Present: COUNCILMEN BLEWETT, Roll Call: HAMILTON, KING, MC CARON, AND MAYOR GREGORY JULY 21. 1971 7:30 P.M. Mayor Gregory suggested that Council might possibly adjourn to the auditorium to accommodate everyone. Councilman Blewett suggested tl^at the regular Agenda be handled in the Council Chambers, and that Council could then adjourn to the auditorium, where those wishing to speak under Oral Communications on other than Agenda items could be heard. The City Engineer recommended that Council drop both nuisance actions and instruct the Staff to take the necessary steps to initiate an assessment district. Planning Director Gordon stated that the original zone change was applied for in 1965, which the City Council approved, and first reading on the ordinance was held, with second reading withheld until curb and gutter were installed. In 1970 the owner was notified that his use of the property, a contractor's storage yard, was in violation of the then present zoning, and he should complete the zone change or vacate the property. The owner now wishes to complete the zone change; however, there are some conditions which must be met, such as completion of paving, and cleanup. Planning Director Gordon suggested the matter be held over to allow the applicant to complete the requirements for the zone change. Addressing Mayor Gregory, he asked whether she had any irrefutable evidence that Mr. Nordby was guilty of bribery. Mayor Gregory replied that she had just read a statement of reasons for Mr. Nordby's dis- missal. Mr. Morehead stated that he would record that her answer to his question was no". Mr. Morehead asked Mayor Gregory whether there was any evidence that Mr. Nordby was guilty of a moral of tense, embezzlement, or malfeasance of office; in the absence of a response from the Mayor, other than stating that she had made a statement, in each instance, Mr. Morehead stated he would record that her answers to his questions Mr. Morehead asked whether Mr. Nordby had not always carried out the directives of the majority of the City Council when they were in session; Mayor Gregory answered that he had not. He stated that the dismissal of Mr. Nordby and the lack of reasons was causing concern among the employees, as were rumors of the possible dismissal of other depart- ment heads. Mr. Ensminger remarked that no pressure of any type had been exerted on any employees to attend the meeting last Saturday. JOE ENSMINGER B.P. POLICE ASSN. He stated that the Association would continue to support Mr. Nordby until just and satisfactory cause for his dismissal was shown. He further assured the Council that the Police Department employees would con- tinue to provide the highest caliber law enforcement. Gloria Zook, 4817 N. La Rica, commented that out of 128 employees, only 40 of them live in Baldwin Park. GLORIA ZOOK 4817 N. LA RICA James Garrow, President of the Baldwin Park Improve- ment Association, 1011 N. Baldwin Park Boulevard, stated that at a recent meeting of the Improvement Association, on July 19, 1971. a motion was passed, as follows: THAT MAYOR ADELINA GREGORY, COUNCILMAN LEO KING. AND COUNCILMAN RUSSELL BLEWETT BE COMMENDED FOR MAINTAINING DEMOCRACY FOR THE CITIZENS OF BALDWIN PARK AND WE SUPPORT THEM IN THEIR ACTION. IN THE DISMISSAL OF THE CITY MANAGER," John Taylor, 14242 Ohio, stated he understood why the employees would support Mr. Nordby, after the salary increase he gave them. Dr. Merle P. Smith, 3657 N. Vineland, stated he understood Mrs. Gregory was a full-time Mayor, and asked whether she truly understood the relationship between the Mayor and the City Manager? Mayor Gregory replied she did. By way of explanation, she stated she was an official responsible to the citizenry, and the City Manager was responsible to the Council- Dr. Smith asked Mayor Gregory whether she had a City Manager in mind, to which she replied, no", as did Councilmen King and Blewett. Councilman Blewett stated he had been asked by Councilman Hamilton whether he would go along with granting Mr. Nordby 30 days' separation pay, and he assumed the money would come from the City, but it would be on Councilman Hamilton's motion. Mr. Nixon stated he was concerned with being loose with the taxpayers' money. Mr. Nixon stated that Councilman King had been quoted as saying he would give substantial reason for Mr. Nordby's dismissal at a later time", and he wondered if he would do so now. Filhurst, asked who had been present on July 6, 1971 when Mr. Nordby was first asked to resign. Mayor Gregory replied that she and Councilman Blewett had been present. Mr. Cole asked whether Councilmen Hamilton and McCaron had been informed of the action taken that date, and Mayor Gregory replied they were not. Mr. Cole asked how many times Mr. Nordby had been approached to resign, and Mayor Gregory replied there had been only the one meeting; she understood Mr. Nordby had commented to some of the merchants that he was approached a second time, but he was approached only one time to resign. James Speer, 4233 N. Baldwin Park Boulevard, elaborated on the many accomplishments of