The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Blewett led the salute to the flag. Roll Call: Present: COUNCILMEN BLEWETT. GREGORY. Mayor McCaron stated that, in view of previous testimony, consideration should be given to possibly rewriting the ordinance after more stucly, and presenting it again to the citizens and if they are still not receptive, perhaps it should be dropped. He called for any testimony that had not been presented previously. TESTIMONY WAS GIVEN BY: James Q. Gibson, 13268 Francisquito Boulevard, stated that the Baldwin Park Improvement Association had adopted a resolution on March 29, 1971 opposing the passage of Ordinance No. 584 or any similar ordinance of equal intent. and he read the resolution in its entirety. Mr. Gibson then commented that the Improvement Association is not a negative organization, but is interested in the City's development. He stated that several years ago, when the City did not have sewers, he, personally, and the Improvement Association, collectively, were active in obtaining names on petitions and in getting sewers for the City. He stated that the City has a definite problem now, and we definitely need more tax money; however, he stated he doesn't feel it is necessary to take such extreme measures as eminent domain. He stated he felt the organi- zations in the community, no matter how small, would be willing to work to help solve the problem. Michael Lawrence Stokes, 4733 Grace, stated it seems as though everyone is afraid of having their property taken away from them, but nobody has looked around to see what has been done in other cities where they have this power. He commented that he felt sure if his property were to be taken he would receive a fair price. He stated that by giving the City some power, the City could afford to do what a few citizens could not afford to do as far as cleaning up some of the slum areas in the City. Mr. Stokes stated that he wished to go on record as being for the program and for the Mayor and the City Council. Andrew Memeth, 1318 N. Virginia Avenue, suggested that if the City wishes to use community redevelopment, they use it in a limited fashion and where it is most constructive. He stated that the City's business district leaves much to be desired, and in his opinion it should be developed, probably with public money with the assistance of the people who own the property in the particular area. Page 3 Councilman Blewett asked Mr. Nemeth if this meant he was not opposed to C.R.A. as long as it was used in a limited fashion and in the downtown area. Mr. Nemeth stated he believed-it should be tried in a manner that will cause some impression on the people, such as in the heart of the City. Kenneth Thompson, 13818 Kenmore Avenue, stated he had attended the information meeting on April 1, 1971, sponsored by the Chamber of Commerce, and listened to two speakers, Mr. Mitchetl, the executive director of the Los Angeles Redevelopment Agency, and Mr. Morris, an appraiser. He stated that the Los Angeles Agency is laying off approximately fifty people because of lack of federal funding. He further stated he could not see the comparison between Los Angeles and Baldwin Park. Mr. Thompson stated the people are scared of eminent domain because no particular area has been specified, and they don't know where the agency is going to strike". Mr, Tano Toscano, 4332 N, Maine Avenue, stated he has lived in Baldwin Park fourteen years. He stated the City of Irwindale has taken a portion of his father's land by eminent domain. He further commented that eminent domain has no place in the United States at all, unless it is done the right way. He stated that about seven or eight years ago, the City of Irwindale was considering a redevelopment agency. He stated that some of the people investigated and researched the matter to find out exactly what a redevelopment agency was, because some of the people didn't know. Mr» Toseano stated they proved to the Council that the redevelopment agency idea was no good, but some of the Councilmen were stubborn, so two months later the people initiated a recall. He stated that there were no problems, because the people just cooperated without a redevelopment agency, and the city has progressed without the use of eminent domain. He further stated he did not believe this is the time for this City to have such an ordinance. Mr. Toscano asked who had started the idea of the redevelopment agency. Mayor McCaron explained that the idea was suggested in 1960, at the time the master plan for the City was drawn. He stated the planner drew up the plan itself, and Included suggestions; the City is trying to follow some of the suggestions that were made at that time. Mayor McCaron explained that under urban renewal, you are funded by the federal government directly, and once involved you have to go through with the project; community redevelopment is controlled by the local agency, and whatever is done has to be brought out in a public hearing among the people; the owners of the property are given first choice to join in the redevelopment. Mayor McCaron stated this was an emotional thing, and he felt that if the ordinance were rewritten to reflect the people's thinking, it might be more acceptable. Mrs. Amos Slater. 