City Engineer French stated this item was continued in order to have a meeting with the property owner to determine an equitable time for abatement of the nuisance. He stated a meeting was held with Mr. Sherman, the owner, and he agreed to a 90-day time limit for completion of the abatement. Actinn Ptannino Director Gordon stated the overtav zone was proposed for Live Oak, Arrow Highway, and Ramona Boulevard, from 100 feet east of Baditio to the Uest Ccvina city limits. He stated that under the new City regulations, the only place a billboard is allowed is in an 0" overlay zone, under certain conditions, some of which are that they must be 300 feet apart, sion face area must be less than 600 square feet, and the maximum height is 40 feet. Councilman Blewett stated that at the request of the Billboard Industry, he would like to have this natter continued to the nay 5, 1971 meetinq. Applicant: Marvin and Dorothy Tinkler. Proper publication, postings and mailinqs had been accomplished. There were no written protests. Actinq Planning Director Gordon stated that the property is in an M-1 zone. and the applicant lives in a residential house on the property and has been maintaining a doq kennel at the rear of the property. He stated that in 1968 an application for a conditional use permit was denied by the Planning Commission, and upon hearing testimony the Commission again recommends denial for the following reasons: 1) the proposed kennel would create a mixed use upon the property; 2) the proposed use would be in variance with the Planning Commission's recommended study for rehabilitating the area to encourage industrial development; and 3) the proposed kennel would have a detrimental effect on the abutting single-family residences. TESTIMONY HAS GIVEN BY: April 21. 1971 Pane 4 PUBLIC HEARING CP-155 DOG BREEDING KENNEL MARVIN & DOROTHY TINKLER PUBLICATION. POSTINGS AND MAILINGS NO HRITTEN PROTESTS RESUME TESTIMONY Mrs. Dorothy Tinkler. 5120 Gayhurst. stated that they had applied for a conditional use permit in 1968 when the property was in escrow. She stated they had put In the dog beds in the existing building, but had not built or added on to the building, but had only remodeled the inside. She stated that they had not asked for a kennel in the sense that they wanted to board or groom dogs, but wanted a hobby kennel. i Mrs. Tinkler stated they had insulated the building, put in new wiring so it would be adequate for the air conditioners, and had installed a compactor for the dog garbage and papers. She stated they had also installed a 6-foot redwood fence to keep the dog section of the yard separate from the other part of the yard. Mrs. Tinkler stated they had a petition signed by a11 the neighbors within a 300-foot radius, stating they had no objections to the kennel. She stated they only wanted a hobby kennel, because they show dogs. Councilman Blewett asked how many dogs Mrs. Tinkler wanted to keep, and she replied about fifteen. She stated the doqs they kept are small dogs, Pomeranians, which weigh about 3-1/2 to 4 pounds. Councilman King asked how often she kept dogs for other people, and Mrs. Tinkler stated she did not keep dogs; she stated she had kept six doqs for a friend who had been hospitalized for quite some time, but eventually had boarded them out elsewhere. In answer to a query by Councilman Kinc. Mrs. Tinkler stated they were Utilizing a work shop at the back of their two-car garage to house the doqs and. therefore, were still able to park their cars in the garage. Mrs. Constance Choate. 3328 N. Patritti, stated she wished to speak on behalf of her mother, Mrs. Ora Payne, 5117 Gayhurst, who was unable to e present because of illness. She read a note written by Mrs. Payne, which stated she had never been bothered with noise or odor from the kennel, and which further stated that the kennel was not a detriment to the neighborhood, but rather, an asset. City Clerk Balkus again administered the oath. Frank Seidel. 819 Hillcrest, Monrovia, stated he is an apprentice American Kennel Club judge, and has known the Tinklers for approximately twelve y6ars. He stated there are hundreds of dog shows every year, and people are very proud to have their dog named champion, and spend a lot of money to show their dogs. He stated this is not a comnercial venture or a money-raising project. Mr. Seidel stated that the Tinklers have always raised and shoWn Pomeranians, and they are hobbyists, and not in a conmer- ciat business. Discussion followed. Councilman McCaron stated that animals are sometimes hard to control, and could become a nuisance. He stated he felt that if Council approved this, they should limit the number of dogs allowed, and limit it to the Pomeranians. He stated further that if the dogs do become a nuisance to the neighbors, the permit should be subject to cancellation, Councilman King stated he agreed with Councilman McCaron in that the dogs should be limited to Pomeranians, and no more than 15 dogs allowed at any one time, there should be no appreciable odor, the garage should be used as a garage, and there should be no selling from the property as a commercial venture. Councilman King stated that the age of the puppy could enter into the picture, and asked what Council felt the limit should be before they should be disposed of, so that there would not be several titters for any great length of time. Mayor Gregory stated that these dogs were beautiful and probably would not be hard to dispose of, and she was sure that this could be accomplished within a year. April 21. 