Mr. Nordby while City Manager, including improvement of streets, sewers, storm drains, a lighting district, and many others. He also commented on Mr. Nordby*s part in a successful program to obtain revenue for the City from the cigarette taxes. He further commented on several new programs that had been started or proposed, such as Cable T.V. He indicated he could not understand why a man who had done so much for the City had been summarily dismissed; it was obviously not for dishonesty, incompetence, or the inability to get along with the people he worked with. Mr- Speer noted also that the pay raises are not granted by the City Administrator; they are granted by the City Council. Mr. Speer stated that if there were problems, the entire Council should have discussed them in private in an attempt to resolve them, but instead, three members agreed to take the action on July 17, 1971. Mr. Speer stated that if Council had only come together and acted as a five-member Council, that possibly this could have been worked out; he could not understand why the action was taken by only three members of the Council. Mayor Gregory stated this was deliberated long and hard before action was taken. Councilman King stated that the Improvement Association had initiated the Lighting District, and they initiated and pursued the park building and the public library; he felt credit should be given to the citizens. Emmitt Waldo, 4170 Sharons Way, stated he had read in EMMITT WALDO The Tribune last Friday that Mr. Nordby's future" 4170 SHARONS WAY would be decided at the meeting this evening, but last Friday he also heard that the Council members had been called into a special session. He asked Mayor Gregory why it had been necessary to fire a man on Saturday when the matter had been scheduled to come up at the meeting tonight. Mayor Gregory stated that when she and Council- man Blewett went to Mr. Nordby on July 6, 1971 they had asked him to think about it and to put down on paper all those things the total Council should talk about at a future meeting. She stated that she did not feel it was honorable that he chose to go out into the City and comment to people, so the word that was passed around the community had to come from him, forcing the meeting on Saturday and the ultimate firing on that day. Mr. Waldo asked whether Mayor Gregory, on July 6, 1971, had requested that Mr. Nordby not say anything about this, to which she replied, no". Mr. Waldo asked what money was offered to Mr. Nordby, and Mayor Gregory stated, we did not offer him one red cent." Mr. Waldo asked whether when they found out that Mr. Nordby had talked to somebody about it, was that when they decided to call the emergency meeting. Mayor Gregory stated she denied only that she had brought it up. Mrs. Near asked why Council did not put some facts before the people and not the distorted newspaper facts. John Kunz, 13904 Masline, stated there is little doubt in anybody's mind that Mr. Nordby had done a fine job; however, the taxpayers of Baldwin Park are faced with an almost unbearable, burden of taxes. He stated Council had the right to do what they did, and they were undoubtedly thinking of the future of Baldwin Park; we have to get some industry in town in order to lower taxes. JOHN KUNZ 13904 MASLINE He stated he sympathized with the City employees, but at the same time, the Council has to move to get the tax base lowered, and he felt that is what happened. Alfred Wittig, 4707 N. Edra,, stated that his main interest in the community has been with planning. He stated that the City's biggest concern is to get industry into the community, but the action taken by Council could preclude any sound developer putting his money into a city which is torn apart by dissent. He stated that it was the Board's view that the image and cohesiveness of the community had greatly suffered by Council's action when weighed against the published reasons for dismissal. He stated that the employees are also concerned as to future action that might affect their immediate positions or the positions of their respective department heads, and the working conditions. He stated he felt Council should take immediate action to stabilize the present situation so that these con- cerns would be clarified. Mr. Caresio thanked the Council for their attention and consideration of the Board's areas of belief and concern. Richard Wallingford, 14342 E. Ramona Boulevard, stated he had recently moved from Baldwin Park, but had lived in the city 27 years, and he did not think the citizens had been fully represented by the City Council. He asked Councilman Hamilton and Councilman McCaron whether they had been notified of Mr. Nordby's pending dismissal prior to last Saturday's meeting. Councilman Hamilton replied he had not been notified? however, on July 7, he had heard about Mayor Gregory's and Councilman Blewett's visit to Mr. Nordby's office on July 6. He stated that Mr. Nordby told him he had been asked to resign quietly and had been offered 120 days of severance pay if he would do this, and had been told not to say