4814 N. Stancroft, asked whether Council was considering urban renewal or community redevelopment. Mayor McCaron stated Council was considering community redevelopment; he asked City Manager Nordby where the line was where federal funds were brought in. Is financed with local funds, but urban renewal requires an appropriation by Congress. Mrs. Slater asked whether, 1f the agency were formed but given restricted powers, would the defined a^eas be made public before hand so the people could decide, or would the ordinance be passed first. Mayor McCaron stated the agency would have to be formed first to create a tool to present a project; each area would have a public hearing with testimony taken. Mrs. Slater stated that. In other words, the ordinance would be on the books, and the City Council could approve a project whether the people approved or not. City Attorney Flandrick stated that there was the recourse of referendum, and If a referendum Is started on any action, the action must be suspended. Gloria Zook. 4817 N. La Rica, referred to the Alhambra Redevelopment Agency's Annual Report for 1970. She stated that on the back page, entitled Planning Ahead" it Indicates that now that they have their Industrial area, they are going into residential areas where the people do not want It, Mayor McCaron stated that Council has no intention of redeveloping an area that does not need It. Mrs. Zook connented that in the State law it says that if you have a community redevelopment agency, you cannot turn down any H.U.D. project. Roger Mannix, 4855 N. La Sena Avenue, stated he was glad Council was not going through with H.U.D. He commented that Council has not said what area they are going to go Into. He stated that the northeast section of the City does not coincide with the master plan. Mayor McCaron stated there has to be a public hearing before there can be any changes made in the master plan. Mr. Mannix stated that under eminent domain, he would have to accept whatever he was offered for his property, whether he wanted it or not. Anna Tobias, 409 S. Fifth Street, Alhambra, stated she is caught up In Alhambra*s redevelopment agency, and many of the promises that they made In the beginning have not been kept, or they refuse now to recognize them or to answer. She stated this is something the people should decide, because this Is their domicile. She stated that in her opinion, redevelopment agencies are motivated by one thing—money. Mrs. Tobias read a lengthy statement and commented on redevelopment agencies in general, and on conditions In Alhambra caused by the redevelopment agency. She stated that eminent domain does not allow a person to receive fair market value" to purchase another home equal to the one he had. George Buckley, 4948 Fortin. stated he had not heard a thing about the redevelopment agency until last night. Carman, 807 King Street, San Gabriel, stated he is president of the San Gabriel Taxpayers Association, and was invited to this meeting by the Baldwin Park Improve- ment Association, of which he is a member. Mr. Carman stated he thought the redevelopment agency is everybody's business, because it is becoming epidemic; we are all trying to compete with each other. He stated he felt there should be a series of two-day conventions in Baldwin Park and that the people should have the privilege of going over the matter thoroughly so they and the Council would understand each other. Mr. Carman stated that the federal government has been criticized for getting into business, and now the city governments are getting into it. He stated that if Council thinks it wilt be a success, they should have a banker grant them a loan; under no circumstances should they be able to place a lien on anybody's property. Mr. Carman stated he writes articles for newspapers, but without compensation. He had an article printed in the Post Advocate in regard to redevelopment agencies. He stated he felt it was about time we did something about fixing the taxes in such a way that our children can afford to buy a home; today 80% of the young people cannot afford to buy an average home. He commented that the Constitution and the Bill of Rights were not written to allow anybody to use eminent domain for private projects—it was for public use. He stated that the City may be legally right in what it is doing, but stated he believes the people will rise up and file a taxpayers' suit and prove that this thing is absolutely wrong. He stated that there are other ways, and that Council should be careful not to lose the confidence of the taxpayers in their city. Mr. Carman handed out to Council members and the staff copies of a 1969-1970 tax bill, and stated there were twelve reasons why, if this ordinance were passed, the tax bills would be fictitious, and he elaborated on the various points. Mr. Carman stated he had had occasion to converse with Councilmen Hamilton and Blewett after a previous Council meeting, and had enjoyed the conversation. He stated our Council members were very patient in listening to the people, and stated he hoped they would always listen. Mrs. Claire Middleton. 13122 Corak Street, stated there were possibly thousands of people who did not come to this meeting because they were in favor of the ordinance. She stated she felt it should be put to a vote of the people. Councilman Blewett stated he would like to echo the sentiments of Mr. Nemeth and Mrs. Middleton, and stated he felt it was a mistake on Council's part not to have designated a particular area. He also stated he would tike to have the issue put before the people for a vote, and that he felt if the people know about it and understand it. they will be for it. He further stated that Baldwin Park must be a balanced community, with both commercial and residential. He stated he felt C.R.A. was a solution, but was not the only one. He stated that the City is now getting only 259; of each dollar spent by Baldwin Park residents; 75% is going to other cities. He commented that his home and business are in Baldwin Park, and he would not intentionally do anything to hurt Bal<lwin Park or its citizens. Albert Stockton, 5042 El ton Street, stated that about two years ago, his property was rezoned from A-l to R-l, and the City lost