There were no written protests. City Engineer French stated the work was 75% complete, and permits had been taken for the rest, and he recommended this case be dismissed. He stated thai on observing the property this date, there was a posting from the County Administrator's Office. The County office was then contacted and notified of the public hearing* The title report shows no County ownership or Interest In the property, TESTIMONY WAS GIVEN BY: Harry C. Long, 13351 Waco, stated there is some question as to who owns the property, and for that reason no repairs or any great expenditures are warranted until this is settled; Mr. Kristovlch, the Public Administrator. seemed to think that the guardian has an interest in it, but the title is in his Mr. Long's) name, and he felt it should stay in his name. He stated the garage was falling apart, but he had a lot of things stored in it and had no place else to put it, and that unfit the matter was settled he did not feet he was in a position to make any great move. City Attorney Flandrick asked Mr. Long whether he had any objection to the property being declared a public nuisance for the reasons stated, and Mr. Long replied he had none, but needed time to remove the contents of the garage. Mayor Gregory asked whether 90 days would be sufficient. Mr. Long stated that by then he should know what the decision regarding the ownership would be; there had been dual owner- ship for some 20 years, and was put into one name because of domestic problems; he had made the payments, and now has found he has no Interest in the property. Mr. Long asked whether he could get permission to replace the building. Mayor Gregory suggested he come In to the City Engineer's office to discuss this, which he agreed to do. He stated he had received a letter from an Attorney, Carroll S. Cooper, which indicated that Building Inspector Fred Edgerly had placed a down payment toward purchase of this property and Intended to bring it up to Code. Mr. French stated that, after talking to Mr. Edgerty, he replied to Mr. Cooper's tetter and informed him that Mr. Edgerly was not proceeding to purchase the property. City Engineer French presented photographs of the property taken on April 16 and July 7, 1971; he stated the majority of the work had been completed, and permits were to be taken out shortly to complete the rest. TESTIMONY WAS GIVEN BY: Tony Bankston, 1666 Sheridan Road, Glendale, stated he had only recently gotten the deed straightened out on the properties at 12908 and 12910 Bess, both of which were public nuisances, and had proceeded toward correcting the nuisances, there was one major item left to be completed, which is new electrical service in the building at 12908 Bess, and this would be done as soon as they are able to get a contractor to accept the job. He stated that he did not feel this was a public nuisance at this point, only vacant property. City Attorney Flandrick stated that in view of the fact that Mr. Bankston did not feel this was a public nuisance because of the construction, he would recommend holding the hearing over for 30 days. Mayor Gregory stated that 71-N-30 would be continued to August 4, 1971. The motion carried and was so ordered. 00- It was the time and place fixed for a public hearing on Z-341, application for a zone change from C-M Zone to R-3 Zone. located at 14101 Baditio Street, Baldwin Park; applicant: Ralph H. Speakman, Jr. Proper publication, postings and mailings had been accomplished. There were no written protests. Planning Director Gordon stated that the property in question is a vacant 3.1 acres of land at the northeast corner of Puente and Badillo, and was zoned from A-1 to C-M in 1962. He stated the applicant is proposing develop- ment of a 79-umt apartment complex on the property. Mr. Gordon stated he felt the property should not remain in the C-M zone because of the tight manufacturing, which could be detrimental to the tract at Kenoaks and Adams, directly to the east; however, the staff felt that good commercial land should not be used for apartments, and Mr. Gordon stated it was his recommendation that if the land were to be rezoned, it be to C-2 2 acres), which would insure the parcel being developed into a revenue- producing use in one package. He stated that the Planning Commission had recommended approval of the R-3 zone because 1) C-M zone is undesirable for this location; 2) the adjacent tract is of good quality and the City should place compatible development next to it; and 3) the plans as submitted to the Connnission appear to be of high quality, and the Commission felt this would be a very desirable development at this location. Marty Martinez, representing the applicant, Ralph Speakman, presented an artist's conception of the proposed development He stated that presently there was no break between the industrial and the residential areas, and changing this property into apartments would give a buffer between these two areas. He stated that the property would be enclosed on the east by a watt and landscaping, separating it from the existing residential area; the garages for the units are proposed to be on the southwest line, again providing a buffer between the industrial and residential areas. He stated there would be one-and two-bedroom apartments, which would rent for between $185 and $240, and the development would be confined to adults. He further commented that all the buildings would be two stories* Mr. Martinez stated that he had been driving around the City. and there appears to be quite a bit of revenue property available for development in other locations, and he felt that this type of development would enhance and be an asset to the City. He comnented that he had talked to the Chief of Police and the City Engineer, who had Indicated the double-double line was a safety factor, but he was not aware of any accidents that had taken place at this particular area, but there had been some at the place where the customers now had to leave, and this was contributing to this accident rate. Mr. Snyder further stated that a man rented from him who ran a small produce business, and this double-double line had practically put him"out of business, because customers coming from the east cannot get to his place of business. Councilman King stated that, at this time, to help these people as well as the City economically, Caution11 signs should be placed In the area, the lines should be broken, and try to slow the traffic down through signs, then look for a permanent alternate solution* Councilman Hamilton suggested another area that should be studied Is on Franclsquito near the corner of Maine, in the area of the Car Wash. Franclsquito, stated that on Friday morning, when he went to open his fireworks stand, he