anything about this meeting, because if the news got out they would know how it got out. He stated Mr. Nordby told him not to mention this, hoping the Mayor would tell him about it, but she did not? the first official notice he had received was on Friday, July 16 at 11:55 a.m. Councilman McCaron stated that a couple of months ago he had heard out on the street that there was a move- ment afoot to dispose of Mr. Nordby? the next thing he heard was on July 7, the day after Mayor Gregory and Councilman Blewett had requested Mr* Nordby's resignation. He stated he also was told that they wanted to keep it under wraps" until Mr. Nordby had made a decision. He then received notice 24 hours prior to the special meeting on Saturday. Mr. Wallingford stated that in school he had learned that everyone was entitled to his day in court", and he did not believe Mr. Nordby had had his. Anne Farkas, 3120 N- Frazier, stated that a special meeting had been called on Saturday, at which no attorney was present, thereby denying the right of the people to speak. It was explained that it was not necessary for the attorney to attend an executive session Mrs. Farkas stated that for eight years Baldwin Park went nowhere, and for the last eight years the progress had been slow, but it had been progress, and she asked how long it would take before we start moving again. Mayor Gregory replied that, in her opinion, we had not stopped moving. Mrs. Farkas asked Councilman Blewett whether he had a City Manager in mind, and then asked whether Mr. Chivetta, the former Planning Director, was coming back. Councilman Blewett stated he absolutely did not have anybody in mind, and would like to look at the field to find the right person, and that Mr. Chivetta would not be coming back with his vote. He stated that the man who comes to Baldwin Park must be somebody that all five Council members can have a line of communica- tion with, and he did not believe that Mr. Chivetta, although he is a very fine man, could unify the City. Boyd Cummings, 4629 Maine Avenue, stated that in order BOYD CUMMINGS to alleviate an already bad situation, he would like 4629 MAINE AVE to suggest that the Ordinance dealing with the hiring and firing of a City Manager be altered to include a majority of four instead of three, stating that it had been apparent for the past several months that three people are running the City. He stated that increasing the majority would be a major improvement. Councilman Blewett stated that Council was elected by the majority of the people, and to increase the majority of the Council to 4/5 would be to decrease the authority of the City Council and decrease the authority of the people of the City, and he stated he could never agree to that. Mr. Cummings reminded Councilman Blewett that when he ran for office he said he would do everything in his power to make a better city. Councilman Blewett stated that to decrease the power of representative government, representing the majority of the people, would be the worst thing you could do. Mr. Cummings asked the Council to try to get together on this matter, and Councilman Hamilton commented that at the last Council meeting regarding the Charter they had tried to change the vote to 4/5, but it was voted down, 3 to 2. Councilman Blewett referred to an editorial in The Tribune on July 15, 1971. He stated he felt some- body should come up with a tax rate that people could live with. 14420 CIARK ST Councilman Hamilton pointed out that the increase in the tax assessment was made by the County, and that Mr. Shuman should contact the County Supervisors, rather than the City Council. He indicated that the City sets their tax rate in August, and were hopeful it might be lowered. T. E. Carpenter, 4346 N. Jerry, stated he had lived in To E. CARPENTER Baldwin Park for 22 years. Addressing Mayor Gregory, 4346 N. JERRY Councilmen Blewett and King, he stated they had divided the City. He said they had stated that Mr. Nordby failed to do his duties, and asked what, specifically, did he not do; was he guilty of malfeasance of office; and when did he not communicate? Mr. Carpenter stated that should a recall action be taken, the taxpayers must pay for it. He suggested that the three members immediately resign and save the taxpayers the cost of a recall. Councilman King stated that before Council was reorgan- ized in April, Mr. Nordby confronted Councilman Blewett and told him he had two votes to make him Mayor. He stated that when Councilman Blewett related this information to him, he went to Mr. Nordby"s office and told him he would be accountable for his actions. Councilman King stated this was only a small part of the things that had taken place. He stated that Mr. Nordby had also told him that if Mrs- Gregory got out of line, he would institute a recall. Councilman Kinc, stated that he did not feel this was ethical. COUNCILMAN KING Councilman McCaron commented any statement Mr. Nordby may vote for whom for Mayor; the prior to the election. that he was not aware of have made as to who would pattern was cut and dried COUNCILMAN MC