. Councilman Gregory suggested that second reading on the Ordinance could be held until the applicant applied for permits. Mayor McCaron agreed and stated that a clean up program has been started and that it will be a continuing process. He stated that property owners must come in with the proper type of development that will be acceptable to the Council or it will not be rezoned from R-1 to M-1. Mayor McCaron stated further that this hearing could be continued until such time as more complete development plans could be presented. Councilman King concurred. The yard setbacks fpr main buildings. 2. The yard setbacks for accessory buildings, such as garages. 3. Covered parking spaces required for a multiple family development. The Municipal Code requires a 20" front yard setback on all street frontages of the property. Planning Director Chivetta stated that the applicant has 20' on Bresee and has a varying front yard setback on Olive Street of 10 to 16'. The covered parking is requested to be deleted on 6 of the 48 parking spaces, so the applicant can comply with a 20' front yard setback. This particular area along Olive Street was pointed out on the map. Planning Director Chivetta stated that it is also requested that the jarages be allowed to be constructed on the property line instead of set back 5'. This request has been denied by the Planning Commission because of the applicants failure to show a hardship and the applicant has appealed to the City Council. The Planning Commission recommended that the property be reclassified from R-1 to R-3, some time ago, the Council held second reading pending a development plan. Planning Director Chivetta presented a development plan showing a Mediterranean or French Provincial style of architecture and the layout itself. AH street improvements would be installed, as shown on the plot plan, marked Exhibit A, as amended. There is one discrepancy in this particular plan. Planning Director Chivetta stated that the Commission was led to believe that there was a future street affecting the rear of the property. However, he stated that is not the case. This was done, some time ago, by an Engineer of the applicant on a partial map for R-1 development and he had brought that street in. Planning Director Chivetta stated that on checking records the Commission discovered the general plan does not require the cut-de-sac to come up to the rear of the applicant's property. TESTIMONY WAS GIVEN BY: Mr. Charles E. Berthet, 4615 N. Bresee, presented photographs of what he stated were existing buildings located at Rosemead Blvd. and Huntington Drive. He stated that the architecture was very similar to the buildings he had in mind. Mr. Berthel stated that plans were submitted to Planning Director Chivetta for any suggestions he might have and many good constructive suggestions were red pencilled in by Mr. Chivetta. However, not alt problems were resolved, according to Mr. Berthel. Mr. Berthel stated that they are planning to lease to teachers and retired people, with very few two car family's. He stated that they are not asking for less space fut rather, for less covered space. He stated further that this apartment complex, to be called Mountain View Apartments, would be better than any thing in Baldwin Park, at the present time, as far as safety, lighting, etc. is concerned. Mr. Berthel stated that he hopes to own the buildings and he hopes to live there. He stated that he is very much aware of maintenance costs. He stated that it is his contention that a well constructed building means low maintenance cost and a poorly constructed building means high maintenance cost. He stated that there wi11 be no connection between these apartments and F.H.A. low cost housing. Rents will be between $135 and $170. Mayor McCaron asked what created the problem of needing so many setbacks and why this development could not have been designed to fit the property. Mr. Berthel stated that the first plans called for 24 units, then the plans were cut to 23 units and now it is 21 units, because of the requirements for space, parking areas, etc. Planning Director Chivetta stated that it had been suggested to Mr. Berthel that he have subterranean parking and Mr. Berthel is considering this. If this type of parking is adopted, Mr. Berthel"s probelms would be solved. Mayor McCaron asked Mr. Berthel if there was an urgency on this matter and Mr. Berthel answered that there was not. Mayor McCaron stated that he would like to study the matter further because if the cost becomes unreasonable for the development, this should have some bearing on the matter. Mr. Berthel stated that he is in a very precarious position financially. He would be pumping money into the development and he is not sure he will get a return on the investment. Planning Director Chivetta stated that the development has been thought out by Mr. Berthel and his architect and they have attempted to draw a set of plans that would be compatible with the property, the surrounding area and with the Codetf. He stated that the variances requested are minor, however the State Planning Code and the Baldwin Park Municipal Code are very explicit. Mayor McCaron stated that as long as there was no urgency on this. Council would continued ZV-230 until the next Council Meeting, November 4, 1970, in order for the plans to be studied and an intelligent determination reached. 00- Mr. Michael Dargas, 13260 E. Francisquito, asked if the Charter Commission agreement was signed and how much money was involved for attorneys fees. He was told that the amount of money involved is $5,000.00 and when he asked where the money was coming from. City Manager Nordby stated that it wilt come from Income and Revenue the City has, and a budget adjustment will be necessary at a later date. Mayor McCaron pointed out that this is not just a Charter Study but also a drawing up and rewriting of the Baldwin Park Municipal Code. 00- City Clerk Balkus read a letter from the residents of Stancroft Street involving 25 signatures, Letter in official files.) Chief of Police Adams, when asked to comment on the letter stated that the action on the night of October 10th involved two cars and a hit and run. However. Chief Adams stated that this did not qualify as hit and run because the suspect came to the Police Department some 20 minutes after the episode occurred. He stated that the suspect was assaulted and in attempting to escape had run into the second car. Chief Adams stated that the driver is stilt responsible for the damage done to the car. According to She neighbors the majority of the problems seem to stem from the property at 4828 Stancroft, where three teenagers, reside with apparently very little adult supervision. The teenagers are two girls, ages 14 and 15 and a boy 18. It appears that loud parties, excessive noise, property damage and tate hours has created an intolerable situation on the street. The police have been contacted and have cooperated, however, the noise and activity seems to subside white the police are it) the area and then a11 the activity resumes as soon as they leave. He stated that he does not mind up until about 11:00 or 12:00 p.m. but he needs his sleep and his daughters will no longer visit him because of the situation with the neighbors. Mr. Masson stated that on one occasion he went to see Mrs. Gonzales. He stated that he explained to her that they could not sleep the night before because of the noise and she said that her children were with her and it could not have been them. Mr. Masson concluded with the fact that it was a very bad situation. He referred specifically to the Area Study in the far north end of town and the Civic Center Proposal.
