Roll Call: Present: COUNCILMEN BLEWETT, HAMILTON, KING. MC CARON AND MAYOR GREGORY CITY MANAGER NORDBY, CITY ENGINEER FRENCH. CHIEF OF POLICE ADAMS AND CITY CLERK BALKUS AND FINANCE DIRECTOR DUNCAN CITY ATTORNEY FLANDRICK, FINANCE DIRECTOR DUNCAN,^-^-^ AND CITY TREASURER CODLING / i f f 1 I't^fT. 00- Also Present: Absent: Mayor Gregory stated that this meeting was an adjourned meeting of the regular meeting of April 7, 1971, nd that there was no set agenda. She asked City Manager Nordby to comment on the two 2) reports from the Chief of Police presented to Council and City Manager Nordby stated that Chief of Police Adams would go over the reports which concerned 1) several alternatives proposed for a police facility, and 2) converting of Police Safety Equipment from 38's to 45's which wilt involve funds. He explained that a recently enacted law has placed the burden on cities to provide safety equipment for police officers. Councilman King stated that the state law is ambiguous in this area; that the 38 is minimum and state law says minimum. City Manager Nordby stated that Sgt. Mooneyham had made an extensive study and that the 45 is preferable for police work and that if they are going to have a gun it should be one that is effective. He stated that in a review of the current proposed budget, salary and fringe benefits requested by the Police Officers Association are estimated at $132,000.00 which is a part of the over a11 budget. Employees salaries other than police is approximately $97,000.00. The safety equipment could cost $17,000.00. The increase projected, without a tax increase, in revenue based primarily on assessed valuation, at the same tax rate and sales tax revenue, is about 4%. The General Fund last year approached almost $2,000,000.00 and 4% applied to that figure is an $80,000.00 increase. Referring to a new Police Facility he stated that financing is the key issue, and to accomplish this would require sacrifices for everyone. The electorate should be called upon tQ approve a General Obligation Bond. At current interest rates, debt service would be about $70,000.00, annually. At the current assessed valuation this would require approximately 14^ on the tax rate. As the assessed valuation increases, the rate will diminish. Mayor.Gregory requested that City Manager Nordby outline various methods of financing a building program. Continued) APRIL 15, 1971 7:00 P.M. This is the reason for a low interest rate on General Obligation Bonds; 2) Pay as you go; however, there is no revenue; 3) Non-profit corporation whereby Council sets up an agency with authority to issue bonds and proceed with construction by competitive bidding doesn't require a vote); 4) Joint Powers Agreement, as used by West Covina with Los Angeles County doesn't require a vote). He felt that a method not requiring a vote is objectionable. Mayor Gregory stated that to accrue money for the Recreation building the citizens were assessed an additional 5(. The money was accrued for approximately 3 years and the building was built for approximately $122,000.00. She proposed that thris method could be used for the police facility. City Manager Nordby agreed? however, he stated there would be a delay in acquiring the facility and there could be an increase in construction costs. It would require some years to acquire sufficient funds and there is a critical need for a police facility now. Councilman Btewett stated he hoped the Council could make a determination in a relatively short time; that he would be opposed to anything that did not go to a vote of the people and he hoped they would have enough faith in the elected officials to build a facility which is needed now. City Manager Nordby stated that what he was suggesting was that there be a determination on whether or not the facility should be built and then decide on the procedure. Chief of Police Adams at Council's request came forward to review the report on the need for a police facility. He stated that the need is now", that the detective bureau had been expanded by using the area formerly used by Civil Defense, however, remodeling of the present facility for added space is not feasible. This building was declared substandard in 1948. Wiring is overloaded, plumbing is old and subject to stoppage and leaks. The Creede Building 13135 Garvey ex-California Highway Patrol) has less space than the present facility and would require expansion, is too far from City Hail and has other draw backs. A new building can be designed for better operations. The Bowling Alley structure and Hub Furniture Building would require extensive, costly remodeling and prisoner activity would be objectionable to the business community. By putting in a basement and 3 floors the Auditorium could be rebuilt; however, it would be costly. There are some matching funds available thru Civil Defense, however, he did not recommend this method as requirements made it very costly. City Manager Nordby explained that presuming the electorate approves the bonds, then there is an advertising period to market the bonds, after the bond sale the cash is available. At the same' time it is possible to have an architect proceeding with the design. The time would depend upon the order of procedure. Also several months before the election are necessary to explain the issue to the public. It is possible to proceed with construction within 1 year. Councilman Hamilton felt the building should not be piece meal and that a new building under one plan would be more economi cal. Discussion followed regarding the site of the proposed structure. City Manager Nordby stated it would cost approximately $800,000.00 to acquire an adequate site for the City Hall and the Police Department. He also explained that on the present site there wilt be a problem relocating the Public Works yard. i Councilman Blewett stated he felt the City cannot afford to build the entire complex at this time; that the people would probably approve the police facility and City Hail could remain in the present facility and th,e basement for some time yet. He quoted from a letter Council received regarding a County Building in Pasadena as follows Building Marble Monuments for Perpetuity". Councilman King felt this should be a long range plan and the Police Department facility would have priority regardless of the site. Mayor Gregory stated that a high rise facility on this site appeared to be the answer. COUNCILMAN BLEWETT MOVED THAT THE PRESENT LOCATION OF CITY HALL BE DESIGNATED AS THE CIVIC CENTER SITE OF THE CITY OF BALDWIN PARK. COUNCILMAN MC CARON SECONDED. Chief of Police