found it red tagged", indicating he must obtain an electrical permit and have an inspection before he opened for business; he checked the other stands, and all of them were so tagged. He called the Building Department and was told the Fire Marshal had requested the electrical inspec- tion. He stated he called the State Fire Marshal downtown and was told they had issued no such request to Baldwin Park, and their requirements were the same as they had been in the past several years, relating to openings in the booths, fire hydrants, etc. He stated he did not understand why the electrical permits were required, and also why the stands were posted at such a late date, because If everyone had been able to obtain a permit before opening for business, the City did not have enough staff to make 14 proper Inspectionsr City Engineer French stated that the Fire Marshal hiid gotten in touch with Mr. Palmer and said this should be done, and he then put the notes on the stands. Some stands had drop cords and extensions, and they were trying to eliminate hazards. Mr. Dargus stated the permit requirement was not his complaint; he felt there should have been more notice given to allow more time to obtain the permit and have the inspection. Mayor Gregory stated the problem would be researched and an answer be given to Mr. Dargus as soon as possible. 00- James Garrow, 1011 N. Baldwin Park Boulevard, addressed the Council regarding Assembly Bill 544, which removes the exemption of sales tax on gasoline. He felt that necessities, such as food, should not be taxed, and he felt gasoline was in this category. He stated that gasoline was already one of the highest taxed commodities. He commented that this is just another tax that takes money away from people going to work; you cannot take one conmodity and just beat it to death". Mr. Garrow stated that the City would probably realize about $75,000, and If they did not feel the need for rapid transit. It could be channeled into the General Fund; however, he felt gasoline was already overburdened* 00- Edwin Eiko, 13052 Bess Avenue, stated he again would like to ask Council to go easy on spending anticipated money which would supposedly be gained because of the increased assessments; he felt the money should not be spent, but there should be a reduction in taxes, or the money should be saved, because the City needs many things, one of which is a new City Hall. The total construc- tion cost for Improving this Intersection will be $14,105.72, and under this agreement, the City will pay $4,700 for the improvement. The City Engineer stated this agreement would be beneficial to the City, In that the original construction proposed by the State as part of the freeway was to leave the Intersection exactly as It Is presently. Mayor Gregory stated she had some concern about the plants and borders, but that since the park was not to be opened until around October, the growth would have a good foothold by then and this problem would resolve Itself. Mr. Gordon presented photographs taken of the last ten relocations. He stated that the Planning Comlsslon had recommended a complete prohibition on move-Ins. Councilman HcCaron asked whether the Planning Co—ilsslon had held a public hearing. Planning Director Gordon stated they had, although It had not been required, and there had been almost no response, and none from the move-In people. BIB] 37659-U01 1971-U02 07-U02 07-U02 CC-U02 MIN-U02 LI1-U03 FO9591-U03 FO9838-U03 DO9989-U03 C4-U03 MINUTES1-U03 2/6/2003-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 peCC05031 Regular Meeting of the Baldwin Park City Council July 7, 1971 Page 10 Mr. Colwick comnented that this was hurting business, was a jeopardy to the customers and the businessmen alike, and also caused a loss of revsnue* He stated that he was speaking of 200 feet from the Intersection, and just a breakthrough alone would adequately suffice, Rick Donnelly, 1200 N, Harbor Boulevard, Anaheim, representing Carl Karcher Enterprises, stated that their Carl's Jr. Restaurant had opened about three weeks ago; when they applied for their building permit, there was no mention that double-double lines were to be painted there, and that a week after the lines went In, they had lost over $1,000 In business that week. He stated there was a need for eating establishments In the area, and he urged Council's consideration of an alterna- tive to the double-double lines. Delbert Morgan, 4528 N. Sunflower, Covlna, stated that he had come to the City Engineer's office when he first heard about the lines going to be put In, to Inquire what would happen at the In N Out Burger along Franclsqulto. He stated he was shown a plan which depicted the painted lines and he was told they could be crossed, and that the only thing this would do would be to cut out the parking along Franclsqulto and would benefit people going toward the freeway on Franclsqulto by giving them a left-turn pocket In order to try to stop the rear-end accidents; at that time there was no mention of not being able to enter or exit on Franclsqulto across these lines. Alton Moses, 3550 E. Holt, West Covlna, stated he operated the Toot'n Totum Market at 13756 E. Franclsqulto. He stated that the other gentlemen had made the pertinent points, but he wanted to go on record as concurring with their remarks. Bob Lang, 1226 Concord Lane, Glendora, stated he Is the Manager of the In N Out Burger on Franclsqulto, and has worked at this particular stand for 17 years, 6 days a week. He stated he understood the reason for the lines was the number of accidents at this Intersection, but from his observation over this length of time, the accidents at the corner are not from people leaving their driveway to go across Franclsqulto onto the freeway ramp, but are caused by people making the left turn coming out of Branson's Auto Parts. Councilman King stated he had counted four cars within five minutes making Illegal left turns at this spot In one evening, and he was sympathetic with the businessmen In the area. He asked the City Engineer whether there was an alternate solution. City Engineer French stated that a traffic stiaty had been made In this area; there were 20 accidents within a two-year period attributed to the driveway In question. He stated It would be difficult to place a value on the loss of business as opposed to the losses caused by accidents, and to assess which would be more Important. Councilman McCaron suggested a study of the area to see what changes might be necessary to accommodate the traffic, such as changes in the driveways, widening the street In certain areas, etc. He stated that the majority of businesses on Franclsqulto require automobile access, and we should do whatever possible to accommodate the businesses.