taxes by rezoning the property. He stated that Instead of upsetting the people. If the City wants more taxes, we should start on the business district and clean that up. He stated if Council wanted his support, he would be in favor of increasing taxes that would bring other businesses Into the City. April 7, 1971 Page 6 COUNCILMAN HAMILTON ALBERT STtfCKTON 5042 ELTON STREET Councilman King stated he was Chairman of the Planning Commission at the time Mr. Stockton spoke of. He stated the Commission had presented a plan to the City Council, but the plan was defeated. He stated the plan would benefit a particular area of the community, and that they were not trying to uproot people, but they had the circula- tion element, and were trying to rezone to the wishes of the people. In regard to the downtown area, Councilmen King stated he felt this was the major area for consideration, and that many owners live out of town and let their stores become dilapidated. He stated that the City has initiated the Industrial and Commercial Development Division, and the Precise Plan Review which will provide esthetic control, and will hopefully entice development to come into the area. Councilman King commented on the large turnout at this meeting, and stated it Indicated the people are not complacent, and are willing to let the Council know what they want. He stated Council is interested only in a plan that will be beneficial to the people. Norman L. Proffitt, 4811 N. Stewart, stated he felt there was a lack of communication, because he had not heard anything about this matter or the meeting until he had just gotten the information from a friend today. Edward Lowers, 15112 Nubia, stated that a thing of this importance should not be decided by just a few, but should be decided by a vote of the people. He commented that most of the people who own business property are older people who don't feel they will live long enough to get their investment back, and also there are out-of-town owners. He stated he felt the downtown area should be used as a pilot project to show the people what can be done; then, if the people don't want this, that is all we can do. Edwin Eiko, 13057 Bess Avenue, stated it appeared that one thing has been forgotten entirely; the instigation of this was to bring large businesses to Baldwin Park. He stated he did not feel we could support big businesses such as our neighboring cities have, and that we should push for small business, because we have missed the boat" as far as big business. He stated that if the sales tax were divided by population, we would get somewhere. He stated he felt the answer is small business and sales tax apportion- ment. and we should push for it. Mayor McCaron stated there were several alternatives—- the matter could be given complete study with the thought in mind of rewriting the ordinance; the areas could be defined, starting with one or two areas, and after study, a determination could be made; or, the matter could be dropped this evening and presented later after rewriting the ordinance taking a different approach. He stated there was a possibility that something else might come up in the way of development also, but he felt that in order to keep the idea of the redevelopment agency from dying, it should be continued. Councilman King stated he felt the idea of the people making a study of the matter was a good one. He commented that he felt Mr. Eiko had made a good point, in that big business is probably gone, but we do have land that is zoned for this and we should keep the zoning as it is. He stated that he felt the redevelopment should be directed toward the downtown area, and there would be no uprooting of the residential sections. He stated that since their request for a rate increase was considered at the March 3, 1971 meeting, the cities of San Gabriel and South E1 Monte had granted the increase. Councilman Blewett asked what action had been taken by the City of West Covina, and Mr. Mitchell replied that their request would be considered at West Covina's next Council meeting, on April 12. 1971. Mr. Mitchell stated that he or Mr. Stallans, President of Yellow Cab Company of San Gabriel Valley, who was present in the audience, would be happy to answer any questions Council might have. Councilman Gregory asked whether Yellow Cab had the same type of franchise with West Covina as with Baldwin Park. Mr. Mitchell replied that they actually have no franchise with any of the cities; anyone who wishes could come in and start a taxi service. Councilman Gregory commented that during previous testimony the Welfare Commission had been mentioned, and she asked Mr. Mitchell what the relationship was between this Commission and his company. He explained that the Welfare Commission is a connisslon set up by the mayor of Los Angeles to alleviate some of the work of the Board of Supervisors, and is concerned with the welfare of all the people", and not welfare" as relates to the Department of Social Services. He stated the Company had to initiate their request for a rate increase with this Commission. Mr. Mitchell further stated that certain welfare recipients do receive aid as far as transportation, such as for medical assistance and similar reasons. Councilman Gregory commented that this did not apply, however, to people on fixed incomes, such as many of the senior citizens of Baldwin Park. Mr. Mitchell stated he sympathized with these people, but it was Impossible to have a separate meter for them and another for other customers. He stated that the taxicab is the only form of public trans- portation that is not subsidized In any we^y, and that they must make a profit to stay in business. He stated that they have constantly increasing insurance costs, vehicle