CARON Councilman Blewett stated that you looked at this from COUNCILMAN a credibility standpoint"—wasn't this a form of one-man BLEWETT rule? He stated that he did not feel it was proper for a City Manager to insert himself into the internal affairs of a legislative body, and that this was a form of dictatorship. The voters are entitled to put Councilmen in and they can also put them out. Councilman Hamilton stated Mr. Nordby had never said a word to him about the election of the Mayor. MERLE SMITH Dr. Merle Smith asked Councilman Blewett whether he had said to him before he was elected that one of the first things he would do was to get rid of our present City Manager, councilman Blewett stated, If I did, I was very slow in doing it", and that for a while he and Mr. Nordby were quite close. Mayor Gregory remarked that whenever Mr. Carpenter had problems in his neighborhood, he had turned to her for assistance, and they went to the City Manager and the problems were never resolved, so Mr. Carpenter went to the County. Mr. carpenter replied that he could not see anyone acting like this, and that the citizens had not been given reasons for Mr. Nordby's dismissal; he believed in being fair to people. MAYOR GREGORY Jack Lyons, 13420 Frazier, stated he has property in Baldwin Park, and has resided here for many years, and has supported the Council for many years. He stated he still feels the majority rules, and that all of the people who believe in a democratic society should stand behind the Council; they may make mistakes, but they are governing the City, JACK LYONS 13420 FRAZIER Esther Klepper, 3663 Ahern Drive, stated she had called ESTHER KLEPPER the police with what she thought was a drug problem, and received no help. She called City Hall several times, but Mr. Nordby was always busy". Sho stated that Mayor Gregory was the one who helped her and made her feel that somebody cared, and was concerned about her. She commented that Mr. Nordby had never returned her call. 3663 AHERN DR Mrs. Amos J. Slater, 4814 N. Stancroft Street, stated she was glad we had three Councilmen who are thinking of the citizens of Baldwin Park, and she commended them for their action. MRS. AMOS SLATER 4814 N. STANCROFT Kenneth Thompson, 13818 E. Kenmore Avenue, stated he believes in the democratic form of government, and that the citizens should be ruled by the legally con- stituted representatives and not by one appointed official. KENNETH THOMPSON 13818 E. KENMORE Mrs. Susan Gray, 4600 Walnut Street, stated she had been a citizen of Baldwin Park for 27 years, and the City still has barns, weed fields and dumps. She stated we do have sewers, but the citizens paid for them, not Mr. Nordby; and, also, that the business buildings in Baldwin Park could stand improvement. The motion carried and was so ordered. 00- Councilman Hamilton stated that if there was to be no change in Council's action regarding the City Manager's dismissal, he wished to offer an alternate proposal that upon the submission of the City Manager's resignation, the Council's action of July 17, 1971 be rescinded and the City Manager be paid sever- ance pay equal to thirty days at his last salary rate. i Councilman Hamilton further stated that it had never been explained to him to his satisfaction why the City Manager had been dismissed; however, the majority rules. But, Mr. Nordby did have a professional future to think of. The City of Irwindale will award the contract, and no action is required by Council on this matter. 00- Planning Director Gordon reviewed his report on Lot Split No. 644, which Council had requested. The location of the parcel is 13603 Rexwood. He stated that the owner, Mr. Powell, had put up a cash deposit in 1965 to guarantee street improve- ments, but since the street had not been built, he was requesting a refund of his deposit. He stated that the Planning and Engineering Depart- ments were working out a specific plan to open up this area and hoped to have the plan developed and to meet with the affected property owners this month. Councilman Blewett stated that in the event the Staff was not able to obtain agreements from the property owners, he would like to see Mr. Powell's deposit refunded to him. Councilman McCaron stated he would like to see a program designed to provide for entrance streets on all blocks that need them; he stated he was not in favor of refunding money and would rather have the project go through and something set up so that the problem would not be reoccurring. Councilman Blewett commented that he did not feel it was fair to the property owner to hold the money when there was little or no chance of developing the rear lots in the immediate future. Planning Director Gordon stated that the package which would be presented to Council would include a program such as Councilman McCaron suggested, but also in concurrence with Councilman Blewett's suggestion, if development becomes unfeasible, a recommendation would be made to Council to release the money. 00- The matter of appointment of a Planning Commissioner was brought before the Council.
