Roll Call: Present: COUNCILMEN BLEWETT, HAMILTON, KING, MC CARON AND MAYOR GREGORY Also Present: CITY MANAGER NORDBY, CITY ATTORNEY FLANORICK, CITY ENGINEER FRENCH. ACTING PLANNING DIRECTOR GORDON, LICENSE AND PURCHASING CLERK KLETT. CHIEF OF POLICE ADAMS. CITY TREASURER COOLING, CITY CLERK BALKUS Absent: FINANCE DIRECTOR DUNCAN 00- Mayor Gregory announced that Certificates were to be presented to Mr. Mike Geraldl and Mr. Francis Gregory In appreciation for service to the citizens of Baldwin Park. Mr. Gregory was unable to be present; however. Mayor Gregory recognized his years of service and dedication as a member of the Planning Commission and the Parks and Recreation Commission, and she accepted the Certificate for Mr. Gregory. Mayor Gregory pre- sented Mr. Geraldl with a Certificate in appreciation for his service and dedication to the City as a member of the Planning Commission. She expressed appreciation from the members of the Council, as well as the citizens, for h1& years of service. 00- COUNCILMAN MC CARON MOVED THAT THE MINUTES OF APRIL 7, 1971 AND MAY 17, 1971 BE APPROVED AND THAT FURTHER READING BE WAIVED. Mr. Hawk-ins stated that the Improvements would take 3 feet of his property, and City Engineer French stated that In his case, the Improvements under either the cut de sac plan or the extension of the street would be In exactly the same place. Mr. Hawklns stated he did not see how the City could force a man to put curb and gutter on a private street 3 feet In on his property where there are no dedications to the City. Mayor Gregory asked the City Engineer If It was not a dedicated street, were there areas similar to this where the streets had been Improved. He stated that the Ordinance does not differentiate between Improved or unimproved or dedicated or not dedicated streets. He stated this case was similar to Baldwin Avenue,and California Street. Mr. Hawklns stated he did make Improvements to his property and would put In curb and gutter outside his property line, but would not give the City 3 feet of his property without a court order, as he had already dedicated 15 feet. He stated that when he had built his building he had left enough room for parking, and If he puts In curb and gutter It will put the cars out In the street 6 feet. Councilman McCaron asked whether If this street were developed would the width be adequate to serve the area. City Engineer French stated the existing private street width Is not adequate, and when developed It will require restricted parking. Councilman McCaron asked how this street could be made adequate. Inasmuch as there was no way to put a freeze" on building until an adequate street was developed. City Attorney Flandrick stated the procedures open would be an assessment district or use of gas tax or general funds, whichever Is available. In answer to Councilman McCaron's question. City Attorney Flandrick stated the City could Initiate an assessment district, which would be subject to protest. City Engineer French stated that on May 20, 1971 a meeting was held which four of the property owners attended; two were against the improvement and two were In favor. He stated he had received two written protests against the extension of tne street and In support of the cul de sac. He Indicated that percentage- wise, from the information he had received, those In favor f and aqainst the ext nsion of the street were about equally split. Mr, Hawklns replied that the best way to have the petition signed Is to hold a meeting and have the petition right there* Mayor Gregory suggested possibly giving one more try toward getting the people out and also stated that perhaps Mr. Hawklns could be Instrumental In obtaining the necessary signatures on the petition. City Engineer French suggested the matter be held over to July 21, 1971 Councilman McCaron stated he felt the matter should be held over with the idea 1n mind that if the property owners did not undertake to Improve the area, the City will initiate an assessment district. In answer to a question by Councilman Hamilton, City Engineer French stated that for this area 1t would be better circulation for the property owners and well worth their expenditure to extend the street to Los Angeles Street. Mayor Gregory stated that Cases 70-C-16 and 70-C-22 would be continued to July 21» 1971. City Engineer French stated that one protest had been filed, against District 71-S-35, from Harry G. and Agnes Offield, 14056 Benbow Street, and he read the protest in its entirety. He explained that this was the only block on La Rica with over 50< of the sidewalk in, and concerning the Of field's reference to four other corner houses not being required to make the improvements, this refers to the fact that this is the only block that has sidewalk, and also the fact that it is not on Benbow. Mr. French stated the Offields also have a problem in that the way their backyard fence was built would mean it would have to be relocated because of the sidewalk, as well as a swing set and other things which would be in the way. TESTIMONY WAS GIVEN BY: Garland Harmon, 3132 Syracuse, stated he would like to know why the sidewalk and drive approaches had to be put in, because there were none on this side of the street Case 71-S-40). He stated he had paid for half the curbing on the street, as he had formerly owned property at 3120 Syracuse also, and had put in 163 feet of curb there. Mr. Harmon stated he agreed the improvements were needed, but he