1971 Page 5 MR. LBHS 5126 GAYHURST OATH ADMINISTERED DISCUSSION COUNCILMAN MC CARON COUNCILMAN KING Councilman Btewett stated he had seen the Tinklers' property and he agreed with the testimony that it was one of the nicest houses in the neighborhood. He stated he would like a time limit placed upon the permit in the event the Tinklers would leave, since this would be authorized to the property, and not to the Tinklers. Councilman Hamilton stated he felt the restrictions suggested by Councilman McCaron were sufficient, in that if the kennel became a nuisance to the neighbors, the permit could be revoked. He further stated that he felt the Tinklers should be permitted to sell the puppies if they do not wish to keep them for showing, but not on a commercial basis. Discussion followed reaardinq the necessity for a business license in this instance. Mrs. Tinkler stated she would willingly comply and obtain a business license if this were found to be necessary. Councilman McCaron asked how many dogs in excess of 15 would be produced every year. Mrs. Tinkler stated that of the 15 dogs, you miqht have 15 puppies to sell in a year. She stated the dogs were bred two seasons and then skipped for one season. Mayor Gregory directed Acting Planning Director Gordon to have the staff prepare a set of conditions under which the permit would be approved and present them at the next meeting, and directed the City Attorney to prepare a resolution accordingly. She stated the matter would again be considered at the May 5» 1971 meeting. PLANNING DIRECTOR DIRECTED TO PREPARE REPORT LISTING CONDITIONS FOR APPROVAL AND C.A. TO DRAW RESOLUTION CP-155 JOHN C. GIBSON 3853 N. DUNDRY PRESENTS PROPOSED CITY CHARTER TO COUNCIL 00- Under Oral Communications, John C. Gibson, 3853 N. Dundry Avenue, stated he was Chairman of the Charter Commission which had been appointed by the Council, and that the Commission was now ready to submit the Charter to the Council. Mr. Gibson thanked City Attorney Flandrick and City Manager Nordby for their help, and also extended thanks to City Clerk Balkus and Deputy City Clerk White for their help in recording minutes of the meetings. Mayor Gregory, on behalf of the Council, expressed appreciation for the dedication of the Charter Commission members and the effort they had put into drafting a Charter for the City. Mayor Gregory acknowledged the presence in the audience of Commission members Blair Holman and Ralph Hanken. 00- James Q. Gibson, 13268 Francisquito, representing the Baldwin Park Improvement Association, read a letter to the Council stating that the Improvement Association had unanimously passed a resolution urging the City Council to adopt a resolution requesting the State legislative bodies to distribute the cities' share of sales tax on a population basis, and that the members of the Council, the City Administrator, and the department heads take steps to approach and persuade our legislative representatives to secure legislation which will apportion sales tax funds on a population basis for the benefit of all residential communities in the State of California. Mr. Gibson stated he felt this was the ultimate answer to Baldwin Park's personal dilemma, as well as other communities in the same situation as Baldwin Park. He stated that a fight in this direction is good, and help could be solicited from the Chamber of Commerce and every civic organization in the community, and stated the City had a leader in Mr. Nordby who could be of immeasurable help. City Manager Nordby stated this was a matter of great interest to him, and that he had made some calculations, at the request of Mr. Garrow, President of the Improvement Association. He stated that the 1970 census Indicated there were seven million people in Los Angeles County; the 1% sales tax allocated to municipalities in that year totaled approxi- mately $159,000,000; the per capita sales tax for every city in Los Angeles County is $22.67; Baldwin Park's runs approximately $8, or a little more than one third of the average Continued) JAMES 0. ORDINANCE NO. 595 AMENDING THE BALDWIN PARK MUNICIPAL CODE TO PROVIDE FOR ABATEMENT OF PUBLIC NUISANCES Councilman McCaron commented that he had no objection to this ordinance as it was written, but in order to avoid criticism or confusion on something that is as far reaching as this ordinance is. he felt possibly it should be set for public hearing. He stated the City Attorney had indicated it was not necessary to hold a public hearing, but he felt it might be wise to hear any objections the public might have, in this particular case. Councilman King stated he agreed with Councilman McCaron that this should be a public hearing. Councilman Hamilton stated a public hearing might prevent controversy later on, so he would agree it should be set for a public hearing.