Adams explained that using the present site would involve acquiring an additional 50 ft. of land in the rear to eliminate discomfort to a few residents; that this was shown in preliminary plans. Councilman McCaron suggested that the Council establish a site and then have a report from the architect; that what is being talked about is about a $1.500,000.00 building complex as our goat. There should be some ideas on cost and on building of the Police; Department itself. Then decide on how to acquire funds. City Manager Nordby stated that Robert G. Butot, representative of Stone and Youngberg, the financial consultant, projected the current rate of interest on 25 year bonds at $75,000.00 to $80,000.00. $70,000.00 a year on one million based on current interest rates will run 5-1/4 to 5-1/2 percent. He stated the architect had checked on the departmental needs. Roll Call. The motion carried by the following vote: AYES: COUNCILMEN BLEWETT, HAMILTON, MC CARON AND MAYOR GREGORY NAYES: COUNCILMAN KING 00- MOTION CARRIED Councilman Hamilton stated that anything built piece meal is more costly. That this complete facility is needed and he felt that if full information was presented to the citizens they would agree. Substantial, attractive, low cost maintenance are requirements. Mayor Gregory stated it could be put on the ballot in 2 parts. Discussion followed regarding one or two buildings, additions, a plan of procedure, the need for the facility that the present City Hall can be used for awhile but the needs of the Police Department were urgent. Councilman Blewett asked that Mr. Grimsgaard be present at a special Council meeting to present his observations and that the City Attorney render an opinion on what progress has been made as far as the one man one vote rule in the supreme court on the handling of bond issues as there is a case pending which would negate the 2/3 vote on bond issues and make it a simple majority. City Manager Nordby stated that children especially enjoyed touring the Police Department which as everyone knows is inadequate*, however, he suggested that the office desks, etc. and the so called lounge facilities in the Public Works Yard be viewed. Mayor Gregory directed that the City Manager contact the architect regarding a presentation before Council. Chief of Police Adams stated the Police Department design should have a minimum number of windows and this could be worked out with the architect. Chief of Police Adams explained that the recently enacted change in the Government Code, Section 50081, changed the requirements for alt Police Safety Equipment but at this time he was only making a recommendation in regard to the weapon and its accessories. He stated that the 45 has a clip load and the 38 bullets were inserted one at a time; that an adequate weapon could mean the difference between life and death to an officer. He explained that when an officer is hired he is given a badge, I.D. and mace and then it is up to the individual to spend $500.00 on equipment to do the job. He stated that 4 or 5 out of service departments surveyed had changed to 45's and the others were studying the change over. The 38 was a light gun which came into use over the years and the one now in use is a 1911 model. Mayor Gregory thanked Chief oF Police Adams for his report. 00- Mayor Gregory stated the Irwindate City Council agenda for this evening included a hearing on the use of the raceway for cycle racing and she was concerned about the effect of the noise factor. City Manager Nordby stated that a member of the Planning Commission planned to attend the meeting and appear on his own behalf. Councilman McCaron explained that he was aware of the meeting and that Irwindale City Council had appealed the Planning Comnission's decision as they were in sympathy with Baldwin Park and the areas of the City affected by the noise. He stated the owner of the raceway lives in Glendora and has a sound expert; that the noise can be deflected when areas affected by the noise are determined; that noise has been abated in the American Tract by use of the noise deflector. 00- City Clerk Balkus read by title April 15. 1971 Page 5 RESOLUTION NO. 71-108 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS COUNCILMAN MC CARON MOVED THAT RESOLUTION NO. 71-108 BE ADOPTED AND THAT FURTHER READING BE WAIVED. COUNCILMAN KING SECONDED. There were no objections. The motion carried and was so ordered. 00- Mayor Gregory stated that appointees to the Recreation and Park Commission should be made and she submitted Mrs. Montenegro's name for consideration. She also stated that Commissioner Gregory did not wish to serve another term so another replacement would be necessary. Councilman Blewett and Councilman King agreed that Mrs. Montenegro would be a very capable appointee. Councilman Hamilton suggested Harry L. Furnatd, 3644 N. Maine Avenue, as an appointee. The Council concurred that they would interyiew Mr. Fumald and that appointment would be made at a later date. 00- Councilman Hamilton stated that qualified appointees for the Community Redevelopment Agency Study Committee should be made. Mayor Gregory stated that each Council member would propose 3 candidates which they should contact to see if they will serve. She emphasized that there are many knowledgeable Continued) RES. Also, regarding the $50.00 charge, $25.00 had been discussed. He disagreed with the $100.00 appeal fee which he felt could discourage development. Councilman Hamilton stated the appeal fee of $100.00 seemed high to him. He also questioned the $200.00 fee under Section 9492. City Engineer French stated that the City Attorney and the department were in the process of rewriting these sections and that they would have a report by May 5, 1971. 00- Councilman Me Caron stated that Ordinance No. 593 referring to Precise Plan Regulations, Section 9462 4) concerning color and texture of materials. Section 9462 10) landscape plan, could possibly be revised. He also questioned Section 9464.2 Appeals, Notice by Secretary, as he wondered if there would be a conflict. Also, Section 9460 12) Requirements for Water Meters, and the cost. City Engineer French stated that a review of a11 these Sections would be included in the report. Councilman Hamilton and Councilman Btewett stated that requirements should not be so restrictive as to hinder development; that the City does want quality and development of which it can be proud. Councilman Blewett commented that spelling a11 requirements out in the Ordinance and presenting them in a packaqe may speed up processing of applications. 00- AT 9:40 P.M.