upkeep, etc., so there is nothing else they can do except to Increase the rates in order to make a profit; otherwise, they cannot remain in business. Improvements consist of curb and gutter, decorative sidewalk, drive approaches, drains, Xmas tree light conduits, street lights, traffic signals, landscaping, and appurtenant work as necessary to complete the job. Construction proposed includes four through lanes of traffic in what is now the railroad track area, and will provide five tiers of landscaping. A coordinated traffic signal system will be included. The frontage road wi11 provide for one way travel. City Attorney Ftandrick asked how many parcels are proposed for assessment, and Mr.. Minamide replied there are 62 proposed assessments. The City Attorney asked whether Mr. Minamide was familiar with 1911 Act procedures, and with plans and specifications and diagrams relating to the district, and Mr. Minamide answered that he was. Mr. Minamide stated that the traffic signal at Bogart will facilitate and provide safer means of traversing Ramona Boulevard; there wi11 be left turn pockets into Bogart leading to the subject business, and additionally, access may be gained at Downing Avenue, one block easterly. In response to questions by Mayor McCaron, City Engineer French stated we had not heard from the property owner who will protest, but the proposed improvements will go right through his nursery business. He stated that the people who are in favor of the improvements want to develop the street, and this will develop Paddy Lane to its ultimate in this area. Mayor McCaron stated this Is a needed improvement, but could also be a damaging one. He stated he felt the Engineering Department should contact the opposing property owner and present a report at a later meeting. Councilman Hamilton stated he felt it would be a good idea to also contact those owners who were mildly against" to learn the reasons for their objections. City Engineer French stated he would contact the property owners and prepare a report for the Council. 00- City Engineer French reviewed a report prepared by Planning Director Chivetta regarding Mrs. Euaenia Iqna's trailer parks. Wolverine Nos. 1, 2 and 3, Case Nos. CP-130, CP-131, and CP-132. The report outlines what is necessary to com- plete development on Mrs. Igna's property. He stated that if the Council is desirous of granting more time to complete the improvements, thirty days would be more than ample; if the work is not completed in thirty days. City Engineer French statedlhe felt Council should instruct the City Attorney to take legal action to cancel Mrs. Igna's conditional use permi ts. Councilman King stated it did not appear Mrs. Igna intends to comply with the requirements of the conditional use permits, and stated it is costing the City money each time Mrs, Igna files a lawsuit against the City, and also takes much of the staff's time. Mayor McCaron asked whether any work had been completed since Mrs. Igna appeared before the Council on March 17, 1971 and asked for an extension of time. H. Hudson, 14702* Arrow Highway, and K. C. Willis, 14506 Arrow Highway, on 71-S-20; Lenora Woodside, 15028 Arrow Highway, and E. Harriman, President, Tab-Loc, Inc., 15004 Arrow Highway, on 71-S-21; and Barttett S. and Clive W. Higgins, owners of Genco, at 15320 Arrow Highway, on 71-S-22. Copies in official files.) TESTIMONY WAS GIVEN BY: Ken Witlis, 14506 Arrow Highway, stated he was present to affirm his written protest. He stated that he felt the improvements would serve no practical purpose, and he has been on this street for fifteen years. He stated the timing is bad; there is no foot traffic on Arrow Highway, and very little business of any kind. He commented that it was his understanding this was a gas tax supported street, and he couldn't understand why the City Council was telling the property owners to put the improvements in, Lenora Woodside, 4537 N. Walnut, owner of property at 15028 and 15022 E. Arrow Highway, stated she agreed the improvements would serve absolutely no purpose at a11. She stated that on her particular lot sidewalk was included, and there might be six people walking there compared to 900 trucks traveling the street. She stated she was of the opin" ion that curb and gutter and small drive approaches would create a hazard trying to get out onto Arrow Highway, because it is almost impossible to hit one of those small drive approaches. Mrs. Woodside stated there are so many rules and regulations being placed on the small businesses that they are going to leave Baldwin Park. Mr. Seay, 14846 Arrow Highway, stated he does not object to curbs and gutters, but at the present time they are hard-pressed economically. It was the time and place fixed for a public hearing on 71-S-23, a Short Form 1911 Act, west side of Bresee Avenue between Lubican Street and Palm Avenue for sidewalk. Proper postings and mailings had been accomplished. There were no written protests. As there was no further testimony either in behalf of or in opposition to 71-S-17, 71-S-18. 71-S-19. 71-S-20, 71-S-21. 71-S-22. or 71-S-23. Mayor McCaron declared the public hearing dosed. Discussion followed on Case Nos. 71-S-20, 21 and 22. Mayor McCaron stated it might be advisable to postpone these for a year, and also to give consideration to the fact that the property is on a major highway, and the highway is In the City of Irwindale and the curb, gutter and sidewalk are in Baldwin Park. He stated, however, that curb, gutter and sidewalk are improvements that the City has in mind for the entire City, and these improve- ments are essential to keep the City clean, and for proper drainage. Councilman Blewett asked City Engineer French to comment on gas tax, which had been previously mentioned.