was 100% disabled and had a very small income and could not afford to pay for them. City Engineer Frenchi after reviewing the Resolution, stated that there had been a typographical error in that this district had been set up for curb and gutter only, and Mr. Harmon's property was not included. He stated that the recorded documents Indicated curb and gutter only, and the posting had either been moved or inadvertently posted on Mr. Harmon's property, Mrs. Harry Offield, 14056 Benbow Street, stated she was protesting District 71-S-35. and that their biggest protest was why they were the only ones who had to make the improvements, when there were four other corner homes. City Engineer French again explained the reason for the required improvements; however, he stated that since the Offields did have a somewhat unique problem In the placing of their fence, he recoroended holding this district off for a year, at which time it should be reviewed to see how development had taken place In the area. City Engineer French stated these districts were initiated on the order of the City Council» and would improve the whole block in these areas. 50% of the improvements are not in; therefore, it would reouire a 4/5 vote of the Council to order the work. TESTIMONY WAS GIVEN BY: i Michael Dargus, 13260 E. Francisquito, stated he had canvassed the neighborhood from Frazier to Athol, and everyone is in favor, because they have a traffic problem, in that you cannot make a left-hand turn into your driveway, because when you stop other cars pass on the right and there are chuck holes and there is not enough room to pass safely. James Q. Gibson, 13268 Francisquito, stated he had driven in this area this evening to observe the conditions as far as turning into the driveways and any cars in the left lane would have the right of way, and any cars in the right tane would have to go onto the shoulder to proceed. He stated It presents a hazard, and there have been many hear accidents. He stated Francisquito is a main thoroughfare carrying hundreds of cars In both directions every day, and he felt this area, including between Ramona and Puente, should be completely improved. Proper postings and mailings had been accomplished. There were no written protests. City Engineer French stated that the front yard had been cleaned up; the property owner had informed the enforcement officer that they would have the rear yard cleaned up within 60 days. TESTIMONY WAS GIVEN BY: rtyron McClaflin stated he was the owner of the property at 4328 Filhurst. He stated Mr. Palmer had informed him of the situation, and he asked the tenant to cooperate in cleaning up the property. After several phone calls, the tenant told him Mr. Palmer had agreed to a 15-day extension, and since he heard nothing further, he had assumed the matter was settled. He stated Mr. Palmer had suggested that he have his lawyer write the tenant a letter, which he did. Mr. McClaflin stated he then received the notice of the public hearing, at which time he contacted neighbors he knew in the area of the Filhurst property, and they informed him of the unkempt condition of the property. He advised his attorney of this, and the attorney sent the tenant an eviction notice effective June 30, 1971. Mr. McClaflin stated that if it came to a point that the trash in the rear yard had to be moved, the City had his full authority to move it and he would pay for it. Councilman King stated this was a comnendable attitude. however, he hoped that in the future Mr. McClaflin would check his tenants more closely and relieve the City of this responsibility. Councilman Blewett also comnended Mr. McClaflin on his attitude in recognizing the problem and taking steps to resolve it. He stated that the property owner next door, Mrs. Emma Chance, had requested that the subject property be sold to her. Mr. Nordby stated that, due to the nature of the lot, the narrow side fronting on Francisquito and the length on Frazier, it was his recommendation that the property not be sold with permission to the buyer to construct on the lot. He stated an appraisal had been received from Jerry Morris in the amount of $2,200. Mrs. Chance, tha prospective buyer, has indicated she wishes to combine this property with her house and lot next door. City Attorney Flandrick stated that one of the conditions of escrow should be that a covenant to hold It as a single parcel should be recorded contemporaneously with the deed, which will make a single R-1 lot and no further development other than accessory structures, such as a garage. Councilman Blewett asked whether It would be possible in the future, if Mrs. Chance were desirous of tearing down the current structure, to divide the lot and build two. COUNCILMAN BLEWETT SECONDED. There were no objections. The motion carried and was so ordered. 00- City Engineer French reviewed his report on the initiation of Short Form 1911 Act Case Nos. 71-S-44, on the south side of Nubia Street between Fortin Street and El ton Street, for curb and gutter; 71-S-45, on the south side of Nubia Street between Fortin Street and Lante Street, for curb and gutter; 71-S-46, on the south side of Nubia Street between Borel Street and Etton Street, for curb and gutter; and 71-S-47, on the north side of Nubia Street between La Sena Avenue and Azusa Canyon Road, for curb and gutter* He stated that in these districts, 50% of the Improvements are not in, and they wilt require a 4/5 vote of the Council for Initiation.
